{"id":491646,"date":"2010-03-30T16:19:53","date_gmt":"2010-03-30T20:19:53","guid":{"rendered":"http:\/\/blogs.edf.org\/texasenergyexchange\/?p=410"},"modified":"2010-03-30T16:19:53","modified_gmt":"2010-03-30T20:19:53","slug":"las-brisas-rubber-stamp-gone-missing","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/491646","title":{"rendered":"Las Brisas: Rubber Stamp Gone Missing"},"content":{"rendered":"<p><a rel=\"nofollow\"  href=\"http:\/\/blogs.edf.org\/texasenergyexchange\/files\/\/2009\/07\/jim226.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-36\" title=\"Jim Marston, Environmental Defense Fund, Energy Program Director\" src=\"http:\/\/blogs.edf.org\/texasenergyexchange\/files\/\/2009\/07\/jim226.jpg\" alt=\"\" width=\"94\" height=\"131\"\/><\/a>Yesterday, the law won.<\/p>\n<p>Texas state administrative judges Tommy Broyles and Craig Bennett just handed down a negative <a rel=\"nofollow\"  href=\"http:\/\/www.soah.state.tx.us\/Alerts\/LasBrisasPfdPage.asp\">decision<\/a> temporarily thwarting plans for a $3 billion petroleum coke-fired Las Brisas power plant in Corpus Christi.<\/p>\n<p>Their opinion <a rel=\"nofollow\"  href=\"http:\/\/www.soah.state.tx.us\/Alerts\/582-09-2005-CvrL.pdf\">letter<\/a> to the Texas Commission on Environmental Quality (TCEQ) stated that they have been unable to find grounds for approving the permit and this means that for now, Texans can breathe just a little bit easier.<\/p>\n<p>We applaud the administrative judges for reaching a decision that was clearly justified on both the facts and the law. The facts in the case against Las Brisas were overwhelming (see my <a rel=\"nofollow\"  href=\"http:\/\/blogs.edf.org\/texasenergyexchange\/2010\/01\/13\/las-brisas-strike-two\/\">January<\/a> post). Also, in addition to air pollution issues incorrectly outlined in the application, no one seemed to talk much about the added $100 million costs to build a water pipeline.<\/p>\n<p>Now it&#039;s up to TCEQ as they decide whether or not to grant the air permit.
