{"id":580814,"date":"2010-05-26T19:40:29","date_gmt":"2010-05-26T23:40:29","guid":{"rendered":"http:\/\/www.grist.org\/article\/2010-05-26-the-federal-government-needs-to-take-command-of-the-disaster-res\/"},"modified":"2010-05-26T19:40:29","modified_gmt":"2010-05-26T23:40:29","slug":"the-federal-government-needs-to-take-command-of-the-disaster-response","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/580814","title":{"rendered":"The federal government needs to take command of the disaster response"},"content":{"rendered":"<p>by Brad Johnson.<\/p>\n<p><em>This post is co-authored by <a href=\"http:\/\/www.americanprogress.org\/experts\/KenworthyTom.html\">Tom<br \/>\nKenworthy<\/a>.<\/em><\/p>\n<p>There are obvious limits to how much control the federal government<br \/>\ncan exert over the frantic and so far hapless effort to stem the<br \/>\ncatastrophic oil eruption that threatens the entire Gulf of Mexico with<br \/>\necological devastation. As Coast Guard Commandant Thad Allen said<br \/>\nMonday, the government does not have the equipment or technical<br \/>\nexpertise to simply shove aside BP and its industry partners a month<br \/>\nafter the explosion of the Deepwater Horizon rig off the coast of<br \/>\nLouisiana. &#8220;To push BP out of the way, it would raise the question, to<br \/>\nreplace them with what?&#8221; Allen said.<\/p>\n<p>The Obama administration&#8217;s embattled and frustrated Interior<br \/>\nSecretary Ken Salazar, who on Sunday had threatened to do the pushing,<br \/>\nrecognized the sobering reality 24 hours later. &#8220;This administration has<br \/>\n done everything we can possibly do to make sure that we push BP to stop<br \/>\n the spill and to contain the impact,&#8221; Salazar said. &#8220;We have also been<br \/>\nvery clear that there are areas where BP and the private sector are the<br \/>\nones who must continue to lead the efforts with government oversight,<br \/>\nsuch as the deployment of private sector technology 5,000 feet below the<br \/>\n ocean&#8217;s surface to kill the well.&#8221;<\/p>\n<p>But if government has little choice but to keep the perpetrator on<br \/>\nthe job at the immediate crime scene, it does have a choice when it<br \/>\ncomes to operations beyond the urgent task of quelling the erupting<br \/>\nwell. BP will necessarily remain in charge of plugging the hole; but the<br \/>\n federal and state governments in the gulf must take greater charge of<br \/>\ncontaining the onshore ecological impacts.<\/p>\n<p>This requires a greater mobilization than exists today, and<br \/>\nWashington needs to send the message that it is in full command of the<br \/>\ndisaster response with the following actions:<\/p>\n<p>One highly visible leader at the White House should lead the<br \/>\ncommand and coordination at the cabinet level between the <a href=\"http:\/\/www.dhs.gov\/ynews\/testimony\/testimony_1274125488135.shtm\">Department<br \/>\n of Homeland Security<\/a>, the Department of the Interior, the<br \/>\nDepartment of Commerce, the National Oceanic and Atmospheric<br \/>\nAdministration, the Department of Energy, the EPA, the Department of<br \/>\nJustice, the White House Office of Energy and Climate Policy, the White<br \/>\nHouse Office of Science and Technology, and the Department of Defense.<br \/>\nTwo excellent choices for this role would be Vice President Joe Biden or<br \/>\n energy advisor Carol Browner. This leader should also work directly<br \/>\nwith the affected states&#8217; governors.<br \/>\n<br \/>\nThe Federal Emergency Management Agency should be in charge of<br \/>\nonshore coastal recovery and disaster response, assisted by the Army<br \/>\nCorps of Engineers. The <a href=\"http:\/\/www.ng.mil\/news\/archives\/2006\/08\/082806-Finest_Hour.aspx\">National<br \/>\n Guard<\/a> should be fully deployed under the control of each state&#8217;s<br \/>\ngovernor, with Army units if necessary. The EPA, NOAA, and U.S. Fish and<br \/>\n Wildlife Service should exercise relevant oversight. And any <a href=\"http:\/\/www.deepwaterhorizonresponse.com\/go\/doc\/2931\/559191\/\">environmental<br \/>\n and disaster response contractors<\/a> working for BP should instead<br \/>\nwork directly for the federal government.<br \/>\n<br \/>\nThe federal government should clearly be in charge of<br \/>\nsurface-water recovery and maritime disaster response. The <a href=\"http:\/\/www.deepwaterhorizonresponse.com\/go\/doc\/2931\/542683\">Vessels<br \/>\n of Opportunity<\/a> and other maritime contractors now working for BP<br \/>\nshould be under contract with the federal government, including research<br \/>\n vessels. The Coast Guard with the EPA, NOAA, and U.S. Fish and Wildlife<br \/>\n Service oversight should manage <a href=\"http:\/\/articles.latimes.com\/2010\/may\/23\/nation\/la-na-oil-spill-20100523\">dispersant<br \/>\n use<\/a> for cleanup.<br \/>\n<br \/>\nThe Environmental Protection Agency should immediately <a href=\"http:\/\/www.propublica.org\/feature\/epa-officials-weighing-sanctions-against-bps-us-operations\">bar<br \/>\n BP from new federal contracts<\/a>-including drilling in federally<br \/>\ncontrolled oil fields-because of its repeated environmental crimes.<br \/>\n<br \/>\nThe State Department should continue to reach out to other<br \/>\nnations that have experience with disastrous oil spills to see if<br \/>\nassistance and ideas are available. This should be a<br \/>\ngovernment-to-government effort, not one undertaken by private<br \/>\ncompanies.<br \/>\n<br \/>\nClaims for damages and lost revenues should be put under the<br \/>\nauthority of the <a href=\"http:\/\/www.uscg.mil\/npfc\/\">U.S. Coast Guard<br \/>\nNational Pollution Funds Center<\/a>. The scope of this disaster far<br \/>\nexceeds the NPFC&#8217;s traditional resources, and other federal, state, and<br \/>\nlocal claims processing resources must therefore be brought to bear,<br \/>\nparticularly from the Coast Guard&#8217;s sister agency FEMA.<br \/>\n<br \/>\nThe EPA, the Justice Department, the Internal Revenue Service,<br \/>\nand other law enforcement branches of the federal, state, and local<br \/>\ngovernment should exercise subpoena authority to <a href=\"http:\/\/www.csmonitor.com\/USA\/2010\/0521\/Feds-demand-that-BP-provide-confidential-Gulf-oil-spill-data\">seize<br \/>\n or monitor relevant communications and data collection<\/a>, and assets<br \/>\nif necessary.<br \/>\n<br \/>\nThe EPA and the Centers for Disease Control and Prevention<br \/>\nshould begin a health-monitoring program for the most at risk<br \/>\npopulations so there is a baseline from which to measure health<br \/>\ncomplications from the spill and cleanup.<br \/>\n<br \/>\nFederal agencies, not BP, should handle spill response hotlines<br \/>\nfor volunteers, <a href=\"http:\/\/www.msnbc.msn.com\/id\/37241470\/ns\/business-oil_and_energy\/\">technology<br \/>\n ideas<\/a>, affected wildlife, and others. Full call records need to be<br \/>\nlogged with incident reports and technology ideas presented publicly on<br \/>\ndynamic websites.<\/p>\n<p>BP is required as the responsible party for this apocalyptic disaster<br \/>\n to provide full and instant funding for the response by the federal,<br \/>\nstate, and local governments and their contractors. BP personnel and<br \/>\nequipment being used for disaster response in the Gulf should be put<br \/>\nunder governmental control during the crisis.<\/p>\n<p>BP&#8217;s funding should come in the form of an escrow account that draws<br \/>\non BP&#8217;s <a href=\"http:\/\/www.bp.com\/assets\/bp_internet\/globalbp\/globalbp_uk_english\/set_branch\/STAGING\/common_assets\/downloads\/pdf\/BP_Annual_Report_and_Accounts_2009.pdf\">$100<br \/>\n billion<\/a> in capital reserves, without limit. The federal government<br \/>\nshould require BP to use its first quarter 2010 profits&#8212;<a href=\"http:\/\/www.americanprogress.org\/issues\/2010\/04\/big_profits.html\">$5<br \/>\n billion<\/a>&#8212;to establish the escrow account. Congress needs to pass the<br \/>\n Big Oil Liability Bailout Prevention Act, S. 3305, to lift the<br \/>\nliability limit to $10 billion.<\/p>\n<p>The Center for American Progress also supports a full moratorium on<br \/>\nnew leases or new drilling for all companies until the commission issues<br \/>\n its report and recommendations. The Department of Interior has approved<br \/>\n at least <a href=\"http:\/\/www.nytimes.com\/2010\/05\/24\/us\/24moratorium.html\">17 new<br \/>\npermits and 19 environmental waivers<\/a> since the Deepwater Horizon rig<br \/>\n explosion.<\/p>\n<p>Congress and the administration must meanwhile take further steps to<br \/>\nend our dependence on big oil. The administration should beef up federal<br \/>\n research and development efforts into how to prevent oil spills and<br \/>\nbetter contain them if they occur. The federal government should<br \/>\nestablish additional protection for continental shelf areas beyond just<br \/>\nthe three miles states can control. Congress should cut tax loopholes<br \/>\nand other handouts to big oil companies, which would save $45 billion<br \/>\nover 10 years&#8212;money that can be spent on investing in a clean energy<br \/>\neconomy instead.
