{"id":576600,"date":"2010-05-24T07:59:19","date_gmt":"2010-05-24T11:59:19","guid":{"rendered":"http:\/\/opiniojuris.org\/?p=12503"},"modified":"2010-05-24T07:59:19","modified_gmt":"2010-05-24T11:59:19","slug":"dershowitz-%e2%80%9cmy-job-today-is-to-delegitimize-international-law-%e2%80%9d","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/576600","title":{"rendered":"Dershowitz: \u201cMy job today is to delegitimize international law.\u201d"},"content":{"rendered":"<p><strong><em>by Julian Ku <\/em><\/strong><\/p>\n<p>The Jerusalem Post <a  href=\"http:\/\/www.jpost.com\/Israel\/Article.aspx?id=176243\">reports<\/a> on a recent discussion discussion between Alan Dershowitz, Aharon Barak, and Amnon Rubinstein on Israel&#8217;s proper attitude toward international law. \u00a0Each represented a different perspective. Barak (former Israeli Supreme Court chief) suggests that Israel must follow international law as it is, while Rubinstein argued that Israel should engage to make sure international law is interpreted fairly and reasonably against it. \u00a0And then there is Dershowitz&#8217;s position, which is (predictably), the most interesting and extreme position:<\/p>\n<blockquote>\n<p>Dershowitz charged that Israel was singled out for\u00a0<span id=\"IL_AD4\" class=\"IL_AD\">discrimination<\/span> by those who interpret international law, whether they are international tribunals like the International Court of Justice, human rights organizations or left-wing academics, including Israeli and Jewish ones.<\/p>\n<p>\u201cThe judges in the international tribunes are corrupt,\u201d Dershowitz said. \u201cThey are appointed by political leaders to do their state\u2019s bidding. You can\u2019t have one law for Britain, one for America and another one for Israel. You can\u2019t have different laws for thee and me. We see human rights turning into human wrongs or human lefts.<\/p>\n<p>\u201cMy job today is to delegitimize\u00a0international law, to attack it to the core. There must be one standard for all. Until that day happens, I will be its sworn enemy. I prefer no international law\u00a0to unfair\u00a0international law.\u201d<\/p>\n<\/blockquote>\n<p>Buried beneath Dershowitz&#8217;s colorful rhetoric (&#8221;sworn enemy&#8221;!) is a lot of legitimate criticism of how the laws of armed conflict are applied against Israel. \u00a0Since the Israeli government has been, in general, pretty sensitive to international law issues, its ultimate attitude toward this kind of international law is pretty important. \u00a0Interestingly, it is Dershowitz, the non-Israeli, who is recommending the most radical and aggressive position.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/feeds.feedburner.com\/~r\/opiniojurisfeed\/~4\/Bjhf3CqZyT0\" height=\"1\" width=\"1\"\/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>by Julian Ku The Jerusalem Post reports on a recent discussion discussion between Alan Dershowitz, Aharon Barak, and Amnon Rubinstein on Israel&#8217;s proper attitude toward international law. \u00a0Each represented a different perspective.
