Bob McDonnell&#8217;s (R-Va.) 2009 campaign was that his record as state attorney general was marked more by nuts-and-bolts accomplishments than by any noticeable right-wing crusade. New Attorney General Ken Cuccinelli has not really followed that playbook. Fresh off a controversy <a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2010\/03\/08\/AR2010030804999.html\">surrounding his attempted rollback<\/a> of anti-discrimination policy for gays, Cuccinelli &#8212; who pulled out of a CPAC event when a &#8220;birther&#8221; figure was included &#8212; is <a href=\"http:\/\/notlarrysabato.typepad.com\/doh\/2010\/03\/cooch-gone-wild.html\">caught on tape<\/a> discussing the possible strategies for a challenge to President Barack Obama&#8217;s eligibility.<span id=\"more-79230\"><\/span><\/p>\n<p><object classid=\"clsid:d27cdb6e-ae6d-11cf-96b8-444553540000\" width=\"425\" height=\"350\" codebase=\"http:\/\/download.macromedia.com\/pub\/shockwave\/cabs\/flash\/swflash.cab#version=6,0,40,0\"><param name=\"src\" value=\"http:\/\/www.youtube.com\/v\/Q-3nkQYONic\" \/><embed type=\"application\/x-shockwave-flash\" width=\"425\" height=\"350\" src=\"http:\/\/www.youtube.com\/v\/Q-3nkQYONic\"><\/embed><\/object><\/p>\n<blockquote>\n<p>Q What can we do about Obama and the birth certificate thing?<\/p>\n<p>CUCCINELLI: It will get tested in my view when someone\u2026 when he signs a law, and someone is convicted of violating it and one of their defenses will be it is not a law because someone qualified to be President didn\u2019t sign it.<\/p>\n<p>Q: Is that something you can do as Attorney General? Can you do that or something?<\/p>\n<p>CUCCINELLI: Well only if there is a conflict where we are suing the federal government for a law they\u2019ve passed. So it\u2019s possible.<\/p>\n<p>Q: Because we are talking about the possibility that he was not born in America.<\/p>\n<p>CUCCINELLI: Right. But at the same time under Rule 11, Federal Rule 11, we gotta have proof of it.<\/p>\n<p>Q: How can we get proof?<\/p>\n<p>CUCCINELLI: Well\u2026 that\u2019s a good question. Not one I\u2019ve thought a lot about because it hasn\u2019t been part of my campaign. Someone is going to have to come forward with nailed down testimony that he was born in place B, wherever that is. You know, the speculation is Kenya.
