    Former Beach Boy Al Jardine’s Hemi ‘Cuda – Click above for high-res image gallery

    Al Jardine, a founding member of the Beach Boys, was definitely not feeling good vibrations with this one. His restored Hemi Cuda recreation was stolen in St. Louis in 1975. It was returned that same year, but the authorities never removed the convertible from the stolen vehicle database.

    The car was slated for auction at this year’s Barrett-Jackson auction in Scottsdale, but when a Motor Vehicle Department official noticed that the numbers on the car didn’t match those on the title, the Phoenix police impounded the classic. Turns out the car wears remakes of its original VIN, but the ‘Cuda was given a new VIN when it was re-registered after being stolen.

    The St. Louis police gave the all-clear, though, so the Plymouth has been released and will make it to the auction dais. It will probably be playing, softly, “Don’t worry baby, everything will be all right…”

  • Amazon Backs Down On Demanding Publisher Use Only Its Own Print-On-Demand Solution

    Back in 2008, we wrote about Amazon’s questionable demand to book publishers that if they wanted to offer print-on-demand books, they had to use Amazon’s own POD solution. A few months later, a class action lawsuit was filed, and after a judge refused to throw out the case, it looks like Amazon quickly agreed to settle (thanks Achura). Unfortunately, from the wording of the agreement, even though this was filed as a class action, it’s not clear if it only applies to this one publisher or others as well. It is worth noting that Amazon is allowing the publisher to keep using alternative solutions and also agreed to pay the legal fees of the publisher. Amusingly, a monetary reward was on the table, and the publisher turned it down — and wanted it written into the settlement that it refused to take money — but Amazon didn’t want that mentioned in the official settlement. Still, it seems unfortunate that at least one publisher had to go through all this trouble just to use the print-on-demand offering of its own choosing. And, while it’s great for this one publisher, it leaves out the fact that many others caved in and agreed to deals that required them to only use Amazon’s solution.

    With the official debut of the 2010 NASCAR season only weeks away, the Motorsports division of American manufacturer Dodge announced its objectives for the future season, without aiming high.   • Former Mayoral Assistant Indicted in Michigan on Bribery and Extortion Charges

    Today a federal grand jury returned a five-count indictment against DeDan C. Milton, 37, of Detroit, charging him with one count of conspiracy to commit bribery and extortion and two counts each of bribery and extortion, United States Attorney Barbara L. McQuade announced.McQuade was joined in the announcement by Andrew G. Arena, Special Agent in Charge of the Detroit Field Office of the Federal Bureau of Investigation.

    DeDan Milton had served as an executive assistant to former Mayor Kwame Kilpatrick.

    The charges stem from the federal government’s investigation into bribes and kickbacks involving the sale of City of Detroit owned properties, including Camp Brighton in Livingston County and the Detroit Police Department’s 8th Precinct Station near West Grand River and Six Mile Road in Detroit.

    Each extortion count carries a maximum sentence of 20 years and each bribery count a maximum of 10 years.

    The investigation of this case was conducted by the Federal Bureau of Investigation. The case is being prosecuted by Assistant U.S. Attorneys Mark D. Chutkow and R. Michael Bullotta.


  • Conan O’Brien Leaving NBC

    It’s official: Comedian Conan O’Brien has inked a nearly $45 million deal to part ways with NBC after 16 years of service to the network.

    After days of negoitations with Jay Leno and O’Brien, the network has announced an agreement that will allow Leno to return as host of The Tonight Show, while paying O’Brien to leave. Tom Hanks and Barry Manilow will be among the final guests when Conan signs off as host of the 60 year old TV institution this Friday, Jan. 22.

    According to The Associated Press, the deal includes a figure exceeding $33 million settlement for Conan. The $12 million remaining dollars of the $45 million settlement will be reserved for his staff. The terms allow Coco to pick up a gig at another network for the fall television season.

    Leno is expected to return to his post as host of The Tonight Show on March 1.

    Fans of the cult classic The Big Lebowski now have the chance to pay homage to the film and get paid for having sex thanks to an upcoming open casting call for a new X-rated version of the Coen Brothers film.

    Executives at adult film house New Sensations are looking for unknowns and porn newcomers to get their moan on in the upcoming project The Big Lebowski – A XXX Parody, a spoof of the popular 1998 comedy.

    There are currently six leading roles up for grabs: Jeffrey ‘Big’ Lebowski, Walter, Brandt, Blonde Treehorn Thug, The Stranger, and Liam.

    “We are looking for the most devoted and enthusiastic fans to fill these roles,” Director Lee Roy Myers tells WENN. “This is my dream project since I am such a huge fan of The Big Lebowski. It is an amazing movie! Sex, bowling, cursing, a cable guy… Lebowski has everything a great pornographic movie needs.”

    Just one little catch: Phillip Seymour Hoffman, John Goodman, Mark Pellegrino, and David Huddleston have been invited to reprise their roles in the porn remake — Myers says they’ll be given preference over look-a-likes and fans. Somehow, we don’t think that will be a problem.

  • Goldman Sachs Destroys Expectations With $6.41 Billion of Trading Revenue

    Goldman Sachs’ (GS) fourth quarter earnings hit $8.20 per share. Analysts were looking for just $5.20 on average according to Yahoo Finance.

    They’ll have a conference call at 11:00 AM EST.

    Full year earnings of $22.13.

    Release: The Goldman Sachs Group, Inc. (NYSE: GS) today reported net revenues of $45.17 billion and net earnings of $13.39 billion for the year ended December 31, 2009. Diluted earnings per common share were $22.13 compared with $4.47 for the year ended November 28, 2008. Return on average common shareholders’ equity (ROE) (1) was 22.5% for 2009.

    Fourth quarter net revenues were $9.62 billion and net earnings were $4.95 billion. Diluted earnings per common share were $8.20 compared with a diluted loss per common share of $4.97 for the fourth quarter ended November 28, 2008 and diluted earnings per common share of $5.25 for the third quarter ended September 25, 2009. Annualized ROE (1) was 31.7% for the fourth quarter of 2009.

    Goldman Sachs achieved net earnings of $13.39 billion in 2009 and produced a 22.5% return on average common shareholders’ equity.

    Lowest % compensation ever.

    The firm’s 35.8% ratio of compensation and benefits to net revenues was its lowest as a public company. While net revenues in 2009 were only 2% lower than the firm’s record net revenues in 2007, total compensation and benefits was 20% lower, representing a reduction of $4 billion.

    Book value spikes 23%.

    During the twelve months ended December 31, 2009, book value per common share increased 23% to $117.48 and tangible book value per common share (4) increased 27% to $108.42.

    Investment Banking revenue up 58% year over year in 4Q, higher backlog.

    Net revenues in Investment Banking were $1.64 billion, 58% higher than the fourth quarter of 2008 and 82% higher than the third quarter of 2009. Net revenues in Financial Advisory were $673 million, 17% higher than the fourth quarter of 2008, reflecting an increase in client activity. Net revenues in the firm’s Underwriting business were $962 million, more than double the amount in the fourth quarter of 2008, reflecting significantly higher net revenues in both equity and debt underwriting. The increase in equity underwriting primarily reflected higher net revenues from initial public offerings. The increase in debt underwriting primarily reflected higher net revenues from high-yield activity. The firm’s investment banking transaction backlog increased during the quarter and increased significantly during the twelve months ended December 31, 2009. (5)

    Net revenues in Trading and Principal Investments were $6.41 billion, compared with negative net revenues of $4.36 billion for the fourth quarter of 2008 and net revenues of $10.03 billion for the third quarter of 2009.

  • EPA Ignores Reality in Scientific Breakthrough – Unable To Disprove Greenhouse Effect In Equilibrium

    Abstract:

    Earth’s Greenhouse Effect is constant and does not rise with human CO2 emissions. That is the main point of Dr. Miskolczi’s results, called to the attention of the EPA in the “Endangerment Finding” evaluation process. The EPA could not disprove this or Miskolczi’s conclusions.

    Recently, the United States Environmental Protection Agency issued an “Endangerment Finding” stating that CO2 and five other green house gasses constituted a danger to public health and welfare. Many people are not aware that the Obama administration, through the EPA’s finding, can now pass through environmental regulations that will force businesses to comply with the changes without going to congress in order to pass Cap and Trade Legislation. With this finding, the administration could regulate CO2 by dictate from the White House to any degree it chooses.

    What is little known is that the EPA held public comment sessions before issuing their finding. By law, the EPA is obligated to respond to substantive comments, and some of those comments cited a Hungarian physicist who discovered the Law and Constants that describe the Equilibrium of Earth’s greenhouse effect. In 2004 and 2007, Dr. Ferenc Miskolczi published his work and to date, no scientific study or authentic peer review (which is to say, something more substantive than random naysayers in the blogosphere whose livelihoods are dependent on the myth of Global Warming not being exposed) has been published which finds Dr. Miskolczi’s work in error.

    The EPA itself made several errors in the attempt to understand Miskolczi’s work, and illustrates a number of incorrect arguments that have been used in the attempt to discredit the Doctor’s work. We will address these misconceptions here as they are repeated time and again in a show of complete misunderstanding of Miskolczi’s law and constant.

    EPA: “The hypothesis that increased CO2 forcing will lead to a counterbalancing decrease in water vapor is highly speculative, and is not supported by the vast body of scientific literature.”

    Response: “It is not hypothesis, and not speculative at all. It is based on a huge amount of radiative transfer calculations by Dr. Miskolczi’s High Resolution Atmospheric Radiative Transfer Code (HARTCODE, 1990), made on the TIGR global radiosonde data archive of the Laboratoire de Météorologie Dynamique (Paris, Director Hervé Le Treut, lead IPCC author). Details of the dataset and the results of calculations were published in Miskolczi & Mlynczak (2004). The relations revealed by Miskolczi explicitly were there implicit in the Kiehl-Trenberth 1997 global energy budget, but Miskolczi’s computations made them exact and clear. He took those flux relations as equations in his 2007 paper, and calculated the solutions of the new set of energy balance equations. The solution gives a theoretical equilibrium value of the clear-sky greenhouse effect, exactly equal to that given on empirical grounds in Kiehl and Ramanathan (2006).”

    EPA: “A climate sensitivity of zero is completely incompatible with historical temperature variations, as it would imply an unchanging climate in direct contrast to historically recorded temperatures changes on all timescales.”

    Response: “This is a complete misunderstanding. It is the surplus greenhouse temperature (33 degrees Celsius) that does not vary. The basic (or so called effective) temperature (now about 255 Kelvin, or minus 18 Celsius) varied, and is varying, according to the available energy. (This latter term includes the incoming energy from the sun, the effects of solar variations and orbital parameters, cloud and ice coverage, planetary albedo [reflectivity], ocean-atmosphere heat exchange, human industrial heat generation, geothermal heat production etc.). To be precise about the scientific content of Miskolczi’s statements, it is the ratio, not the difference, of the surface temperature (now about 288K) to the effective temperature that is an energetically uniquely determined constant. This ratio determines the greenhouse temperature, given the incoming available energy.”

    EPA: “Miskolczi also claims that “On global scale, however, there cannot be any direct water vapor feedback mechanism, working against the total energy balance requirement of the system. Runaway greenhouse theories contradict to the energy balance equations and therefore, cannot work.” This demonstrates a lack of understanding of feedback mechanisms in the climate (see response in Volume 4 for a discussion of runaway climate).”

    Response: “Their understanding of water vapor feedback is based on only one part of the effects (higher water surface temperatures lead to more evaporation and more greenhouse effect with further increasing temperatures). This is only one loop of the feedback. The other, revealed by the relations found in climate databases by Miskolczi, shows a strict energetic limit of this hypothetical (never happened) runaway feedback. (The case of Venus is absolutely different: closed cloud cover, contrary to Earth’s partial overcast, and its atmosphere is almost 100 percent CO2, whilst we have only 0.04 percent CO2).

    EPA: “There is now evidence for global increases in uppertropospheric specific humidity over the past two decades, which is consistent with the observed increases in tropospheric temperatures and the absence of any change in relative humidity.”

    Response: Yes, over the past two decades the NOAA NCEP/NCAR database (as can be seen also in the referred Miskolczi calculation) shows a slight increase in specific humidity, but the first two decades of the database (1948-68) shows a slight decrease, and the middle two decades (1969-1989) displays fairly stable conditions. On the whole 61 years in 1948-2008, there is a very stable atmospheric concentration of the total effective greenhouse gases (1 percent decrease in integrated water vapor content, and vast increase in CO2 and others). The whole process gives us a very stable 33 degrees Celsius average greenhouse effect, without any definite increase.

    To summarize:

    EPA’s answer only repeats their known position, full with the old unproved hypotheses (positive water vapor feedback, runaway greenhouse effect), without a real understanding of the logic that led to the new results. They do not give new data. The real debate would be if they said: Here are our numbers for the greenhouse effect since 1948, year by year, and here are our equations for the equilibrium value, let’s see where the differences might come from. – But without their numbers, no real discussion is possible.

    Miskolczi’s numbers remained valid, unchallenged and un-falsified. The 61-year global average mean greenhouse effect is the same as the theoretical equilibrium value, within 0.1C temperature difference. Nowadays the additional (greenhouse) temperature fluctuates around the 33 Celsius as it did 60 years ago and will do 60 years later, without showing an increasing trend. It is not possible that it grew up to 35 or 38 C, to produce 2 or 5 degrees warming. TheEPA did not disprove this.

  • ‘Officer Friendly’ back in action

    The primary school students file into their Englewood school auditorium where a half-dozen police officers are waiting.

    officerfriendly612.jpgOne first-grader says she feels scared, eyeing the uniformed men and women whose presence often signifies problems.

    The principal overhears a little boy tell his peers, “I’m not afraid of no police.”

    But by the end of the 30-minute gathering with the officers, the Randolph Elementary School children were cheering and giving the officers high-fives and handshakes.

    The presentation launched a new “Officer Friendly” program, a revival of sorts of the popular police icon who swept into Chicago classrooms in the 1960s and 1970s to the delight of schoolchildren.

    While programming for young children has long been a part of community policing, the folksy name faded.

    But police are using it again in Englewood, one of the toughest neighborhoods in the city, with an updated mission: not only to bring a message of safety and citizenship, but also to help repair a fractured relationship between police and the community.

    “He’s been resurrected,” Englewood District Cmdr. Keith Calloway said of Officer Friendly. “With the young kids, they really love the police. Somewhere along the line we are losing these kids.”

    The Officer Friendly program was started in Chicago in the late 1960s. Officers talked to children about traffic safety, playing with matches, “stranger danger” and even the importance of properly disposing of gum.

    Calloway remembers the visit Officer Friendly made to his own grammar school, complete with the coloring book and a shiny gun. Then Calloway found himself looking for a way to reach the youngest children on the gang-ridden blocks of Englewood, where police are engaged in a daily battle with crime.

    He knows that young children often see police officers when they are arresting a relative or stopping a neighbor. Scandals involving police misconduct and abuse damage public perception. And rap songs deride the police.

    So while many children still stare starry-eyed at officers, police also see a hardened glare on the faces of younger children who cross their path.

    “We get called to incidents that are not the best incidents in their lives,” said Englewood school liaison Officer Rafael Yanez. “If they could have more positive memories … ‘he was there and he taught me not to speak to strangers. To be careful when I cross the street,’ ” that would build trust.

    Calloway said six patrol officers plan to repeatedly visit the neighborhood’s roughly 30 elementary schools, targeting pre-kindergarten to second-graders.

    Randolph Elementary Principal Michelle Smith said the safety tips are just as important as reshaping impressions of police. She said some students don’t know things like the difference between “good touch” and “bad touch,” or how to get help in an emergency.

    On Wednesday, Officer Angela Wormley asked several students if they knew their home addresses. One girl recited several numbers but no street name. Another student replied “Chicago.”

    Wormley told them to ask their moms for the correct information — and said she’d be back to check up on them.

  • Mini Countryman John Cooper Works seriously under consideration

    Yesterday will go down in automotive history as the day Mini, a go-kart-like hatchback brand, introduced a crossover – the Mini Countryman. The 2011 Mini Countryman will hit the stateside market early next year with two gasoline engine options including the base 1.6L 4-cylinder Mini Countryman and a turbocharged Countryman S.

    According to Mini’s UK general manager Jochen Goller, a high-performance John Cooper Works model is also in the works.

    “It’s definitely under consideration,” Goller said. “JCW has been a big success and we’ll look at doing it again here.”

    Refresher: The base 2011 Mini Countryman will be available in the U.S. with a 1.6L 4-cylinder engine making 120-hp and a maximum torque of 118 lb-ft. The Mini Cooper S Countryman model will be powered by a 1.6L twin-scroll turbocharged 4-cylinder engine making 180-hp and 177 lb-ft (192 lb-ft with Overboost) of torque. Both models will come standard with a 6-speed manual transmission. A 6-speed automatic will be available as an option.

  • John Edwards Fathered Baby With Mistress Rielle Hunter

    For the first time, former presidential candidate and North Carolina Senator John Edwards is admitting that he is the father of a 2-year-old daughter conceived with former mistress Rielle Hunter, a one-time videographer for his campaign.

    Edwards’ attorney released a statement to NBC’s The TODAY Show this morning.

    “I will do everything in my power to provide her with the love and support she deserves…..I have been able to spend time with her during the past year and trust that future efforts to show her the love and affection she deserves can be done privately and in peace.”

    NBC is also reporting that Edwards and his long-suffering, cancer-stricken wife Elizabeth have separated.

    Harrison Hickman, Edwards’ close friend and personal advisor, spoke to NBC’s Lisa Myers on Edwards’ behalf.

    “The senator wants to say, first of all, that he is the father of Quinn,” Hickman said. “Secondly, he wants people to know that he has provided for her and will continue to provide for her, as he should, both financially and emotionally.”


  • Kia Ray plug-in hybrid concept teased ahead of Chicago show

    Kia is hoping to steal the spotlight at what may be another relatively quiet auto show in Chicago next month with a new plug-in hybrid concept dubbed the Ray. The teaser image sent out by Kia last night shows off what looks like a four-door sedan, possibly with a solar photovoltaic roof to aid in charging the battery or cooling the interior.

    The concept was created at the Kia Design Center America and is the first from the Korean brand based on this powertrain architecture. We’d guess the powertrain is similar to the Hyundai Blue-Will concept that was shown at the Detroit Auto Show last week. That car is based on the same configuration that will go into a production hybrid Sonata later this year, but with a bigger motor and battery that is claimed to give a 40-mile electric driving range.

    The event will be held at on Monday, February 15, 2010, at 15:00-16:00 Central European Time  at the  Conference Garden Room, Catalonia Barcelona Plaza Hotel , Plaza Espana 6-8, 08014 Barcelona .

  • “Don’t Jam Through Health Care ‘Reform’”


    “President Obama warned Democrats in Congress today not to “jam” a health care reform bill through now that they’ve lost their commanding majority in the Senate, and said they must wait for newly elected Massachusetts Republican Scott Brown to be sworn into office…” (source)

    When I read this, I couldn’t wait to see how the DUers and the Kos Kids were taking the admonishment…The answer is –not well. I’m sure they scanned our sites after Obama won to gloat at our depression, so we should feel no guilt at doing the same…here’s a little snapshot of their pain:

    First they all turned on Obama:
    Says it all, doesn’t it
    Yep – how disappointing.
    Mmmph
    I guess [Obama] just does not get it.
    He gets it
    Not Sure
    He cares more about being the bipartisonator
    If he’s more interested in how the GOP likes his initiatives than in how they affect Americans
    Right

    But before you feel proud that Obama is doing the honorable thing by haltingn the bill until Brown is seated…don’t. In this same interview he basically said that Brown won because of eight years of anger over the Bush administration. Huh?

    Ok, back to the Democratic Undergrounders, once they had verbally spanked the President their ire turned to Senator Jim Webb:

    “Less than 15 minutes after the race was called for Republican Scott Brown, the first of what could be many conservative Democrats asks for leadership to put the brakes on health care reform.

    Sen. Jim Webb (D-VA) congratulated Brown on his win and delivered a zinger:

    “In many ways the campaign in Massachusetts became a referendum not only on health care reform but also on the openness and integrity of our government process. It is vital that we restore the respect of the American people in our system of government and in our leaders. To that end, I believe it would only be fair and prudent that we suspend further votes on health care legislation until Senator-elect Brown is seated.” (source)

    It’s pro-forma. Obama called Brown, too. So did Vicki Kennedy, though
    So much for Webb doing the “Democrats” much good. Of course, the Dems don’t even fuckin’ know who
