{"id":519169,"date":"2010-04-07T08:43:46","date_gmt":"2010-04-07T12:43:46","guid":{"rendered":"tag:www.southernstudies.org,2010:\/\/5.12214"},"modified":"2010-04-07T09:03:17","modified_gmt":"2010-04-07T13:03:17","slug":"profit-baby-profit","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/519169","title":{"rendered":"Profit, Baby, Profit"},"content":{"rendered":"<p>        <span class=\"mt-enclosure mt-enclosure-image\" style=\"display: inline;\"><a href=\"http:\/\/www.southernstudies.org\/images\/sitepieces\/offshorerig2.jpg\"><img loading=\"lazy\" decoding=\"async\" alt=\"offshorerig2.jpg\" src=\"http:\/\/www.southernstudies.org\/assets_c\/2010\/04\/offshorerig2-thumb-250x246.jpg\" class=\"mt-image-right\" style=\"float: right; margin: 0pt 0pt 20px 20px;\" height=\"246\" width=\"250\" \/><\/a><\/span>President Obama&#8217;s drill-baby-drill (but not quite everywhere) gambit<br \/>\ndoes not only link him to an environmentally backward policy. It also<br \/>\nwill force his Administration to defend one of the most <a href=\"http:\/\/dirtdiggersdigest.org\/archives\/78\" >dysfunctional<\/a><br \/>\n federal programs in modern history: the Interior Department&#8217;s offshore<br \/>\noil and gas leasing system.<\/p>\n<p>Interior&#8217;s Minerals Management Service (MMS) is supposed to collect<br \/>\nroyalties from companies drilling in offshore public waters. After new<br \/>\nactivity was restricted in the wake of the devastating spill off the<br \/>\ncoast of Santa Barbara, California in 1969, the oil industry sought to<br \/>\nmake its leases more profitable by pressing for reductions in these<br \/>\npayments.<\/p>\n<p>In the mid-1990s, when energy prices were low, Big Oil got Congress<br \/>\nto expand the &#8220;royalty relief&#8221; provisions that were already in the Outer<br \/>\n Continental Shelf Lands Act of 1953. Royalties were supposed to return<br \/>\nto higher rates when prices rebounded, but things got complicated.<br \/>\nFirst, it <a href=\"http:\/\/www.nytimes.com\/2006\/02\/14\/business\/14oil.html\" >came to light<\/a> that MMS had failed to write those<br \/>\nprovisions into some 1,000 deepwater leases it signed in 1998 and 1999,<br \/>\nputting into question its ability to collect billions of dollars in back<br \/>\n royalties.<\/p>\n<p>While this was being sorted out, one of the drilling companies &#8212;<br \/>\nKerr-McGee (now part of Anadarko Petroleum) &#8212; filed suit challenging the<br \/>\n right of MMS to impose the higher royalties on any leases. The<br \/>\ncompany&#8217;s self-serving arguments found a sympathetic ear in federal<br \/>\ncourt. Last fall the Supreme Court <a href=\"http:\/\/www.reuters.com\/article\/idUSN0537765920091005\" >declined<\/a> to review an appellate ruling in favor of<br \/>\nthe company, thus allowing Anadarko to avoid paying more than $350<br \/>\nmillion in back royalties. For the industry as a whole, the Court<br \/>\nblocked the Interior Department from trying to collect on a bill that<br \/>\nthe Government Accountability Office once <a href=\"http:\/\/www.gao.gov\/new.items\/d08792r.pdf\" >estimated<\/a><br \/>\n could run as high as $53 billion.<\/p>\n<p>Then there&#8217;s the small matter of the wild parties and gifts that<br \/>\nindustry representatives lavished on MMS employees in charge of the<br \/>\nagency&#8217;s royalty-in-kind program. In September 2008 Interior Department<br \/>\nInspector General Earl Devaney (now in charge of the Recovery<br \/>\nAccountability and Transparency Board) issued <a href=\"http:\/\/www.propublica.org\/article\/new-reports-details-wide-ranging-ethics-scandal-at-interior-dept-910\" >three reports<\/a> describing gross misconduct at MMS,<br \/>\nincluding cases in which agency employees were <a href=\"http:\/\/dirtdiggersdigest.org\/archives\/185\" >literally<br \/>\n in bed<\/a> with the industry. Devaney <a href=\"http:\/\/s3.amazonaws.com\/propublica\/assets\/docs\/oig_devaney_letter_080909.pdf\" >concluded<\/a> that the royalty program was mired in &#8220;a<br \/>\nculture of ethical failure.&#8221;<\/p>\n<p>Not all MMS employees were bought off. Some agency auditors came<br \/>\nforward and <a href=\"http:\/\/www.nytimes.com\/2006\/09\/21\/business\/21royalty.html\" >charged<\/a> that they had been pressured by their<br \/>\nsuperiors to terminate investigations of royalty underpayments.<\/p>\n<p>Once the Obama Administration took office, Interior Secretary Ken<br \/>\nSalazar took steps to clean up MMS. Last September he <a href=\"http:\/\/www.nytimes.com\/2009\/09\/17\/business\/energy-environment\/17royalty.html\" >announced<\/a> plans to terminate the royalty-in-kind<br \/>\nprogram, whose staffers had been at the center of the sex and gifts<br \/>\nscandal.<\/p>\n<p>For a while it was unclear whether Salazar would tighten up the<br \/>\nremaining royalty programs. In fact, he <a href=\"http:\/\/www.chron.com\/disp\/story.mpl\/business\/6691828.html\" >told<\/a> the editorial board of the <em>Houston<br \/>\nChronicle<\/em> last fall that in some cases he thought drilling<br \/>\ncompanies should pay even lower royalty rates. He changed his tune this<br \/>\nyear, and the Administration is seeking <a href=\"http:\/\/www.pennenergy.com\/index\/petroleum\/display\/9391821362\/articles\/oil-gas-journal\/general-interest-2\/government\/2010\/03\/salazar-defends_proposed.html\" >modest increases<\/a> in royalties and fees.<\/p>\n<p>Yet the entire offshore leasing program still amounts to a giant<br \/>\nboondoggle. Thanks to the federal courts, artificially low royalty rates<br \/>\n are now effectively an entitlement for the drilling industry. <a href=\"http:\/\/query.nytimes.com\/gst\/fullpage.html?res=9B01E7DC1131F931A15751C1A9609C8B63\" >Research<\/a> conducted by the Interior Department<br \/>\nitself suggested that the incentives result in little additional oil<br \/>\nproduction. Not to mention the environmental risks.<\/p>\n<p>And now, thanks to a dubious calculation that making concessions on<br \/>\noffshore drilling will help prospects for a climate bill, the Obama<br \/>\nAdministration is bringing about a major expansion of a program that is<br \/>\ndisastrous even if there are no spills.
