{"id":218723,"date":"2009-12-29T09:36:47","date_gmt":"2009-12-29T14:36:47","guid":{"rendered":"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/?p=1078"},"modified":"2009-12-29T09:36:47","modified_gmt":"2009-12-29T14:36:47","slug":"michigan-lawyers-taking-attorney-fees-on-voluntary-no-fault-insurance-benefits","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/218723","title":{"rendered":"Michigan Lawyers Taking Attorney Fees on Voluntary No-Fault Insurance Benefits"},"content":{"rendered":"<h3>Just Say No: Lawyers Should NOT Take Fees on Voluntarily Paid No-Fault Benefits Like Wage Loss, Replacement Services and Medical Bills<\/h3>\n<p><a href=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/wp-content\/uploads\/2009\/12\/michigan-personal-injury-lawyer-the-good-ones-dont-take-fees-on-voluntarily-paid-no-fault-benefits.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-1079\" title=\"no-fees-on-voluntarily-paid-no-fault-benefits\" src=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/wp-content\/uploads\/2009\/12\/michigan-personal-injury-lawyer-the-good-ones-dont-take-fees-on-voluntarily-paid-no-fault-benefits-300x202.jpg\" alt=\"\" width=\"300\" height=\"202\" \/><\/a><\/p>\n<p>Let me be clear: There is absolutely no reason whatsoever for a Michigan personal injury lawyer to try to take an attorney fee when an auto insurance company is voluntarily paying a crash victim <a title=\"Attorney video: Wage loss\" href=\"http:\/\/www.michiganautolaw.com\/videos\/wage-loss-benefits.php\" >wage loss<\/a> and <a title=\"Attorney video: Replacement services\" href=\"http:\/\/www.michiganautolaw.com\/videos\/replacement-services-benefits.php\" >replacement services<\/a>.<\/p>\n<p>This practice by some lawyers who handle <a title=\"Recent car accident FAQs\" href=\"http:\/\/www.michiganautolaw.com\/caraccidents\/caraccidentfaq.php\" >car accident <\/a>cases in Michigan makes me cringe. It represents the worst excesses of my profession; and these personal injury lawyers have no excuse for doing this\u00a0 They are literally taking thousands of dollars that rightfully belongs to their injured clients for no reason.<\/p>\n<p>If you have been in a car accident, and this is happening to you, this is my advice: Run (don\u2019t walk) away.\u00a0 Find a <a title=\"Finding the best auto accident lawyer\" href=\"http:\/\/www.michiganautolaw.com\/firm_profile\/find-best-lawyer.php\" >respected lawyer<\/a> who truly really cares about you and is trying to <strong>maximize the dollars in your pocket<\/strong> \u2014 not his or her own.<\/p>\n<h3>But\u2026 Attorney Fees on Attendant Care<\/h3>\n<p>Ok, I\u2019m a lawyer, so sometimes I have to talk like one.\u00a0 Here\u2019s one important exception to this black and white issue. It lies with <a title=\"How to preserve your attendant care rights\" href=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/2009\/11\/24\/how-to-preserve-your-attendant-care-rights-in-michigan\/\" >attendant care (AC)<\/a>, also called nursing care services.<\/p>\n<p>Attendant care is so complicated in Michigan, and the insurance abuse and outright fraud by insurance companies is so great, that when it comes to attendant care, it does makes sense to hire a lawyer right away to help you collect these important benefits \u2014 even if the insurance company is willing to pay an amount voluntarily.<\/p>\n<p>Here\u2019s the rub: Even with an attorney fee being taken, an experienced<a title=\"Attendant care lawyer\" href=\"http:\/\/www.michiganautolaw.com\/accidents\/attendant-care\/index.php\" > attendant care lawyer<\/a> in Michigan can normally double or triple the hourly rate that an insurance company would otherwise voluntarily pay for attendant care.\u00a0 Also, an attendant care lawyer can also normally negotiate a higher number of hours per day that attendant care services should be paid.<\/p>\n<p>Finally, after the string of cases allowing an insurance company to avoid paying attendant care, hiring an experienced no-fault insurance lawyer can stop insurance companies from later trying to evade paying the full value of attendant care services.<\/p>\n<p>The legal pitfalls and obstacles are mind boggling in the area of attendant care law.\u00a0 Cases in Michigan have literally allowed insurance claims adjusters to <a title=\"Why your insurance company can legally lie to you\" href=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/2009\/05\/28\/why-your-insurance-company-can-now-lie-to-you-%E2%80%93-and-legally-get-away-with-it\/\" >lie to their own insureds<\/a> about their right to collect attendant care.\u00a0 And there are many <a title=\"Blog, Michigan attendant care law change\" href=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/2008\/03\/28\/important-michigan-attendant-care-law-change\/\" >hyper-technical traps<\/a> that allow an insurance company to get out of paying for attendant care, even when they have already made a promise to pay.<\/p>\n<p>In the next in my series of blogs on insurance company abuse in Michigan (and the resulting excesses and abuses that has caused lawyers and doctors to <a title=\"Staring into the abyss of insurance company abuse in Michigan\" href=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/2009\/12\/15\/staring-into-the-abyss-of-insurance-company-abuse-in-michigan\/\" >\u201cstare into the abyss\u201d),<\/a> I&#8217;d like to discuss the false Internet advertising and outright fraud committed by some personal injury lawyers both in Michigan and throughout the country.\u00a0 It&#8217;s important for accident victims to know that lawyer advertising on the web today is truly the wild west, with very little oversight and regulation.<\/p>\n<p>Now, it&#8217;s more important than ever to look for trusted, independent third-party reviews of lawyers.<br \/>\n<em><br \/>\n&#8211; <a title=\"Steven M.
