Senator Kent Conrad (D-N.D.) told CNSNews.com that he does not know
\nspecifically where in the Constitution Congress is given the authority
\nto require that Americans buy health insurance, as mandated in both the
\nSenate and House health care bills, but Conrad said he assumes the
\npower is granted through the Constitution\u2019s Commerce clause.
\n 
\nAt the Capitol on Tuesday, CNSNews.com asked Senator Conrad:
\n\u201cCould you specifically say where in the Constitution does
\nCongress get the authority to mandate that individuals get health
\ninsurance?\u201d
\n 
\nConrad said: \u201cNo, but I\u2019ll refer you to the legal counsel
\nfor the Senate and they\u2019re the ones that lead there as the full
\nlegal basis for the individual mandate \u2014 and I assume it\u2019s
\nin the Commerce clause.\u201d<\/p>\n

The Commerce clause, found in Article 1, Section 8<\/a>
\nof the Constitution, states that Congress has the power \u201cTo
\nregulate Commerce with foreign Nations, and among several States, and
\nwith the Indian tribes.\u201d<\/p>\n
