It  has once again brought to light the problem of false confessions used by Japanese police.<\/p>\n<p>In the past, the methods adopted by Japanese cops have been repeatedly criticized after details of exhausting interrogations, long pretrial detention periods and other power abuses (leading to suicide sometimes) were reported by the victims. But despite widespread publicity on these problems,  the system hasn&#39;t changed. <\/p>\n<p>According to <a href=\"http:\/\/blog.goo.ne.jp\/ukonkmy\/e\/ceadae8a32e9f0f35f3ce9dcf12b3ba8\">blogger Ukon<\/a> the problem is the importance given to confession, used in most of the cases as damning evidence, as well as a system that doesn&#39;t admit of any objection to authority improperly exercised.<\/p>\n<blockquote>\n<p>\u73fe\u4ee3\u306e\u65e5\u672c\u793e\u4f1a\u306b\u304a\u3044\u3066\u3001\u81ea\u767d\u504f\u91cd\u306e\u635c\u67fb\u3084\u3001\u81ea\u767d\u3084\u72b6\u6cc1\u8a3c\u62e0\u3092\u6839\u62e0\u3068\u3057\u3066\u88ab\u544a\u3092\u6709\u7f6a\u3068\u3059\u308b\u5211\u4e8b\u88c1\u5224\u304c\u5b58\u7d9a\u3057\u3066\u3044\u308b\u3002\u81ea\u767d\u504f\u91cd\u306e\u635c\u67fb\u3084\u3001\u81ea\u767d\u3084\u72b6\u6cc1\u8a3c\u62e0\u3092\u6839\u62e0\u3068\u3057\u3066\u88ab\u544a\u3092\u6709\u7f6a\u3068\u3059\u308b\u88c1\u5224\u3067\u306f\u3001\u4eba\u9593\u3092\u5b64\u7acb\u3055\u305b\u3001\u56fd\u5bb6\u306e\u66b4\u529b\u306b\u5bfe\u3059\u308b\u7570\u8b70\u7533\u3057\u7acb\u3066\u3092\u56f0\u96e3\u306b\u3059\u308b\u3002\u6c11\u4e3b\u7684\u306a\u793e\u4f1a\u3092\u5b9f\u73fe\u3059\u308b\u305f\u3081\u306b\u306f\u3001\u81ea\u767d\u504f\u91cd\u306e\u635c\u67fb\u3084\u3001\u81ea\u767d\u3084\u72b6\u6cc1\u8a3c\u62e0\u3092\u6839\u62e0\u3068\u3057\u3066\u88ab\u544a\u3092\u6709\u7f6a\u3068\u3059\u308b\u5211\u4e8b\u88c1\u5224\u3092\u662f\u6b63\u3057\u3001\u56fd\u5bb6\u306e\u66b4\u529b\u306b\u5bfe\u3059\u308b\u7570\u8b70\u7533\u3057\u7acb\u3066\u3092\u5b9f\u73fe\u3059\u308b\u305f\u3081\u306e\u6a29\u5229\u3084\u793e\u4f1a\u7684\u56de\u8def\u3092\u78ba\u7acb\u3057\u3066\u3044\u304f\u3053\u3068\u304c\u5fc5\u8981\u3060\u3068\u3001\u79c1\u306f\u8003\u3048\u308b\u3002<\/p>\n<\/blockquote>\n<div class=\"translation\">In  Japanese society, investigations based on suspect confession and trials which convict a defendant relying upon such confessions and circumstantial evidence continue to exist. In these trials, the person is purposely isolated and it is made difficult for them to oppose such tactics by the authorities.<br \/>\nIn order to develop a truly democratic society, it is necessary to revise a system that convicts relying only  upon investigations based on suspect confessions and circumstantial evidence and establish instead a social environment where the right to object against abuse of power by authority is possible.<\/div>\n<p>The concept of presumption of innocence until proven guilty is not much honored  in Japan and conceding  benefit of the doubt to a person suspected of committing a crime is rare.<br \/>\nAs soon as one is arrested they are immediately portrayed as a &#39;suspect&#39; by the local media (<em>yogisha<\/em> \u5bb9\u7591\u8005 in Japanese) which undoubtedly sways public opinion in a way that makes it difficult to win back social trust even after being acquitted.<\/p>\n<p>There are many cases where the victims of wrong accusations, like Toshikazu Sugaya in the Ashikaga case above, are shunned by their own relatives because they are considered as one who has soiled the family name.<\/p>\n<p>Blogger <a href=\"http:\/\/merry-akkii.cocolog-nifty.com\/blog\/2010\/01\/post-c617.html\">akkii points <\/a>to the cozy relation between cops and media as the prime cause of the problem.<\/p>\n<blockquote>\n<p>\u3053\u306e\u3088\u3046\u306a\u51a4\u7f6a\u4e8b\u4ef6\u306f\u3001\u306a\u305c\u8d77\u304d\u308b\u306e\u3067\u3042\u308d\u3046\u304b\u3002\u305d\u308c\u306b\u306f\u3001\u8b66\u5bdf\u3084\u691c\u5bdf\u306e\u81ea\u767d\u504f\u57f7\u4e3b\u7fa9\u304c\u3042\u308b\u304b\u3089\u3067\u3042\u308b\u3002\u305d\u3057\u3066\u3082\u3046\u4e00\u3064\u3001\u305d\u306e\u767a\u751f\u306b\u5927\u304d\u306a\u5f71\u97ff\u3092\u4e0e\u3048\u308b\u3082\u306e\u306b\u8b66\u5bdf\u3084\u691c\u5bdf\u304c\u3059\u308b\u30ea\u30fc\u30af\u304c\u3042\u308b\u3068\u8003\u3048\u3089\u308c\u308b\u3002\u3053\u308c\u306f\u3001\u30e1\u30c7\u30a3\u30a2\u306b\u5411\u3051\u3089\u308c\u305f\u30ea\u30fc\u30af\u3067\u3042\u308b\u3002\u305d\u3057\u3066\u3001\u3053\u308c\u304c\u30cb\u30e5\u30fc\u30b9\u3068\u306a\u308a\u3001\u3055\u3082\u3001\u5bb9\u7591\u8005\u3084\u88ab\u544a\u4eba\u304c\u72af\u7f6a\u8005\u3067\u3042\u308b\u304b\u306e\u3088\u3046\u306a\u932f\u899a\u3092\u793e\u4f1a\u306b\u4e0e\u3048\u308b\u306e\u3067\u3042\u308b\u3002\u305d\u306e\u7d50\u679c\u3001\u3053\u308c\u304c\u53d6\u8abf\u3079\u3084\u5224\u6c7a\u306b\u30cf\u30ec\u30fc\u30b7\u30e7\u30f3\u3092\u8d77\u3053\u3057\u3001\u53cd\u6620\u3055\u308c\u3066\u3057\u307e\u3046\u3068\u8003\u3048\u3089\u308c\u308b\u306e\u3060\u3002<\/p>\n<\/blockquote>\n<div class=\"translation\">Why do such cases of false accusation occur? It\u2019s because of the culture of exacting confession which  is rampant among both prosecutors and cops. Another  element  is information leaked by the same prosecutors and cops to the media.<br \/>\nThe leaked information becomes news, which impacts on the perception of people towards crime suspects or defendants who will be automatically be  perceived as guilty.<br \/>\nConsequently, this ends up affecting the investigation and the trial itself.<\/div>\n<p>Recently other cases where false confessions were used to convict suspects have emerged.<br \/>\n<a href=\"http:\/\/www.jiadep.org\/Nakamura_arson.html\">The latest one<\/a> [en] in December saw the Hiroshima High Court acquitting a Japanese man, for whom prosecutors have asked death penalty, because its confession was found \u201cnot credible\u201d.<br \/>\nIn December another case, the <a href=\"http:\/\/ja.wikipedia.org\/wiki\/\">Fukawa case<\/a> [ja] dating  back to 1967, was reopened because the accusations were based only on the two defendants&#39; alleged confession and testimony of eyewitnesses.<\/p>\n<p>A <a href=\"http:\/\/iitaizou.at.webry.info\/200912\/article_26.html\">blogger <\/a> expresses his bitterness on the matter.<\/p>\n<blockquote>\n<p>\u5e03\u5ddd\u4e8b\u4ef6\uff1a\u518d\u5be9\u958b\u59cb\u304c\u78ba\u5b9a\u3068\u5831\u3058\u3089\u308c\u3001\u7121\u5b9f\u304c\u78ba\u5b9a\u7684\u3068\u805e\u3044\u305f\u3002\u3053\u308c\u3082\u307e\u305f\u81ea\u767d\u306b\u554f\u984c\u3042\u308a\u3060\u305d\u3046\u3067\u3001\u306a\u305c\u304b\u53d6\u308a\u8abf\u3079\u306e\u9332\u97f3\u30c6\u30fc\u30d7\u304c\u3042\u308b\u3068\u3044\u3046\u3002\u691c\u5bdf\u3082\u8b66\u5bdf\u3082\u3044\u3044\u52a0\u6e1b\u306b\u3057\u3066\u6b32\u3057\u3044\u3068\u601d\u3046\u304c\u3001\u305d\u308c\u3092\u5831\u9053\u3059\u308b\u5074\u3082\u88c1\u5224\u6240\u3082\u554f\u984c\u304c\u3042\u308b\u3068\u601d\u3046\u5225\u4ef6\u304c\u3042\u308b\u3002<\/p>\n<\/blockquote>\n<div class=\"translation\">About the Fukawa case, I heard that they will reopen the trial and that it&#39;s likely that the two will turn out to be innocent. This is going to be another case where confession becomes a problem since the recorded tape of the interrogation still exists. I think it&#39;s time prosecutors and police got their act  together but media and the courts have their responsibilities also.<\/div>\n<p>Citing  article 38 of the Japanese Constitution the same blogger makes clear how the principle of not relying on confession alone does exist in Japan, but is seemingly disregarded.<\/p>\n<blockquote>\n<p>\n\u7b2c\u4e09\u5341\u516b\u6761\u3000\u4f55\u4eba\u3082\u3001\u81ea\u5df1\u306b\u4e0d\u5229\u76ca\u306a\u4f9b\u8ff0\u3092\u5f37\u8981\u3055\u308c\u306a\u3044\u3002<br \/>\n\uff12\u3000\u5f37\u5236\u3001\u62f7\u554f\u82e5\u3057\u304f\u306f\u8105\u8feb\u306b\u3088\u308b\u81ea\u767d\u53c8\u306f\u4e0d\u5f53\u306b\u9577\u304f\u6291\u7559\u82e5\u3057\u304f\u306f\u62d8\u7981\u3055\u308c\u305f\u5f8c\u306e\u81ea\u767d\u306f\u3001\u3053\u308c\u3092\u8a3c\u62e0\u3068\u3059\u308b\u3053\u3068\u304c\u3067\u304d\u306a\u3044\u3002<br \/>\n\uff13\u3000\u4f55\u4eba\u3082\u3001\u81ea\u5df1\u306b\u4e0d\u5229\u76ca\u306a\u552f\u4e00\u306e\u8a3c\u62e0\u304c\u672c\u4eba\u306e\u81ea\u767d\u3067\u3042\u308b\u5834\u5408\u306b\u306f\u3001\u6709\u7f6a\u3068\u3055\u308c\u3001\u53c8\u306f\u5211\u7f70\u3092\u79d1\u305b\u3089\u308c\u306a\u3044\u3002<\/p>\n<\/blockquote>\n<div class=\"translation\">Article XXXVIII.
