{"id":526690,"date":"2010-04-13T18:59:26","date_gmt":"2010-04-13T22:59:26","guid":{"rendered":"http:\/\/www.grist.org\/article\/2010-04-13-how-green-are-obamas-potential-supreme-court-picks\/"},"modified":"2010-04-13T18:59:26","modified_gmt":"2010-04-13T22:59:26","slug":"how-green-are-obamas-potential-supreme-court-picks","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/526690","title":{"rendered":"How green are Obama&#8217;s potential Supreme Court picks?"},"content":{"rendered":"<p>\t\t\t\tby Jonathan Hiskes <\/p>\n<p>President Barack Obama<br \/>\nis <a href=\"http:\/\/www.cbsnews.com\/stories\/2010\/04\/12\/politics\/main6388904.shtml\">reportedly<br \/>\nconsidering<\/a> about 10 people to replace retiring Supreme Court <a href=\"http:\/\/feeds.grist.org\/article\/2010-04-09-what-justice-stevens-retirement-means-for-clean-energy-progress\">Justice<br \/>\nJohn Paul Stevens<\/a>, although popular consensus has quickly settled on just<br \/>\nthree: Elena Kagan, Diane Wood, and Merrick Garland. A National Journal <a href=\"http:\/\/ninthjustice.nationaljournal.com\/2010\/04\/experts-predict-kagan.php\">poll<\/a> of court-watchers picked Kagan as the most likely, with Wood and Garland as the<br \/>\nonly close contenders.<\/p>\n<p><\/p>\n<p>Obama&#8217;s choice will<br \/>\nhave a direct bearing on climate policy, as the court is likely to hear a<br \/>\nnumber of consequential cases in the coming years. It <a href=\"http:\/\/feeds.grist.org\/article\/supreme-slapdown\">already affirmed<\/a> the<br \/>\nEPA&#8217;s authority to regulate greenhouse gas emissions, but the agency is facing <a href=\"http:\/\/www.reuters.com\/article\/idUSN1661844120100216\">new legal<br \/>\nchallenges<\/a> to that authority from the state of Texas, among others. If<br \/>\nCongress passes a climate bill, it would face similar challenges. And towns<br \/>\nsuch as <a href=\"http:\/\/www.nytimes.com\/2010\/01\/27\/business\/energy-environment\/27lawsuits.html?scp=1&amp;sq=kivalina&amp;st=cse\">Kivalina,<br \/>\nAlaska<\/a>, threatened by the effects of carbon pollution, are pursuing public<br \/>\nnuisance lawsuits against fossil fuel companies, which could be appealed up to<br \/>\nthe Supreme Court.<\/p>\n<p><\/p>\n<p>So here&#8217;s a look at the<br \/>\nenvironmental records of these leading contenders:<\/p>\n<p><\/p>\n<p>&nbsp;<\/p>\n<p><\/p>\n<p>Courtesy <a href=\"http:\/\/commons.wikimedia.org\/wiki\/File:Elena_Kagan_2.jpg\">Doc Searls<\/a> via Wikimedia Commons<strong><\/strong><\/p>\n<p><\/p>\n<p><strong>Elena Kagan<\/strong><\/p>\n<p><\/p>\n<p>As Obama&#8217;s <a href=\"http:\/\/www.justice.gov\/osg\/\">solicitor general<\/a>, Kagan represents the<br \/>\nU.S. government before the Supreme Court. But because it&#8217;s her job to represent<br \/>\nthe government&#8217;s view, the work doesn&#8217;t reveal much about her judicial<br \/>\nphilosophy or environmental priorities. And she&#8217;s never served as a federal<br \/>\nappeals judge (unlike the other nominees and all current justices), or any kind<br \/>\nof judge, so she has no judicial record to assess.<\/p>\n<p><\/p>\n<p>One indicator of her<br \/>\nphilosophy is her six years as dean of Harvard Law School, from 2003 to 2009,<br \/>\nwhere she helped found the <a href=\"http:\/\/www.law.harvard.edu\/programs\/about\/elp\/\">Environmental Law Program<\/a>.<br \/>\nKagan lured the highly regarded environmental policy and regulation scholar <a href=\"http:\/\/www.law.harvard.edu\/faculty\/freeman\/\">Jody Freeman<\/a> from UCLA<br \/>\nto lead the program, one of the most prominent hires of her Harvard tenure.<br \/>\nKagan also launched an <a href=\"http:\/\/www.law.harvard.edu\/programs\/about\/elp\/clinic.html\">Environmental<br \/>\nLaw and Policy Clinic<\/a> that puts students to work on current cases.<\/p>\n<p><\/p>\n<p>&#8220;For many years,<br \/>\nHarvard was not known for a primary expertise in the environmental<br \/>\njurisprudence, and that changed under Dean Kagan&#8217;s watch,&#8221; environmental law<br \/>\nprofessor Jim Rossi <a href=\"http:\/\/www.nytimes.com\/gwire\/2009\/03\/26\/26greenwire-environmental-policy-a-specialty-of-obamas-sol-10309.html\">told<br \/>\nGreenwire<\/a> last year.<\/p>\n<p><\/p>\n<p>&nbsp;<\/p>\n<p><\/p>\n<p><strong><\/strong><\/p>\n<p><\/p>\n<p><strong>Merrick Garland<\/strong><\/p>\n<p><\/p>\n<p>The District of Columbia<br \/>\nCourt of Appeals judge is considered the insider&#8217;s choice&#8212;widely known and<br \/>\nliked in Washington legal circles, able to draw support from both Democrats and<br \/>\nRepublicans. Former Bush Justice Department official Ed Whelan called Garland<br \/>\n&#8220;the best that conservatives could reasonably hope for from a Democratic<br \/>\nPresident.&#8221;<\/p>\n<p><\/p>\n<p>That won&#8217;t excite<br \/>\nprogressives, but they might appreciate the role he played on the D.C. Appeals<br \/>\nCourt in repeatedly smacking down environmental shenanigans from the Bush<br \/>\nadministration EPA. In 2004, he wrote <a href=\"http:\/\/www.earthjustice.org\/library\/legal_docs\/DC_SIP_2-3-04_Decision.pdf\">the<br \/>\ncourt&#8217;s opinion<\/a> [PDF] that found the Bush EPA had deliberately dragged its<br \/>\nfeet on smog standards, ruling in favor of Earthjustice and the Sierra Club.<\/p>\n<p><\/p>\n<p>&nbsp;<\/p>\n<p><\/p>\n<p>Courtesy <a href=\"http:\/\/commons.wikimedia.org\/wiki\/File:Diane_Wood.jpg\">Linda Rux<\/a> via Wikimedia Commons<strong><\/strong><\/p>\n<p><\/p>\n<p><strong>Diane Wood<\/strong><\/p>\n<p><\/p>\n<p>Wood sits on the<br \/>\nSeventh Circuit Court of Appeals in Chicago, where she&#8217;s considered a liberal<br \/>\ncounterweight to conservative heavyweight Richard A. Posner. Her signature<br \/>\nenvironmental mark was defending the scope of the Clean Water Act in <a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/99-1178.ZS.html\">Solid Waste Agency<br \/>\nof Northern Cook County (SWANCC) v. U.S. Army Corps of Engineers<\/a>. The<br \/>\ncase questioned whether seasonal and non-navigable waterways should be<br \/>\nconsidered protected, a dilemma stemming from ambiguous language in the Act.<br \/>\nWood&#8217;s majority opinion held that regulations should apply to such waterways.<br \/>\nThe Supreme Court reversed that decision, however, limiting the reach of<br \/>\nclean-water regulation.
