{"id":342991,"date":"2010-02-19T19:50:04","date_gmt":"2010-02-20T00:50:04","guid":{"rendered":"http:\/\/opiniojuris.org\/?p=11375"},"modified":"2010-02-19T19:50:04","modified_gmt":"2010-02-20T00:50:04","slug":"whale-wars-australia-gives-japan-one-more-chance-to-settle","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/342991","title":{"rendered":"Whale Wars: Australia Gives Japan One More Chance to Settle"},"content":{"rendered":"<p><strong><em>by Julian Ku <\/em><\/strong><\/p>\n<p>I had almost forgotten about t<a  href=\"http:\/\/www.guardian.co.uk\/world\/2010\/feb\/19\/australia-japan-whaling-lawsuit-theat\">his ongoing dispute between Australia and Japan over whaling<\/a>, which has been going on for years (and which <a  href=\"http:\/\/lawofnations.blogspot.com\/2005\/06\/whale-wars-why-does-japan-bother-with.html\">I first noted on this blog<\/a> way back in 2005). \u00a0The Australian Prime Minister warned Japan yesterday that if whaling doesn&#8217;t stop by November, Australia will take Japan to court, either the ICJ or the International Tribunal for the Law of the Sea. \u00a0Australia seems ready to go. It has its evidence lined up and appears to have <a  href=\"http:\/\/www.smh.com.au\/news\/whale-watch\/whaling-expert-to-consider-court-case\/2008\/01\/04\/1198950075821.html\">James Crawford <\/a>on board to argue its case before either the ITLOS or the ICJ. \u00a0I wouldn&#8217;t hold my breath on a quick decision on this, but it would be an interesting case nonetheless. As far as I know, Japan has never faced a case in the ICJ.
