{"id":520498,"date":"2010-04-08T12:19:53","date_gmt":"2010-04-08T16:19:53","guid":{"rendered":"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/?p=1337"},"modified":"2010-04-08T12:19:53","modified_gmt":"2010-04-08T16:19:53","slug":"legal-loophole-lets-smart-bus-off-the-hook-despite-causing-serious-accident","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/520498","title":{"rendered":"Legal Loophole Lets SMART Bus Off the Hook Despite Causing Serious Accident"},"content":{"rendered":"<h3>Tragic bus accident result shows why Michigan law must change<\/h3>\n<p><a href=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/wp-content\/uploads\/2010\/04\/michigan-bus-accident-lawyer.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-1339\" title=\"michigan-bus-accident-lawyer\" src=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/wp-content\/uploads\/2010\/04\/michigan-bus-accident-lawyer-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" \/><\/a><\/p>\n<p>Talk about putting form over substance. That\u2019s exactly what happened after a SMART <a title=\"Michigan bus accidents\" href=\"http:\/\/www.michiganautolaw.com\/truck-accident\/facts-causes\/bus-accidents.php\" >bus accident<\/a> caused serious injuries to a completely innocent woman. SMART bus relied upon putting form over substance to allow it to escape responsibility for serious, debilitating <a title=\"Personal injuries\" href=\"http:\/\/www.michiganautolaw.com\/injuries\/index.php\" >personal injuries<\/a> it caused one of its most vulnerable wheelchair-bound passengers.<\/p>\n<p>In <em>Eugene Rose v. Suburban Mobility Authority for Regional Transportation [SMART bus], et al.<\/em>, SMART bus got Eugene Rose\u2019s lawsuit thrown out of court by insisting it didn\u2019t have proper \u201cnotice\u201d of the injuries Ms. Rose suffered in a <a title=\"Detroit accident resource center\" href=\"http:\/\/www.michiganautolaw.com\/firm_profile\/local-resources\/Detroit-accident-resources.php\" >Detroit accident<\/a> involving one of its buses &#8211; even though SMART bus knew about both the bus accident and the serious nature of Ms. Rose\u2019s injuries.<\/p>\n<p>You see, Michigan residents are actually punished if they don\u2019t run to a lawyer right away after if they\u2019ve been injured in a bus accident. And they are punished in the most drastic way \u2013 they lose any right to sue for their injuries, no matter how serious or catastrophic those injuries may be.<\/p>\n<p>This is all because of a tiny loophole that requires strict notice be provided by accident victims within 60 days. No exceptions. No room for common sense. No regard for public policy or reaching a just result. And no case better illustrates this than what happened to Eugene Rose after her bus accident.<\/p>\n<p>On April 23, 2006, Ms. Rose, who was in a three-wheel, motorized wheelchair, rode as a passenger on a SMART bus. When the bus took a sharp turn, it caused Mrs. Rose&#8217;s unsecured wheelchair to tip over, throwing her to the floor. She suffered very serious injuries that were obvious at the scene.\u00a0 In fact, she was rushed to the hospital by ambulance, having suffered a fractured hip and left femur.<\/p>\n<p>SMART certainly knew instantly all about Ms. Rose and her injuries. It was a SMART bus that caused the accident, and the bus was being driven by a SMART bus employee.\u00a0 Reports had to be filled out. In fact, SMART bus received incident reports, as well as a police report, presumably, from both its own bus driver and from the property owner on whose property the accident occurred.<\/p>\n<p>Nevertheless, to avoid responsibility for the serious injuries it inflicted, SMART bus complained that Ms. Rose shouldn\u2019t be able to sue because she hadn\u2019t personally told SMART bus about her bus-accident-related injuries within 60 days of the accident.<\/p>\n<p>60 Days?<\/p>\n<p>Never mind that SMART bus had already been told what happened by its own driver and by a property owner.<\/p>\n<p>Sounds ludicrous, right?<\/p>\n<p>But what\u2019s even more ludicrous is it was enough to get SMART bus off the hook. SMART escaped all responsibility for causing Ms. Roses\u2019 injuries because she had not personally given SMART notice within 60 days.<\/p>\n<p>Sadly, four Michigan judges bought into SMART bus\u2019s argument. Wayne County Circuit Court Judge John A. Murphy relied on it to grant SMART bus\u2019s motion to dismiss, and <a title=\"Michigan Court of Appeals blogs\" href=\"http:\/\/www.michiganautolaw.com\/auto-lawyers-blog\/category\/michigan-court-of-appeals\/\" >Michigan Court of Appeals<\/a> Judges Deborah A. Servitto, Richard A. Bandstra, and Karen M. Fort Hood affirmed Murphy\u2019s decision to throw Ms. Rose\u2019s personal injury lawsuit out.<\/p>\n<p>It actually isn\u2019t their fault.\u00a0 Judges are duty bound to follow the law.\u00a0 The fault lies with our Michigan law. It&#8217;s very, very dumb. SMART took advantage of a very dumb law, with a public policy that could not be worse for Michigan residents and for all people who ride buses or depend upon public transportation.<\/p>\n<p>All of the judges agreed with SMART bus\u2019s \u201cform over substance\u201d contention that the \u201cnotice\u201d law for transportation authorities \u2014 which protects negligent bus operators like SMART bus at the expense of innocent, powerless, legally-untrained passengers like Ms. Rose \u2014 applied in this case to compel the dismissal of Ms. Rose\u2019s lawsuit.<\/p>\n<p>The law, <a title=\"MCL 124.419\" href=\"http:\/\/www.legislature.mi.gov\/%28S%285ydrea45cjebilnqs1afdy45%29%29\/mileg.aspx?page=getObject&amp;objectName=mcl-124-419\" >MCL 124.419<\/a>, says that any public transportation authority must have \u201cwritten notice of any claim based upon injury to persons or property shall be served upon the [transportational] authority no later than 60 days from the occurrence through which such injury is sustained \u2026\u201d<\/p>\n<p>That was enough for the judges.\u00a0 And that was it for Ms. Rose. \u201cThat SMART was provided an incident report by its own employee, and by the shopping center where the injury occurred does not suffice to meet [the statutory notice] requirement,\u201d the Court of Appeals judges said.<\/p>\n<p>Consequently, SMART bus will not be held accountable for the injuries its negligence caused Ms. Rose to suffer. And, to me, that\u2019s just plain dumb.<\/p>\n<p><em>&#8211; <a title=\"Steven Gursten bio\" href=\"http:\/\/www.michiganautolaw.com\/firm_profile\/attorney-steven-gursten.php\" >Steven M.
