  • Le Mans 24 Hours Entry List Revealed

    This year’s entry list for the Le Mans 24 Hour race has been revealed earlier today, and out of the 55 places 21 will be filled by LMP1 cars. In the LMP1 class, Peugeot, last year’s winner, will enter this year’s event on a three-car effort. As teams only had to register one driver per car, Peugeot until now confirmed only Alexander Wurz, Nicolas Minassian and Sebastien Bourdais.

  • SlingPlayer iPhone App Finally Allowed to Stream TV Over 3G [At&t]

    When the SlingPlayer iPhone app launched last May, it was hamstrung by AT&T’s insistence that it stream video only over Wi-Fi. It was an untenable position, given that MLB.com and others already stream over 3G. Today, finally, the carrier relented.

    This has been in the works since mid-December, and both companies still need Apple’s sign-off before the new 3G SlingPlayer app is available. And don’t worry: if you’d previously purchased the $30 Wi-Fi only app, you’ll get a free upgrade once the new version is available.

    As for what it will do to AT&T’s already clogged 3G network, only time and a few dozen dropped calls will tell. [NY Times]






  • “The Fast & The Furious 5″

    The adrenaline-pumping The Fast & The Furious franchise is revving its engine for a fifth installment, Variety said Thursday.

    Universal has greenlit the project — tentatively-titled Fast Five — will find the Dom Toretto and Brian O’Conner on the run from the law. The feature is expected to reunite director Justin Liu and series stars Vin Diesel and Paul Walker — who withdrew from the franchise in the third film Tokyo Drift but returned for 2009’s Fast & Furious. Bringing in a global total of over $350 million, Fast & Furious was one of Universal’s highest-grossing films of the year.

    Fast Five will race into theaters next year.

  • Carrie Underwood “Soul Surfer” Movie [Bethany Hamilton Biopic]

    Carrie Underwood has been cast to appear alongside Dennis Quaid, Helen Hunt, and AnnaSophia Robb in the upcoming movie Soul Surfer, based on the life of Bethany Hamilton — the Florida teen who lost her arm in a shark attack several years ago.

    According to Variety, Bethany will be played by AnnaSophia, with Helen and Dennis cast as her parents. The recently-engaged Carrie will portray a youth leader at a church. Filming is currently underway in Hawaii. The film is expected to debut later this year.

  • Missouri man pleads guilty in $3.6 million mortgage fraud, money laundering scheme

    KANSAS CITY, MO — Beth Phillips, United States Attorney for the Western District of Missouri, announced that a Kansas City, Mo., man pleaded guilty in federal court today to his role in a mortgage fraud conspiracy that involved loans on 34 properties in the inner city and midtown areas of Kansas City totaling more than $3.6 million.

    Quentin Henley, 37, of Kansas City, pleaded guilty before U.S. Chief District Judge Fernando J. Gaitan this morning to the charges contained in a July 14, 2009, federal indictment.

    Henley did business as Quality Remodeling, as All and One Construction and as Corporate Remodeling Associates. Henley admitted that he participated in a mortgage fraud conspiracy from July 2003 to January 2009, in which he acquired residential properties at reduced rates for the stated purpose of rehabbing the properties, then renting or selling them.

    In reality, Henley did little or no work to rehab some of the properties.

    Henley and his co-conspirators submitted materially false, fraudulent and misleading loan applications and supporting documentation to mortgage lenders, all to induce the lenders to approve the applications and lend funds.

    Henley admitted that he caused mortgage lenders to make loans regarding at least 34 properties in the amount of at least $3,600,482.

    In addition to the mortgage fraud conspiracy, Henley also pleaded guilty to money laundering. Henley admitted that he engaged in a financial transaction that involved funds obtained by fraud.

    Under federal statutes, Henley is subject to a sentence of up to 15 years in federal prison without parole, plus a fine up to $500,000 and an order of restitution.

    A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.

    This case is being prosecuted by Assistant U.S. Attorney Linda Parker Marshall.

    It was investigated by IRS-Criminal Investigation and the Federal Bureau of Investigation.


  • Audi Confirms Drivers’ Lineup for 2010 Le Mans 24 Hours Race

    German manufacturer Audi will come to this year’s Le Mans 24 Hours race eager to wipe off the poor impression they left last year, when their newly-developed R15 TDI failed to beat its rival Peugeot 908 HDi FAP for the overall win. It was Audi’s first loss to the French manufacturer in the history of the competition, and the former plans to get even from as early as 2010.

  • Toyota admits Prius had a braking problem *UPDATED

    Toyota has received a lot of negative publicity for its sticking accelerator pedal and floormat recalls, and now brake problems with the Prius can be officially added to the list. While there were reports of some serious concern about the brakes in the best-selling hybrid, Toyota has now admitted that there are indeed known problems with the car’s anti-lock braking system.

    A Toyota spokesperson said on Thursday that Prius models sold before the end of January have this brake system design problem, but that the problem has been corrected on models sold since then, according to the Associated Press. The announcement follows Japanese and U.S. officials ordering the company yesterday to investigate around 180 claims of braking problems in the 2010 Prius.

    The Japanese automaker’s explanation for what causes the braking issue seems right in line with the possible explanation we posited yesterday. Long story short, the Prius has both a regenerative and friction braking system, and can apparently experience a short, temporary loss of braking during the transition between the two on slick or bumpy surfaces. Toyota calls it a “slight unresponsiveness” and it usually lasts under a second.

    While 2004-2009 Prius models are included in Toyota’s floormat recall and none are affected by the sticking accelerator pedal recall, the new third-generation model had remained above the fray completely until yesterday. And while a recall to fix the brake issue on these models has not been announced yet, it is being considered.

    UPDATE: The U.S. Transportation Department has opened an investigation into brake problems with the 2010 Toyota Prius after the company admitted it knew of the problem earlier this morning.

  • Eighth annual ‘Give Kids A Smile’ day provides free dental care to children

    With an economy that might cause some parents to postpone regular dental visits for their children and tooth decay being the most prevalent chronic disease in America’s children, the American Dental Association (ADA) is mobilizing dental professionals for the eighth consecutive year in a national campaign to extend necessary care to children and adolescents from low-income families.

    On Friday, Feb. 5, during the eighth annual ADA Give Kids A Smile® program, some 50,000 dental professionals will volunteer and provide free services for over 320,000 children at 2,000 sites throughout the country.

    Recent Centers for Disease Control and Prevention data show that tooth decay is on the rise for preschoolers.  In addition, children five to seven years of age are estimated to lose more than 7 million school hours annually because of dental problems.

    ADA’s major oral health outreach program

    Give Kids A Smile (GKAS) is the ADA’s major oral health outreach program, launched to encourage parents, health professionals and policymakers to address this important health issue.

    “We all know that a one-day event is not a delivery system and cannot solve the ongoing problem of untreated dental disease,” stressed ADA President Ronald L. Tankersley, D.D.S.

    “It is important that policymakers at the federal and state level strengthen dental provisions in public health programs to help put children on the road to good oral health.”

    At the various sites, GKAS dental volunteers will provide educational materials, screenings and, where possible, free dental care such as cleanings, X-rays and fillings.

    “Although many children will benefit from the services provided through Give Kids A Smile, our concern is for the countless others who continue to suffer from untreated dental disease,” said Dr. Tankersley.

    “We will continue to advocate for a larger and lasting way, through public policy, to ensure that kids who have been falling through the cracks in our delivery system receive the attention they need.”

    Give Kids A Smile events take place during February’s National Children’s Dental Health Month, through the volunteer efforts of dentists and dental team members and the generous support of corporate sponsors.

    In 2010, the Colgate-Palmolive Company will supply 300,000 toothbrushes and 300,000 tubes of toothpaste for GKAS events; DEXIS Digital X-ray donates the use of DEXIS Digital X-ray systems and support staff to U.S. dental schools requesting help; Henry Schein Dental will provide professional dental kits containing gloves, masks, patient bibs, dental floss, prophy paste and fluoride products.

    The ADA urges parents to make sure their children brush twice daily with fluoride toothpaste, floss daily, eat a balanced diet and see their dentist regularly to address tooth decay in its earliest stages.

  • Tobacco heir to speak out against tobacco at Saint Francis Hospital

    Saint Francis Hospital’s keynote speaker at HeartFest 2010 will be Patrick Reynolds, grandson of  cigarette company founder R.J. Reynolds and president of the Foundation for a Smokefree America.

    The keynote speech by Mr. Reynolds, a leading anti-smoking advocate, will be held Thursday, Feb. 18 at 1 p.m. in the auditorium at Saint Francis Hospital, 355 Ridge Avenue, Evanston, Ill.

    Mr. Reynolds will discuss the dangers of tobacco in his address “Tobacco Wars: the Battle for a Smoke-free Society.”

    Saint Francis Hospital’s annual Heart Festival includes free health information, physician lectures, a healthy cooking demonstration, and free health screenings.

    The festival runs from 10 a.m. to 2 p.m. at the hospital, with the keynote speaker beginning discussion promptly at 1 p.m.

    Patrick Reynolds lost his father, R.J. Reynolds, Jr., his oldest brother R.J. Reynolds III, his aunt and other family members due to cigarette-induced emphysema, heart disease, and lung cancer.

  • Fifteenth defendant sentenced in tribal drug investigation in Wisconsin

    MADISON, WI — Stephen P. Sinnott, United States Attorney for the Western District of Wisconsin, announced that Steven R. Lang, 30, Webster, Wis., was sentenced today in U.S. District Court in Madison by Chief U.S. District Judge Barbara B. Crabb for his role in distributing methamphetamine on St. Croix tribal lands from approximately 2005 to 2008. Chief Judge Crabb sentenced Lang to four years in prison without parole.

    With today’s sentencing, 15 defendants have now been sentenced as a result of this investigation into drug dealing on St. Croix tribal lands.

    As set out above, 15 defendants have now been convicted of federal drug offenses as a result of this investigation.

    Four additional defendants have pleaded guilty and are awaiting sentencing; six additional defendants were indicted on December 2, 2009, and are awaiting trial.

    Assistant U.S. Attorney John W. Vaudreuil is handling the prosecution of these cases.

    Yesterday, while addressing the Senate Democrats, Obama said:

    “Do you know what I think would actually make a difference…. If everybody here — excuse all the members of the press who are here — if everybody turned off your CNN, your Fox, just turn off the TV, MSNBC, blogs, and just go talk to folks out there, instead of being in this echo chamber where the topic is constantly politics.     Which immediately reminded me of this famous quote by Neville Chamberlain addressing England after “securing peace” with Hitler:

    “My good friends, this is the second time in our history that there has come back from Germany to Downing Street peace with honour. I believe it is peace for our time. We thank you from the bottom of our hearts. And now I recommend you to go home and sleep quietly in your beds.”

    This is not the time to turn off the news, stop reading blogs or to “sleep quietly in our beds.” I’m sure Obama and his administration would appreciate a lack of interest in politics so they can ram a health care reconciliation bill through and maybe Cap and Trade and Employee free choice with no one balking and without mass repercussions in the 2010 elections…

    So I recommend you delve deeper and, like they always said when Bush was in the White House, question everything. Dissent is Patriotic.

    Ugh. Do you know how hard it was to type that?! I’m totally annoyed with Sarah Palin because thanks to her I have to side with that horror show.

    I was driving around yesterday wondering where Palin’s Tea Party principles had gone… Let’s not even get into free speech here, Rahm didn’t give a statement on the evening news…he called THE FAR LEFT “F-ing RETARDED” BEHIND CLOSED DOORS. Private meeting, hello? An America where you can’t say that liberals are F-ing retarded? What kind of America is that? So, he apologized -under duress I’m sure and prompted by the manufactured rage I hate so much? Am I under-reacting? Would my response be different if one of my kids had Down’s? I really don’t think so. No. I’m 99% sure I’d be writing the same post.

    I’m curious when using the term ‘retarded’ became equivalent to using the N-word? Retarded means slow. You can retard something’s growth. It’s not a made up word just to denigrate someone. I understand being upset over ‘retard’…but retarded is an obsolete label anyway, isn’t it?

As the mother of special needs child, condemned Emanuel and demanded his resignation, prompting bloleague Jack Farrell to wonder why the conservative icon was suddenly embracing political correctness. Apparently Jack’s not the only one. Rush Limbaugh, also came to Rahm’s defense, in his own way, castigating “our political correct society” for “acting like some giant insult’s taken place by calling a bunch of people who are retards, retards.”

    So will Palin now turn on Limbaugh?

    I’m going to go with no.

  • Frances Reid, “Days Of Our Lives’” Alice Horton, Dies

    Soap opera legend Frances Reid — who played matriarch Alice Horton on NBC’s long-running daytime drama Days of our Lives for 42 years — passed away on Wednesday.

    The actress began her career with a small role in 1938 movie Man-Proof, before landing a string of jobs on Broadway. The actress was initially accept the part of Alice after appearing for 12 years on another television soap opera, Portia Faces Life. But Reid ultimately decided Alice was a character that deserved her consideration, and she made the role made a household name after the Days series’ premiere in Nov. 1965.

    Reid left Days of our Lives in Dec. 2007, but not before earning a Lifetime Achievement Award at the Daytime Emmys in 2004.

  • TV Station Issuing DMCA Takedowns To Try To Hide Weatherman Making A Bad Joke

    It’s been well documented how many people/organizations abuse the DMCA takedown process to try (and usually fail) to make content they don’t like disappear, even if there’s a legitimate reason for it being up. In the latest such example, a weatherman in Boston made a comment that many considered to be… a bit off-color for the local evening news. In discussing the snowfall in certain areas, he noted: “Picking up some snow are we? Yes we are. In Princeton we picked up 9 inches of snow and in Billerica we had 7.” Then there’s a brief pause before he steps forward and says: “The biggest amount I could find–almost as big as me–about 9 inches.”




    The station came up with an explanation for the statement, saying that he had a problem with his monitor and was displayed funny — and thought that the viewing audience could see him that way too. Perhaps.

    Still, though, the station, WHDH, has been aggressively issuing DMCA takedowns over the video (who knows how long the video above will stay up), even though it’s almost certainly fair use, and courts have found that those sending takedowns need to take fair use into account. Justin Silverman, over at the Citizen Media Law Project, explains succinctly why this is almost certainly fair use:


    In this case there’s a fairly strong argument that the 27-second clip of Bouchard is fair. The amount of the original broadcast used is very small, the purpose of the clip is to spur public discussion, and there is arguably no effect on WHDH’s news market. It’s likely WHDH either didn’t consider fair use before ordering the clip’s takedown, or it simply didn’t care.

    And that’s an issue. The DMCA allows copyright holders to shoot first and not care later. And that’s a problem, because it can put a serious crimp on public discussion (which raises some serious First Amendment questions). Yes, in this case, it’s just an off-color joke, but in many other cases it could be much more important speech.
