  • Health Care Reform and You

    Picture of a DoctorLast week, one of our frequent commenters, Thomas, suggested we post on the health care bill President Obama signed into law last month. Thomas says there’s a lot of information in the news about the bill and he was hoping that we could just give the "facts" about the law.

    There are major provisions of the health care insurance bill that begin immediately but it is hard for me to tell you how the law will impact each of you without knowing your specific health insurance situation. Also keep in mind that some of the provisions will take the Department of Health & Human Services (HHS) four years to implement.

    What I have been able to do is put together a list of resources where you can begin to research how the law will affect you. The White House has set up separate web pages with frequently asked questions for people in different health insurance situations. I would suggest you start at the webpage with information on the situation that applies to you. Your choices are: I have insurance through my work, I own a small business, I have medicare, I buy my own insurance and I do not have health insurance. Second, our National Contact Center created a web resource for our contact center agents that has a number of resources about the law.

    Finally, HHS has created Healthreform.gov where you can find information about implementation of the health care law. You can sign up to get email updates about the ongoing implementation of the health insurance law and most importantly you can email them your questions.

  • For Developers: Visual Studio 2010 and Silverlight 4.0 launches, brings improved Windows Phone 7 developer tools

    logo1 Over the weekend Microsoft has launched the latest iteration of their Visual Studio product, Visual Studio 2010.  Silverlight 4.0 will also be released later this week to the web for download.

    The combination brings further improved tools to developers, such as multi-monitor support and better debugging tools. 

    Windows Phone 7 developers specifically can however expect the ability to more easily create good-looking applications with the built-in integrated phone design surfaces.

    Silverlight 4, of which elements exists in the current Windows Phone 7 build,  delivers media and business application capabilities that enable developers to deliver application experiences on or off the Web. New features in Silverlight 4 include extended out-of-browser capabilities, enhancements for enterprise application developers, and more than 60 customizable pre-written controls to quickly build rich, interactive applications.

    “We’re excited to celebrate the launch of Visual Studio 2010 with developers around the world today,” said Bob Muglia, president of the Server and Tools Business at Microsoft, in a statement. “Customer and partner feedback was instrumental in shaping this release. The functionality of Visual Studio 2010, .NET Framework 4 and Silverlight 4 creates a powerful and unique combination, opening up new opportunities for developers to build applications that take advantage of new and existing devices, as well as emerging platforms like cloud services.”

    Eddie Amos, general manager of developer platform and tools marketing at Microsoft told eWEEK  a key theme for VS2010 was simplicity. "We wanted to be able to allow developers to keep it simple, but dream big," he said, noting that the Microsoft tools story has been consistent for many years. That consistency enables the company to deliver tools and development platforms for developers that allow developers to use what they are familiar with to create applications that can run across a variety of environments — from the cloud to mobile devices.

    "A lot of the same components are in place, so developers can leverage the skills they have to build web applications and other types of applications from within Visual Studio," Amos said. "We can enable them to optimize their code for the different platforms."

    Microsoft is kicking off a global launch of its flagship application development environment, with more than 150 developer-focused events around the world today.

  • Jesse James Spike TV Reality Show “Jesse James Is A Dead Man” Cancelled

    Spike TV has pulled the plug on Jesse James’ cable reality show, although the program premiered to solid ratings last season.

    Jesse James is a Dead Man will not return for a second season, a Spike TV spokesperson confirmed last weekend.

    “A decision was made to not move forward with a second season.”

    A spokesman reveals the decision was made shortly after news of James’ alleged serial cheating on wife Sandra Bullock hit the tabloids last month. Weeks later, a photo of James decked out in Nazi garb and giving the Hitler salute surfaced online.


  • Marchionne: Restructuring process at Chrysler is showing “positive results”

    Fiat SpA and Chrysler Group LLC CEO Sergio Marchionne said that restructuring at the U.S. automaker is showing “positive results.” Marchionne has been working hard in order to turn around Chrysler after it came out of bankruptcy.

    “In terms of the market share numbers coming out of the U.S., it’s a slow, gradual process, a re-making exercise. You need to give it time,” Marchionne said.

    He said that he is now “more confident” than he was 12 months ago about Chrysler’s future prospects.

    Chrysler’s U.S. sales fell 5 percent in the first quarter of 2010, while the industry deliveries were up 16 percent. However, Marchionne is opposed to incentives to increase sales at the expense of profits. He cut discounts for Chrysler, Dodge and Jeep brand vehicles by $1,122 in the first quarter – that’s more than quadruple the cuts made by GM and FoMoCo at $230 and $214 respectively, according to Autodata Corp.

  • Has Modern Living Made The People Weak, Unhealthy & Disease Prone?

    On one hand, modern technology has enabled people to live in cleaner, less disease-ridden environments, freed up time for many people; enabling children to spend their time learning, and relieving the pressure on families to be financially responsible for their sick and disabled. It has made a standard education available to all, and through the welfare state eliminated a great deal of extreme poverty, and brought advanced healthcare to save and prolong millions of lives.

    However, the question there is, how much of this is really as good as it looks?
    (If you’re in a hurry or don’t fancy a long read, skip to the last section now.)

    Our Cleaner Environment

    Our cleaner environment exposes our children to disease to a lesser degree as they are growing up, which combined with our advanced healthcare means the child mortality rate is a great deal lower. However, this also means children do not develop natural resistance to disease in the same way they previously would have done, providing they survived childhood. Some people also argue the lack of challenges to a child’s developing immune system may also be responsible for many allergies. Whether this is true or not… We will probably find out as time goes on. The other thing modern medicine and cleanliness does, is mess with natural selection. This is a sad thing to have to say, as no one wants a child to die, but as the children being saved by modern medicine would not have survived previously, their vulnerabilities would not have been passed on. Saving children’s lives is a wonderful thing for parents, but for the human race as a whole, this may not be such a good thing. However, time will tell, and nature will generally take care of itself.
    Yes, this aspect of modern living has probably made us weaker. This is a trade off for our quality of life.

    The Welfare State

    Lack of pressure on families to care for their sick, disabled and elderly financially (and practically, due to the acceptable nature of abandonment in care homes etc.) has caused a culture where people who are no longer productive in societies are deposited and put into a separate category where they are no longer in control of any aspect of their own lives, and no longer respected as human beings. This is a psychological strain on both these people and their families, and therefore a potential hazard to health.

    Modern Medicine

    Modern medicine saves lives, cures and prevents illness to enable people to gain back full and productive lives. However, it also grasps at prolonging life as long as possible, often at the cost of quality of life. The financial aspects of drug companies in many countries also contribute to an approach often no closer to scientific fact-based medicine than that of a witch doctor. Segments of the population are marked out as mentally ill (e.g. Creative/right-brained types diagnosed as ADD/ADHD in the USA,) or even physically ill (e.g. Podiatrists recommending further support to people whose problems caused by a lifetime of unnatural gait (shoe wearing) and who would often be cured by taking their shoes *off*.) Modern medicine does a great deal to improve life in the right hands, providing its practitioners are not misguided, however it also does a great deal of harm when used to further profit-orientated or practical/political agendas, thereby contributing to ill-health.

    Modern Lifestyle – Excesses and Sedentary Activity Levels

    The modern lifestyle encourages sedentary behaviour, not only through bad habits, but directly through its culture and practicality. Long working hours at desk jobs and lack of natural movement mean most people not only become “unfit” but see a state of real natural human fitness as exceptional. People are designed to have a lot more fitness, flexibility, and natural control and use of their bodies than the average person would dream of. Gyms are a poor substitute for the rigours of natural movement, and the result is a population struggling to keep themselves in healthy condition.
    Not only pizza and burgers are a hazard to health, but most fine dining, if indulged in regularly does exactly the same thing. (despite the more natural content, these meals are still high in fat and calories.) Heart disease, obesity, diabetes, are all results of our lifestyle, but even without these, many people who would consider themselves healthy, are in fact in very poor condition simply due to their lack of appropriate movement.
    Alcohol on the other hand, has been around for much longer than modern technology.
    Modern society supports our wants, but is negligent towards our needs.

    Standardised Availability of Education

    Due to the demands of modern society’s structure, education needs to be widespread to produce the necessary number of specialists to fill the required jobs. This education is therefore necessary and beneficial to society, and to maintaining the standard of living supported by modern society. However, to make this work, the school system is more of a socialization process than an education process, which channels people into appropriate fields of speciality and strongly enforces conformity in individuals. Although there are rewards; prestige, increased access to material rewards, for those who do well at this, this cog-in-wheel mentality fails to treat students as individuals or recognise individual needs and differences, and can put heavy demands on students’ personal welfare. Psychological problems are widespread.
    University students are also culturally subjected to extremes of an unhealthy lifestyle as they are introduced to this by their peers, risking long-term health problems including liver damage and alcoholism. Education as we manage it is beneficial to society, and therefore to supporting the individual’s modern living standard, but detrimental to the personal development of the individual.

    Anti-work attitudes towards children have protected them from exploitation and dangerous environments, however, this has also meant a strong work ethic and sense of independence and capability has not been forged in the current generation of many westernised countries. People often have little self-discipline and remain innocent and childlike later in life. The individual has an easy and protected life, however, this naivety could prove potentially damaging to the development of society as a whole.

    Psychological problems.

    Modern society has created both a high-pressure living environment and a value system which appears to be prone to resulting mental illness. People, as thinking, feeling beings have probably always experienced psychological distress in some shape or form. However, in addition to the usual experiences of violence and bereavement, modern society adds values which define worth in terms such as thinness for example, causing anorexia, and pressures to conform leading to the invention of psychiatric disorders. (bear in mind, psychiatric disorders are not simple cut and dry facts like a broken leg, but are classifications invented by professionals in an attempt to treat psychologically distressed individuals.) Many aspects of modern society are potentially damaging psychologically.

    To wrap things up…

    In general, our society has developed to favour protection over proficiency or practicality, and wants over needs. Diseases wiped out by modern living and technology have been replaced in prevalence by those often caused and contributed to by it. In a practical sense, people are no more disease prone, because modern technology and living standards protect them from it, though less well-trained immune systems may well mean that in actual terms, people are more disease-prone, and therefore weaker. Our value systems often mean people are self-conscious and psychologically vulnerable.

    So I can quite clearly come down on the side of Yes; Modern Living has made the people weak, unhealthy and disease-prone. So what can/do we do about it? Should we all go back to living without modern society? This isn’t of course, entirely feasible; the earth is massively overpopulated and the society, (and therefore the lifestyle) we have today, is a reaction to solve this overpopulation problem; a society which has developed to function living as we do today. There are clear advantages to modern living, and clear disadvantages. We need to question how we can evaluate the positives and negatives whilst being open enough to restructure not only our lifestyle and policies, but even our morals, objectives, and values, to emphasise and capitalise on the positives whilst eliminating as many of the negatives as possible. After all, what are we kidding ourselves that we as a race are trying to achieve, if not the best possible for ourselves?

  • Candidate for Congress Touted “Safe” Coal Days Before Massey Disaster

    Coal industry uses friendly smiling animated lumps of coal to promote clean coalBy now the name Don Blankenship is practically a household word all across the U.S. following the death of 29 miners at a Massey Energy coal mine, but Blankenship — the company’s CEO — has been well known in West Virgina and throughout Appalachia for some time now.  Perhaps equally well known is an apparent pal of his, former  state Supreme Court judge Elliot Maynard.  While on the bench, Maynard hooked up with Blankenship on an overseas vacation and voted to reverse a $50 million jury award against Massey.  When the relationship came to light in 2008, it helped spike Maynard’s re-election.

    Now Maynard is now vying to be the Republican nominee for Congress in a West Virginia district deep in coal country.   Is he still thisclose to Blankenship?  Zachary Roth over at Talking Points Memo has the story with a link to Maynard’s Facebook campaign page, which sports a March 26 press release.  In it Maynard announces that he’s invited a celebrity to visit a coal mine in West Virginia.  The money quote:  “We would love to have Sarah showcase modern mining as a clean, safe and cheap way to produce energy.

  • DASH7: Bringing Sensor Networking to Smartphones

    You think your smartphone is cool now? Wait till it gets RFID chips, then it’ll truly be ‘smart.’ That’s the promise of two emerging RFID-based mobile technologies called NFC and DASH7. We’ve already looked at NFC (Near Field Communication), which holds great promise as an enabler of mobile payments. Today we look at DASH7, a wireless sensor networking standard that complements NFC.

    Both NFC and DASH7 may soon be a part of the mobile phone that you carry around everywhere – they’ll enable mobile payments, building access, advanced location-based services, ticketing, and more. We spoke to Pat Burns, co-founder and president of the DASH7 Alliance, to find out what DASH7 can do.

    DASH7 was originally created for military use – and it’s still being used for those purposes. In January 2009 the U.S. Department of Defense announced a $429 million contract for DASH7 devices, to four vendors: Savi Technology, SPEC, Northrop Grumman, and Unisys. Pat Burns works for one of those vendors, Savi Technology. He also writes the DASH7 blog, which is an excellent daily read.

    According to an upcoming report by the DASH7 Alliance, which ReadWriteWeb got an early peak at, DASH7 is typically used for applications requiring low power, “bursty” wireless communication. The report states that DASH7 is "ideal for large area sensor networking or supporting reliable communication with things on the move."

    That means that DASH7 is going to be an integral part of the Internet of Things, as it can acquire sensor data and help run social networking applications that use sensor data.

    Both DASH7 and NFC are technologies that enable your phone to communicate with other devices. So for example, these technologies allow your phone to read a ‘smart poster’ (a poster with a barcode or chip in it). The major difference between the two is that NFC is a short-range communications technology, with a range of about 10 centimeters. DASH7 however has a much longer range, of hundreds of meters.

    DASH7 is also a low power wireless technology, meaning batteries can last for many years. The main disadvantage of DASH7 is that it can’t handle high bandwidth data transfers.

    DASH7 competes directly with a wireless data protocol called ZigBee. However DASH7 and NFC complement each other, according to the upcoming DASH7 report. Both technologies can potentially be hosted on the same phone. The report states:

    "NFC is a short-range passive RFID technology whose “killer” application is the enormous-but-elusive mobile payments opportunity. […] in the future we will probably just ditch our credit cards and instead wave our smartphones next to a cash register or vending machine in order to complete a purchase. Enhancing NFC silicon to include DASH7 functionality will accelerate the adoption of NFC for non-payment applications and ultimately for NFC generally."

    The reason why DASH7 is hitching its wagon to NFC is that NFC has received the most interest so far by mobile handset manufacturers. Nokia is an early adopter of NFC, while both Apple and Google are rumored to be close to adopting it in 2010.

    Pat Burns told ReadWriteWeb that DASH7 could play at the intersection of location-based services, Internet of Things, social networking, and other mobile services. Examples include enhanced location-based apps, building automation smart energy, tire pressure monitoring, and in-transit temperature monitoring of perishable goods.   • Ice-T Twit-Rips Aimee Mann Over “Law & Order: SVU” Diss

    Award-winning musician Aimee Mann sent the Twitter World into a tailspin this weekend when she incurred the wrath of Ice-T and his legion of followers by lighting into the rapper-turned-actor’s onscreen talents on NBC’s Law & Order: Special Victims Unit.

    “Christ, there is no reason in the world anyone should ever have cast Ice T in a television show,” she Tweeted.

    Well, you didn’t expect Coco’s penis supplier to take that sitting down, did you?


    “Hey @aimeemann stop worrying bout my acting b–ch, and worry about your WHACK ass music. In the mean time.. Eat a hot bowl of D–ks!” Ice replied.

    Sorry Aimee, you just pissed off a real live rap legend! This is probably a good example of why people over the age of 40 should get their kids to explain the concept of social networking to them before they just jump into cyberspace and start Tweeting to their heart’s content.

    After realizing that her diss had made its way back to Ice-T, Aimee quickly backtracked.

  • Lowe’s Companies, Inc. (LOW) Dividend Stock Analysis

    Company Description: Lowe’s Companies, Inc. and its subsidiaries operate as a home improvement retailer in the United States and Canada. The company offers a range of products and services for home decoration, maintenance, repair, remodeling, and property maintenance.

    Fair Value: I consider four calculations of fair value, see page 2 of the linked PDF for a detailed description:

    1. Avg. High Yield Price
    2. 20-Year DCF Price
    3. Avg. P/E Price
    4. Graham Number

    LOW is trading at a discount to only 1.) above. The stock is trading at a slight discount to its calculated fair value of $24.84. LOW earned a Star in this section since it is trading at a fair value.

    Dividend Analytical Data: In this section there are three possible Stars and three key metrics, see page 2 of the linked PDF for a detailed description:

    1. Free Cash Flow Payout
    2. Debt To Total Capital
    3. Key Metrics
    4. Dividend Growth Rate
    5. Years of Div. Growth
    6. Rolling 4-yr Div. > 15%

    LOW earned two Stars in this section for 2.) and 3.) above. The stock earned a Star as a result of its most recent Debt to Total Capital being less than 45%. LOW earned a Star for having an acceptable score in at least two of the four Key Metrics measured. Rolling 4-yr Div. > 15% means that dividends grew on average in excess of 15% for each consecutive 4 year period over the last 10 years (2000-2003, 2001-2004, 2002-2005, etc.) I consider this a key metric since dividends will double every 5 years if they grow by 15%. The company has paid a cash dividend to shareholders every year since 1961 and has increased its dividend payments for 47 consecutive years.

    Dividend Income vs. MMA: Why would you assume the equity risk and invest in a dividend stock if you could earn a better return in a much less risky money market account (MMA)? This section compares the earning ability of this stock with a high yield MMA. Two items are considered in this section, see page 2 of the linked PDF for a detailed description:

    1. NPV MMA Diff.
    2. Years to > MMA

    LOW earned a Star in this section for its NPV MMA Diff. of the $880. This amount is in excess of the $500 target I look for in a stock that has increased dividends as long as LOW has. If LOW grows its dividend at 15.0% per year, it will take 9 years to equal a MMA yielding an estimated 20-year average rate of 3.98%.

    Other: LOW is a member of the S&P 500, a Dividend Aristocrat and a member of the Broad Dividend Achievers™ Index.

    Conclusion: LOW earned one Star in the Fair Value section, earned two Stars in the Dividend Analytical Data section and earned one Star in the Dividend Income vs. MMA section for a total of four Stars. This quantitatively ranks LOW as a 4 Star-Buy.

    Using my D4L-PreScreen.xls model, I determined the share price would need to increase to $28.44 before LOW’s NPV MMA Differential decreased to the $500 minimum that I look for in a stock with 47 years of consecutive dividend increases. At that price the stock would yield 1.23%.

    Resetting the D4L-PreScreen.xls model and solving for the dividend growth rate needed to generate the target $500 NPV MMA Differential, the calculated rate is 13.6%. This dividend growth rate is less than the 15.0% used in this analysis, thus providing a margin of safety. LOW has a risk rating of 1.00 which classifies it as a low risk stock.

    LOW is a stock that I have watched for some time. It is a well-managed company with a highly automated distribution network. The short-term weakness in the housing market is countered with LOW’s long-term prospects given the U.S.’s aging homes and relatively high home ownership. LOW has an excellent balance sheet with low debt and strong free cash flows – which more than doubled in 2009. Even though LOW is trading below my $24.84 fair value price, I hesitate to initiate a position due to its low yield.   • Israeli Court Says Course Ads Are Not Copyrightable; Aggregating Them Is Legal

    Over at Eric Goldman’s blog, Israeli lawyer Yoram Lichtenstein has written up a discussion of two Israeli rulings concerning copyright on advertisements (Lichtenstein was a lawyer in the second case, so he’s not a neutral observer — though his writeup appears to be quite neutral, much more so than I would have expected). The first case, from a few years ago, involved a website that collected job ads from various sources, including various local newspapers. The newspapers sued, but the court noted that it wasn’t clear that the job ads were even covered by copyright — and even if they were, the copyright wouldn’t be held by the newspapers who were suing, but by the advertisers.

    The more recent case delved deeper into that original question of whether or not ads are copyrightable. It involved a site, called Hug, that aggregated “a directory of leisure activities and courses” from a variety of different sources. Nine advertisers apparently sued the company for copyright infringement. Beyond wondering why advertisers would ever get pissed off at a site that would advertise them for free, and help drive more business to them, Hug also noted that it provided a lot more information than just what it pulled from elsewhere. But the key question was whether or not the information in the ads was covered by copyright at all.

    Thankfully, the court said no (for the most part):


    The court decided that the course listings lacked originality (or creativity); usually they include only “dry” data. The court emphasized that although previous decisions did not demand very much creativity, ads still need at least some creative value to become copyrightable. Thus, “the advertiser holds no rights in the content of the advertisement, in a manner that enables to prevent other billboards and index sites to publish the ad without her authorization” (my translation).

    The court used, as an example to explain why the course descriptions were not copyrightable, a course description for sculpting sugar-figures for cakes. The text was (my translation, again): “Figure sculpturing workshop, consisting of two 5 hours encounters, each. The workshop emphasizes female and male proportions. First meeting shall include preparing the cake-base, and a winter male figure with proper clothes and accessories.   • How a Business Can Span the Globe and Stay Close-Knit: Microsoft’s “Telepresence” Project

    Stop me if this sounds familiar. You work in a tight-knit team that has one or two colleagues who are located in a different office—across the street, across the state, or across the country. You’d like to communicate with them more regularly, but phone calls, e-mails, and video conferences have to do. Inevitably, you feel like you (and they) miss out on some day-to-day interactions that help all of you stay fully connected to the company’s goals and culture.

    Microsoft feels your pain—and its researchers are trying to do something about it. That’s why a group from Microsoft Research, based in Redmond, WA, is presenting a paper tomorrow at CHI 2010, the big international conference on human-computer interaction in Atlanta. The team, led by senior researchers Gina Venolia and John Tang, has developed a prototype system that gives a satellite colleague a “telepresence” not just in meetings but in the daily workflow of the hub office. They pull this trick with basically a laptop, speakerphone, and webcams on a cart, plus software to coordinate it all. Their project is called “Embodied Social Proxy,” or ESP.

    OK, it’s a pretty jargony name, but it addresses a real and growing need in companies that have satellite workers or that expand to new geographies. The researchers have tested the prototype in four different product groups at Microsoft in addition to their own research group. They’re reporting that it increased the “attention and affinity” of the hub towards the satellite, and that it improved the interpersonal social connections between team members. (Of course, this might be difficult to quantify—more on that below.)

    In this globalized era in which teams are being spread over long distances and “virtual” businesses, a number of tech giants are trying to help companies stay culturally tight-knit as they grow larger. The list includes Microsoft, Hewlett-Packard, IBM, Cisco, and Skype, who have led the way in developing technologies for Web conferencing and remote communications. A whole slew of startups are working in related sectors such as social business software (like Jive in Portland, OR) and online project management (like Smartsheet and LiquidPlanner in the Seattle area).They all share the goal of boosting productivity in the face of complexity. Recently, notable technology and business leaders Kelly Jo MacArthur and Stephen Wolfram have emphasized the importance of remote communications in running an organization.

    The Microsoft project builds on years of social science and communications research. It also seems decidedly old-school and low-tech. That is part of what makes it interesting, as a complement to social-media efforts to improve business collaboration (including Microsoft’s relatively new FUSE Labs led by Lili Cheng). Microsoft’s ESP effort began in 2008 when Venolia and Tang’s colleague, principal researcher George Robertson, a co-author on the study, moved to Maine to work from home. The team decided to test out a system that was “as simple as possible, to fix what was most broken,” Venolia says.

    That meant daily interactions and face-to-face contact. So the team assembled a PC, monitor, some decent wide-view cameras, and a speakerphone, and mounted them on a cart that could be wheeled into meeting rooms (see photo above), or left in a dedicated office space that has become Robertson’s de facto “office” in Redmond. In meetings, the Redmond team can see Robertson’s face at the table and hear his voice, and he can interact with people in the room by controlling different cameras that allow him to focus on a particular person, or a whiteboard, or slides.   • PIMCO’s Bill Gross Frantically Dumping Treasuries, Thinks US Interest Rates Will Soar

    Nine months ago, Bill Gross’s Total Return Fund was 50% in US Treasuries. Now it’s only 30%, the lowest percentage in the 23 year history of the fund, says Nelson Schwartz of the NYT.

    Why is Gross dumping Treasuries?

    Two primary concerns:

    • Inflation
    • The massive tidal wave of money the US needs to raise in the coming years, which will increase the supply of Treasuries (driving prices down and rates up).

    More broadly, Gross believes that, while interest rates have now generally been declining for more than 25 years, we’re now moving to an era in which rates will rise, not fall.

    PIMCO has shifted money into corporate bonds and foreign bonds, including Greece.
