Public-health-related bans are set to take effect with the New Year in a bunch of states. Here’s a sampling:
California restaurants will be banned from using trans fats. Starting tomorrow, restaurants won’t be able to use “oil, shortening, or margarine containing specified trans fats,” according to the text of the legislation. In 2011, the bill will expand to prohibit restaurants from serving “any food containing artificial trans fat.” Certain exceptions will apply, and some school cafeterias will be exempt. Eating trans fats increases the risk of heart disease, stroke and diabetes. California is the first state to ban restaurants’ use of trans fats, the San Francisco Chronicle says, though some cities (including New York) have similar bans in place.
Smoking will be banned in North Carolina bars and restaurants starting Saturday. Yes, dozens of states already have smoking bans in place. But this one’s noteworthy because North Carolina is a big tobacco state, and home to cigarette giants like R.J. Reynolds (Camel, Winston) and Lorillard (Kent, Newport). “Even as recently as a decade ago, this was unthinkable,” a UNC prof told the Charlotte Observer.
Texting while driving will be banned in New Hampshire, Oregon and Illinois, the Associated Press reports. That will bring the number of states that ban the practice to 19, according to the Governors Highway Safety Association, which publishes this handy chart of state laws that limit the use of cell phones while driving.
Astonishingly, the AP found a 42-year-old woman who said for the record that she didn’t plan to stop texting while driving in New Hampshire, where the fine for getting caught will be $100. “I’d better start saving my money,” she told the AP.

The Mophie Credit Card Reader
Jack Dorsey’s Square, Incase, Verifone and now Mophie — these companies’ credit card readers are turning the iPhone/iPod touch platform into an e-commerce engine.
Mophie, a Los Angeles-based company that makes accessories for the iPod/iPhone devices will release a credit card reader at CES in January 2010. The device is going to have a reader and a software that would allow small businesses to take credit cards. No more details are available just yet.
I, for one, would like to see Mophie or one of these other startups come up with a way for me to scan my own credit card to enter it into an app or web site. Even better, I’d love it if they married their hardware with the functionality of something like 1Password. In doing so, they could enable e-commerce via the iPhone apps. Think of it as iEconomy.
I know, I know — it’s easier said than done, considering it would need some deep, system-level mucking around, and Apple isn’t going to let that happen. But it should! By opening up, it would make the iPhone into an even more useful platform. While I can understand Apple’s hesitation at opening up the iPhone, it can start with iPod touch, which is not tethered to a wireless phone company’s network.
By focusing on the consumers, these companies can also overcome two things: somewhat finite number of likely small business customers and get scale, which would allow them to get cheaper. And this would also help them overcome the slower adoption rates normally encountered when chasing the small business market. In fact, companies such as Visa, MasterCard and large banks should be trying hard to figure out how they can put these kind of readers in the hands of both merchants and consumers, thus shifting even more transactions into the electronic realm.

OK, you can see I am just way too excited about this stuff. Why not? I am encouraged to see such experimentation. It ties in with my big belief: the marriage of computing and connectivity without the shackles of being tethered to a location is the the biggest disruptive force of our times, and it will redefine business models for decades.
For a long time, companies like Symbol Technologies, a division of Motorola, have been making point-of-sale and handheld computing devices for non-office environments such as retail locations and warehouses. It is becoming obvious by the day — they are amongst those being disrupted.

Most turnaround professionals predict a hard slog toward economic recovery in 2010 as businesses weighed down by debt hit rough patches and credit markets shun them.
Nearly half (49 percent) the respondents to the Turnaround Management Association’s distressed industries forecast think durable economic improvement is unlikely until at least the second half of 2010.
About three out of 10 think the worst is over, but nearly 20 percent suggest the economy has yet to hit rock bottom.
Industry Outlook
Three out of four respondents think the commercial real estate industry will fare the worst in 2010 as debt matures and lenders remain reluctant to refinance.
Retail again garnered the second highest proportion of responses, 35 percent, down from 52 percent last year.
Automotive, at the top of last year’s predictions list for most troubled industries, slipped to third (31 percent) during a year in which the federal government brokered restructurings of two of the big three automakers.
Technology appealed to nearly 30 percent of respondents as the industry most likely to improve in 2010, and energy and health care ranked nearly as high.
Commercial banks, which ranked third among industries most likely to improve in 2009, slid to fourth place.
Persistent Economic Trouble
Nearly all (92 percent) said economic conditions pose the greatest threat to struggling industries, and the most hard pressed will contend with too much debt compounded by lack of access to capital, according to 78 and 52 percent of respondents, respectively.
Industries likely to fare better in 2010 will do so mainly because of increased demand for products and services (59 percent) and an improved economy (52 percent).
Joblessness Cures
If the economy recovers without sufficient job creation, most respondents suggest the unemployment rate could be lowered through tax incentives for hiring, capital spending, and technology investment.
To a lesser degree, respondents think stimulus spending to create public works and youth employment projects and repatriate manufacturing jobs could help absorb some of the millions of out-of-work Americans.
The Chicago-based Turnaround Management Association has more than 9,000 members in 46 regional chapters who comprise a professional community of turnaround practitioners, attorneys, accountants, investors, lenders, venture capitalists, appraisers, liquidators, executive recruiters and consultants.

It’s December 31, the last day of the 2000s. It’s always fun, and often quite moving, at times like these to take a look back and remind ourselves how far we’ve come, to recall where and what we were and how and why we are different now. These exercises can seem a little cheesy, but I think they’re quite useful. Some change comes so gradually that you hardly recognize it’s occurring at all. With a little self-reflection you can acknowledge that real change has occurred, be proud of it and own it, and then commit to further personal growth.
I was inspired by this Mark’s Daily Apple forum thread. In it forum user bonesheal asked, “What did YOU learn this year?” Seeing that Mark’s Daily Apple may have played a small part in raising the consciousness of the people that responded makes the experiment that is MDA all worth it. I started MDA over 3 years ago now with the goal to, as I say, empower people to take full responsibility for their own health and enjoyment of life by investigatng, discussing and critically rethinking everything we’ve assumed to be trued about health and wellness. I’m thrilled to see that people are doing just that. And I look forward to continuing to provide the resources and this forum for change.

According to a new report from Cambridge University (PDF), students aren’t interested in being able to read eBooks and eJournals on their mobile phones. Instead, users are far more interested in opening hours, location maps, contact info, and access to the library catalog. Most respondents were also far more interested in getting alerts by text message than being able to use library resources over the mobile web.

According to the researchers, libraries that serve colleges should invest in text alerting services, and text reference services instead of mobile web services. With text alerting services, users could receive alerts when books are due, for example, while text reference services would give students access to the library reference desk over SMS. The report also advises libraries to allow mobile phone use in their buildings, “as long as they are set to silent or to flight mode.”
It is important to note that the researchers only surveyed users at Cambridge University and the Open University, so these results are somewhat skewed and only apply to the U.K., where text messaging is even more prevalent than in the United States.

The report, however, also found that users of more advanced phones like the iPhone are far more inclined to read e-books on their phones than users of feature phones (no surprise there, given the difference in screen estate and quality). In the end, though, the report argues that it is currently “not worth libraries putting development resource into delivering content such as e-books and e-journals to mobile devices at present.”
While these recommendations seem reasonable based on the survey data, we agree with Lorcan Dempsey, a library blogger and Vice President of OCLC, who argues that with the advent of better eReaders and the iPhone, these survey results will probably look very different in just a few years from now.
As Sarah Bartlett from the Panlibus blog points out, the recommendations in this report are anchored in the past (getting SMS alerts about due books, for example), while now would be a good time to “re-imagine the library and its services.”
While some libraries are often conservative when it comes to adopting new technologies, we would think that starting to adopt some of these technologies like e-books and better mobile services now would help these institutions to remain relevant in a future where those large buildings in the middle of campus are already turning more into places for study groups to meet up and grab a cup of coffee than centers of academic research.

After canceling a earlier deadline of December 31, General Motors has given potential suitors until January 7 to come up with a bid for Saab or the storied Swedish brand will go the way of the dodo. On a business level, the move to rid itself of Saab makes sense. Saab is a perennial money loser and it has never quite figured out how to handle the brand. At this point, about the only possibility for Saab to escape the guillotine is for Spyker Cars or another bidder to somehow come up with a satisfactory last minute bid- or is it?
The brand enthusiasts at Saab History are trying to stage a last minute rally of their own – only instead of a bid for the company, these fans are looking to rally at GM’s Renaissance Center headquarters in Detroit, hoping that a show of force will help keep the doors open in Trollhättan. The goal is to assemble an impressive show of force just hours prior to the General’s January 7 board meeting that will determine the fate of the brand. The directions are simple. Get to GM headquarters, park your Saab, get some group photos and talk to the press.
The hope of the rally is that GM’s board members will see the outpouring of support for Saab and somehow push harder to make a deal a reality. While that sounds nice – and probably fun – like the hoped-for agreement with Spyker itself, it remains to be seen whether the plan can be seen through. After all, the rally suggestion was floated just yesterday, and thus far plans are in their infancy. Two travel bloggers, Steven Frischling and Chris Elliott received friendly visits from the Department of Homeland Security this week. Why? Because both published SD-1544-09-06, the document that showed us what to expect when we flew in scardeyplanes from now on. A reaction to the pants bomber, the document essentially outlined a few points including the directive to prevent passengers from using their electronics during the last hour of a flight (I mirrored it below.)
Anyway, both Elliott and Frischling apparently received the document from an anonymous Gmail account and told the government as much. In a Danger Room interview, Frischling reports that DHS agents went through his Blackberry and laptop, including driving to Wal-Mart to buy a hard drive onto which to copy his files. They couldn’t get the copy to work so they seized his laptop for a while, presumably to hit up the Geek Squad for help.
It’s hard to side with the TSA agents here. They sent the directive to tens of thousands of people and organizations and, ostensibly, it’s a unclassified item. The TSA is clearly depending on some permutation of security through obscurity here and it’s just not going to cut it.
Here’s hoping Elliott and Frischling don’t get in trouble for sharing the truth.

APPLICABILITY: THIS SD APPLIES TO AIRCRAFT OPERATORS THAT CARRY OUT A SECURITY PROGRAM REGULATED UNDER 49 CODE OF FEDERAL REGULATIONS (CFR)1544.101(a).
ACTIONS REQUIRED: If you conduct scheduled and/or public charter flight operations under a Full Program under 49 CFR 1544.101(a) departing from any foreign location to the United States (including its territories and possessions), you must immediately implement all measures in this SD for each such flight.
1. BOARDING GATE
1. The aircraft operator or authorized air carrier representative must ensure all passengers are screened at the boarding gate during the boarding process using the following procedures. These procedures are in addition to the screening of all passengers at the screening checkpoint.
1. Perform thorough pat-down of all passengers at boarding gate prior to boarding, concentrating on upper legs and torso.
2. Physically inspect 100 percent of all passenger accessible property at the boarding gate prior to boarding, with focus on syringes being transported along with powders and/or liquids.
3. Ensure the liquids, aerosols, and gels restrictions are strictly adhered to in accordance with SD 1544-06-02E.2. During the boarding process, the air carrier may exempt passengers who are Heads of State or Heads of Government from the measures outlined in Section I.A. of this SD, including the following who are traveling with the Head of State or Head of Government:
1. Spouse and children, or
2. One other individual (chosen by the Head of State or Head of Government)3. For the purposes of Section I.B., the following definitions apply:
1. Head of State: An individual serving as the chief public representative of a monarchic or republican nation-state, federation, commonwealth, or any other political state (for example, King, Queen, and President).
2. Head of Government: The chief officer of the executive branch of a government presiding over a cabinet (for example, Prime Minister, Premier, President, and Monarch).
2. IN FLIGHT
1. During flight, the aircraft operator must ensure that the following procedures are followed:
1. Passengers must remain in seats beginning 1 hour prior to arrival at destination.
2. Passenger access to carry-on baggage is prohibited beginning 1 hour prior to arrival at destination.
3. Disable aircraft-integrated passenger communications systems and services (phone, internet access services, live television programming, global positioning systems) prior to boarding and during all phases of flight.
4. While over U.S. airspace, flight crew may not make any announcement to passengers concerning flight path or position over cities or landmarks.
5. Passengers may not have any blankets, pillows, or personal belongings on the lap beginning 1 hour prior to arrival at destination.AIRCRAFT OPERATOR ACKNOWLEDGMENT: The aircraft operator must immediately provide written confirmation to its assigned PSI indicating receipt of this SD.
AIRCRAFT OPERATOR dissemination required: The aircraft operator must immediately pass the information and directives set forth in this SD to all stations affected, and provide written confirmation to its PSI, indicating that all stations affected have acknowledged receipt of the information and directives set forth in this SD. The aircraft operator must disseminate this information to its senior management personnel, ground security coordinators, and supervisory security personnel at all affected locations. All aircraft operator personnel implementing this SD must be briefed by the aircraft operator on its content and the restrictions governing dissemination. No other dissemination may be made without prior approval of the Assistant Secretary for the Transportation Security Administration. Unauthorized dissemination of this document or information contained herein is prohibited by 49 CFR Part 1520 (see 69 Fed. Reg. 28066 (May 18, 2004).
APPROVAL OF ALTERNATIVE MEASURES: With respect to the provisions of this SD, as stated in 49 CFR 1544.305(d), the aircraft operator may submit in writing to its PSI proposed alternative measures and the basis for submitting the alternative measures for approval by the Assistant Administrator for Transportation Sector Network Management. The aircraft operator must immediately notify its PSI whenever any procedure in this SD cannot be carried out by a government authority charged with performing security procedures.
FOR TSA ACTION ONLY: The TSA must issue this SD immediately to the corporate security element of all affected U.S. aircraft operators.
