\nEXECUTIVE ORDER <\/p>\n

PROVIDING AN ORDER OF SUCCESSION WITHIN THE
\nDEPARTMENT OF DEFENSE <\/p>\n
\n By the authority vested in me as President by the
\nConstitution and the laws of the United States of America,
\nincluding the Federal Vacancies Reform Act of 1998, as amended,
\n5 U.S.C. 3345 et seq., it is hereby ordered that: <\/p>\n
Section 1. Order of Succession. <\/p>\n
(a) Subject to the provisions of section 2 of this order,
\nthe following officials of the Department of Defense, in the
\norder listed, shall act as and perform the functions and duties
\nof the office of the Secretary of Defense (Secretary) during any
\nperiod in which the Secretary has died, resigned, or otherwise
\nbecome unable to perform the functions and duties of the office
\nof the Secretary, until such time as the Secretary is able to
\nperform the functions and duties of that office: <\/p>\n
(1) Deputy Secretary of Defense; <\/p>\n
(2) Secretary of the Army; <\/p>\n
(3) Secretary of the Navy; <\/p>\n
(4) Secretary of the Air Force; <\/p>\n
(5) Under Secretary of Defense for Acquisition,
\nTechnology, and Logistics; <\/p>\n
(6) Under Secretary of Defense for Policy; <\/p>\n
(7) Under Secretary of Defense (Comptroller); <\/p>\n
(8) Under Secretary of Defense for Personnel and
\nReadiness; <\/p>\n
(9) Under Secretary of Defense for Intelligence; <\/p>\n
(10) Deputy Chief Management Officer, Department of
\nDefense; <\/p>\n
(11) Principal Deputy Under Secretary of Defense for
\nAcquisition, Technology, and Logistics; <\/p>\n

\nNuclear and Chemical and Biological Defense
\nPrograms, the Director of Operational Test and
\nEvaluation, the Director of Operational Energy
\nPlans and Programs, and the Director of Cost
\nAssessment and Program Evaluation; <\/p>\n
(18) Under Secretaries of the Army, the Navy, and the
\nAir Force; and <\/p>\n
(19) Assistant Secretaries of the Army, the Navy, and
\nthe Air Force, and General Counsels of the Army,
\nthe Navy, and the Air Force. <\/p>\n
(b) Precedence among officers designated within the same
\nparagraph of subsection (a) shall be determined by the order in
\nwhich they have been appointed to such office. Where officers
\ndesignated within the same paragraph of subsection (a) have the
\nsame appointment date, precedence shall be determined by the
\norder in which they have taken the oath to serve in that office. <\/p>\n
Sec. 2. Exceptions. <\/p>\n
(a) No individual who is serving in an office listed in
\nsection 1 in an acting capacity, by virtue of so serving, shall
\nact as Secretary pursuant to this order. <\/p>\n
(b) No individual listed in section 1 shall act as
\nSecretary unless that individual was appointed by the President,
\nby and with the advice and consent of the Senate, and that
\nindividual is otherwise eligible to so serve under the Federal
\nVacancies Reform Act of 1998, as amended. <\/p>\n
(c) Notwithstanding the provisions of this order, the
\nPresident retains discretion, to the extent permitted by law,
\nto depart from this order in designating an acting Secretary. <\/p>\n
Sec. 3. Revocation. Executive Order 13394 of December 22,
\n2005 (Providing An Order of Succession Within the Department of
\nDefense), is hereby revoked. <\/p>\n

Sec. 4. Judicial Review. This order is not intended to,
\nand does not, create any right or benefit, substantive or
\nprocedural, enforceable at law or in equity by any party against
\nthe United States, its departments, agencies, or entities, its
\nofficers, employees, or agents, or any other person. <\/p>\n
