{"id":367560,"date":"2010-02-24T18:02:19","date_gmt":"2010-02-24T23:02:19","guid":{"rendered":"http:\/\/www.theatlantic.com\/business\/archive\/2010\/02\/john-yoo-and-the-torture-memos\/36559\/"},"modified":"2010-02-24T18:02:19","modified_gmt":"2010-02-24T23:02:19","slug":"john-yoo-and-the-torture-memos","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/367560","title":{"rendered":"John Yoo and the Torture Memos"},"content":{"rendered":"<p>I followed<a mce_href=\"http:\/\/jamesfallows.theatlantic.com\/archives\/2010\/02\/more_on_opr_margolis_sel.php\" href=\"http:\/\/jamesfallows.theatlantic.com\/archives\/2010\/02\/more_on_opr_margolis_sel.php\"> James Fallows&#8217;s advice<\/a> and read the <a mce_href=\"http:\/\/judiciary.house.gov\/hearings\/pdf\/OPRFinalReport090729.pdf\" href=\"http:\/\/judiciary.house.gov\/hearings\/pdf\/OPRFinalReport090729.pdf\">OPR report on John Yoo<\/a>.<br \/>\nI agree with what I think is Jim&#8217;s main point&#8211;that parts of the<br \/>\ndocument force the reader to confront the disgusting reality of<br \/>\n&#8220;enhanced interrogation&#8221;, which is a salutary experience. But I can&#8217;t<br \/>\nsay the report persuaded me that, as it asserts, Yoo <i>knowingly<\/i> misled the government about the law. I can&#8217;t say the report even tries to support that charge. \n<\/p>\n<p>Yoo&#8217;s view that methods like waterboarding and prolonged sleep<br \/>\ndeprivation are not &#8220;torture&#8221; so far as the law is concerned may be<br \/>\nincorrect, as many experts say, but it is nonetheless legally defensible,<br \/>\nand the report admits as much. Yoo seems to me consistent and sincere<br \/>\nin his belief. His view that under the circumstances pertaining after<br \/>\n9\/11, the law imposed no significant restraints on presidential power<br \/>\nis even harder to defend&#8211;but again,<br \/>\nthis appears to be his considered, conscientious view. <\/p>\n<p>Jim Fallows advises readers also to look at the <a mce_href=\"http:\/\/judiciary.house.gov\/hearings\/pdf\/DAGMargolisMemo100105.pdf\" href=\"http:\/\/judiciary.house.gov\/hearings\/pdf\/DAGMargolisMemo100105.pdf\">memo by David Margolis<\/a>,<br \/>\na respected career lawyer in the Justice Department, who overruled the<br \/>\nOPR findings. If you do read the OPR report you should indeed read<br \/>\nMargolis as well. The OPR report comes in for some serious criticism.<br \/>\n(See also these letters on an earlier draft from <a mce_href=\"http:\/\/www2.nationalreview.com\/dest\/2010\/02\/20\/description011909.mukaseyfiliplettertoopr.pdf\" href=\"http:\/\/www2.nationalreview.com\/dest\/2010\/02\/20\/description011909.mukaseyfiliplettertoopr.pdf\">Michael Mukasey and Mark Filip<\/a>, and <a mce_href=\"http:\/\/www2.nationalreview.com\/dest\/2010\/02\/23\/pinionletterrebybeememomay42009.pdf\" href=\"http:\/\/www2.nationalreview.com\/dest\/2010\/02\/23\/pinionletterrebybeememomay42009.pdf\">Ronald Rotunda<\/a>.) It is not an exemplary piece of work. The good faith of its authors, it seems to me, is called into question. \n<\/p>\n<p> Margolis faults Yoo for poor judgment, saying he &#8220;consistently<br \/>\ntook an expansive view of executive authority and narrowly construed<br \/>\nthe torture statute while often failing to expose (much less refute)<br \/>\ncountervailing arguments and overstating the certainty of [his]<br \/>\nconclusions&#8221;. At the same time, Margolis says, &#8220;But as all that<br \/>\nglitters is not gold, all flaws do not constitute professional<br \/>\nmisconduct.&#8221; He quotes Jack Goldsmith, whose <a mce_href=\"http:\/\/www.amazon.com\/Terror-Presidency-Judgment-Inside-Administration\/dp\/039333533X\/ref=sr_1_1?ie=UTF8&amp;s=books&amp;qid=1267050935&amp;sr=8-1\" href=\"http:\/\/www.amazon.com\/Terror-Presidency-Judgment-Inside-Administration\/dp\/039333533X\/ref=sr_1_1?ie=UTF8&amp;s=books&amp;qid=1267050935&amp;sr=8-1\">fine book<\/a> on the Office of Legal Counsel and the war on terror <a mce_href=\"http:\/\/www.ft.com\/cms\/s\/0\/fcd3a4aa-7a55-11dc-9bee-0000779fd2ac.html\" href=\"http:\/\/www.ft.com\/cms\/s\/0\/fcd3a4aa-7a55-11dc-9bee-0000779fd2ac.html\">I have previously recommended<\/a>.<\/p>\n<blockquote>\n<p>All<br \/>\nof these men wanted to push the law as far as it would allow. But none,<br \/>\nI believe, thought he was violating the law. John Yoo certainly didn&#8217;t.<\/p>\n<\/blockquote>\n<p>Goldsmith<br \/>\ncomplains that the Bush administration worried too much about what was<br \/>\nlegal and not enough about what was moral or wise. I think that is<br \/>\ncorrect, and it is why I question Jim&#8217;s assessment that Bush&#8217;s early<br \/>\npolicies on interrogation were, among other things, &#8220;lawless&#8221;. They<br \/>\nwere morally wrong and counter-productive, in my opinion. They were<br \/>\nbased on poor legal advice too, according to the scholarly consensus. They were not lawless.\n<\/p>\n<p> The<br \/>\nlaw itself was and is at fault. It is still not as clear as it<br \/>\nshould be, and Congress has let that state of affairs persist. The<br \/>\nlegal opinions and the policies have been changed, which is good, but<br \/>\nthis important lesson has yet to be learned.\n<\/p>\n<p> Being unwise or evil does not make an act illegal. The OLC&#8217;s job is to advise on the law, not say what is wise or moral. Sometimes, the<br \/>\nlaw is an ass.
