“As soon as the accident happened, he stopped and tried to help the people, who were running across the street through traffic, across the median when they shouldn’t have been,” Greenberg told reporters after the hearing. <\/p>\n
Greenberg said the evidence will show his client was sober the night of the crash. <\/p>\n
Lumpkin, an auto mechanic, is charged with reckless homicide and aggravated DUI. Prosecutors allege Lumpkin was speeding southbound in a Dodge Caravan on Ashland Avenue just north of 74th Street about 6:30 p.m. Tuesday when he crashed into first-grader Jada Washington and her aunt, Tiuette Richardson, 21, who were both standing on the median. Jada and her aunt were walking to a corner store to buy candy. <\/p>\n
Prosecutors said Jada’s body hit the windshield and she was then thrown onto the street. Richardson, who is recovering from her injuries, was thrown across the northbound lanes and landed near the curb, prosecutors said. <\/p>\n
Cook County prosecutor Angel Essig said Lumpkin failed a field sobriety test, and that “subsequent chemical testing” showed he had cocaine in his system. Lumpkin admitted to smoking pot “prior to the incident,” Essig said. <\/p>\n
Two 40-ounce bottles of beer were found in Lumpkin’s vehicle, one of which was open, Essig said. Prosecutors say Lumpkin admitted to buying one of the bottles of beer that evening on his way home from work. <\/p>\n
But Greenberg said the evidence will show his client was sober the night of the crash and had not been using cocaine. Greenberg said his client is taking Tylenol for a workplace back injury. <\/p>\n
Between 1987 and January of this year, Lumpkin has been stopped more than two dozen times and has received about 40 tickets for such offenses as disregarding a stop sign and operating a motor vehicle without insurance, according to court records. <\/p>\n
Greenberg said that’s not the same as being “convicted” of either traffic or criminal offenses. <\/p>\n
“He’s a hard-working family man,” Greenberg said. “He was driving home from work. So, yes, he should have been driving.” <\/p>\n
But Greenberg did say that his client has significant vision problems, for which he wears thick glasses. <\/p>\n<\/p>\n
