{"id":184548,"date":"2010-01-14T11:05:54","date_gmt":"2010-01-14T16:05:54","guid":{"rendered":"http:\/\/nw0.eu\/2010\/01\/14\/human-rights-court-savages-uk-stop-search-terror-powers.html"},"modified":"2010-01-14T11:05:54","modified_gmt":"2010-01-14T16:05:54","slug":"human-rights-court-savages-uk-stop-search-terror-powers","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/184548","title":{"rendered":"Human Rights Court Savages UK Stop &amp; Search Terror Powers"},"content":{"rendered":"<p><span class=\"entry-author-parent\"><span class=\"entry-author-name\"><\/span><\/span><\/p>\n<div class=\"entry-body\">\n<div>\n<div class=\"item-body\">\n<div>\n<p><img decoding=\"async\" style=\"border: 1px solid black; margin: 5px;\" src=\"http:\/\/nw0.eu\/wp-content\/uploads\/HLIC\/124bfe2ed4f34f29a6a1edcec0fd98da.jpg\" alt=\"Human Rights Court Savages UK Stop &amp; Search Terror Powers 120110stop\" title=\"Human Rights Court Savages UK Stop &amp; Search Terror Powers Photo\" align=\"right\" border=\"1\" hspace=\"5\" vspace=\"5\" \/><\/p>\n<p><span><strong>Landmark decision clears the way for restoration of privacy, right to protest, photograph unhindered<\/strong><\/span><\/p>\n<p><span>Steve Watson<br \/>\n<a  href=\"http:\/\/prisonplanet.com\/\">Prisonplanet.com<\/a><br \/>\nTuesday, Jan 12, 2010<\/span><\/p>\n<p>The use of \u201ccounter-terrorism\u201d stop and search laws by the police in the UK has been <strong><a  href=\"http:\/\/www.guardian.co.uk\/world\/2010\/jan\/12\/stop-and-search-ruled-illegal\">ruled illegal by the European Court of Human Rights<\/a><\/strong>,<br \/>\na decision that paves the way for protesters, photographers and<br \/>\neveryday citizens to fight back against such gross invasions of privacy.<\/p>\n<p>Under section 44 of the Terrorism Act 2000, police can stop and search anyone without reasonable suspicion.<\/p>\n<p>The court in Strasbourg has referred to that power as not in<br \/>\n\u201caccordance with the law\u201d, and a violation of article eight<br \/>\n\u2013 the right to respect for private and family life.<\/p>\n<p>Judges noted that there is no grounds for considering the powers<br \/>\n\u201cnecessary\u201d, and that they are only<br \/>\n\u201cexpedient\u201d, adding that there is a \u201cclear risk of<br \/>\narbitrariness in granting such broad discretion\u201d to a police<br \/>\nofficer.<\/p>\n<p>They also stated that the searching clothing and belongings<br \/>\ninterferes with the right to privacy as it involves an element of<br \/>\nhumiliation and embarrassment.<\/p>\n<p>The use of the powers and their authorisation is \u201cneither<br \/>\nsufficiently circumscribed, nor subject to adequate legal safeguards<br \/>\nagainst abuse\u201d, according to the court.<\/p>\n<p>The court also highlighted a lack of judicial oversight, stating<br \/>\n\u201cThe absence of any obligation on the part of the officer to show<br \/>\na reasonable suspicion made it almost impossible to prove that the<br \/>\npower had been improperly exercised\u201d.<\/p>\n<p>The full judgment is online <strong><a  href=\"http:\/\/cmiskp.echr.coe.int\/tkp197\/view.asp?action=html&amp;documentId=860909&amp;portal=hbkm&amp;source=externalbydocnumber\">here<\/a><\/strong>. <a  href=\"http:\/\/prisonplanet.tv\/signup.html\"><em><\/em><\/a><\/p>\n<p>The freedom stripping powers, which were initially conceived only to<br \/>\nbe used in emergency situations, have come under intense scrutiny<br \/>\nrecently following the publication of multiple sets of figures<br \/>\nhighlighting huge increases in stops with a relatively miniscule<br \/>\nsuccess rate.<\/p>\n<p>In May 2009, <strong><a  href=\"http:\/\/news.bbc.co.uk\/1\/hi\/england\/london\/8034315.stm\">data released to the BBC<\/a><\/strong><br \/>\nrevealed that the Metropolitan Police in London used section 44 of the<br \/>\nTerrorism Act more than 170,000 times in 2008 to stop people in the<br \/>\ncapital. That figure equated to stopping and searching a member of the<br \/>\npublic <em>every three minutes<\/em> under terrorism laws.<\/p>\n<p>The figures represented a more than 140% increase on 2007 numbers.<\/p>\n<p>Of all the stops in 2008, only 65 led to arrests for terror<br \/>\noffences, a success rate of just 0.035%. Furthermore, when you take<br \/>\ninto account how many of those arrests have translated into<br \/>\nconvictions, according to the Home Office, you come up with a round<br \/>\nfigure of 0.0%.<\/p>\n<p>A separate Freedom of Information Act request in 2009 also revealed<br \/>\nthat the use of the stop and search power has increased exponentially<br \/>\nby <strong><a  href=\"http:\/\/www.dailymail.co.uk\/news\/article-1141342\/Terror-law-overkill-Police-stop-180-000-people-draconian-laws-255-arrested.html\">over ten times in less than ten years<\/a><\/strong>.<\/p>\n<p>Furthermore, <strong><a  href=\"http:\/\/www.guardian.co.uk\/uk\/2008\/jul\/08\/police.uksecurity?gusrc=rss&amp;feed=worldnews\">Ministry of Justice statistics<\/a><\/strong>,<br \/>\npublished in mid 2008, revealed that from 2006-2007 police used their<br \/>\npowers to stop (but not search) nearly two million members of the<br \/>\npublic and demand they account for their behavior or actions, a rise of<br \/>\none third from the previous year.<\/p>\n<p>This meant that in just one year around 3.5% of the entire British<br \/>\npopulation was stopped in the street by the police under suspicion of<br \/>\nterror related offences.<\/p>\n<p align=\"left\">While not resulting in the prevention of any terrorism,<br \/>\nthe section 44 powers have been most notably used against the<br \/>\n82-year-old Walter Wolfgang for <strong><a  href=\"http:\/\/news.bbc.co.uk\/1\/hi\/uk_politics\/4291388.stm\">heckling Jack Straw <\/a><\/strong>at the Labour Conference; Sally Cameron for <strong><a  href=\"http:\/\/www.timesonline.co.uk\/tol\/news\/uk\/article579334.ece\">walking on a cycle-path<\/a><\/strong> in Dundee; the 80-year-old John Catt for being caught on CCTV passing a demonstration in Brighton; the <strong><a  href=\"http:\/\/news.bbc.co.uk\/1\/hi\/england\/gloucestershire\/3069411.stm\">11-year-old Isabelle Ellis-Cockcroft<\/a><\/strong> for accompanying her parents to an anti-nuclear protest; and a cricketer on his way to a match over his possession of a bat.<\/p>\n<p align=\"left\">More recently, <strong><a  href=\"http:\/\/www.guardian.co.uk\/society\/2008\/may\/16\/children.ukcrime\">Scotland Yard admitted<\/a><\/strong><br \/>\nthat its officers have been photographing children who are stopped and<br \/>\nsearched, even after they have been found to be innocent, and keeping<br \/>\nthe pictures on a database for \u201cintelligence-gathering<br \/>\npurposes\u201d.<\/p>\n<p align=\"left\">In the past we have reported on instances where police have admitted stop and search records are <strong><a  href=\"http:\/\/www.prisonplanet.com\/articles\/january2006\/310106IDprotester.htm\">permanently retained<\/a><\/strong>.<\/p>\n<p align=\"left\"><img decoding=\"async\" style=\"border: 1px solid black; margin: 5px;\" src=\"http:\/\/nw0.eu\/wp-content\/uploads\/HLIC\/52458806b73076598fadcf204594b555.jpg\" alt=\"Human Rights Court Savages UK Stop &amp; Search Terror Powers 060509terror3\" title=\"Human Rights Court Savages UK Stop &amp; Search Terror Powers Photo\" align=\"right\" border=\"1\" hspace=\"5\" vspace=\"5\" \/> The Home Office guide to stop and search states that \u201cif they don\u2019t find anything, your details will be <strong><a  href=\"http:\/\/www.homeoffice.gov.uk\/police\/powers\/stop-and-search\/\">recorded for monitoring purposes<\/a><\/strong>, and you\u2019ll be allowed to go.\u201d<\/p>\n<p align=\"left\">The government has continued to<strong><a  href=\"http:\/\/news.bbc.co.uk\/1\/hi\/uk_politics\/7216815.stm\"> push for greater stop and search powers<\/a><\/strong> for police.<\/p>\n<p align=\"left\">Section 44 of the Terrorism Act bestows exceptional<br \/>\npowers on the police to stop and search at random, once a particular<br \/>\ngeographical area has been designated by a chief officer as one that<br \/>\nmight be targeted by terrorists and authorised as such by the Home<br \/>\nSecretary. The government has since <strong><a  href=\"http:\/\/www.dailymail.co.uk\/news\/article-511217\/Return-sus-laws-police-given-powers-stop-search-giving-reason.html\">extended this power<\/a><\/strong><br \/>\nto stop and search WITHOUT REASONABLE SUSPICION to include<br \/>\n\u201ctroubled areas\u201d, which since 2001 has included the whole<br \/>\nof Greater London.<\/p>\n<p>As of February 17 2009, <strong><a  href=\"http:\/\/www.infowars.net\/articles\/february2009\/170209pictures.htm\">Section 76 of the Counter Terrorism Act<\/a><\/strong><br \/>\nalso prohibits photographing police and permits the arrest of anyone<br \/>\nfound \u201celiciting, publishing or communicating information\u201d<br \/>\nrelating to members of the armed forces, intelligence services and<br \/>\npolice officers, which is \u201clikely to be useful to a person<br \/>\ncommitting or preparing an act of terrorism\u201d.<\/p>\n<p>Essentially, under anti-terror laws, anyone caught photographing<br \/>\npolice could face a fine or a prison sentence of up to 10 years.<\/p>\n<p align=\"left\">As we have<strong><a  href=\"http:\/\/infowars.net\/articles\/april2009\/160409Tourists.htm\"> recently reported<\/a><\/strong>,<br \/>\nthis section of the act is being used primarily to target journalists<br \/>\ncovering protests, who say they are being targeted by police<br \/>\nsurveillance officers more so than the actual protesters. The law has<br \/>\nalso been used against tourists snapping pictures of landmarks and<br \/>\nmembers of the public documenting police misconduct.<\/p>\n<p align=\"left\">A recent report by the <strong><a  href=\"http:\/\/www.politics.co.uk\/news\/policing-and-crime\/-heavy-handed-police-misuse-terror-laws-$1281978.htm\">Joint Select Committee on Human Rights<\/a><\/strong> confirmed that journalists and protesters were the primary targets of increased police misuse of anti-terror laws.<\/p>\n<p align=\"left\">This week\u2019s ruling from the Human Rights Court<br \/>\nrefers to the case of Kevin Gillan and Pennie Quinton who were detained<br \/>\nfor attending a <strong><a  href=\"http:\/\/news.bbc.co.uk\/1\/hi\/uk\/4786456.stm\">protest outside Europe\u2019s biggest arms fair<\/a><\/strong> in London in September 2003.<\/p>\n<p align=\"left\">Having finally achieved justice after more than six<br \/>\nyears of pursuing the matter, the pair were awarded \u20ac33,850<br \/>\n(\u00a330,400) in costs and expenses. Gillan and Quinton, who like<br \/>\nmany others could have just walked away, should be commended as heroes<br \/>\nfor their efforts to defend freedom in the UK.<\/p>\n<p align=\"left\">Anti-terror laws are intended for use on the general<br \/>\npublic, they always have been, and now we are seeing the rotten fruits<br \/>\nof continued blind acceptance contaminate every section of society in<br \/>\nthis country.<\/p>\n<p align=\"left\">Gillan and Quinton have paved the way for others who<br \/>\nhave been the victims of the misuse of these draconian terrorism laws<br \/>\nto fight back and
