  • The Increasing Irrelevance Of The Major Record Labels

    Yesterday I attended the always worthwhile SF Music Tech Summit. This has to be the fourth or fifth time I’ve gone, and I always find that after it’s all over and I’ve had some time to think about it, I recognize one key theme that kept hitting me over and over again throughout the event. This time it was the increasing irrelevance of the major record labels. I’ve been to a lot of music industry events in the past few years, and there’s no doubt that the presence of the majors at various events continues to decline (though, they still seem to have no problem wasting ridiculous sums of money on lavish parties at some events). While the decreased presence at Music Tech might have been a result of the overlap with another industry event, NARM, which the labels almost certainly deem more important, what was more telling was the audience’s reaction to the major labels.

    The “big draw” at SF Music Tech was certainly the panel in the morning that had Ben Folds (who you hopefully know), Michael Tilson Thomas (again, who you hopefully know, but if not, from the San Francisco Symphony), Jack Conte (from the viral sensation Pomplamoose) and Glenn Otis Brown (from YouTube and Creative Commons). That panel was certainly entertaining, but tragically there wasn’t very much time for any of the participants to speak, and with each one showing a video (often kinda long), the whole thing felt kind of rushed. But what struck me wasn’t so much what anyone on that panel said… but what happened as soon as the panel ended. The very next “panel” was a discussion between a guy at Warner Music Group and someone at Cisco about the “direct to fan” artist websites that Warner Music has set up using Cisco’s Eos platform.

    Not so long ago, you would think that a new technological offering via a major label would be something of interest to this crowd. But, the audience had no interest at all. While the organizers tried to keep people around, lots of people flooded the previous panel’s speakers while many more quickly evacuated the room. Probably one-third of the people were still there by the time the next panel actually began. That says something. In the past, the only way to be successful in the music business was to go through the major label gatekeepers. These days, almost no one believes that any more. In fact, many have realized that the path to success often means getting as far away from the majors as possible. Even if what Warner was doing was interesting (and, honestly, what was presented was full of buzzwords and hype, but little that seemed particularly innovative) just the fact that no one even seems to care says a lot about what people think of the major labels these days.

    The final panel of the day, on “Music & Money,” included both Michael Robertson and Tim Quirk — both of whom have long been critics of the record labels and their business practices. It gave them a chance to (accurately) gripe about the record labels and how they’ve spent the last decade (or longer) shooting themselves in the foot time and time again by basically killing off every innovative new startup that popped up by demanding ridiculous fees just to operate. Honestly, that panel could have been a bit more interesting if it had included a representative from a major label to absorb some of the punches (and even to punch back), but one audience question summed up the whole thing:


    “If the major labels are such a pain to work with, why work with them at all?”

    The guy pointed out that there are tons of independent bands more than happy to embrace innovative new services. The real answer, of course, is that it’s not that simple. While there are tons of bands that are innovative and willing to work with new services, the music business is still (even if it’s changing a bit) a hit driven business. A music service without the hits doesn’t do well. That’s just the facts, right now. If you’re offering a streaming music service or a music locker and major label content is blocked, you’ve cut your potential audience down by a ton.

    But, still, the question — and the answer — is telling of the major label’s stature in the industry these days. Their position now is back catalog filler. That’s more or less how people view the major labels. There’s a lot less interest in working through the old gatekeeper system. The labels will last for a long time (though, perhaps in different forms and under new ownership…) due to their back catalog and the need for music services to have access to those songs. But I don’t think there’s anyone left out there who looks to the major labels to lead the music industry any more (except, perhaps, some out-of-touch politicians).

  • National Economic Council director defends auto industry bailout

    Treasury Secretary Timothy Geithner talks to National Economic Council Director Larry Summers

    Larry Summers, head of the National Economic Council, said today that the Obama administration expects to recover “most, if not all” of the $50 billion bailout it provided to General Motors. At the current pricing of GM bonds, taxpayers are expected to lose about $10 billion on their investment in GM.

    Defending the $85 billion bailout of the auto industry, Summers said that the industry cut 400,000 jobs in 2008. He said that the Bush administration had estimated the losses to total 1.1 million if the government didn’t step in to help GM and Chrysler. Summers said that those number of job losses would have added a number of other problems.

    “They meant state and local budgets pushed to insolvency. They meant rising crime. They meant people dying young(er) than they other(wise) would have,” Summers said.

    The Obama administration said yesterday that the U.S. government would assume at least a $1.6 billion loss on its $4 billion loan to Chrysler in Jan. 2009.

    Most recent public estimates indicate that the government will lose about $30 billion on its bailout of GM, Chrysler and GMAC (now known as Ally Financial).

  • Honda “lacks confidence” in electric-car demand, still plans to offer EVs in the U.S.

    The head of research at Honda said that the company remains skeptical about electric-cars 10 years after it has stopped selling the EV-Plus battery-powered model. Nonetheless, the second-largest Japanese automaker plans to offer electric-vehicles in the United States.

    “We lack confidence” in the electric-vehicle business, Tomohiko Kawanabe, president of Honda’s research and development said. “It’s questionable whether consumers will accept the annoyances of limited driving range and having to spend time charging them.”

    Kawanabe said that Honda still plans to sell electric-cars in the United States to meet California emission rules, but its top priority is to improve fuel-efficiency of its current models.

    “We are definitely conducting research on electric cars, but I can’t say I can wholeheartedly recommend them,” said Kawanabe.

    On the other hand Nissan CEO Carlos Ghosn says that he expects 10 percent of the global car market to be electric-vehicles by 2020.

  • Spy Shots: Aston Martin DB9/DBS nip/tuck spotted swirling ’round the ‘Ring

    A refreshed version of either the Aston Martin DB9 or DBS has been spotting working out at the Nurburgring, likely in preparation for a debut in Paris this September. Up front the lower fascia has been reshaped with a single wider lower opening while a pair of DBS-style air extractors are added to the hood. Both of those point to a bump in output, likely in the range of 10-20 horsepower although it could be considerably more if Aston Martin decides to add something like direct injection to the 6.0-liter V12.

    Obviously, it’s too early to speculate about gearbox changes, but since Aston Martin has indicated that it will be working with Daimler on some future projects, we wouldn’t be surprised to see the SL63’s multi-clutch-transmission supplant the hydraulically actuated manual.

    At the back the DB9/DBS gets clear taillamp lenses, a taller lip spoiler and a big diffuser to help keep the rear wheels stuck to the pavement at elevated speeds. Undoubtedly, there will also be interior upgrades with some new woods and hides and perhaps a better telematics system of some sort.

Of course, that means we’ll just have to be satisfied with the Golf GTI, which is not necessarily a bad thing… but we’re pretty greedy. Not to mention, we are still in dire need of the Volkswagen Golf R.

    Refresher: Power for the 2011 Volkswagen Polo GTI comes from a 1.4L TSI engine that uses a supercharger from 0 to 3,000 rpm. After that a turbocharger cuts in to provide extra boost. The system puts out a total of 180-hp with a maximum torque of 184 lb-ft. Mated to a 7-speed twin-clutch DSG gearbox (or a 6-speed manual), the 2011 Polo GTI runs from 0-62 mph in 6.9 seconds with a top speed of 142 mph.

It was based on an excellent article by Dave Navetta on The Legal Defensibility Era (pdf). For years, IT folks have recognized that they often wear two hats, switching between a technology one and a business one, as they often have to explain or justify the business tradeoffs of the IT decisions they make. But these days, they also really need to add a legal hat.

    Given the immense interest we received in this particular topic, we’ve decided that it will be the topic of our next webinar in our IT Innovation series: What IT needs to know about the law to be held next Wednesday, May 26th at 9am PT/noon ET. We’re thrilled that Dave Navetta, who wrote the article that sparked the original discussion, will be participating and discussing this “era of legal defensibility” that IT people need to understand. Dave has built a career around bridging that gap between IT folks and legal folks, and is obviously perfect to be part of this discussion. With him will be Larry Downes, most recently the author of The Laws of Disruption, which is all about how the legal realm is hugely important to understanding business and technology in the world today, and how anyone looking to succeed in the internet age needs to understand some of these key legal principles.   • Mini unleashes big bag of Countryman prototype photos, model details

    The maxiest Mini is coming in the next few months in the form of the long anticipated Countryman crossover, and BMW has dropped a pile of fresh photos of largely de-swirlied prototypes along with details on the powertrains and trim levels. In Europe, at least, the Countryman will be offered with five engine options, including two diesels.

    The trim levels start off with the Mini One and One D, Cooper D and Cooper S. All of those get the latest updated MINI 1.6-liter four-pots with all three gas engines now equipped with BMW’s Valvetronic full variable valve control. The top 181 horsepower Cooper S now has the same direct injection system previously used on the John Cooper Works models, but for now there is no full JCW Countryman being offered. American buyers will likely only have access to the gas powered Cooper and Cooper S.

    Every Countryman gets a six-speed transmission in either manual or automatic form, and the Countryman is also the first Mini to be offered with all-wheel drive. The system, dubbed ALL4, uses an electromagnetically controlled center differential to distribute up to 100 percent of the drive torque to whichever axle has more grip. The Countryman is also the first Mini to have true four passenger seating and even has an option for a three passenger rear bench seat. The full release is available after the jump.

  • Report: Fiat 500 four-door to be badged as Fiat 600

    The Fiat 500 will be available in North America with a 1.4L Multiair engine in the fourth quarter of 2010. It will be built in Mexico starting December 2010. A 1.4L Multiair turbo is expected to arrive in the fourth-quarter of 2011.

    Following those models, Chrysler Group LLC and Fiat SpA have promised that they will offer the North American market a pure electric version of the Fiat 500 in 2012.

    We’ve previously heard reports of a four-door version of the 500, which is scheduled to arrive in Europe at the end of 2011. The four-door 500 is also expected to be sold in North America.

    Sources are saying that the four-door model will most likely be called the Fiat 600 and will be built along side the 500 in Toluca, Mexico. Power is rumored to come from the 500’s 4-cylinder engine range.

    Between the SEC charges, the criminal investigation, and the general strains on the banking industry, Goldman Sachs has gotten hammered.

    In fact Goldman Sachs has now nearly round-tripped with today’s 3.7% decline, trading just a few dollars above its 52-week high and its book value.

    For those keeping close score: the 52-week low is 133.92. Today it closed at 137.36

  • Gran Turismo 5 releases new Nürburgring shots, complete with tent city!

    Gran Turismo 5 is taking longer to push to market than most automakers need to bring a vehicle from CAD drawing to the showroom floor, but Polyphony Digital is taking every opportunity to show off just how fantastic the racing simulator will (eventually) be. Spectators arriving at the 24 Hours of Nürburgring were surprised with a series of GT5 demo stations featuring the Grand Prix, Nordschleife, and the 24 Hours courses.

    We have been both expecting and demanding that the full Nürburgring experience be included in every copy of the long-awaited game when it finally (hopefully) hits store shelves in time for Christmas, and it looks like our expectations will be met. Check out our ever-increasing gallery of GT5 images below. The first eight shots come straight from Germany, and the quality of the images is very impressive. And make sure to check out the aerial photo of tent city. In true Euro form, almost every virtual vehicle is a wagon.

  • Stocks HAMMERED After Germany’s Giant Blunder: Here’s What You Need To Know (BP, GS, GLD, WMT, SPY)

    Stocks were wobbly all morning, but the situation in the eurozone went from uneasy confidence to nervousness in the blink of an eye after the German government idiotically announced a temporary emergency naked short-selling ban. It applies to certain bank stocks, and the new regulations will also go after bond and currency speculators. Naturally,t he move is being re as a gigantic no-confidence move.

    But first, the scoreboard:

    Dow: -115
    S&P 500: -16
    NASDAQ: -37

    And now for some key stories:

    • Goldman Sachs continues to get hammered, and the stock is now down to close to book value. Other financials were hit hard as well.
    • The one big winner today: Wal-Mart. The firm’s decent earnings helped carry the stock into the green all day.
    • Commodities sold off across the board. Oil is below $70 again. Copper did manage to rally back a bit. Gold slipped.
    • The BP oil slick is taking an ominous turn for the worse, with the emergence of a large “tail” extending to Florida.

  • Illinois Governor Pat Quinn to Deliver Harper College Commencement Address

    PALATINE, IL – Illinois Governor Pat Quinn will deliver the Commencement address to Harper College graduates at 2 PM Sunday, May 23 on the College’s main campus in Palatine, IL.  Governor Quinn is expected to speak to over 400 graduates about the critical role community colleges play in providing affordable access to higher education and training workers for 21st century jobs.

    Enrollment at Illinois community colleges surged 8% during the spring semester to an all-time record headcount of 390,142 students. At Harper, enrollment was up more than 8%, with a record spring headcount of 16,878 students.

    “We are pleased Governor Quinn has chosen to speak at Harper,” said Harper College President Dr. Ken Ender. “Community colleges are a key catalyst for job growth as workers look to us to enhance their skills or retrain for new careers in the wake of the economic downturn.”

    Dr. Ender is presiding over his first Harper College commencement. Dr. Ender came to Harper in July of 2009 after serving as president of Cumberland County College in New Jersey. In his short time at Harper, Dr. Ender is already positioning the College to be a leader in the national student success movement, which includes creating new programs to increase student completion, forming new partnerships with local high schools, businesses and four-year universities, and increasing accountability and transparency in programs and operations.

    In addition to Governor Quinn’s address, Harper’s commencement ceremony will also recognize the winners of the Motorola “Award for Excellence” scholarship. The award is given annually to a traditional and a non-traditional Harper student who exhibits exemplary achievement in academics, community service, leadership and extracurricular activities.

  • BMW CEO: X1 sales have exceeded expectations, 36,000 units sold since launch

    Even though Jeremy Clarkson thinks that the BMW X1 is complete “rubbish,” sales of the compact crossover have been doing well for the German automaker.

    “The BMW X1 has significantly exceeded even our own ambitious expectations: Since its introduction last fall, we have delivered more than 36,000 units to customers,” BMW CEO Norbert Reithofer said that the company’s annual shareholder’s meeting. “Among these customers are plenty of younger people for whom BMW was not a serious option before.”

    The BMW X1 will go on sale in the United States in 2011.

    Refresher: The BMW X1 will hit markets next year and will be available with three engine choices. Kicking of the lineup is the X1 xDrive20d, which is powered by a 177-hp diesel engine. Second is the X1 xDrive23d, which is powered boy 204-hp turbodiesel. The X1 xDrive28i gasoline model is powered by a 3.0 6-cylinder making 231-hp and a 199 lb-ft of torque. It will be the only model offered in North America.

  • Pirate Party Starts Hosting The Pirate Bay

    Many people who don’t follow these issues closely have long assumed that The Pirate Party and The Pirate Bay were somehow connected. That’s never been true, even if the people involved in each were philosophically aligned on certain issues (but not on all issues…). Either way, it’s a bit of a surprise to find out that, following the injunction against The Pirate Bay’s bandwidth provider, that The Pirate Party has agreed to become the new host for The Pirate Bay. It’s unclear exactly what this means, as The Pirate Party must be getting its bandwidth from another provider, who, one would imagine, is also soon to be a target for an injunction. Still, it seems like the Pirate Party is basically begging for a lawsuit to challenge these types of fourth party injunctions…

    Ford’s Special Vehicle Team (SVT) recent hit the Virginia International Raceway (VIR) to do some track testing on the 2011 Ford Shelby GT500.

    Vehicle Dynamics engineer Gene Martindale piloted the 2011 Shelby GT500 coupe equipped with the new aluminum 550-hp, 5.4L engine and the optional SVT Performance Package. Martindale brought in a lap time of 2:58.48, over eight seconds faster around VIR than the 2010 model. Ford says that the lap time is comparable to six-figure supercars.

    Refresher: The 2011 Ford Shelby GT500 Coupe and Convertible are powered by a 5.4L supercharged V8 making 550-hp (an increase of 10-hp) with a peak torque of 510 lb-ft. The new powertrain weighs 102 pounds lighter, resulting in a better power-to-weight ratio, improved fuel-economy, acceleration, handling and steering precision. Buyers can also opt for the SVT Performance Package to further enhance performance. For 2011, the Shelby GT500 gets an EPA-projected fuel-economy of 23/15 mpg (city/highway).

    Indrani, also known as Julia I. Pal-Chaudhuri, is  a 36 year old photographer reality star. Indrani is part of the highly regarded lens duo, Markus Klinko and Indrani. Indrani, publicized that she and Lindsay went out on a series of dates in Los Angeles. It has been stated that Indrani and Lindsay Lohan lately spent the night at Lindsay Lohan’s hotel room.

    Indrani have commented to New York Post that she and Lindsay Lohan are spending a lot of time together. What adds to the intrigue is that Indrani never had a relation with any women before.
