{"id":129111,"date":"2010-01-02T21:03:40","date_gmt":"2010-01-03T02:03:40","guid":{"rendered":"http:\/\/www.stoth.com\/2010\/01\/02\/oregon-cell-phone-ban-has-loophole\/"},"modified":"2010-01-02T21:03:40","modified_gmt":"2010-01-03T02:03:40","slug":"oregon-cell-phone-ban-has-loophole","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/129111","title":{"rendered":"Oregon Cell-Phone Ban Has Loophole"},"content":{"rendered":"<p><\/p>\n<p>Beginning New Year&#8217;s Day, Oregon police officers may hear some arguing when they start pulling motorists over for violating a new law banning them from talking on hand-held cell phones while driving.<\/p>\n<p>\nThe new law, passed by the 2009 Oregon Legislature, exempts motorists who are on their hand-held cell phones &#8220;in the scope of the person&#8217;s employment if operation of the motor vehicle is necessary for the person&#8217;s job.&#8221; The exemption was intended for taxi drivers, delivery trucks, tow trucks and the like.<\/p>\n<p>\nLaw enforcement officials are getting ready for some motorists to try to drive through that legal loophole by insisting, for example, that a call to a co-worker who also happens to be a friend is really for business purposes.<\/p>\n<p>\n&#8220;There is a gray area,&#8221; says Oregon State Police Lt. Gregg Hastings. &#8220;It doesn&#8217;t clearly define what jobs fall under the exemption. Ultimately, maybe judges are going to have to clarify that.&#8221;<\/p>\n<p>\nWith the new law, Oregon joins a half dozen other states that ban drivers from talking on hand-held cell phones while driving. Police officers can pull someone over under the Oregon law and violators face a minimum fine of $142.<\/p>\n<p>\nHowever, the Insurance Institute for Highway Safety says that only Oregon has included such a broadly worded exemption.
