  • Hedge Fund Brevan Howard Drops Goldman, Picks Up Substantial Gold Stake (BBD, GLD)

    Brevan Howard’s 13F filing with the SEC shows that they dumped a $34 million investment in Banco Bradesco, one of Brazil’s four big banks last quarter.

    Alan Howard’s hedge fund also dropped its holding in Goldman, though it wasn’t that big to begin with: $1.15 million.

    Other big changes last quarter include Brevan Howard’s taking up a big stake in gold, through both SPDR gold Trust ($43 million) and Select Sector SPDR ($110 million).

    The hedge fund also picked up $112,000 of Bare Escentuals, a makeup company recently purchased by Shiseido, and $9 million of Occidental, an oil company that just announced a hedge fund partnership with Andy Hall.

    The stakes they increased were in Bank of America, an investment they upped from $1.6 million to nearly $30 million, and Citi, a stake they increased from $2.5 million to $10 million.

  • University Of Texas Claims Trademark Over ‘Texas’; Wants Useful iPhone App Blocked

    Trademark law, when used properly, serves an important purpose in making sure that consumers are not made worse off by being tricked into buying lower quality products and services under the belief that they’re actually coming from someone else who is trusted. But in the age of the “ownership culture,” where too many people have tried to twist trademark law away from its true origins to make it appear to be a quasi-“property right,” you get too many cases of people using trademark law to actually make consumers worse off.

    Take for example this story, sent in by iamtheky about how the University of Texas is trying to stop some former students from making an incredibly useful iPhone app for UT students, called iTexas, by claiming it infringes on their trademark on Texas.

    The makers of the app, Mutual Mobile, have made a bunch of successful iPhone apps, but UT got upset last year when the company introduced the UT Directory, which put a much more useful interface on (you guessed it) the UT staff and student directories. After the University complained, the company felt that perhaps the use of the school’s colors made it look like an “official” app, so they agreed to fix that part. When the company launched iTexas, it made sure that it didn’t have the school’s color scheme or do anything to make it appear as the official app. But it did make the app a lot more useful:


    A free download, the app retains the searchable directory but also lists menus from different cafeterias across campus, tallies students’ dining-card and Bevo Bucks balances, delivers class schedules, shows campus maps, and more.

    This sounds like a great and rather useful app. Exactly the sort of thing that the University should be encouraging, not just because it would help some alumni succeed, but also because UT students would likely find the app quite useful. But, that’s not the way UT officials think, apparently:


    On Feb. 1, the Mutual team learned that UT had raised another objection to its latest app, specifically to the use of the word “Texas” in the name. “As this name is confusingly similar to the Texas [trademark], UT objects to such use,” reads a notice sent to the Apple app store by attorney Wendy Larson. UT’s board of regents began trademarking university properties back in 1981. A list of protected trademarks appears on the university Office of Trade mark Licensing Web page; alongside more specific trademarks such as Bevo and Lady Longhorns is, simply, Texas.

    Lesson learned: don’t try to make life better for UT students without first paying the University.

    We’ve just seen the 2011 Volvo S60 in all its production glory, and hot on the heels of that, we’ve got some snaps of the wagon version undergoing winter testing. Volvo’s array of offerings have always included wagons. Safe, stolid Swedish Estates are a big part of what built the brand, and that’s why the V50, V70 and XC70 are rockin’ the two-box in Volvo’s current lineup.

    Since the V70 moved up to share the S80’s underpinnings, there’s been a midsize-wagon shaped hole in Göteborg’s showrooms. Sure, the V50 is there on the compact end of the spectrum, but it’s often not quite big enough. The V60 snapped in these photos aims to change all that. Targeted directly at Audi A4 Avant and BMW 3 Series Touring, and likely carrying all the wily charms the Volvo has been showing off lately, Volvo’s latest estate looks to be capable of heating up even a Nordic winter.

  • Toyota to suspend production at two U.S. plants after lag in sales

    Toyota factory workers can breathe a sigh of relief. Although the manufacturer plans to suspend production at two U.S. plants in response to a major lag in sales following its massive recent recalls, company spokesman Mike Goss announced that the company will be retaining all of its employees during the suspensions in production set to take place in Kentucky and Texas.

    The suspensions are measures intended to adjust production levels after the sales haults earlier this month. “We don’t want inventory to build up for our dealers,” Goss said. “We can’t keep sending vehicles to dealers until they can start moving those vehicles.”

    Though no official plans have been announced, the kentucky plant, which produces the Camry, will be going dark on Feb.26, and possibly a few days the following week. Texas will be halting production the week of March 15, and then again in mid-April. That plant normally produces the Tundra pickup, and will be modified to begin producing the Tacoma during the suspension.

    NHTSA complaints against Toyota have also spiked, totaling 34 complaints alleging deaths involving Toyota vehicles since 2000.

    The company has launched an extensive PR campaign and is consodering variety of incentives in order to lure customers back ot the brand.

  • Music Journalism is the New Piracy

    Imagine you’re a music journalist who maintains a blog. You’ve just found a great, new, virtually-unknown artist that you want to tell the world about. How can you do so, in a way that is simple and convenient for your readers, but does not place you or your blog’s host at risk of being sued?

    Thanks to the increasingly aggressive copyright-enforcement tactics of the music industry, this has become a startlingly complicated question with no good answer.

    In the latest signal of this conundrum, at least six music blogs were deleted last week by Blogger due to copyright complaints. It’s uncertain who made the accusations that lead to the deletions, but the most likely culprit is the International Federation of the Phonographic Industry (IFPI), a copyright-enforcement organization which had previously filed copright takedown notices against some of the targeted blogs.

    Although the takedowns were made in the name of stopping piracy, the deleted blogs do not appear to have been hotbeds of illegal file-sharing. Indeed, some had operated for years and acquired a serious and substantial readership. Like many music blogs and magazines, they mostly posted reviews of artists, albums and concerts.

    In at least one case, IFPI’s accusations of copyright infringement were almost certainly incorrect. Bill Lipold, author of the deleted I Rock Cleveland, has outlined in painstaking detail the ways in which he received explicit permission to post every file on his blog, including ones which were later accused of infringement and forcibly removed. In one case, the band’s publicist wrote of the takedown, “Just so you know, this is none of our doing…apparently, DMCA operate on their own set of odd rules, as they even requested that the (band’s) official blog remove the song….What a headache…”

    In cases like this, attacks on music blogs seem to be the latest example of the widening disconnect between the goals of the music industry’s promotional wing and its enforcement wing. Smart musicians and promoters understand that the Net is a powerful promotional tool, and know that sharing an artist’s music is the best way to earn new fans. The IFPI, on the other hand, writes clearly in its takedown notices that “Our top priority is to prevent the continued availability of the IFPI Represented Companies’ content on the internet.” We’ve already seen this divergence of interests play out in recent fiascos surrounding bands like OK Go and Death Cab For Cutie. And the television industry has seen similar problems in its attacks on YouTube.

    In other cases, it appears that the bloggers may have posted or linked to copyrighted material without permission. But, as targeted blogger Patrick Duffey explains, it’s often next to impossible to know exactly which content is being accused of infringement:

    In their DMCA take down letters they never inform you what the infringing mp3’s are, forcing the writer to take down ALL the mp3’s in the offending post whether they have the permission to post them or not… If they had just included what the offending mp3’s were they could have avoided all of these headaches and bad press and we could have kept on going like any other day.

    Living Ears, another targeted blog, echoes those sentiments:

    One problem with these notices is that they do not mention infringing files by name. When I post the playlist from Scene Not Heard and link to a couple of tracks, if I receive a DMCA notice, how can you tell which file is to be deleted?

    Targeted bloggers need to know these details, not only so that they can remove the file if it’s indeed infringing, but so that they can file a DMCA counter-notice in the event that the file is not infringing.

    Ordinarily, the party issueing the takedown notice would be required by US copyright law to specify which content is being accused. But, as an international organization headquartered in London, IFPI is arguing that it doesn’t even need to play by the USA’s rules. “We neither admit nor accept,” they write, “…that Google is entitled to be served a notice in compliance with the DMCA.” Translation: IFPI is essentially threatening to sue Google under some unspecified foreign law — presumably one which lacks even the modest safe-harbor provisions available in the USA. It’s no wonder Google felt the need to take drastic action to avoid liability, even at the expense of the resulting headaches and bad press.

    By now, the affected blogs have mostly migrated elsewhere — in most cases to software like WordPress, deployed on smaller and less well-known hosting services. While this will buy them some time, these smaller hosting services are just as vulnerable as Google is to attacks by the IFPI and their ilk. In fact, most smaller hosts are likely to be even less helpful to bloggers than Google has been, since they tend to lack Google’s legal resources and PR imperatives.

    That being said, there are steps that music bloggers can take to protect themselves. Though EFF hasn’t created resources specifically for music bloggers, many of the suggestions made in our Guide To YouTube Removals and Guide To Avoiding Gripes About Your Gripe (or Parody) Site will be relevant. Note especially this list of web-hosts that have been known to show some spine when faced with legal threats over their customers’ content. And, of course, all current users of Blogger should make regular use of Blogger’s “export” feature to back-up their work.

    If this game of whack-a-mole seems familiar, that’s because it is. The same copyright-enforcement machine that was originally designed to fight music piracy, having largely failed at that goal, has now been turned on music journalists, and — in some cases — musicians themselves. It’s just the latest example of how legitimate speech and innovation will continue to be endangered until either Congress or the music industry takes serious steps to fix things.

  • Weatherizing St. Louis Homes Creates Jobs, Reduces Energy Bills

    Apollo Alliance Highlights Urban League’s Recovery Act-Funded Project as Prime Example of Green Job Creation

    St. Louis, MO — The Apollo Alliance and the St. Louis Urban League joined forces today to highlight the availability of a weatherization assistance project that has created new jobs in the St. Louis area and holds the potential for continued job creation as more qualified homeowners participate. Administered by the Urban League and made possible with funding from the American Recovery and Reinvestment Act (ARRA), the Weatherization Assistance Program is responsible for the creation of 39 green jobs so far throughout greater St. Louis.

    “This is a shining example of how investing in green jobs can help revitalize the economy, while also saving low-income citizens money on their energy bills,” said Emily Andrews, executive director of the Greater St. Louis Green Building Council and a member of the Missouri Apollo Alliance steering committee. “If we follow this model with further investments in energy efficiency and weatherization, we’ll see a windfall of good, green jobs throughout the country.”

    Weatherization assistance for eligible applicants may include installing wall and ceiling insulation; plugging air leaks with caulking; installing weather stripping; dryer venting; glazing and repairing windows and doors; minor duct repair; furnace repair or replacement; and hot water tank repair. Studies have shown that weatherization reduces household energy costs from $260 to as much as $700 over the course of a year.

    “In addition to cutting the energy costs, these services also increase safety and enhance the quality of life for the residents of St. Louis city,” said Urban League President Jim Buford.

    According to the Political Economy Research Institute (PERI), every $1 million invested in weatherization creates at least 16 direct, full-time jobs, as well as additional jobs in the clean energy supply chain. In Missouri, the weatherization program already supports 450 jobs annually. The Recovery Act designated nearly $5 billion for weatherization services for low-income families across the U.S., including more than $128 million for Missouri.

    “While the economic downturn has affected us all, the sharpest pain is being felt by low-income citizens and communities of color, where jobs have been lost at a faster rate than in the general population,” said Buford. “So, weatherization not only offers opportunities for homeowners to save money, it is also an industry primed for expansion.”

    Todd Weaver, CEO of Legacy Building Construction, spoke about the people his company has employed to work on weatherization projects.  “These jobs change lives,” he said. “They may start at entry level, but they lay the foundation for advancement into careers as crew chiefs, pre-weatherization and post-weatherization auditors.”

    “Weatherization and other similar projects create green jobs, which will help support and grow our middle class,” said Andrews. “As this market grows, so do the opportunities to reduce carbon emissions for a cleaner environment. It’s a win-win.”

    Today’s event also focused on promoting pending federal legislation that can build on the success of programs like the one St. Louis.

    The House-passed American Clean Energy and Security (ACES) Act includes several investments in renewable energy and energy efficiency programs, including $2.5 billion to support efficiency retrofits through the Community Development Block Grant program; $100 million to support efficiency revolving loan programs in low-income communities; and a 9.5 percent allowance allocation to support state and local government efforts to improve efficiency.

    Such investments, once made law, will generate thousands of new jobs across the U.S. similar to the ones featured today.

    “The Apollo Alliance is calling on the Senate to follow the House’s example by passing a strong climate and clean energy bill this year that includes robust investments in weatherization and other energy efficiency programs,” said Joe Thomas, Apollo’s Missouri state coordinator.

    Commodities: a killer day as oil closes up 4.1% at $77.18 a barrel, up $3.05.

    Gold is at $1121.40 an ounce, up $31.40 or 2.9%. Silver is at $16.16 an ounce, up $0.71 or 4.6%.

    Of course, the dollar took a shellacking.

    Del-Tron’s DL series linear lead screw actuators and ball screw actuators offer the benefits of a space-saving design, fast and simple assembly, long life, and a competitive price. The rigid enclosed aluminum box structure provides a compact envelope that incorporates the linear bearing and drive mechanism.

    Integrating all components into a single unit that includes the motor adaptor saves assembly time and eliminates the need to source additional parts. DL series linear lead screw actuators and ball screw actuators are offered in travel lengths up to 410 millimeters. These ball screw driven and lead screw driven actuators utilize recirculating guide technology to provide a low profile and compact design solution.

    The anti-backlash lead screw nut is spring-loaded to ensure positive movement when changing direction. The DL series lead screw actuators and ball screw actuators offer a straight-line accuracy of less than 2 microns and repeatability of less than 1 micron. A standard stepper or servo motor adaptor and coupling are provided at no additional charge. Other motor adaptors and motor coupling can be provided at your request. Photoelectric or proximity position sensors are available.

    An anti-dust containment cover protects moving components while also preventing particulate emissions. Load capacities range from 150 newtons to 900 newtons. Del-Tron can provide special leads, diameters, couplings, motor mounts, and vary the size, type and travel of slides on request.
