  • Microsoft: Steve Ballmer will not be speaking at WWDC.

    Early this morning, the rumormill went a bit bonkers. A hole to a parallel universe apparently ripped open outside of an analyst’s office. Through this hole, the analyst saw a world where Steve Ballmer presented something at Apple’s WWDC 2010 keynote. Alas, the analyst didn’t realize that this was a parallel universe, instead interpreting it as a glance into the future. “Steve Ballmer will be presenting at WWDC! Steve Ballmer will be presenting at WWDC!”, he shouted.

    People were skeptical, and rightly so. It’s all a bunch of nonsense, says Microsoft.

    In a brief statement issued over Twitter (what else?) this afternoon, Microsoft straightened things out:

    Steve Ballmer not speaking at Apple Dev Conf. Nor appearing on Dancing with the Stars. Nor riding in the Belmont. Just FYI.

    Good. Between starring as the next Bond villain and training for the Olympics, we figured that Ballmer’s schedule was already getting stretched a bit too thin. While Microsoft could very well make an appearance during WWDC keynote as a partner, it probably won’t be Ballmer’s mug staring back at the audience.


  • Federal judge orders release of Yemeni Guantanamo detainee

    [JURIST] A judge for the US District Court for the District of Columbia [official website] on Wednesday ordered the release of Yemeni Guantanamo Bay [JURIST news archive] detainee Mohammed Hassen [NYT profile]. Hassen had been initially detained [Miami Herald report] in March 2002 following a raid in Faisalabad by Pakistani security forces. He has maintained throughout his detention that he had traveled to Pakistan to study the Qur’an [text] at Salafi University and had no knowledge of al Qaeda [GlobalSecurity backgrounder] prior to his detention. Hassen is the third detainee captured in this raid to be released. The court opinion remains classified.

    The ruling brings the number of Guantanamo detainees who have prevailed in habeas corpus proceedings [JURIST news archive] in federal court to 36. The government has prevailed in only 14 cases. Earlier this month, a federal judge ordered the release [JURIST report] of Russian Guantanamo Bay detainee Ravil Mingazov [NYT profile]. In March, the DC court denied the habeas petition of Yemeni Guantanamo Bay detainee Makhtar Yahia Naji al Warafi [NYT materials] on its merits, allowing the US government to prolong the detention indefinitely. In late February, a DC judge ruled that the government can continue to hold indefinitely [JURIST report] two Yemeni Guantanamo Bay detainees, even though Fahmi Salem Al-Assani and Suleiman Awadh Bin Agil Al-Nahdi [orders, PDF] had been cleared for release by the Bush administration two years ago.

  • Why haven’t our clichés been updated to better reflect today’s technology?

    Our clichés need updating. “Axe to grind”? How many people still regularly use axes, axes that need grinding? Why not something like “hard drive to defrag”? “Best thing since sliced bread”? Why not “best thing since the iPad“? We are surrounded by technology, but our language still reflects life on the farm. Let’s do this!

    First off, yes, this topic is completely ripped off from Fez Ron and Fez. If you going to rip off, you might as well rip off from the best.

    It’s an interesting idea. So many idioms and clichés and whatnot are based in language that has no relevance to us here in the year 2010. Some examples:

    • “Straw that broke the camel’s back.” Means nothing to the average person. Why not “baseclock frequency that causes the processor to overheat and continually crash”?

    • “When pigs fly.” What? Try “when Spotify comes to America.”

    • “Free as a bird.” Lame. I much prefer “free as Firefox.”

    • “Money makes the world go ’round.” Sorry but as we all know “SEO makes the world go ’round.”

    And so on.

    If we’re not going to ban clichés outight, then we might as well update ‘em. I don’t know how to grind an axe, but I do know how to defrag a hard drive.


  • The Kremlin’s Chechen Dragon

    In the summer of 2004, two years and four months before she was gunned down in the entrance to her Moscow apartment, Russian journalist Anna Politkovskaya made a bold visit to Chechnya to interview 27-year-old Ramzan Kadyrov, who had recently become (with the Kremlin’s blessing) the republic’s de-facto leader. It proved to be a harrowing experience. When they met face to face, Kadyrov could not contain his rage at Politkovskaya for reporting on his brutal rise to power, even threatening to have her shot. Politkovskaya concluded later that “a little dragon has been raised by the Kremlin. Now they need to feed it. Otherwise it will spit fire.”

    Politkovskaya was all too right. Since becoming president of Chechnya in 2007, Kadyrov has made the republic into his own fiefdom, which he rules by violence and terror. He has also, apparently, had his gunmen carry out a series of brazen killings of his perceived enemies in Moscow, Dubai, Istanbul and the North Caucasus.

    Until recently, the Kremlin, which has provided military and economic support to Kadyrov’s regime, consistently brushed off the murder allegations against him. Since April, prosecutors in two separate cases—a murder in Vienna and a murder attempt in Moscow—have for the first time implicated Kadyrov directly. And in the weeks since those revelations, the Kremlin leadership appears to be showing misgivings about its unconditional support for Kadyrov. How these cases play out could have profound effects on the future of Moscow’s Chechen policy.

    It has long been known that Moscow has allowed Kadyrov to run the Chechen Republic with ruthless force, facilitating his extensive cult of personality and funding his lavish lifestyle while ignoring the alarmingly frequent kidnappings, disappearances, and torture of those suspected of opposing his rule. But Kadyrov’s bloody vendettas have not been limited to rival Chechen clans. Indeed, it now appears that he has been going after anyone who draws attention to the shocking human rights abuses in Chechnya committed under his auspices—and that Politkovskaya herself may have been one of his first targets.

    The list of likely victims is chilling: In January 2009, there was the Moscow shooting of human rights lawyer Stanislav Markelov (together with a journalist friend) who had pursued legal cases against Kadyrov. That same month Umar Israilov, a former member of Kadyrov’s security team who was granted asylum in Austria and subsequently made shocking allegations of human rights abuses against Kadyrov, was killed by Chechen gunmen in Vienna. And in July 2009 came the murder of Politkovskaya’s close colleague, Natalia Estemirova, who had been documenting the widespread abductions and extra-judicial executions by Kadyrov’s counter-insurgency forces for Novaya gazeta, Human Rights Watch, and Memorial. Estemirova was kidnapped by four men in broad daylight as she left her Grozny apartment. Hours later, her body, riddled with bullets, was found in a ditch in the neighboring republic of Ingushetia.

    After the Politkovskaya killing, then-Russian President Vladimir Putin went out of his way to point out that the murder hurt Kadyrov “much more than any newspaper article [i.e. those written by Politkovskaya] could do.” Last summer, when Estemirova’s family, friends, and colleagues gathered in Grozny to mourn her on the 40th day of her death (a Russian orthodox tradition), Putin flew to the Chechen capitol to attend a state ceremony with Kadyrov by his side. Significantly, Kadyrov was allowed to take personal control of the investigation into Estemirova’s murder and there have been no arrests.

    Moscow has also rejected demands by the Dubai government for the extradition of Kadyrov’s cousin Adam Delimkhanov, a member of the Russian parliament and Putin’s United Russia Party, who they accuse of having organized the March 2009 murder of yet another Kadyrov opponent, Sulim Yamadayev, who was a member of a rival Chechen clan. (On April 12, a Dubai court sentenced two men of Central Asian origin to life imprisonment for the killing.)

    But how long can Moscow ignore the mounting evidence against its Chechen puppet? In April the counter-terrorism department of the Vienna police handed over a confidential 214-page report to Austrian prosecutors in which they named Kadyrov and his top aide, Shaa Turlayev, as the “principal offenders” in the January 2009 murder of Israilov, the former member of Kadyrov’s security guard. According to Israilov’s widow, Turlayev appeared in Vienna shortly before the murder and tried unsuccessfully to meet with her husband. In addition, the man charged with organizing the killing locally, a Chechen refugee who now calls himself Otto Kaltenbrunner, placed a call to Turlayev immediately after the murder. Moreover, a copy of Turlayev’s passport was found in the getaway car, along with an electronic airline ticket that he used to travel to Austria. As a representative of Human Rights Watch puts it: “the conclusions reached by the Austrian Prosecutor’s Office about Ramzan Kadyrov…should prompt the Russian government to finally take the necessary steps to restore the rule of law in Chechnya.”

    Meanwhile, Kadyrov’s Kremlin backers have also been facing pressure from a Moscow investigation into an attempted murder in June 2009. The victim of the failed attempt was Isa Yamadayev, the brother of Salim Yamadayev, the murder victim in Dubai, and of Ruslan Yamadayev, a State Duma Deputy who was killed in Moscow in 2008. In April of this year the Moscow District Court began holding secret hearings about the case. Incredibly, a transcript and video of the interrogation of the accused would-be killer ended up in the hands of the intended victim, Yamadayev, who leaked it to a major Russian paper, Moskovskii Komsomolets. During his questioning, the accused, Khavash Yusupov, confessed to the crime and claimed that he was hired by none other than Shaa Turlayev. Yusupov said that Turlayev took him for a meeting with Kadyrov, who ordered the killing.

    It remains to be seen whether Austria will indict Kadyrov when it issues formal charges in the Vienna murder in a few weeks, and what the Moscow Court will decide to do about Kadyrov. But the fact that, in the Moscow case, highly damaging testimony about the Chechen president and his top advisor was allowed to appear in the Russian media suggests that some members of the Kremlin elite may have decided that Kadyrov needs to be reined in. Could Russian President Dmitry Medvedev be among them? In contrast to Putin, Medvedev has expressed strong concerns about the unsolved murders and the problem of human rights abuses in the Caucasus. Responding to the Estemirova case last summer, Medvedev said it was “obvious” that she was killed because of her human rights work and expressed his personal condolences to her family and friends.

    In January, Medvedev appointed a presidential envoy, Alexander Khloponin, to a newly formed North Caucasus Federal District, which some observers interpreted as an effort to exert Moscow’s control over the region, especially Chechnya. More recently, on May 19, Medvedev invited human rights activists to a two and a half –hour meeting in Moscow, in which Estemirova’s murder was discussed. It was not the first time the Kremlin has met with human rights advocates. But it was a departure for Medvedev because the meeting was devoted entirely to the situation in the troubled North Caucasus. With Khloponin at his side, Medvedev listened to grim details of the abuses attributed to Kadyrov’s counter-insurgency forces in Chechnya and to the concerns that surround unsolved murders like Estemirova’s.

    If you think I don’t know some of the facts,” Medvedev told the participants in the meeting, “well, that’s not the case. I know more than anyone else here because it is my job to know. Have no doubt. I know some very sad things.” In what seemed to be a reference to Kadyrov, who routinely ridicules the efforts of human rights workers, Medvedev also said that political leaders in the Caucasus who do not engage in a dialogue with non-governmental organizations in the region “must ultimately leave.”

    However sincere Medvedev might be (and there are many skeptics), at the moment he is not in a position to topple Kadyrov without the concurrence of Putin and members of his powerful Federal Security Service, who installed Kadyrov as the leader of Chechnya. And it appears that the Putin has been unwilling to rein in Kadyrov in part because he fears that doing so would create even more instability in the North Caucasus region (and possibly more terrorist bombings in places like Moscow).

    As Lyudmila Alexeyeva, head of the Moscow Helsinki Group, observed: “The impunity and omnipotence of Ramzan Kadyrov depends on the support of…Putin. As long as Putin supports him nobody will touch a hair on Kadyrov’s head, even if he kills us all.” Perhaps the recent revelations about Kadyrov will finally convince Putin and his colleagues that it is time for Kadyrov to go.

  • Techdirt Saves* Journalism (And Sells Some T-Shirts)

    Today we’re announcing an event that we’re holding on June 16th, in the evening, at Google’s offices in Mountain View. It’s not your ordinary panel/speaker event. It’s based on the Techdirt Greenhouse series of events that we’ve done over the years, where the focus is on getting lots of smart people together in a room and brainstorming to come up with solutions to certain issues. In the past, those have often been issues faced by a particular organization, but back in January, at Midem, we tried it on a specific industry: the music industry. The results were fantastic, so we’ve decided to start doing similar brainstorming workshops in other areas, and this one is our first, entitled “Techdirt Saves* Journalism.”

    Obviously, the focus is on brainstorming ideas to help the journalism market. It will kick off with three short presentations: one by me, one by Google economist Hal Varian, who’s been doing a ton of fantastic work on newspaper economics, and one by Ian Rogers, the CEO of Topspin, one of a growing group of companies that is helping to reinvent the music business. That last one might seem a bit confusing — since this event is all about the journalism industry — but that’s very much part of the point. These brainstorming sessions work best by bringing in people with very different perspectives. We don’t want this to just be journalists/newspaper people, but have already begun inviting a wide range of folks with diverse backgrounds, well beyond journalism. There will be plenty of journalism/media folks there, as well. But we thought that Ian could provide some perspective about how some parts of the music industry have responded (successfully) to the challenge of the internet, and that could be great in getting people thinking differently and creatively.

    These events are highly interactive — so if you’re coming, expect to participate. Following the brief presentations, attendees will be broken out into small brainstorming groups, and we’ll have about an hour to workshop and brainstorm (with some guidance) to try to come up with creative ideas and ways to help save journalism. After that we’ll regroup, share some of the best ideas, and then partake of some food and drink.

    The event is being both sponsored and hosted graciously by Google — which shouldn’t come as a surprise, given how much effort the company is putting into trying to help the journalism business succeed (that Atlantic article is a fantastic read).

However, if we’re going to get slammed for making the claim anyway, we might as well embrace it and see what we can do.     Washington Post politics blogger David Weigel provides some important context on today’s “news” that Joe Lieberman might endorse Republican Linda McMahon.

    Blumenthal and Lieberman have a long and complicated relationship, one that was severely strained by the 2006 Senate race. Blumenthal endorsed Lieberman early that year, but, like most of the rest of the state’s Democratic establishment, united behind Ned Lamont when he won the Democratic primary.

    UPDATE: The fact that Lieberman is toying with the idea of backing McMahon is suprising in another way as well. Lieberman co-sponsored the Family Entertainment Protection Act, which would have made it a federal crime to sell videos with “mature” content to minors. (The bill did not become law.)

    It makes you wonder what a family-values guy like him thinks of the push-the-envelope-on-sex-and-violence content that reigned during the WWE’s “Attitude Era.”

  • Acer Stream joins the flood of Snapdragon handsets

    Did you ever look at the Nexus One and think that if it only had three big physical buttons to control media, 2 GB of onboard storage, HDMI out and a skinned version of Android 2.1 it would be perfect? If so then I have the greatest news ever for you; Acer just announced your dream phone!

    The Acer Stream was announced today and it comes bearing all the aforementioned goodies atop a Nexusesque core of 1GHz Snapdragon, 512 MB RAM, 3.7″ AMOLED screen and a slim 11.2″ frame. Other notable specs include a 5MP camera capable of 720p video capture, wifi n, FM radio, UPnP and DLNA. The Stream made its way through the FCC with AT&T bands, but there have been no announcements regarding carriers or pricing.

    Acer hasn’t exactly gotten a lot of love for their Android releases thus far, but this one at least on the specs front seems to get things right in a lot of ways. The fact that it will launch with Android 2.1 is of course disappointing and while (like everyone else) Acer assures us that their skin makes Android infinitely more usable and awesome, I’ll withhold judgment on that until I’ve had a chance to really see it in action.

    You can check the video below for 20+ minutes of unboxing and hands-on time by an Italian blogger which if I only spoke Italian would undoubtedly answer any lingering questions I might have about the Stream.

    If this does make it to AT&T and somehow manages to dodge the gimping process that they seem to enjoy levying against Android handsets at the moment this could be a reasonable option for those that aren’t willing to shell out big money for the AT&T compatible Nexus One.

  • Daley blames suburbanites for city beach unrest

    Mayor Richard Daley and Police Supt. Jody Weis today said the city will work to make sure the beaches are safe this summer, following 22 arrests of young people who were fighting and causing other disturbances this week around North Avenue Beach.

     

    "They text people, where people are going in congregation," Daley said. "So you make a number of arrests, a number of arrests were both city and suburban. We had a lot of suburban people arrested."

     

    "We know there’s texting going on, something going on in the suburban area with a lot of young adults, we know that," Daley said. Suburban youths are apparently sending each other texts to meet up and drink on Chicago beaches, he said.

     

    Weis said that of the 22 people arrested Monday and Tuesday on the beach, 14 were suburbanites.

     

    Police are looking into installing cameras along the beach to aid with surveillance, according to Weis, who said it’s unfair to draw conclusions about the safety of the beaches based on a bunch of arrests in a couple days.

     

    "We take a short period of time, and all of a sudden ‘Well, now everything is really bad,’" Weis said. "Just give us credit when we look at the whole summer and we get things in place."

     

    "Sometimes you mix alcohol with youth and bad results happen," Weis said.

  • Apple surpasses Microsoft in market cap, becomes second biggest US company

    Yesterday, for the first time ever, Apple, Inc. surpassed Microsoft in market capitalization, making Apple the most valuable tech company in the US, and the second-largest in the country, behind Exxon Mobil. We’ve gotta say, we’re surprised and very interested in how all this went down. I mean, Microsoft just makes so many more products than Apple does, so much more software, and even has the wildly popular Xbox gaming division to boot, and all the software income that comes along with that platform.   • Silly Bandz: Could Be Dangerous to Kids

    Silly Bandz are silicone rubber bands with shapes that includes animals, objects and letters. The product is distributed by BCP Imports and are generally worn as bracelets and necklaces by middle school, elementary and even highschool students.

    The bandz come in dozen shapes, colors, and themes, and can also be used just like a regular rubber band. They can look like a regular bracelet on someone’s wrist, and goes back to its original shape when taken off.

    The Silly Bandz were developed in 2009 as they first started to gain popularity in the holiday season of that year. Although gained popularity, the bandz were banned in some school districts as causing distraction among most of the students.

    Though these bracelets seem to be cute, in a recent blog, a doctor had an opinion that the bracelets are considered to be “potentially” harmful to children if they are not careful.

    At just five dollars for a pack, the kids are becoming obsessed with the toys. Competitions rise among the arise as students challenge each other of who can collect most.

    The toys may cause an accident, judging on the age of those who use them. The constricting of the bracelet may cause vascular insufficiency, meaning that the blood flow is being altered in or by some external force, and in this case, the rubber bracelets.

    There are symptoms regarding the safety of the child if the bracelet needs to go off. If the skin and tissue has some significant indentation that is being caused by the bracelet and causes arm swelling, a change in the feeling of the child like numbness or tingling, color change, these are signs of the bands constricting and needs to be cut off immediately.

  • Some city kids caught breaking curfew will go to parks, not police station

    Kids caught violating curfew in three high-crime areas of the city will be sent to Chicago Park District buildings instead of police stations this summer under a trial program that Mayor Richard Daley hopes will give police a chance to present youths with alternatives to hanging out on the street.

    Parents of children under age 17 found by police outside the home after 11 p.m. on weekends will have to pick them up at the parks, where neighborhood relations officers will be on hand to talk to them about community organizations and park district programs that can help with their kids.

     

    "The park district buildings will be an easier place for young people to wait than a police station, and an easier place for us to communicate with the parents who come to pick up their own children," Daley said during a news conference at Ogden Park in the 6500 block of South Racine Avenue, one of the sites curfew violators will be brought.

     

    "Common sense says that when you can connect students with mentors, and families with support services and information about positive activities for young people, then those young people have a better chance of avoiding violence or even joining a gang," the mayor said.

    The other parks curfew violators will be diverted to on weekends are Harris Park at 6200 S. Drexel Blvd., and Piotrowsky Park, 4247 W. 31st St. The program will begin this weekend and run through October.

    The city curfew this summer will remain 10 p.m. Sunday through Thursday and 11 p.m. on Friday and Saturday.

  • Bentley considering a shooting brake model

    Carrozzeria Touring Bentley Continental Flying Star

    At the 2010 Geneva Motor Show, Italian coachbuilder Carrozzeria Touring Superleggera unveiled a Bentley Continental-based station wagon – better known to luxury automakers as “shooting brake.” Carrozzeria will produce only 20 units of the shooting brake each going for around $805,000 a pop.

    However, if you’re patient Bentley might provide its own shooting brake model, which will probably cost a lot less than $800,000. Speaking at the launch of the Bentley Mulsanne, Stuart McCullough, VW Board Member in charge of Bentley, said that the idea of doing a shooting brake is not out of the question.

    “We have an idea in the back of our minds that we may yet bring to market,” McCullough said. He said that the designers have been messing around with the idea and Bentley’s version goes “a lot further” than Carrozzeria concept.

    Don’t get your hopes up to high though. We don’t expect to see an official Bentley shooting brake anytime soon.

  • UNICEF expresses concern over Guantanamo detainee Khadr

    [JURIST] UNICEF [official website] expressed concern [press release] Wednesday over Guantanamo Bay [JURIST news archive] detainee and former child soldier Omar Khadr [DOD Materials; JURIST news archive]. Khadr was arrested in Afghanistan in 2002 at the age of 15 after he allegedly threw a grenade that killed on soldier and injured another. The statement held that recruitment and use of child soldiers is a war crime and those that should be punished for a child’s acts of violence are the adult recruiters who manipulate young children into committing violent crimes. UNICEF said that separate systems have been created to accommodate judicial proceedings for child soldiers and are much better equipped to adjudicate juveniles suspected of war crimes:

    [F]ormer child soldiers need assistance for rehabilitation and reintegration into their communities, not condemnation or prosecution. The prosecution of Omar Khadr may set a dangerous international precedent for other children who are victims of recruitment in armed conflicts. At a time when the UN celebrates the 10th anniversary of the Optional Protocol on the Involvement of Children in Armed Conflict, we call on all governments that have ratified this treaty, including the United States, to uphold the spirit of the Protocol and all its provisions. In addition, anyone prosecuted for offenses they allegedly committed while a child should be treated in accordance with international juvenile justice standards, which provide them with special protections. Omar Khadr should not be prosecuted by a tribunal that is neither equipped nor required to provide these protections and meet these standards.

    The Optional Protocol on the Involvement of Children in Armed Conflict requires States that ratify it to “take all feasible measures” to ensure that members of their armed forces under the age of 18 do not take a direct part in hostilities. Khadr is the last child soldier being held at the Guantanamo Bay detention facility.

    Earlier this month, a UN official called on the US and Canada to respect international conventions [JURIST report] and release Khadr into Canadian custody. In February, Khadr’s lawyers filed an emergency motion in the Federal Court of Canada [official website] challenging the decision of the Canadian government not to seek his repatriation [JURIST report]. The Canadian Supreme Court ruled that Canada was not obligated [JURIST report] to seek his repatriation despite having violated his rights under section 7 of the Canadian Charter of Rights and Freedoms [text]. A US military judge has announced that Khadr’s trial will begin on August 10 [JURIST report]. Army Col. Patrick Parrish also ordered pre-trial hearings [JURIST report] on the admissibility of Khadr’s alleged confession to resume July 12. Khadr’s pre-trial hearings were suspended last month so that Pentagon officials could submit him to a mental health evaluation.

    Ferrari fanatics should be familiar with the work of Novitec Rosso. The Dutch tuning house regularly churns out beefed-up versions of Maranello’s finest. But while recent releases have upgraded the California, 599 GTB Fiorano and 430 Scuderia, Novitec has now turned its attention to Ferrari’s flagship grand tourer.

    The custom 612 Scaglietti has been treated to an ECU upgrade and a host of cosmetic and rolling stock upgrades. The lightly massaged 5.7-liter V12 – good for 530 horsepower and 434 lb-ft in stock trim – has been boosted to nearly 560 horsepower and 450 lb-ft of torque, dropping the big coupe’s 0-60 mph sprint below the four-second mark and its top end to north of 200 mph.

    Coupled with interior enhancements, darkened indicator lights and 20-inch front and 21-inch rear modular wheels, Novitec has imbued the big Scag with a modest, but much needed attitude adjustment until its replacement arrives.
