Order of Succession. <\/p>\n<p>(a)  Subject to the provisions of section 2 of this order, <br \/>\nthe following officials of the Department of Defense, in the <br \/>\norder listed, shall act as and perform the functions and duties <br \/>\nof the office of the Secretary of Defense (Secretary) during any <br \/>\nperiod in which the Secretary has died, resigned, or otherwise <br \/>\nbecome unable to perform the functions and duties of the office <br \/>\nof the Secretary, until such time as the Secretary is able to <br \/>\nperform the functions and duties of that office: <\/p>\n<p>(1)   Deputy Secretary of Defense; <\/p>\n<p>(2)   Secretary of the Army; <\/p>\n<p>(3)   Secretary of the Navy; <\/p>\n<p>(4)   Secretary of the Air Force; <\/p>\n<p>(5)   Under Secretary of Defense for Acquisition, <br \/>\nTechnology, and Logistics; <\/p>\n<p>(6)   Under Secretary of Defense for Policy; <\/p>\n<p>(7)   Under Secretary of Defense (Comptroller); <\/p>\n<p>(8)   Under Secretary of Defense for Personnel and <br \/>\nReadiness; <\/p>\n<p>(9)   Under Secretary of Defense for Intelligence; <\/p>\n<p>(10)  Deputy Chief Management Officer, Department of <br \/>\nDefense; <\/p>\n<p>(11)  Principal Deputy Under Secretary of Defense for <br \/>\nAcquisition, Technology, and Logistics; <\/p>\n<p>more <\/p>\n<p>(OVER) <br \/>\n2 <\/p>\n<p>(12)  Principal Deputy Under Secretary of Defense for <br \/>\nPolicy; <\/p>\n<p>(13)  Principal Deputy Under Secretary of Defense <br \/>\n(Comptroller); <\/p>\n<p>(14)  Principal Deputy Under Secretary of Defense for <br \/>\nPersonnel and Readiness; <\/p>\n<p>(15)  Principal Deputy Under Secretary of Defense for <br \/>\nIntelligence; <\/p>\n<p>(16)  Director of Defense Research and Engineering; <\/p>\n<p>(17)  General Counsel of the Department of Defense, <br \/>\nthe Assistant Secretaries of Defense, the <br \/>\nAssistant to the Secretary of Defense for <br \/>\nNuclear and Chemical and Biological Defense <br \/>\nPrograms, the Director of Operational Test and <br \/>\nEvaluation, the Director of Operational Energy <br \/>\nPlans and Programs, and the Director of Cost <br \/>\nAssessment and Program Evaluation; <\/p>\n<p>(18)  Under Secretaries of the Army, the Navy, and the <br \/>\nAir Force; and <\/p>\n<p>(19)  Assistant Secretaries of the Army, the Navy, and <br \/>\nthe Air Force, and General Counsels of the Army, <br \/>\nthe Navy, and the Air Force. <\/p>\n<p> (b)  Precedence among officers designated within the same <br \/>\nparagraph of subsection (a) shall be determined by the order in <br \/>\nwhich they have been appointed to such office.  Where officers <br \/>\ndesignated within the same paragraph of subsection (a) have the <br \/>\nsame appointment date, precedence shall be determined by the <br \/>\norder in which they have taken the oath to serve in that office. <\/p>\n<p>Sec. 2.  Exceptions. <\/p>\n<p>(a)  No individual who is serving in an office listed in <br \/>\nsection 1 in an acting capacity, by virtue of so serving, shall <br \/>\nact as Secretary pursuant to this order. <\/p>\n<p>(b)  No individual listed in section 1 shall act as <br \/>\nSecretary unless that individual was appointed by the President, <br \/>\nby and with the advice and consent of the Senate, and that <br \/>\nindividual is otherwise eligible to so serve under the Federal <br \/>\nVacancies Reform Act of 1998, as amended. <\/p>\n<p>(c)  Notwithstanding the provisions of this order, the <br \/>\nPresident retains discretion, to the extent permitted by law, <br \/>\nto depart from this order in designating an acting Secretary. <\/p>\n<p>Sec. 3.  Revocation.  Executive Order 13394 of December 22, <br \/>\n2005 (Providing An Order of Succession Within the Department of <br \/>\nDefense), is hereby revoked. <\/p>\n<p>more <br \/>\n3 <\/p>\n<p>Sec. 4.  Judicial Review.
