After passing the House, the bill, called <br \/>\nthe S-MINER Act, died in a Senate committee.<\/p>\n<p><\/p>\n<p>Mining interests, who were opposed to this bill, gave twice as much money in <br \/>\ncampaign contributions to House members who voted against the bill as they gave <br \/>\nto members who voted in favor.<\/p>\n<p><\/p>\n<p>In the Senate committee where the bill died, mining firms gave more than <br \/>\ntwice as much money to committee members as the unions in <br \/>\nsupport.<\/p>\n<p>\nBackground<\/p>\n<p>The recent explosion at the Massey Energy coal mine in West Virginia that <br \/>\nkilled 29 coal miners has left many bewildered Americans questioning how the <br \/>\nfederal government could have prevented this tragedy. It has been reported that <br \/>\nMassey was <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210179\/22498\/goto:http:\/www.nytimes.com\/2010\/04\/10\/us\/10westvirginia.html\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210179\/22498\/goto:http:\/www.nytimes.com\/2010\/04\/10\/us\/10westvirginia.html\" >in violation of safety regulations<\/a> and that federal <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210180\/22498\/goto:http:\/www.nytimes.com\/2010\/04\/11\/us\/11mining.html?pagewanted=all\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210180\/22498\/goto:http:\/www.nytimes.com\/2010\/04\/11\/us\/11mining.html?pagewanted=all\" >regulatory oversight of mining conditions was <br \/>\nlax<\/a>.<\/p>\n<p><\/p>\n<p>In June of 2007, Rep. George Miller (D-Calif.) introduced the Supplemental Mine <br \/>\nImprovement and New Emergency Response Act <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210181\/22498\/goto:https:\/maplight.org\/us-congress\/bill\/110-hr-2768\/376113\/contributions-by-vote\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210181\/22498\/goto:https:\/maplight.org\/us-congress\/bill\/110-hr-2768\/376113\/contributions-by-vote\" >(S-MINER) Act<\/a>, which, according to the Congressional Research <br \/>\nService, would have supplemented existing mining provisions in the Federal Mine <br \/>\nAct to require: &#8220;(1) emergency response plans to incorporate new technology; (2) <br \/>\nthe Secretary of Labor to require the installation of rescue chambers in <br \/>\nunderground coal mines; and (3) accident response plans to provide for the <br \/>\nmaintenance of refuges.&#8221;<\/p>\n<p><\/p>\n<p>Miller chairs the House Committee on Education and <br \/>\nLabor, which issued a <a href=\"http:\/\/edlabor.house.gov\/publications\/SMinerSummary0108.pdf\" title=\"http:\/\/edlabor.house.gov\/publications\/SMinerSummary0108.pdf\" >report<\/a> stating: &#8220;The S-MINER Act aims to prevent disasters <br \/>\nand, in cases where disasters do occur, to improve emergency response. It also <br \/>\naims to reduce long-term health risks facing miners, such as black lung.&#8221; <br \/>\nSenator Patty Murray (D-Wash.) <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210182\/22498\/goto:http:\/frwebgate.access.gpo.gov\/cgi-bin\/getdoc.cgi?dbname=110_senate_hearings&amp;docid=f:35852.wais\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210182\/22498\/goto:http:\/frwebgate.access.gpo.gov\/cgi-bin\/getdoc.cgi?dbname=110_senate_hearings&amp;docid=f:35852.wais\" >explained<\/a> the bill was necessary because the 2006 MINER Act <br \/>\nprovisions had not been effectively enforced. So far, I am concerned that the <br \/>\nslow pace of reform is leaving America&#8217;s miners at risk. We&#8217;ve made progress. <br \/>\nBut [the Mine Safety &amp; Health Administration (MSHA)] has not moved <br \/>\naggressively to implement all of the provisions of the MINER <br \/>\nAct.&#8221;<\/p>\n<p>\nOpposition<\/p>\n<p>Two months after introduction of the bill, the Crandall Canyon mining <br \/>\ndisaster occurred, killing six miners in Utah. Even after this tragedy <br \/>\nhighlighted the dangers of industry standard practices and deficiencies of <br \/>\nregulatory oversight, the mining industry continued to oppose the bill. The <br \/>\nNational Mining Association&#8217;s Vice President for Safety, Health and Human <br \/>\nResources <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210183\/22498\/goto:http:\/edlabor.house.gov\/testimony\/072607NationalMiningAssociationStatement.pdf\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210183\/22498\/goto:http:\/edlabor.house.gov\/testimony\/072607NationalMiningAssociationStatement.pdf\" >testified<\/a> before the committee. &#8220;To be forced to respond to an <br \/>\nadditional layer of statutory requirements at this time will undermine the <br \/>\nprogress that has been made on miner training and other vital objectives of the <br \/>\nact. It is premature to consider imposing further legislation before the full <br \/>\nimpact of the original MINER Act can be comprehensively evaluated.&#8221; Further <br \/>\nopposition cited concerns about energy independence and job losses. Congressman <br \/>\nDon Young of Alaska (R) <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210184\/22498\/goto:http:\/www.youtube.com\/watch?v=3_kCEovQuiw\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210184\/22498\/goto:http:\/www.youtube.com\/watch?v=3_kCEovQuiw\" >argued<\/a>, &#8220;If this bill was to become law, mines will be shut <br \/>\ndown. They will be shut down.&#8221; The Bush Administration also strongly opposed the <br \/>\nbill, <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210185\/22498\/goto:http:\/www.whitehouse.gov\/omb\/legislative\/sap\/110-2\/saphr2768-r.pdf\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210185\/22498\/goto:http:\/www.whitehouse.gov\/omb\/legislative\/sap\/110-2\/saphr2768-r.pdf\" >claiming<\/a> that &#8220;several of the regulatory mandates in the <br \/>\nS-MINER bill would weaken several existing regulations and overturn regulatory <br \/>\nprocesses that were required by the MINER Act and are ongoing.&#8221;<\/p>\n<p>\nMoney and Votes<\/p>\n<p>After four <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210186\/22498\/goto:http:\/www.llrx.com\/extras\/mineimprovement.htm\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210186\/22498\/goto:http:\/www.llrx.com\/extras\/mineimprovement.htm\" >amendments were considered<\/a> and three passed, the House passed <br \/>\nthe <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210187\/22498\/goto:http:\/www.llrx.com\/extras\/mineimprovement.htm\">S-MINER Act<\/a> in January 2008. The bill subsequently died in the Senate <br \/>\nHealth, Education, Labor and Pensions (HELP) Committee. The HELP Subcommittee on <br \/>\nEmployment and Workplace Safety, chaired by Sen. Murray, met to consider the <br \/>\nbill. Only three members were present for the hearing. No further action was <br \/>\ntaken on this bill.<\/p>\n<p><\/p>\n<p>For the House vote, 25 House Democrats and nearly all House Republicans voted <br \/>\nagainst the bill. On average, House opponents received <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210188\/22498\/goto:https:\/maplight.org\/us-congress\/bill\/110-hr-2768\/376113\/contributions-by-vote\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210188\/22498\/goto:https:\/maplight.org\/us-congress\/bill\/110-hr-2768\/376113\/contributions-by-vote\" >103 percent more money from mining interests<\/a> than House <br \/>\nmembers voting Yes (an average of $12,526 to each member voting No, $6,174 to <br \/>\neach voting Yes). Democrats voting No received 197 percent more money from mining interests<\/a> than their <br \/>\ncolleagues voting Yes (an average of $16,314 to each Democrat voting No, $5,489 <br \/>\nto each votin g Yes).<\/p>\n<p><\/p>\n<p>Seven House Republicans, including West Virginia&#8217;s Shelley Capito, supported <br \/>\npassage of the bill, although they received little campaign funding from unions, <br \/>\nthe primary special interest MAPLight.org found to be supporting the <br \/>\nbill.<\/p>\n<p><\/p>\n<p>Members of the Senate HELP Committee received 122 percent more from the <br \/>\nmining interests than from the unions (see table below). Only three committee <br \/>\nmembers represent states that have a significant mining industry. Sen. Murray <br \/>\nreceived more than twice as much money from mining interests than any other <br \/>\nDemocrat on the committee, although her state of Washington is not ranked as a <br \/>\ntop mining industry state.<\/p>\n<p><\/p>\n<p>Don Blankenship, CEO of Massey and board member of the U.S. Chamber of Commerce, has spent millions <br \/>\nof dollars in personal funds to support judicial and state political campaigns, <br \/>\nincluding $3 million in <a href=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210191\/22498\/goto:http:\/abcnews.go.com\/print?id=10311477\" title=\"http:\/\/e2ma.net\/go\/6646554288\/208162365\/212210191\/22498\/goto:http:\/abcnews.go.com\/print?id=10311477\" >an attempt<\/a> to buy a West Virginia state Supreme Court <br \/>\njustice.
