{"id":547824,"date":"2010-04-30T09:05:55","date_gmt":"2010-04-30T13:05:55","guid":{"rendered":"http:\/\/climateprogress.org\/?p=23933"},"modified":"2010-04-30T09:05:55","modified_gmt":"2010-04-30T13:05:55","slug":"investors-call-for-massey-%e2%80%98safety%e2%80%99-directors-to-resign","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/547824","title":{"rendered":"Investors call for Massey \u2018safety\u2019 directors to resign"},"content":{"rendered":"<p>I don&#8217;t think it&#8217;s a big coincidence that we&#8217;re seeing all of these fossil fuel accidents after 8 years of lax oversight by Bush-Cheney (see <a title=\"Permanent Link to The deadly toll of the \u2019safe\u2019 and \u2018clean\u2019 coal and oil industries\" rel=\"bookmark\" href=\"http:\/\/climateprogress.org\/2010\/04\/23\/deadly-safe-clean-coal-oil-industry-lies\/\">The deadly toll of the \u2019safe\u2019 and \u2018clean\u2019 coal and oil industries<\/a>).\u00a0 The fox was guarding the henhouse.\u00a0 And in this case, the henhouse itself was not actually run by the hens.<\/p>\n<p>An investment group with ties to labor pension funds called for the  resignation of Massey Energy directors who are \u201c<a href=\"http:\/\/www.prnewswire.com\/news-releases\/ctw-investment-group-makes-case-to-shareholders-to-remove-three-massey-directors-92428979.html\">ultimately  responsible<\/a> for Massey\u2019s alarming safety compliance record.\u201d\u00a0 <em>Brad Johnson has the story in this<\/em><em> Wonk Room <a href=\"http:\/\/wonkroom.thinkprogress.org\/2010\/04\/29\/massey-safety-board\/\">repost<\/a>.<\/em><\/p>\n<p><em><span id=\"more-23933\"><\/span><\/em>The  Change to Win Investment Group \u201cpresented today an in-depth analysis to  shareholders of Massey Energy Company, making the case to vote against  the three directors up for election at the mining company\u2019s May 18  annual meeting, the first meeting of shareholders since the tragic April  5 explosion at Massey\u2019s Upper Big Branch mine in West Virginia, in  which 29 miners lost their lives.\u201d  In a letter to investors, CtW called  for the removal of directors responsible for the \u201cpreventable mine  explosion\u201d that &#8220;killed 29 miners and <a href=\"http:\/\/wonkroom.thinkprogress.org\/wp-content\/uploads\/2010\/04\/CtW-Inv-Grp-to-Massey-Shareholders-4-29-10.pdf\">destroyed  $1.1 billion in shareholder value<\/a>&#8220;:<\/p>\n<blockquote>\n<p><strong>We urge you to vote \u201cWithhold\u201d on directors  Richard M. Gabrys, Dan R. Moore and Baxter F. Phillips, Jr.<\/strong> at  the Massey Energy Company annual meeting on May 18. As members of the  Safety, Environmental and Public Policy Committee (SEPPC), these  directors are ultimately responsible for serious and systematic  non-compliance with mine safety laws over an extended period, a risk  oversight failure that likely led to the catastrophic and preventable  mine explosion on April 5 that <strong>killed 29 miners and destroyed  $1.1 billion in shareholder value<\/strong>.<\/p>\n<\/blockquote>\n<p>The investment group \u201cbelieves Massey Chair and CEO Donald  Blankenship\u2019s \u2018production first\u2019 emphasis fostered a management culture  that tolerated unacceptable safety and compliance failures.\u201d By  supporting Blankenship\u2019s drive for profits over rules, the members of  the Safety, Environmental and Public Policy Committee hold ultimate  responsibility for the deaths of Massey\u2019s miners.<br \/>\n<strong><\/strong><\/p>\n<p><strong>Don Blankenship\u2019s \u2018Safety\u2019 Overseers:<\/strong><\/p>\n<p><strong>Richard Gabrys<\/strong><br \/>\nOn Massey\u2019s board since 2007, Gabrys is \u201cthe <a href=\"http:\/\/people.forbes.com\/profile\/richard-m-gabrys\/20462\">retired  vice chairman<\/a> of Deloitte.\u201d He also serves on the board of the  Michigan-based companies La-Z-Boy Inc., <a href=\"http:\/\/michiganmessenger.com\/36982\/cms-energy-dte-energy-ties-to-appalachian-coal-raise-concerns\">coal-dependent  utility CMS Energy<\/a>, and engineering firm TriMas Corporation. Gabrys  has given $6000 to Republicans, including $1000 to George W. Bush, and  $500 to Rep. John Dingell (D-MI).<\/p>\n<p><strong>Dan R. Moore<\/strong><br \/>\nOn Massey\u2019s board since 2002, Moore is \u201cthe <a href=\"http:\/\/www.reuters.com\/finance\/stocks\/officerProfile?symbol=MEE&amp;officerId=207994\">Chairman  of Moore Group<\/a>, Inc., which owns multiple automobile dealerships in  West Virginia and Kentucky.\u201d He previously ran West Virginia\u2019s Matewan  Bank. Moore also serves on the board of the West Virginia University  Foundation, the Branch Bank and Trust Company, and the West Virginia  Housing Fund. Moore has contributed $8100 to Republicans since 2000.<\/p>\n<p><strong>Baxter F. Phillips<\/strong><br \/>\n<a href=\"http:\/\/people.forbes.com\/profile\/baxter-f-phillips\/51493\">Massey\u2019s  president<\/a> since 2008 and a top executive since 2000, Phillips  joined Massey in 1981. Phillips has contributed $8900 to Republicans and  $5950 to the Massey PAC.<\/p>\n<p>On April 19, Massey director Lady Barbara Thomas Judge <a href=\"http:\/\/www.prnewswire.com\/news-releases\/massey-energy-director-cedes-to-ctw-investment-group-demands-lady-judge-resign-from-massey-board-91567879.html\">resigned  amid shareholder unrest<\/a>.<\/p>\n<p>\u201cDuring times like these, a change in senior management is not  appropriate or in the best interest of our members and shareholders,\u201d  said Admiral Bobby R.
