{"id":218323,"date":"2010-01-22T14:20:36","date_gmt":"2010-01-22T19:20:36","guid":{"rendered":"http:\/\/worldtradelaw.typepad.com\/ielpblog\/2010\/01\/pleading-no-contest-in-the-zeroing-disputes.html"},"modified":"2010-01-22T14:20:36","modified_gmt":"2010-01-22T19:20:36","slug":"pleading-no-contest-in-the-zeroing-disputes","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/218323","title":{"rendered":"Pleading &#8220;No Contest&#8221; in the Zeroing Disputes"},"content":{"rendered":"<p>It&#39;s hard to know what to make of a WTO&#0160;panel&#0160;decision like today&#39;s <a href=\"http:\/\/www.worldtradelaw.net\/reports\/wtopanels\/us-carrierbags(panel).pdf\">U.S. &#8211; AD Measures on Carrier Bags<\/a> report.&#0160; In a nutshell, Thailand alleged that the U.S. used &quot;zeroing&quot; in the anti-dumping proceeding at issue, in violation of the AD Agreement.&#0160; In response, the U.S. did not contest the facts or the applicable law (see <a href=\"http:\/\/worldtradelaw.typepad.com\/ielpblog\/2009\/12\/the-shortest-wto-dispute-written-submission-ever.html\">my post<\/a> on the U.S. written submission in the case).&#0160; In fact, the parties had a whole procedural agreement where they laid all of this out, including the period of time for implementation:<\/p>\n<blockquote dir=\"ltr\">\n<p>3. The United States will not contest Thailand&#39;s claim that the measures identified in the attached request for the establishment of a panel are inconsistent with the first sentence of Article 2.4.2 of the Anti-Dumping Agreement on the grounds stated in United States &#8211; Final Dumping Determination on Softwood Lumber from Canada, WT\/DS264\/AB\/R (adopted 31 August 2004).<\/p>\n<p>&#8230;<\/p>\n<p>5.
