    Washington Times editorial advanced numerous falsehoods in order to paint Elena Kagan as anti-free speech, including the false claim that Kagan has argued that the government could ban pamphlets such as Thomas Paine’s Common Sense

    Wash. Times falsely claims that Kagan’s First Amendment work “suggests she might restrict Thomas Paine, circa 1776, from distributing his famous pamphlet.” From a May 18 Washington Times recently told The Washington Post, “It’s a mistake to assume that every argument an SG makes on behalf of the government reflects her personal legal philosophy.” Indeed, the Times editorial itself acknowledges that “it isn’t always fair to ascribe personally to solicitors general the positions they argue in court on the government’s behalf.” However, the Times adds: “it is fair if the arguments they use in court echo ones they made in private practice,” and then proceeds to distort Kagan’s scholarly articles on the First Amendment.

    The Supreme Court agrees with Kagan’s statement that the government can restrict some categories of speech

    Wash. Times suggests that Kagan’s statement that categories of speech can be restricted is controversial. From the Times editorial:

    In the government’s brief in a case called United States v. Stevens, Ms. Kagan elaborated: “Whether a given category of speech enjoys First Amendment protection depends upon a categorical balancing of the value of the speech against its societal costs.” Whoa, Nellie, who – pray tell – does the balancing? Judges? Bureaucrats? The Almighty President?

    In fact, the Supreme Court has long held that some categories of speech — such as child pornography — can be restricted orbanned because their potential for harm outweighs their societal value. In the brief the Times cites, Kagan notes that the Supreme Court has banned entire categories of speech — including fighting words and child pornography. Indeed, in a R.A.V. v. City of St. Paul, which invalidated an anti-hate speech law enacted in St. Paul, Minnesota. Kagan argued that the R.A.V. decision was based on St. Paul’s “illegitimate, censorial motives” in passing the law — not on the ways in which the law might have impermissibly “skewed” public debate. Kagan wrote:

    Finally, the notion of a skewing effect, as an explanation of R.A.V. or any other case, rests on a set of problematic foundations. The argument assumes that “distortion” of the realm of ideas arises from — and only from — direct governmental restrictions on the content of speech. But distortion of public discourse might arise also (or instead) from the many rules of property and other law that, without focusing or intending to focus on any particular speech, determine who has access to expressive opportunities. If there is an “overabundance” of an idea in the absence of direct governmental action — which there well might be when compared with some ideal state of public debate — then action disfavoring that idea might “unskew,” rather than skew, public discourse. Suppose, for example, that racists control a disproportionate share of the available means of communication; then, a law like St. Paul’s might provide a corrective.  

    A court well might — as the R.A.V. Court did — refuse the government the power to provide this corrective, but to do so, the court must discard a rationale focused purely on effects and adopt a rationale focused on motive.

    The worry in a case like R.A.V. is not with skewing effects per se; the fear of skewing effects depends upon, and becomes meaningless without, the fear that impermissible considerations — call them for now “censorial” or “ideological” considerations — intruded on the decision to restrict expression. 

    The R.A.V. Court made this concern about illegitimate, censorial motives unusually evident in its opinion, all but proclaiming that sources, not consequences, forced the decision. [Kagan, “Private Speech, Public Purpose,” 1996, wrote:

    On then to my own evaluation of the First Amendment articles: I think they’re excellent. I disagree with them in significant ways (this article, for instance, reaches results that differ quite a bit from those suggested by Kagan’s Private Speech, Public Purpose article, see, e.g., PDF pp. 8-9). But I like them a lot.

    My guess is that the likeliest bet would be to say that a Justice Kagan would be roughly where Justice Ginsburg is — generally pretty speech-protective, but probably with some exceptions in those areas where the liberal Justices on the Court have taken a more speech-restrictive view, chiefly expensive speech related to campaigns and religious speech in generally available government subsidies. Not perfect from my perspective, but not bad, and no worse than Justice Stevens, with whom Justice Ginsburg largely agreed on such matters.

    Former Chicago Law School Dean Stone: Kagan approached First Amendment issues “without even a hint of predisposition.”Geoffrey R. Stone, a law professor at the University of Chicago who was dean when Kagan was hired there, wrote in a May 10 article:

    In her formative years as a scholar, Kagan wrote a series of illuminating articles about freedom of speech. They were illuminating not only because they shed interesting light on the First Amendment, but also because they reveal a lot about Kagan. In an area rife with ideology, her articles addressed complex and weighty legal questions without even a hint of predisposition.

    In one early essay, she addressed the provocative issue of hate speech. After examining the question in a rigorous, lawyerlike manner, she came out in full support of a highly controversial 5-4 decision authored by none other than conservative Justice Antonin Scalia, which held that the government cannot constitutionally ban hate speech. Kagan reached this result even though it was clearly contrary to the liberal orthodoxy at the time.

    Even Fox News’ Megyn Kelly says Kagan “seems pretty middle of the road” on “free speech matters.” From the May 11 edition of The O’Reilly Factor (retrieved from Nexis):

    KELLY: Well, I have to say on free speech, Elena Kagan, so far this is something she’s written a lot about, seems pretty middle of the road. I don’t expect her to be a far left liberal on free speech matters.

    NY Times reports there are indications Kagan’s “views on government regulation of speech were closer to the Supreme Court’s more conservative justices, like Antonin Scalia.” The New York Times reported in a May 14 article:

    In her early years as a law professor, Elena Kagan wrote almost exclusively on the First Amendment. There are indications in those writings that her views on government regulation of speech were closer to the Supreme Court’s more conservative justices, like Antonin Scalia, than to Justice John Paul Stevens, whom she hopes to replace.

  • How to get Environmental Impact Assessment

    Dear Energy Professional, Dear Colleagues,

    Do you know how to get your Environmental Impact assessment certification for your new thermal power plant investment? Let me explain.

    Any new thermal power plant project with output capacity more than 100 MW thermal, needs EIA certification for initiation of the investment in our local market.

    It is certified under the scrutiny and supervision of the EIA general Directorate of Ministry of Environment and Forestry. There is a public regulation for that process. You should first find a competent environmental engineering company, preferably based in Ankara, with good relations in the respective Ministries, and Public workers, close to the current administration, with many similar references in the past. Those companies are all well known by the sector. You can reach them by simple goggle search.

    That engineering company normally has sample master EIA document with 200-300 pages in Turkish, created with copy/ paste method, from various similar sources. They use “replace” mode in world and create a new version for your new thermal power plant investment. In this report, you read local insects, birds and flowers of the subject environment. Then the document starts to describe the thermal power plant in loose format, with general explanations of the technical details with no commitment no binding to any technology now to any supplier. Graphs, drawings, charts are all in primitive format, too childish in appearence, within capability of secondary school education.

    These explanations are so simple and funny that you laugh a lot while reading. Those are written usually by non- technical translators, from non-related Internet sources. Many technical terms are false. Investor does not have any commitment to any supplier nor to any technology, all loose information. There is plenty of talk about local employment opportunities. In project execution, the investor places the order to the lowest price supplier, mostly to the Fareast company with one third of the world prices as if it is a virtue, then the plant will be constructed by 2000+ Chinese leaving no employment opportunities to the job hungry locals, whereby it is worse to see that the same plant will be operated by 500+ foreign workers of the same foreign contractor for the next years.

    EIA reports declare that you will create employment to the local people. In the end, the investor creates employment to the foreign workers with the lowest ridicules price declaring Fareast company. The cheap price will certainly have lower life time in operation just to pass the guaranteed period of 2-3 years.

    All these documents are collected, and shall be submitted to the public authorities. The technical details are not important, so are the company’s financial status, or experience, or past references. The important thing is creating the required documents in full compliance to the regulations. If there is a certified commercial company in application, then it is enough to have certification for competence. The authority reads and evaluates the EIA report in a certain period of time. Normally they do not read the same wording on birds, insects, and flowers since they had enough exposure to that rubbish wording so many times in the past. The important thing is to satisfy a higher authority.

    Then “Public information Meeting” is scheduled in the nearest settlement town or village close to the thermal power plant site, serving tea, coffee, and cakes and empty wording, and explanations how wonderful and friendly would be the thermal power plant. The EIA report is released in the Internet with the possible short period of time, without awakening the local NGOs nor the chambers of engineers, nor environmental organisations.

    If those environmental organisations, Chambers of Engineers somehow learn and attend the meeting, and if they declare their objections on the EIA, lack of necessary filtration, lack of enough space for ash dam, inability to conform with deep sea water discharge, danger to underground water for the nearby agricultural activities in Antalya, danger to the air traffic in the nearby airport landing corridor in Denizli. These objections will be noted with care and said to be evaluated. As in Gerze, “Public right not to get informed” is noted, or in Terme “the meeting will be on hold”, enters into the public record.

    Then that EIA report is approved, and certified, so EMRA license is released based on that EIA certification together with many other registration forms already filled in full compliance with the regulation without sound scrutiny of financial status, nor capability, experience or similar references in the past. Public disapproval to the application is so rare.

    Investors’ consultants will then go to the market for shopping for the cheapest price without caring the quality, appropriate technology. They can not monitor or evaluate the technology since all technical drawings are in the original language of the cheap Far East contractor, only a few English wording appears on the title block of the technical drawings. There is limited, or mostly no access to the technical manuals since they are all in the foreign language of the Foreign Far East company with no intention to make English translations.

    These cheap FarEast originated plants operate for neat 2-3 years just to past the guaranteed period under the full operation f the foreign crew of 500+ foreign contractor team. Then the failures start in the dust filters, in the safety valves, in the fuel injection burners, then in the coal mills, in the ash disposal systems. Most of the time the plant has no spares since there is no emergency spare-part policy of the contractor. The investor does not request one because they do not know that they will need spare parts in the long run. These are all new for the investor, and spare part list is an unnecessary cost item in the initial cost of the plant in early comparison.

    Plant starts to pollute the nearby environment, local people reacts in desperation, in the mean time, the investor generates electricity and sells in the local market with high market price while polluting the air, sea and the land. Penalties are not deterrent, the plant is never closed due to ever increasing electricity demand f the local market. Plant shut down is temporary. It is normally re-opened in a short period of time after paying the ridiculous penalties.

    Coal power plant is operated with a staff of approximately 500 employees, similarly a combined cycle power plant works with 50 qualified staff. Local people can work at the door and just outside of the fence as security personnel.

    For how long? Until the time comes for a new political formation which protects the local employment, which restricts the employment of foreign workers, cares the expectations of the local community and responds to the local voters.

    In KaraBiga, there is a cheap 2x 135 MWe CFB design thermal power plants with lots of operational problems. Now the same investor placed a new order for construction of new 2x 600 MWe pulverised imported coal firing new thermal power plant. All technical drawings are in Chinese. Foundation works of the first unit is ongoing. You can not visit the plant but you can visualise via Goggle earth and can see the deep sea water discharge pollution.

    There is an ongoing construction work in Catalagzı for 2x 600 MWe Pulverized imported coal, cheap Chinese power plant. Construction will be completed by the end of the year. All technical drawings are in Chinese so there is possibility of local workers to operate the plant.

    We Mechanical Engineers, are not against the construction of thermal power plants. We are educated to make construction of the thermal power plant in compliance with the technical quality of our local coal. We would like to use the maximum local engineering, local design, local resources, local fabrication and local manpower, in compliance with environmental regulation with the least harm to the nearby environment. The try to design the environmental friendly equipment to collect maximum amount of dust, ash, NOx, SOx, reduce the noise to lowest level, appropriate and clean deep sea water discharge, collect all ash and bottom ash in ash dams, keep the air clean, stack clean, coal stock area non-polluting.

    EIA approvals, environmental controls are too important and should not be left only to the care and regulations of the government agencies. Turkey’s energy policy, should not be “more energy and electricity generation no matter what the cost to the nearby environment” as the public institutions have now been implementing.

    Our energy policy should be, “to generate energy and electricity in respectful to the environment, with maximised use of local fuel, with best local design engineering, fabricated with maximised local portion, installed by the local contractors, with local labour, built at environmentally appropriate areas.

    Engineers can not be against to the thermal power plants. On the contrary it is engineers’ job to design with best engineering capability to meet the firing maximised local coal, to inform and enlighten the society how to reach to that target.

    Pulverised coal-fired thermal power plant coal combustion technologies should be abandoned, new clean coal technologies, CFB, IGCC, Oxy-firing, underground gasification systems must be applied. Combined cycle power plants should be designed to have sea water plant cooling system, with minimum damage to marine life with deep sea discharge properly designed, to the sea water temperature, dust, ash, NOx, SOx emissions should be kept under control, and the plant should not be placed in the forest land.

    Without Energy, and electricity production, a society can not develop, can not raise the level of prosperity. You can not live conformable life. You can not watch opera, cinema, TV, without electricity. You can drive on the freeway without traffic lights, live warm, comfortable environment in your home at night. Newspapers can not be printed, Planes cannot fly nor land.

    More energy production is essential, increase in power production is required. Everybody wants electricity, want more power, but no one wants the thermal power plant in their own backyard, even wind power plants since they make too much noise. How shall we fix this dilemma?

    This dilemma will be fixed. Investors will make investments on appropriate design plants in correct place, environmental friendly, employ more local people, with sufficiently big dust filters in operation, designed to deep sea discharge properly. They will not cheat the local people. Plant will not be in the forest land, nor in agricultural neighbourhood. All depreciation of the nearby land value will be repaid. A new thermal power plant can be constructed next to an old thermal power plant since the local plant around an old plant is used to the presence of a thermal power plant. They worked there for many years. They accept the investment much faster.

    Investors are to pay attention to the environmental issues, care to respond to local engineering and local employment expectations, if they wish to have minimum problem with the locals in the long term operation of the plant. We engineers want all parties to earn money. If the local people can not earn money, while only investor earns money, this is not fair. This one-way happiness can not continue forever. We engineers want all parties to earn money, and the thermal power plant investment should bring wealth to the community and o the investor both. Local NGOs and chambers of engineers should have regulatory and supervisory role for the project at all times.

    What happens next after all?

    If the local people are mostly comprised of highly educated retiree/ pensioner population with sufficient environmental organisations, fully informed of the details of the new investment project, they apply to local courts for cancellation of the investment certificate. Since the EIA report is not so complete, it is weak in content, ill-prepared, with many deficiencies in technology, courts declare cancellation of execution.

    However the construction is not ceased. Investor and the constructor continue the site activities. The investor completes the deficiencies and applies to the administration for renewal of the certification and the license. The public office re- issues the certification in time. The investor spends a little more money, without any change in design and details of the equipment at site.

    The investor with no care in public relations, continues to make mistakes with applications to courts for compensation of the extra costs. It is funny but a reality. It there any other similar court case in the world that an investor goes to court to sue a local person who goes to the court to ask real value to the land which is expropriated??

    That is poor practise public relations, too absurd, and the initiator pays back unnecessary consequences in the long term at all times, since be sure that nobody gets intimidated.

    We engineers do not ride trains if we were scared of the iron, we do not go to mines if we were scared to get dirty, we do not work on off-shore platforms if we were scared from water. (a local saying created in recent years)

    The National Highway Traffic Safety Administration has opened a formal investigation of 900,000 Ford Windstar minivans after receiving 234 complaints of rear-axel fracturing. The investigation covers Windstar models from 1999-2003.

    The NHTSA website said that while a snapped axle can result in loss of control to the vehicle, there have only been two reports of minor crashes.

    The agency said that the vast majority of complaints are from “salt-belt” states, due to possibility that the rear axle beam collects road salt and corrodes until it snaps. A quarter of the complaints said that the axle broke at speeds of at least 40 mph.

    A Ford spokesman did not respond to requests for comment by Automotive News.

The tax has yet to be reinstated, though the House passed a bill late last year to set the tax at the 2009 level. Under the 2009 rate, estates worth less than $3.5 million pay no taxes at all, while larger estates pay 45 percent of anything above that threshold. As a bill to reinstate the estate tax is negotiated in the Senate, some senators have been pushing to cut this tax on millionaires to 35 percent, while raising the exemption to $5 million.

    Today, the National Journal reported that Sen. Chuck Grassley (R-IA) signed on to the plan, which could represent an enormous tax break for his family. Grassley is worth between $2.1 and $5.2 million, according to the Center for Responsive Politics, so his entire estate could be exempted under a $5 million exemption.

    Moreover, Grassley’s proposed tax cut would affect few families other than his own. Under the 2009 rate, 99.8 percent of estates owe no estate tax at all. If these levels were made permanent, the Center for Budget and Policy Priorities points out that “[o]nly three percent of taxes owed” would be from estates that are, like Grassley’s, worth less than $5 million. The vast majority of current estate tax revenue comes from the “extremely wealthy,” with 62.5 percent of revenue coming from estates worth more than $20 million.

    Beyond this, the cut would cost $60 to $80 billion in lost revenue, which would have to be offset with spending cuts. As the Wonk Room’s Pat Garofalo noted, it’s a huge waste to spend $60-80 billion in order to help the 0.2 percent of households that pay estate taxes while we have soaring deficits and high unemployment.

    “The company has formed an unholy alliance with conservative pundits to drive a false narrative and play off public fears in order to sell its products”, says the release.

    While it’s unclear what Weiner has planned, Smith reports that Goldline is girding for a fight against Weiner’s attack on “Goldline International and Glenn Beck.” The company has made top officials available for comment, and sent out its own press release saying, “We are not sure what exactly Weiner will be saying but we do know that it will not be favorable to either Goldline or any of the conservative personalities that support Goldline.”

Note that the upgrade will wipe your phone, so make sure all your important data is synced up somewhere.

    Philippines’ billiards masters’ Francisco Bustamante and Lee Vann Corteza started with a bang in the 2010 US Open 10-ball championship in Las Vegas. Bustamante defeated Neil Cummins (9-0), while Corteza won against Tony Royles (9-6). Both already hit hard in two separate titles and it looks like they are hungry for more. Ten Filipinos are battling it out for the championship. “Corteza took off far from Tony Royles from the start, his determination snapped Royles in the end,” said spokesman Ramon Mistica.

  • T-Mobile HD2 Customers: Update Available, Wipes Games and Movies

    Owners of smartphones get excited when word arrives the phone’s software has a big, fat update coming. It’s always a good thing to get the latest and greatest software for the smartphone, keeping it up to date. There’s nothing that can damper that good feeling; except having to repurchase software that the update wipes out. That’s the warning from T-Mobile to owners applying the ROM update just released. Those who have purchased the full version of games after playing the demo version preinstalled on the HD2 will “need to re-purchase them at standard cost following the software update.”

    The update forces a master reset of the phone and no mechanism was put in place to determine if customers had purchased the full game(s). That’s a drastic solution — just repurchase the games. Those with Blockbuster movie rentals will find them gone after the update too, and it’s recommended you watch all movies prior to applying the update. You’ll have to download those big files again if you don’t.

  • From Butcher Block to Vanity for Two

    Materials: Groland Butcher Block Island

    Description: When we moved into our condo, the one not so great feature was the tiny master bathroom – 45 sq. ft. total! In order to shoehorn in a 2 sink vanity (and not break the bank in doing it), we decided to make our own.
    (1) After assembly of the butcher block island, we cut two sink holes in the top. This was no small feat since the top is a real butcher block about 2 inches thick!

    (2) We stained the whole piece w/clear lacquer to protect it from bathroom moisture;
    (3) Spray painted side of butcher block and lattice shelf (for a li’l pop);
    (4) We hand-tiled the whole butcher block top with li’l iridescent glass tiles (which match the shower accent tile);
    (5) Installed two drop-in stainless steel sinks and single lever/hole faucets.
    (6) Had a plumber hook up a T-line junction from the one existing water line/sink drain and voila!

    We had our own custom 48″ 2 sink spa style vanity!

  • Windows Mobile sales surprisingly flat in Q1 2010

    Gartner have released their Q1 2010 figures for smartphone sales, and unsurprisingly Windows Mobile has continued to lose market share. What is surprising is how well the numbers have held up, with sales between Q1 2009 and Q1 2010 being virtually the same, despite the OS basically being end of life’d at Mobile World Congress  in February this year.

    Of course the smartphone market did grow nearly 50% YoY, which may account for some of those Windows Mobile sales, and of course excellent flagship devices such as the HTC HD2 would have helped.

    Windows Mobile market share now stands at 6.8%, well below Android, and there is a strong sense of the OS being phased out, despite Microsoft’s stated intent to keep it hanging around as an enterprise operating system. Windows Phone 7 is still around 3-6 months away, which means its pretty likely sales numbers will continue to tank.

    Readers will therefore forgive us if we keep our eyes focussed on Windows Phone 7 and its fortunes, because it’s likely by Q1 2011 Windows Mobile sales will be measured in thousands rather than millions.

    A little titbit of note is that Gartner claims HTC sales of 2.6 million, while Windows Mobile sales are 3.7 million.  I guess HTC does not sell 80% of Windows Mobile handsets after all…
