Battery case against train conductor dismissed

CROWN POINT, Ind. — Battery charges have been dropped against a conductor accused of tossing a passenger off a South Shore commuter rail line train in northwest Indiana.

Videotape from the train exonerated Gregory Beach of the charge after his attorney, John Vouga, had it enhanced by a private company.

“It was quite persuasive for us,” Lake County (Ind.) Deputy Prosecutor Mark Acevedo said Friday.

Acevedo said his office provided Vouga with the paperwork to drop the misdemeanor charges on Wednesday.

Calvin Kirk of Gary had accused Beach of rousing him from sleep on March 28 and pushing him off the top steps of the train at Dune Park station in Chesterton, Ind.

Kirk had also claimed that the alleged push caused him to lose teeth and suffer cuts and abrasions.

“The evidence clearly showed that Greg Beach never touched Mr. Kirk,” Vouga said.

“We were able to provide video evidence that showed it was impossible for him to do what he was accused of. He was in fact an innocent man and always was and is extremely happy his name has been cleared.”
