You better be prepared to sign one of the tougher contracts <a href=\"http:\/\/en.wikipedia.org\/wiki\/Faustian_bargain\">this side of Faust<\/a>. <\/p>\n<p>Apple&#8217;s developer agreement &#8212; recently unearthed by the <a href=\"http:\/\/www.eff.org\/\">Electronic Frontier Foundation<\/a> &#8212;&nbsp; severely limits the company&#8217;s liability and enables them to kill any application. <\/p>\n<p>Details on the developer agreement have been scant until now, because it includes a strict confidentiality clause. But the EFF filed a Freedom of Information Act Request with NASA, which has its own <a href=\"http:\/\/itunes.apple.com\/WebObjects\/MZStore.woa\/wa\/viewSoftware?id=334325516&amp;mt=8\">iPhone<br \/>\n app<\/a>. EFF&#8217;s conclusions:<\/p>\n<blockquote><p>Overall, the Agreement is a very one-sided contract, favoring Apple at<br \/>\nevery turn. That&#8217;s not unusual where end-user license agreements are<br \/>\nconcerned (and not all the terms may ultimately be enforceable), but<br \/>\nit&#8217;s a bit of a surprise as applied to the more than 100,000 developers<br \/>\nfor the iPhone, including many large public companies. How can Apple get<br \/>\n away with it? Because it is the sole gateway to the more than 40<br \/>\nmillion iPhones that have been sold. In other words, it&#8217;s only because<br \/>\nApple still &#8220;owns&#8221; the customer, long after each iPhone (and soon, iPad)<br \/>\n is sold, that it is able to push these contractual terms on the entire<br \/>\nuniverse of software developers for the platform. <\/p><\/blockquote>\n<p>The agreement&#8217;s release is especially interesting as it comes amid what <a href=\"http:\/\/gizmodo.com\/5488190\/apples-sexy-app-purge-was-just-the-beginning\">Gizmodo aptly calls <\/a>&#8220;The Great App Store Purge of 2010.&#8221; It began in February when Apple <a href=\"http:\/\/www.theatlantic.com\/science\/archive\/2010\/02\/hell-hath-no-furry-like-a-tech-blogger-without-porn\/36705\/\">began removing<\/a> some, <a href=\"http:\/\/www.nytimes.com\/2010\/02\/23\/technology\/23apps.html?partner=rss&amp;emc=rss\">but not all<\/a>, sex-themed applications from its online App Store. The company then <a href=\"http:\/\/mashable.com\/2010\/03\/05\/wi-fi-stumblers-app-store\/\">started killing<\/a> apps that scan for nearby wireless networks. This week, Apple <a href=\"http:\/\/techcrunch.com\/2010\/03\/07\/apple-cookie-cutter-apps\/\">set its sights<\/a> on &#8220;cookie-cutter applications,&#8221; which offer little more functionality than a simple Web site.<\/p>\n<p>The license agreement must be signed by developers of applications for the iPhone<br \/>\noperating system, which runs on the iPhone, iPod Touch and iPad. <\/p>\n<p>So what&#8217;s in the agreement? For a start, Apple reserves the right to suddenly kill any application &#8212; even after you&#8217;ve purchased it. &#8220;Steve Jobs has <a href=\"http:\/\/www.telegraph.co.uk\/technology\/3358134\/Apples-Jobs-confirms-iPhone-kill-switch.html\">confirmed<\/a><br \/>\nthat Apple can remotely disable apps, even after they have been<br \/>\ninstalled by users,&#8221; wrote EFF staff attorney <a href=\"http:\/\/www.eff.org\/about\/staff\/fred-von-lohmann\">Fred von Lohmann<\/a>. &#8220;This contract provision would appear to allow that.&#8221; The contract also strictly bans tinkering with any Apple products, a limitation that Lohmann points out could prevent developers from making apps that work with open source software.<\/p>\n<p>But one of the most audacious clauses is the one that limits Apple&#8217;s liability:<\/p>\n<blockquote><p>Section 14 states that, no matter what, Apple will never be liable to<br \/>\nany developer for more than $50 in damages. That&#8217;s pretty remarkable,<br \/>\nconsidering that Apple holds a developer&#8217;s reputational and commercial<br \/>\nvalue in its hands&#8211;it&#8217;s not as though the developer can reach its<br \/>\nexisting customers anywhere else. So if Apple botches an update,<br \/>\naccidentally kills your app, or leaks your entire customer list to a<br \/>\ncompetitor, the Agreement tries to cap you at the cost of a nice dinner<br \/>\nfor one in Cupertino.<\/p><\/blockquote>\n<p>As frustrating as the agreement might be for developers, they always could just opt out, as some of the tech-savvy <a href=\"http:\/\/apple.slashdot.org\/story\/10\/03\/09\/1326217\/Apples-iPhone-Developer-License-Agreement-Revealed?from=twitter\">commenters  at Slashdot point out<\/a>. And at least one spurned developer <a href=\"http:\/\/www.infomind.com\/iphone\/yfy.html\">has embraced<\/a> the underground app store Cydia, which can only be accessed on devices that have been <a href=\"http:\/\/en.wikipedia.org\/wiki\/Jailbroken\">jailbroken<\/a>, a process that allows users to run unauthorized software.
