  • The 100 Millionth Deviation on DeviantART Is A Gay Sex Story, But I’m Going To Show You This Arctic Unicorn Instead

    On deviantART, the site for anyone who thinks they are an artist, member submissions are known as “deviations.” The site’s been around since 2000, attracts 33 million monthly visitors (comScore), and just recently passed its 100 millionth deviation. It is, appropriately enough, a short story about gay sex.

    I could quote from it, but it is more of a deviation from good writing than anything else. I might as well just show the “Blizzard” drawing above featuring some sort of black unicorn frolicking in the snow with an arctic fox. How should I put this? There are some creations which are better left in a drawer and maybe shouldn’t be shared with the world. Seriously, would you pay $150 for a print of this drawing?

    I’m sure there’s some great art on deviantART among the 100 million submissions of drawings, photos, videos, and stories, but they are hard to find among the 99.9 million pieces of mediocrity which seem to fill up the site. It’s as though every kid from your high school art class who dropped out to draw dragons is on the site, telling the other drop-outs how amazing their art is. Some of it is so bad that it’s given rise to parody blog divineART, whose slogan is, “When art becomes visual pollution!”

    But, hell, what do I know? Those 33 million visitors a month are enough to classify the site as mainstream (shhh, don’t tell).

  • Flixster Users Name Top 2009 Movies: Avatar, Star Trek And The Blind Side


    Forget the Academy Awards and the professional movie critics. Flixster users reviewed movies 55 million times in 2009, says the company, and they’ve released the top movies based on those ratings. At the top is Avatar with a 92% like rating (compared to 83% for the critics). Second is Star Trek with 91%, and The Blind Side comes in third with 90%.

    The year’s lowest-rated movies were Whiteout (35%); Year One (32%); Dragonball Evolution (30%); Streetfighter: The Legend of Chun-Li (30%); and Transylmania (25%). I’d add Transformers 2 to that list of terrible movies, which is the top grossing film so far this year.

  • Letterman Extortionist Uses Tiger Woods Defense

    It’s the old Tiger Defense: The TV producer accused of shaking down David Letterman about his affairs with Late Show employees is drawing on the Tiger Woods sex scandal as part of his defense.

    In court papers filed Tuesday in Manhattan, an attorney for former 48 Hours producer Robert “Joe” Halderman cites published reports that Woods paid an alleged mistress to remain silent.


    Halderman’s lawyer said his client simply had valuable information and wanted to get paid for it in the same manner that several women involved in the Woods sex scandal have been.

    “Uchitel, Allred and (wife Elin)Nordegrin are being prosecuted because they acted in accordance with a set of basic commercial realities; their behavior was capitalist, not criminal,” Halderman’s legal team says in the court documents.

    Prosecutors accuse Halderman, 52, of trying to shake down the married late night comic for $2 million to keep embarrassing info about the late night comic’s personal life private. The producer was previously romantically-linked to one of Letterman’s former mistresses. Halderman’s defense lawyer claims his client was simply shopping a screenplay.

    If convicted, Halderman faces 15 years in jail.

  • Court Dismisses Defamation Claim Against Consumer Complaint Site, Highlights Section 230 Protections

    It looks like Section 230 protections win out again. Some of the regular critics on this site like to make odd claims about Section 230 — insisting the Section 230 is quite limited, leaving a site liable if it cannot prove who created the content, or that it simply does not apply, if the site in question “helped” create the content in any way. A new ruling should help clear up those misconceptions. The case involves a car dealer, Nemet Chevrolet, that was upset about negative reviews on ConsumerAffairs.com. ConsumerAffairs is one of many “gripes sites” out there — with one interesting distinction. It works closely with class action lawyers to review the gripes and seek out opportunities for filing class action lawsuits. While this may be somewhat distasteful (class action lawsuits are all too often much more about getting money for the lawyers than actually helping the class), the site, like any other gripes site, is protected from defamation claims by Section 230.

    Eric Goldman discusses the latest ruling, in which the appeals court upheld the dismissal by the district court, using Section 230. In the ruling, the court rejected two specific claims that Nemet made to try to get around Section 230. First, Nemet claimed that since ConsumerAffairs solicits complaints and asks users questions to draw out the details, it is partially responsible for the content (an attempted misreading of the Roommates ruling). However, the court tossed this out, saying that the problem with Roommates was that the questions asked specifically requested illegal information. That is not the case with ConsumerAffairs.

    The other attempt by Nemet to get around the Section 230 issue was to say that because it couldn’t figure out who one of the complaints came from, ConsumerAffairs must have made it up, and thus it was liable since it created the content. That didn’t work either. Eric Goldman points out how silly this logic is on the part of Nemet:


    This allegation has an obvious (and IMO embarrassing) logic flaw. Even if Nemet can’t use its records to validate the facts in a consumer review, ConsumerAffairs.com’s fabrication of the post is only one of many possible explanations. The court notes some other possible explanations: “the post could be anonymous, falsified by the consumer, or simply missed by Nemet.” (I would also add the possibility of weak recordkeeping by Nemet).

    So, once again, we see that Section 230 is working properly, requiring that liability be properly applied. It does not mean that there is no liability at all — just that you can’t blame the tool or platform provider for the work of a user. The user may still be liable — which is fine — but the service provider is not.

  • Dr. Lanou Responds to Jack’s Post about Calcium

    Because the comments section to my post, Comments on Bone Health Article in the Vegetarian Voice, has gotten so long, I decided to create a new post that includes Dr. Amy Joy Lanou’s response and my follow-up.

    From Dr. Lanou:

    “I appreciate that you have taken the time to read our article and critique it. I fear, though, that you may have missed the main point. Our overall point is that the literature is pointing to the benefits to bone of a dietary pattern that high in fruits, vegetables and other plant-matter and low protein from animal sources along with adequate weight bearing physical activity to stimulate new bone cell formation. In our book (Building Bone Vitality) we highlight the importance of consuming the at least 17 other nutrients that are important to bone (including adequate, but not excessive protein and vitamin D among 15 others) as part of a healthy dietary pattern based on whole foods from plant sources.

    “The single nutrient, calcium, or single food (cow’s milk) approach to osteoporosis prevention that we have grown up with and are still being sold is not working and may even be counterproductive. Vegan nutritionists arguing over whether the actual amount of recommended calcium should be 400 to 500 mg/day as the World Health Organization recommends for avoiding osteoporosis, >525mg a day as the Appleby and Key study would suggest, or the 700 or 800 mg/day that Jack Norris, RD recommends is part of the problem….not part of the solution. We are still focusing on that same single nutrient.

    “I agree that the literature is not clear on what the exact optimum amount of calcium that an individual vegan may need is…in fact, the “right amount” quite likely has to do with the persons overall dietary pattern, activity level and other individual characteristics. It is, however, quite clear to me from a broad review of the literature that vegans, vegetarians, and omnivores alike are not getting a measurable benefit to hip fracture from pushing calcium intakes via dairy products and calcium supplements from 1000 to 1200 to 1500 to 2000 mg a day as some professionals recommend. I purposefully chose not to make a personal (albeit expert) recommendation for the level of calcium for vegans to consume but instead chose to go with the recommendation of an authoritative source (the WHO) as a useful starting point. I have no argument against a person targeting a calcium intake of 800 milligrams in a whole foods vegan diet (though I would be surprised if it did help prevent fractures more than targeting 500 mg/day calcium intake.) I would suggest, however, that people taking 1000 mg of supplemental or dairy calcium a day (or more) to prevent osteoporosis stop doing so and look instead at putting their efforts instead into moving to a dietary and lifestyle pattern that supports bone health.

    “Please keep in mind that Building Bone Vitality and the article in question were both written to help vegetarians and omnivores alike to understand that milk drinking is not necessary for healthy bones and to urge people to move to a diet built from health-giving and bone-supporting foods the fruits, vegetables and other plant foods and away from a diet that is built from highly processed foods, meat and cheeses. I understand that our message may not be detailed or specific enough for some clinicians and long time vegans. (I appreciate that clinicians are working to make sense out of the research and make more specific recommendations than we have.) I hope your readers will forgive us for this lack of specificity if we manage to do some good with the message (for human health, for the animals, and for the environment) along the way.

    “A couple other points of clarification:

    “We do address the Appleby study in the book, but not in the article. Dr. McDougall has written about the Appleby study as well and he notes that none of the fractures experienced by the vegans in this study were fractures of the hip compared to 30 in the meat eaters, 9 in the fish eaters, and 14 in the vegetarians (dairy). Hip and spine fractures are arguably the most important end point for osteoporotic fracture. Dr. McDougall suggests and this is confirmed to some degree by correspondence with Dr. Key that the younger, thinner and more highly active vegans may have had more injuries due to vigorous physical activity.

    “The meta-analysis of protein intake on bone health by Darling et al published in AJCN in 2009 fails to find either benefit or a lack of benefit of protein on bone. If one approaches this study from the perspective of trying to understand the relationship between dietary patterns and bone, this result is not surprising. Again these researchers are trying to understand relationship of the single nutrient (this time) protein, in the context of widely varying dietary patterns. It makes sense then that any effect of this single nutrient might be obscured in a meta-analysis since other potentially important dietary factors likely also varied widely (fruit and vegetable intake, potassium, vitamin D, sodium, etc.).”

    Dr. Lanou,

    Thank you for your response. I appreciate your goal of helping humans, animals, and the environment.
    I have a few more comments below.

    It is interesting that the vegans did not have any hip fractures. However, the study did adjust for physical activity and age, so those differences should not explain much of the results. And to my knowledge, there is no reason to think that the lifestyles of the vegans getting more than 525 mg of calcium were any less active than the vegans getting less than 525 mg, yet those getting more than 525 mg did not have a higher fracture rate.

    The cross-sectional studies on vegans’ bone health have, for the most part, not shown them to have better bone health than omnivores. Those studies are cited here.

    Thus, to date, there is very little evidence that a vegan diet helps prevent osteoporosis.

    I have not seen a study, that tracked calcium intake over time, that showed people with intakes of 500 mg or less have less fractures than those with higher intakes.

    I realize that Dr. Lanou’s point is that we need to take a holistic approach to bone health and not focus on one nutrient. But even holistic approaches only affect bone on a molecular level; if there isn’t enough calcium to maintain bones, it doesn’t matter if the approach is holistic or not.

    Because of the harm it causes cows, I very much want to see an end to the dairy industry. But it could harm cows and humans just as much if, at the same time, we tell them that it is not important to concern themselves with calcium. In my opinion, the evidence doesn’t justify taking this risk.

  • Axon head-mounted camera records what police see when they keep an eye on Mayberry

    Taser International, not content with zapping people with electricity, now wants you to be able to capture the action on video — hands-free. Similar to the helmet cam used on television sports, the Axon system includes a Linux-powered tablet PC, an eye-level HeadCam that records audio and video (using IR in low-light), and a corresponding account on Evidence.com, an online, real time app for accessing and analyzing the data — sure to become law enforcement’s third favorite web portal (after Sprint’s GPS data dispersal site and Garfield Minus Garfield). The system — which will cost $5,700 per officer every three years — made news recently when a Fort Smith, Arkansas officer was cleared of any wrongdoing in the death of a man who had threatened his wife with a handgun. The policeman was wearing an Axon camera at the time, which the county prosecutor said that the video allowed him to “observe what happened with complete objectivity.” Currently officers in San Jose are using the system as part of a free trial, with other departments around the country expected to get in on the action in the near future. And who knows? At the very least we can hope that some hilarious law enforcement hijinks finds its way to YouTube. Get a closer look in the gallery below.
