{"id":258860,"date":"2010-02-01T09:17:00","date_gmt":"2010-02-01T14:17:00","guid":{"rendered":"http:\/\/www.circleofblue.org\/waternews\/?p=11242"},"modified":"2010-02-01T09:17:00","modified_gmt":"2010-02-01T14:17:00","slug":"u-s-supreme-court-denies-mississippi%e2%80%99s-claims-against-memphis","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/258860","title":{"rendered":"U.S. Supreme Court Denies Mississippi\u2019s Claims against Memphis"},"content":{"rendered":"<p><em>Mississippi wants the city\u2019s water utility to stop excessive groundwater withdrawal and pay $1.3 billion in damages.<\/em><br \/>\n<span id=\"more-11242\"><\/span><br \/>\n<img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.circleofblue.org\/waternews\/wp-content\/uploads\/2009\/10\/Mephis-Tennessee-290.jpg\" alt=\"Mephis Tennessee\" title=\"Mephis Tennessee\" width=\"290\" height=\"232\" class=\"aligncenter size-full wp-image-7489\" \/>The United States Supreme Court declined to hear a lawsuit claiming that Memphis is pumping too much water out of a shared aquifer, the Memphis Commercial Appeal reports.<\/p>\n<p>The Court also refused, without comment, to overturn an appellate court\u2019s ruling in favor of Memphis, according to <a href=\"http:\/\/www.businessweek.com\/ap\/financialnews\/D9DG8VK01.htm\">BusinessWeek<\/a>.<\/p>\n<p>Mississippi Attorney General Jim Hood says he will consult neighboring attorneys general before continuing any legal action.<\/p>\n<p>\u201cWe were attempting to avoid including our sister states in the litigation against Memphis and Memphis Light, Gas and Water,\u201d Hood said, BusinessWeek reports. \u201cBefore we file the action, I intend to consult with my fellow attorneys general in Arkansas and Tennessee to see if we can reach some settlement.\u201d<\/p>\n<p>The case began in 2005 when Hood <a href=\"http:\/\/www.circleofblue.org\/waternews\/2009\/world\/mississippi-vs-tennessee-billion-dollar-supreme-court-question-is-memphis-stealing-water\/\">filed a lawsuit against Memphis Light, Gas and Water (MLGW)<\/a>\u2013-the city\u2019s water supply division. The suit claimed that excessive pumping by MLGW had created a \u2018cone of depression\u2019 in the aquifer, causing water in Mississippi to flow into Tennessee. More than 20 percent of Memphis&#8217; water supply has been taken from Mississippi, the suit claims.<\/p>\n<p>Memphis is the largest city in the world relying solely on groundwater for its water supply, according to documents filed by Hood. The city pumps over 150 million gallons per day from the Memphis Sands aquifer on average.<\/p>\n<p>The suit sought $1.3 billion in damages from Tennessee, the city and MLGW.<\/p>\n<p>Tennessee officials praised the ruling.<\/p>\n<p>\u201cWe are gratified by the court&#8217;s decision, which recognizes state sovereignty in these matters and avoids protracted and expensive litigation,\u201d a spokesperson for Attorney General Bob Cooper said in a statement.<\/p>\n<p>U.S. District Judge Glen Davidson ruled in 2008 that the state of Tennessee, though not named in the suit, had to be party to it. That would have made the case an interstate dispute under the Supreme Court\u2019s jurisdiction, the Commercial Appeal reports.
