{"id":516666,"date":"2010-04-05T15:14:31","date_gmt":"2010-04-05T19:14:31","guid":{"rendered":"http:\/\/www.grist.org\/article\/2010-04-05-abandoning-congress-is-not-a-winning-strategy-for-climate-activi\/"},"modified":"2010-04-05T15:14:31","modified_gmt":"2010-04-05T19:14:31","slug":"abandoning-congress-is-not-a-winning-strategy-for-climate-activists","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/516666","title":{"rendered":"Abandoning Congress is not a winning strategy for climate activists"},"content":{"rendered":"<p>\t\t\t\tby Brad Johnson <\/p>\n<p>Cross-posted from the <a href=\"http:\/\/wonkroom.thinkprogress.org\/2010\/04\/03\/dont-abandon-congress\/\">Wonk Room<\/a>. <\/p>\n<p><\/p>\n<p>Senators drafting comprehensive climate and clean energy legislation are <a href=\"http:\/\/wonkroom.thinkprogress.org\/2010\/03\/26\/aeeg-pollutocrats\/\">negotiating with polluters<\/a>, and talking about <a href=\"http:\/\/wonkroom.thinkprogress.org\/2010\/03\/29\/sanders-kgl-bonanza\/\">combining a cap on carbon with public incentives<\/a> for nuclear plants, &#8220;clean coal,&#8221; and <a href=\"http:\/\/wonkroom.thinkprogress.org\/2010\/03\/26\/aeeg-pollutocrats\/\">offshore drilling<\/a>.<br \/>\nShould supporters of strong, progressive action to solve the climate<br \/>\ncrisis give up on Congress and work within the existing legal framework<br \/>\nof the Clean Air Act, Endangered Species Act, and other environmental<br \/>\nlegislation?<\/p>\n<p><\/p>\n<p>We would then rely entirely on the Environmental Protection Agency&#8217;s<br \/>\nexisting authority to set rules for greenhouse gas pollution. However,<br \/>\nthe EPA is <a href=\"http:\/\/wonkroom.thinkprogress.org\/2010\/02\/22\/jackson-ghg-weaken-delay\/\">subject to the same outside political pressures<\/a> as lawmakers, who control the EPA&#8217;s purse-strings. Single members of<br \/>\nCongress or single committee chairmen can interfere quite effectively<br \/>\nwith agency activities if they put their mind to it.<\/p>\n<p><\/p>\n<p>In addition, polluters have all kinds of legal tools they can&#8212;and<br \/>\nalready are starting to&#8212;use to tie up, slow down and otherwise impede<br \/>\nthe implementation of EPA rules. Without a Congressional mandate behind<br \/>\nit, the EPA will not have the political power it needs to implement<br \/>\nrules with the kind of strength activists want and the science demands.<br \/>\nThe success of EPA rules absent Congressional action would depend on<br \/>\nthe politics of whatever administration is in power.<\/p>\n<p><\/p>\n<p>By abandoning legislative reform, climate advocates could instead spend their resources on <a href=\"http:\/\/www.nytimes.com\/gwire\/2010\/03\/30\/30greenwire-brazen-environmental-upstart-brings-legal-musc-82242.html?pagewanted=4\">litigating against sources of global warming pollution<\/a>.<br \/>\nBut it also takes a lot of money and time to litigate against a coal<br \/>\nplant, and even more to win at it. Even if we could knock out all the<br \/>\nnew coal plants through litigation, that isn&#8217;t going to be a workable<br \/>\nstrategy for dealing with the ones that are already chugging away, not<br \/>\nto mention the refineries, chemical plants, and the rest of the<br \/>\nindustrial sector, or the transportation sector.<\/p>\n<p><\/p>\n<p>If climate legislation reaches President Obama&#8217;s desk with a robust<br \/>\nframework, and gets core elements in place, we will come back to it and<br \/>\nkeep making it better over time. We couldn&#8217;t get Congress to get the<br \/>\nClean Air Act right the first time. So the original 1967 law was<br \/>\namended&#8212;in 1970, then again in 1977, then again in 1990. This is why<br \/>\nstrong&#8212;and rapid&#8212;scientific review provisions are an important<br \/>\nelement.<\/p>\n<p><\/p>\n<p>It is a travesty that political reality makes it is incredibly<br \/>\ndifficult to get even a watered-down climate bill even into the<br \/>\nballpark of passage. To change that situation, we need to <a href=\"http:\/\/www.1sky.org\/\">mobilize grassroots activism<\/a> to change the political calculus for key states like Arkansas, Missouri, the Dakotas, Indiana, West Virginia, and so on.<\/p>\n<p><\/p>\n<p>At the same time, the federal legislative push shouldn&#8217;t be the<br \/>\nbasket where all the eggs are placed either; policymaking at the <a href=\"http:\/\/www.greenforall.org\/get-involved\">local, state, and regional levels<\/a> have always led the federal level, and the traditional Clean Air Act<br \/>\nframework is well-designed and understood. New climate legislation<br \/>\nshould integrate with existing policy through amendment, not blanket<br \/>\npreemption.<\/p>\n<p><\/p>\n<p>Anyone who wants to see a stronger bill can help make it happen by putting <a href=\"http:\/\/www.theleadershipcampaign.org\/\">meaningful pressure<\/a> on the <a href=\"http:\/\/www.eenews.net\/eed\/documents\/climate_debate_senate.pdf\">senators who are sitting on the fence or near it<\/a> to support strong climate legislation, and <a href=\"http:\/\/www.1sky.org\/about\/solutions\">being descriptive<\/a> in naming what you&#8217;d like to see legislation do.<\/p>\n<p><\/p>\n<p>That&#8217;s the only way to reduce the number of unappetizing deals that<br \/>\nare going to get made. Telling people that the vehicle that&#8217;s moving<br \/>\nright now is <a href=\"http:\/\/yglesias.thinkprogress.org\/archives\/2010\/03\/sanders-voices-concerns-about-emerging-senate-legislation.php\">hopeless and worthless<\/a> makes the sponsors&#8217; jobs that much harder&#8212;which means they&#8217;ll just cut more deals in order to get the bill done.<\/p>\n<p><\/p>\n<p>What&#8217;s critical for activists&#8212;including professional environmentalists&#8212;to remember is that the goal of climate activism isn&#8217;t comprehensive climate legislation, or strong<br \/>\nEPA enforcement of the Clean Air Act.
