Can you be too fat to fly in Canada?"},"content":{"rendered":"<p><\/p>\n<p>In the last few days, I have been deeply disturbed by the horrible treatment of <a title=\"http:\/\/twitter.com\/ThatKevinSmith\" href=\"http:\/\/twitter.com\/ThatKevinSmith\" >Kevin Smith<\/a> and Natali by\u00a0<a title=\"http:\/\/en.wikipedia.org\/wiki\/Southwest_Airlines\" href=\"http:\/\/en.wikipedia.org\/wiki\/Southwest_Airlines\" >Southwest Airlines<\/a>. So, this past Friday (Feb 19) when I dropped my better half to the airport for her to <a title=\"http:\/\/kempton.wordpress.com\/2010\/02\/21\/party-vancouver-party-go-canada-go\/\" href=\"http:\/\/kempton.wordpress.com\/2010\/02\/21\/party-vancouver-party-go-canada-go\/\" >have some fun in Vancouver<\/a>, I took the opportunity to ask the nice <a title=\"http:\/\/www.westjet.com\/\" href=\"http:\/\/www.westjet.com\/\" >WestJet<\/a> check-in lady about their &#8220;person of size&#8221; policy. You see, I know <a title=\"http:\/\/www.westjet.com\/\" href=\"http:\/\/www.westjet.com\/\" >WestJet<\/a> modelled itself after <a title=\"http:\/\/en.wikipedia.org\/wiki\/Southwest_Airlines\" href=\"http:\/\/en.wikipedia.org\/wiki\/Southwest_Airlines\" >Southwest Airlines<\/a>, I was expecting the worst.<\/p>\n<p>Well, to my surprise, the lady mentioned something called &#8220;<strong><em>one-person-one-fare<\/em><\/strong>&#8221; (more on this later) in response. My initial thought was: Cool, one person (regardless of size) pays one fare only, thats nice.<\/p>\n<p>Upon further research, I found that in Canada, we have <strong><a title=\"http:\/\/www.otc-cta.gc.ca\/index.php?lang=eng\" href=\"http:\/\/www.otc-cta.gc.ca\/index.php?lang=eng\" >Canadian Transportation Agency<\/a><\/strong> helping consumers. From their <a title=\"http:\/\/www.otc-cta.gc.ca\/index.php?lang=eng\" href=\"http:\/\/www.otc-cta.gc.ca\/index.php?lang=eng\" >website<\/a>,<\/p>\n<blockquote>\n<p>If you have a dispute related to federally-regulated modes of transportation, the Canadian Transportation Agency may be able to help. <strong><em>The Agency can bring you and the transportation operator together informally, help you to understand each other&#8217;s needs and interests, and find a solution that works for both. <\/em><\/strong><\/p>\n<\/blockquote>\n<p>If you think the above words are just some toothless idle BS, then you will be quite wrong. In fact, <a title=\"http:\/\/www.westjet.com\/\" href=\"http:\/\/www.westjet.com\/\" >WestJet<\/a>,\u00a0<a title=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada\" href=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada\" >Air Canada<\/a>, and <a title=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada_Jazz\" href=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada_Jazz\" >Air Canada Jazz<\/a>, <strong>weren&#8217;t nice &#8220;willingly&#8221;<\/strong>!<\/p>\n<p>The <a title=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" href=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" ><strong>&#8220;one-person-one-fare&#8221; policy was an order<\/strong><\/a> from <a title=\"http:\/\/www.otc-cta.gc.ca\/index.php?lang=eng\" href=\"http:\/\/www.otc-cta.gc.ca\/index.php?lang=eng\" >Canadian Transportation Agency<\/a>! And <a title=\"http:\/\/www.westjet.com\/\" href=\"http:\/\/www.westjet.com\/\" >WestJet<\/a>,\u00a0<a title=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada\" href=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada\" >Air Canada<\/a>, and\u00a0<a title=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada_Jazz\" href=\"http:\/\/en.wikipedia.org\/wiki\/Air_Canada_Jazz\" >Air Canada Jazz<\/a> appealed the decision all the way to the Supreme Court of Canada\u00a0and lost (both the Federal Court of Appeal and the Supreme Court of Canada dismissed the airlines&#8217; application). Here is an <a title=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" href=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" >excerpt<\/a>,<\/p>\n<blockquote>\n<p>In February 2008, Air Canada, Air Canada Jazz and WestJet sought leave to appeal to the Federal Court of Appeal.<\/p>\n<p>In May 2008, the Federal Court of Appeal dismissed the airlines&#8217; application.<\/p>\n<p>In August 2008, the airlines applied to the Supreme Court of Canada for leave to appeal the Federal Court of Appeal&#8217;s Decision to dismiss their application.<\/p>\n<p><strong><em>On November 20, 2008, the Supreme Court of Canada dismissed Air Canada, Air Canada Jazz and WestJet&#8217;s application for leave to appeal. The Agency&#8217;s January 2008 Decision stands.<\/em><\/strong><\/p>\n<\/blockquote>\n<p>See reports from <a title=\"http:\/\/www.cbc.ca\/canada\/manitoba\/story\/2008\/01\/10\/one-fare.html\" href=\"http:\/\/www.cbc.ca\/canada\/manitoba\/story\/2008\/01\/10\/one-fare.html\" >CBC News<\/a> and <a title=\"http:\/\/www.canada.com\/calgaryherald\/news\/story.html?id=b1b82c57-d633-479a-bfde-18e6424ccd46\" href=\"http:\/\/www.canada.com\/calgaryherald\/news\/story.html?id=b1b82c57-d633-479a-bfde-18e6424ccd46\" >Canada.com<\/a>.<\/p>\n<p>I am not a lawyer, but for persons functionally disabled by obesity, the <a title=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" href=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" ><strong>&#8220;one-person-one-fare&#8221; policy <\/strong><\/a> applies. So you will only need to pay one fare.<\/p>\n<p>And for other persons of size, I strongly suspect if you can put the seat handles down, you will be OK. You see, with the <a title=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" href=\"http:\/\/www.otc-cta.gc.ca\/doc.php?did=2168&amp;lang=eng\" ><strong>&#8220;one-person-one-fare&#8221; policy<\/strong><\/a> in effect for over a year, I seriously doubt any Canadian airlines&#8217; flight crews will make any fuzz for people flying within Canada.
