TALLAHASSEE \u2014 Attorney General Bill McCollum
\ncalled on other states\u2019 legal officers Tuesday to review a
\n\u201ctax on living\u201d in the pending federal health-care
\nproposals.<\/p>\n

In a conference call with reporters, McCollum also said he might
\nmount a court challenge if the final health package includes a Senate
\nprovision requiring the federal government to cover future Medicaid
\ncosts in Nebraska. That was added last week for Sen. Ben Nelson,
\nD-Neb., who provided the 60th vote needed by President Obama and Senate
\nDemocrats to get the plan to a vote.<\/p>\n

State Sen. Dan Gelber of Miami Beach, a Democratic candidate for
\nattorney general, accused McCollum, a Republican, of pouncing on the
\ncontroversy to advance his own campaign for governor. Gelber said
\nMcCollum didn\u2019t use his discretion as the state\u2019s chief
\nlegal officer to enforce a state constitutional requirement for
\nadequate funding of education, but chose to make a \u201clegal
\nreview\u201d of health care because that issue stirs the conservative
\nbase among Republicans and independent voters.<\/p>\n

McCollum said \u201cthere are a lot of other problems\u201d with
\nthe health package, but his main legal objection focused on a
\nrequirement all citizens get insurance or pay into a fund that would
\nhelp cover their medical costs if they get sick or injured. Proponents
\nof the plan have said the mandate is no different than requiring
\ndrivers to have auto insurance, but McCollum said people are not
\nrequired to have a car or to drive.<\/p>\n
