Schwarzenegger&#8217;s signature environmental accomplishment, the 2006 Global Warming Solutions Act.Gov. Schwarzenegger&#8217;s OfficeBig Oil is nothing if<br \/>\nnot brazen, so while BP works to protect its tattered reputation in the Gulf,<br \/>\ntwo Texas oil companies are on the attack in California. Their target is <a href=\"http:\/\/www.arb.ca.gov\/cc\/ab32\/ab32.htm\">Assembly Bill 32<\/a>, the most<br \/>\nambitious cap-and-trade climate plan in the nation, which was signed into law<br \/>\nby Gov. Arnold Schwarzenegger (R) in 2006 and is set to really kick into gear<br \/>\nnext year. Their weapon is a ballot initiative that would mothball the plan<br \/>\nuntil state unemployment drops to below 5.5 percent for four consecutive<br \/>\nquarters (from a current 12.6 percent), which would effectively kill the plan<br \/>\nfor the time being.<\/p>\n<p><\/p>\n<p>Last week, a group<br \/>\nturned in 800,000 signatures in support of the initiative, ensuring it a place<br \/>\non state ballots in November. Texas refinery companies Tesoro and Valerog an attack on Gov. Schwarzenegger&#8217;s signature and<br \/>\nprivate donors have poured more than $1 million into the campaign. Clean-air<br \/>\nadvocates worry that figure could reach $50 million by year&#8217;s end.<\/p>\n<p><\/p>\n<p>The group works under<br \/>\nthe name <a href=\"http:\/\/www.suspendab32.org\/\">California Jobs Initiative<\/a>,<br \/>\nwhich is ironic given the threat it poses to jobs in the state&#8217;s growing<br \/>\ncleantech industry. The clean-energy sector has noticed the threat, and it&#8217;s <a href=\"http:\/\/www.nytimes.com\/cwire\/2010\/05\/13\/13climatewire-venture-clean-tech-sectors-brace-for-50-mill-97154.html\">partnering<\/a> with green groups and venture capital firms to build up its own war chest to<br \/>\ndefend the climate plan.<\/p>\n<p><\/p>\n<p>Schwarzeneger, for his<br \/>\npart, has stuck to his guns: &#8220;We have to do everything we can to fight<br \/>\nback and push back those greedy companies and make sure we protect our<br \/>\nenvironmental laws,&#8221; <a href=\"http:\/\/www.mcclatchydc.com\/2010\/05\/13\/94077\/schwarzenegger-touts-california.html\">he<br \/>\nsaid<\/a> last week.<\/p>\n<p><\/p>\n<p>Two ways this could<br \/>\nplay out:<\/p>\n<p><\/p>\n<p><strong>Worst-case scenario: Defeat<\/strong>. A successful ballot initiative would<br \/>\nbe catastrophic, and not just for clean-energy workers in California. The fight<br \/>\nis a symbolic proxy for the national battle over fossil-fuel pollution and<br \/>\nclimate legislation, and a victory for polluters in the nation&#8217;s most populous state<br \/>\nwould embolden them to try to repeal climate plans in other states.<\/p>\n<p><\/p>\n<p>&#8220;People see<br \/>\nCalifornia as ground zero in this fight,&#8221; Ann Nothoff, California advocacy<br \/>\ndirector for the Natural Resources Defense Council, told the <a href=\"http:\/\/articles.latimes.com\/2010\/feb\/06\/local\/la-me-ballot-warming6-2010feb06\/2\">L.A. Times<\/a>. &#8220;Polluters will do<br \/>\nanything to defeat climate legislation in Washington, D.C., even if it means<br \/>\nusing California as a pawn.&#8221;<\/p>\n<p><\/p>\n<p><strong>Best-case scenario: A long, expensive distraction.<\/strong> Even if the<br \/>\nmeasure fails six months from now, it still forces environmental groups to<br \/>\nspend scarce money and attention on defending an existing law when they want to be proactively campaigning for more progress.<\/p>\n<p><\/p>\n<p>In this way it works<br \/>\nthe same as concerted attacks on climate science or climate action plans.<br \/>\nPolluters don&#8217;t have to win public<br \/>\narguments over science or the best climate solutions. They just have to<br \/>\ncontinue attacking, keeping the public confused and the media covering the<br \/>\n&#8220;debate.&#8221; For them, the best defense is relentless series of attacks.<br \/>\nClean-energy advocates are stuck playing defense.<\/p>\n<p><\/p>\n<p><strong>The silver lining: Cleantech gets tough. <\/strong>If there&#8217;s a bright side<br \/>\nhere, it&#8217;s that California&#8217;s politically inexperienced clean-energy companies<br \/>\nand venture firms may learn to use their considerable funds and intellectual<br \/>\ncapital in the political arena. In February, cleantech executives traveled to Washington<br \/>\nfor a &#8220;fly-in&#8221; <a href=\"http:\/\/feeds.grist.org\/article\/2010-02-02-cleantech-execs-learn-to-lobby\">crash<br \/>\ncourse<\/a> on lobbying and media strategy. The attack on California&#8217;s climate<br \/>\nplan could hammer home some of the same lessons on the need for businesses to<br \/>\nengage with policy. Now <a href=\"http:\/\/www.nytimes.com\/cwire\/2010\/05\/13\/13climatewire-venture-clean-tech-sectors-brace-for-50-mill-97154.html\">Climatewire<br \/>\nreports<\/a> that cleantech firms and environmental groups are working to craft<br \/>\na unified response plan to the oil-company attacks.
