{"id":646349,"date":"2013-03-12T14:20:20","date_gmt":"2013-03-12T18:20:20","guid":{"rendered":"http:\/\/gigaom.com\/?p=619694"},"modified":"2013-03-12T14:20:20","modified_gmt":"2013-03-12T18:20:20","slug":"t-mobile-metropcs-sails-through-fcc-without-even-a-vote","status":"publish","type":"post","link":"https:\/\/mereja.media\/index\/646349","title":{"rendered":"T-Mobile-MetroPCS sails through FCC without even a vote"},"content":{"rendered":"<p>The <a href=\"http:\/\/gigaom.com\/2012\/10\/13\/how-the-t-mobile-metropcs-merger-affects-consumers\/\">T-Mobile-MetroPCS merger<\/a> is apparently so uncontroversial that the Federal Communications Commission didn\u2019t even find a reason to vote on it. Instead of having the FCC\u2019s five commissioners review the merger, the agency\u2019s staff approved the deal in what is known a bureau-level decision, usually reserved for routine transactions.<\/p>\n<p>So far the T-Metro deal has sailed past regulatory obstacles. The U.S. Department of Justice <a href=\"http:\/\/gigaom.com\/2013\/03\/06\/justice-department-t-mobile-metropcs-merger-is-fine-by-us\/\">declined to initiate any antitrust review<\/a> last week. The deal\u2019s biggest remaining hurdle is a vote by MetroPCS shareholders on April 12. The MetroPCS board has already unanimously approved the deal, but <a href=\"http:\/\/gigaom.com\/2013\/03\/01\/shareholder-opposition-to-t-mobile-metropcs-tie-up-mounts\/\">institutional shareholders are opposing it<\/a>, trying to hold out for a better terms.<\/p>\n<p>The lack of a full commission review and vote is sure to earn the ire of the Communications Workers of America, which anticipated the FCC\u2019s move earlier this week and tried to stop it. The \u201cfull Commission has voted on much smaller transactions, including the $72 million Guam Cellular\/DoCoMo Guam transaction and the $2.8 billion AT&#38;T\/Dobson deal,\u201d CWA said <a href=\"http:\/\/www.cwa-union.org\/news\/entry\/t-mobile-metropcs_deal_will_result_in_significant_job_cuts_fcc_must_give_tr#.UT9WSOs4Up8\">in a statement<\/a> Monday. \u201cThere is no reason that the full Commission should not fully evaluate and assess all the elements of this $30 billion deal.\u201d<\/p>\n<p>Considering the deal would merge the country\u2019s fourth and fifth largest carriers, you\u2019d think the deal with merit the commission\u2019s full attention. But in <a href=\"http:\/\/www.fcc.gov\/document\/order-and-declaratory-ruling-approving-t-mobile-metropcs-applications\">its declaratory ruling<\/a>, the FCC\u2019s Wireless Telecommunications Bureau staff said that the benefits of the deal for competition and the public interest were numerous:<\/p>\n<blockquote id=\"quote-we-find-that-the-tra\">\n<p>&#8230; we find that the transaction is not likely to result generally\u00a0in competitive or other public interest harms. In addition, to the extent there may be some possible\u00a0competitive harms in selected geographic areas, we find that these possible competitive harms are\u00a0outweighed by certain public interest benefits likely to result from the proposed transaction.
