{"id":421752,"date":"2010-03-12T10:30:41","date_gmt":"2010-03-12T15:30:41","guid":{"rendered":"http:\/\/www.theatlantic.com\/business\/archive\/2010\/03\/tech-pharma-clash-on-patent-reform\/37322\/?rss=37322"},"modified":"2010-03-12T10:30:41","modified_gmt":"2010-03-12T15:30:41","slug":"tech-pharma-clash-on-patent-reform","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/421752","title":{"rendered":"Tech, Pharma Clash on Patent Reform"},"content":{"rendered":"<p><font class=\"Apple-style-span\" color=\"#000000\"><span class=\"Apple-style-span\" style=\"FONT-SIZE: medium\"><font class=\"Apple-style-span\" style=\"FONT-SIZE: 0.8em\"><font class=\"Apple-style-span\" style=\"FONT-SIZE: 1.25em\"><font class=\"Apple-style-span\" style=\"FONT-SIZE: 0.8em\"><br \/><\/font><\/font><\/font><\/span><\/font><\/p>\n<p>The Coalition for Patent Fairness, an ad-hoc interest group that represents Google, Apple, Intel, and Oracle, among other high-tech giants, has <a href=\"http:\/\/www.rollcall.com\/news\/43804-1.html?mostemailed=1\">condemned<\/a>&nbsp;a <a href=\"http:\/\/leahy.senate.gov\/press\/press_releases\/release\/?id=8b0f5bb3-121b-484a-b0b7-092d7bdee1ac\">recently unveiled<\/a>&nbsp;patent reform bill. In <a href=\"http:\/\/thehill.com\/blogs\/hillicon-valley\/technology\/85515-tech-industry-splinters-over-patent-reform-proposal\">the opposing corner<\/a> are interest groups representing biotech firms, pharmaceutical companies, and smaller tech companies.<\/p>\n<p>Why the difference of opinion? To vastly oversimplify matters: The first group tends to gets sued over patents, and the second group licenses them.<\/p>\n<p>The sticking point seems to be a lack of litigation damage limits. From 1996-2008, Google, Apple, and 13 other major tech companies (12 of which are also represented by the Coalition for Patent Fairness) were defendants in 730 patent infringement lawsuits, and collectively shelled out about $4 billion in damages, according to economist Pat Choate&#8217;s book &#8220;Saving Capitalism.&#8221;<\/p>\n<p>Many <a href=\"http:\/\/news.google.com\/news\/url?sa=t&amp;ct2=us%2F0_0_s_0_0_t&amp;ct3=MAA4AEgAUABqAnVz&amp;usg=AFQjCNGVUyJZVwjqncGuBNOOreopcO_bQw&amp;sig2=PLKP6jQNzwjTHMse-C1jsw&amp;cid=8797515001239&amp;ei=sAiYS7j4M6r9lQfF9rIw&amp;rt=SEARCH&amp;vm=STANDARD&amp;url=http%3A%2F%2Fthehill.com%2Fblogs%2Fhillicon-valley%2Ftechnology%2F85515-tech-industry-splinters-over-patent-reform-proposal\">argue<\/a> these exorbitant damages have created a dodgy &#8220;litigation lottery&#8221; mindset. Drawn by the allure of potentially huge payouts,&nbsp;aggressive&nbsp;companies including so-called &#8220;patent trolls,&#8221;&nbsp;as companies who exist solely to sue others for infringement are derisively called by their opponents, have taken to sniping at deep-pocketed tech companies through the court system and have made <a href=\"http:\/\/www.good.is\/post\/the-patent-troll\/\">quite a bit of money<\/a> doing so. Tough damage limits could reduce trolling by making it less lucrative. <\/p>\n<p>And trolls aren&#8217;t the only problem. As the recent <a href=\"http:\/\/www.theatlantic.com\/science\/archive\/2010\/03\/is-the-apple-htc-lawsuit-good-for-consumers\/37047\/\">Apple lawsuit against HTC<\/a> (and also Google, by proxy) demonstrates, tech giants have just as much or more to fear from <a href=\"http:\/\/www.ipwatchdog.com\/2010\/03\/04\/apple-sues-htc-on-iphone-patents-but-google-is-the-real-target\/id=9484\/\">each other<\/a>. Companies have complained that the looming possibility of gargantuan lawsuits has made&nbsp;everyone afraid to move and is&nbsp;significantly stifling innovation. So why aren&#8217;t damage limits being demanded across the board?<\/p>\n<p>One reason is that pharmaceutical companies and universities structure their businesses around licensing patented technology, so patent trolls aren&#8217;t always problems &#8212; indeed, they are often good customers. Microsoft&#8217;s muted stance on the new legislation may be a result of its interests as a <a href=\"http:\/\/jonathanischwartz.wordpress.com\/2010\/03\/09\/good-artists-copy-great-artists-steal\/\">major<\/a> <a href=\"http:\/\/www.infoworld.com\/t\/intellectual-property\/microsoft-amazon-strike-patent-licensing-deal-597?source=rss_infoworld_news\">patent licensor<\/a>.&nbsp;A central argument against tighter damage limits is that they will weaken patents in general. This is bad news for&nbsp;licensors, who rely on a healthy fear of litigation as part of their business models.<\/p>\n<p>But to most high-tech giants, weakened patents are not necessarily a bad thing.&nbsp;<\/p>\n<p><a style=\"TEXT-DECORATION: underline\" href=\"http:\/\/thehill.com\/special-reports\/patent-reform-june-2009\/47125-tech-giants-are-aiming-to-infringe\">Politicians like <span class=\"author\">Rep. Marcy Kaptur<\/span><\/a> (D-OH) have gone so far as to say that companies seeking tougher damage limits, are &#8220;aiming to infringe&#8221; and not just trying to protect themselves from wrongful lawsuits. <\/p>\n<p>It remains to be seen whether tech giants&#8217; lobbying efforts will be enough to get a damage limits measure tacked on. If not, we should expect to see more of the same&nbsp;<a style=\"TEXT-DECORATION: underline\" href=\"http:\/\/www.bloomberg.com\/apps\/news?pid=newsarchive&amp;sid=acishqhFv2uc\">blockbuster lawsuits<\/a>&nbsp;and <a href=\"http:\/\/jonathanischwartz.wordpress.com\/2010\/03\/09\/good-artists-copy-great-artists-steal\/\">licensing &#8220;protection rackets&#8221;<\/a>&nbsp;that have become par for the course in the high-tech industry.
