{"id":386701,"date":"2010-03-03T12:30:00","date_gmt":"2010-03-03T17:30:00","guid":{"rendered":"http:\/\/www.businessinsider.com\/apples-wimpy-patent-suit-is-proof-that-its-terrified-of-google-2010-3"},"modified":"2010-03-03T12:30:00","modified_gmt":"2010-03-03T17:30:00","slug":"apples-wimpy-patent-suit-is-proof-that-its-terrified-of-google-aapl-goog","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/386701","title":{"rendered":"Apple&#8217;s Wimpy Patent Suit Is Proof That It&#8217;s Terrified Of Google (AAPL, GOOG)"},"content":{"rendered":"<p><img decoding=\"async\" class=\"float_right\" src=\"http:\/\/static.businessinsider.com\/image\/4b57515c0000000000ba19c1\/steve-jobs-eric-schmidt-ap.jpg\" border=\"0\" alt=\"steve jobs eric schmidt AP\" \/><\/p>\n<\/p>\n<p>Apple <a href=\"http:\/\/www.businessinsider.com\/apple-sues-htc-over-patent-infringement-2010-3\">spun its patent suit against Taiwanese cellphone maker HTC yesterday<\/a> as a way to protect itself from having its technology stolen.<\/p>\n<p>That&#8217;s legitimate, and could be a good move for Apple on paper if it works out in the courts.<\/p>\n<p>But in terms of perception, it&#8217;s really the latest sign from Apple that it is terrified of Google, whose Android operating system is <a href=\"http:\/\/www.businessinsider.com\/eric-schmidt-60000-android-equipped-phones-are-shipping-each-day-2010-2\">becoming a formidable rival<\/a> in the smartphone industry. This amid <a href=\"http:\/\/www.businessinsider.com\/google-apple-war-update-2010-1\">broader, intensifying competition<\/a> between the two companies.<\/p>\n<p>The biggest sign of Apple&#8217;s worry is that this is a war that Apple should be proud to win in the  market, not in a courtroom.<\/p>\n<p>Apple should continue to grow its position  in the smartphone business by being better than its competitors, out-innovating them, out-designing them, out-pricing them, out-marketing them, and out-selling them, using patents as defensive protection.<\/p>\n<p>Instead, it&#8217;s going on the offense with patents, not just products, which reeks of fear. As Apple blogger John Gruber <a href=\"http:\/\/daringfireball.net\/linked\/2010\/03\/02\/stand-by-this\">reiterated  yesterday<\/a> on his site Daring Fireball, &#8220;If you can&#8217;t beat &#8217;em, sue  &#8217;em.&#8221; He <a href=\"http:\/\/daringfireball.net\/linked\/2010\/03\/02\/stand-by-this\">added<\/a>, &#8220;I feel this suit against HTC is a terrible mistake.&#8221;<\/p>\n<p>Other symptoms of Apple&#8217;s Googlephobia:<\/p>\n<ul>\n<li><strong>It&#8217;s suing HTC, but it&#8217;s really suing over Google.<\/strong> Apple could always sue Google later, but it&#8217;s not starting with Google.<\/li>\n<\/ul>\n<ul>\n<li><strong>It&#8217;s going after the weakest, first.<\/strong> HTC just happens to be the smallest (and the best) manufacturer of phones based on Google&#8217;s Android OS. This versus suing a bigger company like Motorola, which likely has a much deeper patent arsenal to use against Apple.<\/li>\n<\/ul>\n<ul>\n<li><strong>Apple is suing over some lame patents.<\/strong> Engadget&#8217;s Nilay Patel, a former attorney, has <a href=\"http:\/\/www.engadget.com\/2010\/03\/02\/apple-vs-htc-a-patent-breakdown\/\">gone through the 20 patents in an excellent post<\/a>. (You can also <a href=\"http:\/\/www.businessinsider.com\/the-20-patents-apple-hopes-will-crush-its-smartphone-competition-2010-3\">flip through some diagrams here<\/a>.) Some patents don&#8217;t even have anything to do specifically with cellphones. But this is one way patent suits work: Throw everything against the wall, see what sticks.<\/li>\n<\/ul>\n<ul>\n<li><strong>It&#8217;s just using the suit to mess up Android&#8217;s development and make HTC nervous. <\/strong>It&#8217;s not like Apple is a patent-troll shell company that needs these suits for income. It&#8217;s not like the government is going to shut down everyone&#8217;s Android phone already in the market. It&#8217;s purely an anti-competitive suit. Which, for consumers, just limits innovation.<\/li>\n<\/ul>\n<p>Again, it&#8217;s perfectly legitimate for Apple to sue HTC, Google, or  anyone &#8212; just as it&#8217;s perfectly legitimate for <a href=\"http:\/\/www.businessinsider.com\/nokia-strikes-back-in-patent-war-with-apple-2009-12\">Nokia or anyone  else<\/a> to sue Apple. That&#8217;s part of doing business.<\/p>\n<p>But it just makes Apple <em>look<\/em> wimpy.
