Rep. Diana DeGette and Rep. Louise Slaughter co-authored a  letter signed by 41 members of Congress, <a href=\"http:\/\/degette.house.gov\/index.php?option=com_content&amp;view=article&amp;id=881:pro-choice-members-vow-to-oppose-health-care-bill-that-restricts-a-womans-right-to-choose-any-further-than-current-law-&amp;catid=76:press-releases-&amp;Itemid=227\">which says quite clearly<\/a>:<\/p>\n<blockquote>\n<div class='wbq'>\n<p><strong>We will not vote for a conference  report that contains language that restricts women\u2019s right to choose  any further than current law.<\/strong><\/p>\n<\/div>\n<\/blockquote>\n<p>That seems pretty straight forward \u00a0 DeGette and Slaughter won\u2019t say  who signed the letter, though Jan Schakowsky, Mike Capuano,\u00a0 Mike  Quigley, Carolyn Maloney, Judy Chu and Betsy Markey have all said that  they did.<\/p>\n<p>Jane Harman, Ann Kirkpatrick, Mary Jo Kilroy, Gabby Giffords, Debbie  Halvorsen, Stephanie Herseth-Sandlin, Suzanne Kosmas,  Carol-Shea Porter, Dina Titus, Rosa DeLauro, Shelley Berkeley, Tammy  Baldwin and Chellie Pingree have all raked in big dollars from rich  pro-choice donors over the years by pledging to defend a woman\u2019s right  to choose with their dying breath. They just don\u2019t want to say whether  they signed the letter or not.<\/p>\n<p>So, does the language in the Senate bill negotiated to make Ben  Nelson happy \u201crestrict a woman\u2019s right to choose any further than  current law?\u201d\u00a0 The answer is an unqualified \u201cyes.\u201d Let\u2019s review:<\/p>\n<ul>\n<li>It allows states to <a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2009\/12\/19\/AR2009121902383.html\">opt  out<\/a> of allowing plans to cover abortion in the insurance exchanges,  a clear violation of Roe v. Wade.\u00a0 Since some state medicaid programs cover abortion as long as it is paid for with state money, the Hyde amendment (current law) obviously does allow insurance to cover abortion as long as it is paid through a separate non-federal funds.<\/li>\n<li>It <a href=\"http:\/\/www.rhrealitycheck.org\/blog\/2009\/12\/20\/the-nelson-compromise\">prohibits  insurance companies<\/a> <em>by law <\/em>from taking into account cost  savings when estimating the costs of abortion care, which raises  premiums, thus limiting access<\/li>\n<li>It includes \u201cconscience clause\u201d language that protecting both  individuals and entities that refuse to provide, pay for, provide  coverage for, or refer for abortion.<\/li>\n<\/ul>\n<p>Choice is already in grave danger with the current radical Supreme  Court majority, and every time Congress tinkers with this, it just  creates another opportunity for the Supremes to whittle away or reverse  Roe v. Wade.<\/p>\n<p>The bottom line:\u00a0 the Senate bill would deal a bigger blow to  abortion rights in this country than anything George Bush ever signed  into law.<\/p>\n<p>NOW President Terry O\u2019Neill <a href=\"http:\/\/news.firedoglake.com\/2009\/12\/19\/stupak-working-with-gop-leadership-to-undermine-abortion-language\/\">called  the Senate bill<\/a> \u201ca health insurance bill for half the population  and a sweeping anti-abortion law for the rest of us.\u201d<\/p>\n<p>Planned Parenthood\u2019s Cecile Richards said the Senate language would   leave \u201ctens of millions of women without abortion coverage,\u201d <a href=\"http:\/\/www.politico.com\/livepulse\/0310\/Planned_Parenthood_decries_Senate_abortion_language_.html\">and  called it<\/a> \u201cthe most significant restriction in access to abortion  coverage in the nearly 35 years since the U.S. Congress first adopted  the Hyde Amendment.\u201d\u00a0 She condemned the bill, saying \u201cit is a sad day  when women\u2019s health is traded away for one vote.\u201d<\/p>\n<p>An analysis done by <a href=\"http:\/\/news.firedoglake.com\/2009\/12\/22\/gwu-nelson-compromise-not-materially-different-from-stupak-amendment\/\">George  Washington University\u2019s School of Public Health<\/a> says \u201cbecause the  amendment reaches the design of the product itself, <strong>it extends  beyond the Hyde Amendment.\u201d<\/strong><\/p>\n<p><a href=\"http:\/\/www.prochoiceamerica.org\/issues\/abortion\/access-to-abortion\/health-care-reform.html\">NARAL\u2019s  called the abortion restriction in the Senate bill<\/a> a \u201cdangerous  provision.\u00a0 <a href=\"http:\/\/www.prochoiceamerica.org\/news\/press-releases\/2009\/pr12192009_healthreformsenate.html\">NARAL  President Nancy Keenan<\/a> called it \u201coutrageous\u201d\u00a0 and said \u201cthe  language regarding abortion coverage comes at too high a price for  reproductive health. Thus, we must oppose this new Nelson language.\u201d<\/p>\n<p>Good veal pen apparachicks that they are, however, neither NARAL nor  Planned Parenthood scored either the House or the Senate bill \u2014 making a  complete mockery of their entire scorecard system.\u00a0 The anti-abortion  groups certainly did.\u00a0 I guess Congress knows who means business.<\/p>\n<p>Put me down with <a href=\"http:\/\/blog.newsweek.com\/blogs\/thegaggle\/archive\/2009\/12\/19\/senate-makes-an-abortion-compromise-to-win-nelson-everyone-is-unhappy-except-nelson.aspx\">Newsweek\u2019s  Sarah Kliff<\/a>, who says \u201cwe hate this compromise.\u201d<\/p>\n<p>But Nancy Pelosi has said that the language in the Senate bill  regarding abortion will not change <a href=\"http:\/\/www.google.com\/hostednews\/ap\/article\/ALeqM5hJ40t0N7wq4o5GLbWHhub2aY83CQD9EDR1CO0\">in  the House bill she puts forward on Monday<\/a>.\u00a0 And Louise Slaughter,  co-author of the pro-choice letter, is proposing a \u201csolution\u201d whereby  the House <a href=\"http:\/\/www.cbsnews.com\/8301-503544_162-20000241-503544.html\">votes  to deem the Senate bill <\/a>\u201cautomatically passed\u201d once they pass a  \u201ccorrections\u201d bill.\u00a0 So it appears the head of the pro-choice caucus is  actively facilitating passage of Ben Nelson\u2019s attack on women\u2019s  reproductive rights.<\/p>\n<p>Despite what Barbara Boxer and Patty Murray said <a href=\"http:\/\/www.politico.com\/livepulse\/1209\/Boxer_affirms_support_for_abortion_deal.html\">when  they told Planned Parenthood and NARAL to get stuffed<\/a>, the Senate  language is not \u201cjust Hyde.\u201d\u00a0 As the George Washington University  analysis explicitly states, it\u2019s far worse than Hyde.\u00a0 Let\u2019s stop  pretending that simply getting Bart Stupak out of the picture is  suddenly some kind of sweeping victory for choice.<\/p>\n<p>So I only have one question.<\/p>\n<p><strong>Will DeGette, Slaughter, Schakowsky and other pro-choice  members of the House keep their promise to protect a woman\u2019s right to  choose, or will they sell them out so the Democrats can get a \u201cwin\u201d on a  health care bill that will do nothing until 2014 but send the stocks of  unregulated insurance monopolies soaring?<\/strong><\/p>\n<p class=\"tagList\">Tags: <a href=\"http:\/\/firedoglake.com\/tag\/ann-kirkpatrick\/\" rel=\"tag\">Ann Kirkpatrick<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/betsy-markey\/\" rel=\"tag\">Betsy Markey<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/carolyn-maloney\/\" rel=\"tag\">Carolyn Maloney<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/diana-degette\/\" rel=\"tag\">Diana DeGette<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/gabby-giffords\/\" rel=\"tag\">Gabby Giffords<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/jan-schakowsky\/\" rel=\"tag\">Jan Schakowsky<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/judy-chu\/\" rel=\"tag\">Judy Chu<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/louise-slaughter\/\" rel=\"tag\">Louise Slaughter<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/mary-jo-kilroy\/\" rel=\"tag\">Mary Jo Kilroy<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/mike-capuano\/\" rel=\"tag\">Mike Capuano<\/a>, <a href=\"http:\/\/firedoglake.com\/tag\/stephanie-herseth-sandlin\/\" rel=\"tag\">Stephanie Herseth Sandlin<\/a><\/p>\n<p class=\"akst_link\"><img decoding=\"async\" src=\"http:\/\/fdlaction.firedoglake.com\/wp-content\/plugins\/share-this\/share-icon-16x16.gif\" alt=\"Share This icon\" \/><a href=\"http:\/\/firedoglake.com\/?p=72734&amp;akst_action=share-this\"  title=\"Email, post to del.icio.us, etc.\" id=\"akst_link_72734\" class=\"akst_share_link\" rel=\"noindex nofollow\">&nbsp;<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>illustration by twolf1 Following the passage of the House health care bill, the outcry against Bart Stupak\u2019s amendment from pro-choice members of Congress was stentorious.
