The iPad? What were they thinking? Didn’t they consider the implications of people mocking the name? “How will Twitter react?” Doesn’t Apple have a social media ninja on its payroll?
It’s a pesky vowel, “A.” Yes, it’s the first letter of the English alphabet, but it’s nowhere near as popular as the letter “E.” Maybe that’s it? Maybe they should have called it “iPed.”
Check with Twiter, call moot. Can “iPed” be mocked?
Ped, ped… Pedestal? Pedestals are fun. You put people on pedestals when you think they can do no wrong. Sounds perfect for Apple. They can do no wrong. Well, except for naming it “iPad.” That was obviously a horrible, horrible mistake.
Let’s try another vowel. How about “I”? “I” is good. It’s the first-person pronoun for me. I like me. (Who doesn’t? Oh, right: you.) But “iPid”? That sounds rubbish. Who makes that, Microsoft? Yeah, probably.
“iPud”? Now we’re talking. No! No, we can’t. P-U? That means it stinks. “I p-yood.” Can’t have people thinking the big iPod touch stinks. (It does stink, but that’s besides the point.) Not helpful. Go away, “iPud.”
Wait, idea! Maybe use “iPod” again? People liked the iPod until that home-wrecker, the iPhone, came and stole its heat. (“Heat” is a pro-wrestling term that means “popularity.”) Put two dots above the “O,” like they do in Fränce, and no one will know the difference. It plays music, right? (I honestly don’t know. All I know is that it’s a magical and revolutionary device that will change the game and that it will innovate markets and shift paradigms for the foreseeable future. Well, until the iPad S comes out.)
Clearly, though, it needs the name “i-Something.” “i-Things” sell well. Remember the Apple TV? Of course you don’t: none of you own one.
And what’s wrong with “iPad,” by the way? I mean, ignoring the fact that Fujistsu owns the rights to the name. It’s a perfectly good name made up of four perfectly good letters. Two vowels, two consonents. Anything more than that and you’ll start confusing people.
“Big iPod touch” just doesn’t roll of the tongue as nicely as “iPad.” Yes, that’s a much more descriptive name, but that’s not the point, now is it?
What else could they have called it? “Huge disappointment”? “Over-Hyped”? “ROFL, That’s It?” No, none of these will do. Not snazzy enough. Plus, too many letters—look at all those vowels.
Samsung announced recently that they will be mass producing 3D HDTVs. They are the first manufacturer to actually come out and say so, but I doubt they will be the last given the sheer volume of 3D technology we saw at CES. Samsung stated they will be producing three sizes initially, in 40-inch, 46-inch, and 55-inch screens. All three sizes will support the current 3D Active Glasses, which is currently the industry standard.
There’s no word on pricing or exactly when you’ll be able to pick them up as of yet, but it’s safe to assume that it will be sooner rather then later.

The company began producing LED and LCD compatible panels for 40-inch, 46-inch and 55-inch full-HD 3D TVs using ‘3D Active Glasses’ this month, employing Samsung’s exclusive true 240Hz technology.
Samsung’s true 240Hz technology delivers full-HD viewing in 2D, and also smooth, natural, full-HD 3D images that can vividly capture rapid movements.
By incorporating true 240Hz technology, operating at 240 frames per second, Samsung’s panels deliver a more lifelike picture with alternating left and right eye images through the use of 3D Active Glasses technology.
Samsung has reduced the response time of its LCD and LED panels by 20 percent to less than four milliseconds, eliminating any interference between left and right eye images. With this improved response time, Samsung is able to achieve natural 3D images and also deliver 2D pictures capturing rapid movement with exceptional clarity.
Samsung’s new 3D Active Glasses technology first blocks the left and then right lens, causing a momentary lag when images are shown to each eye to achieve more lifelike 3D images. The term, ‘3D Active Glasses,’ was selected as an official term by the Glasses Standardization Working Group of the Consumer Electronics Association (CEA) earlier this year.
The polarized glass method previously used in 3D glasses produced separate images for the left and right eyes, resulting in half the resolution of two-dimensional pictures as only half of the screen can be viewed through each polarized filter. Brightness was also lowered because of the polarized filter.
According to a market research firm, DisplaySearch, the 3D display market is expected to grow from $902 million in 2008 to $22 billion in 2018. The 3D TV market is expected to expand to a $17-billion market, with sales increasing from 200,000 units in 2009 to 64 million units in 2018.
Apple’s new iPad is pretty cool. After all, what’s not to love about a giant iPod touch that will make watching movies, reading books and newspapers, and browsing the web a much more compelling experience?
But considering that the iPad must be considered first and foremost an entertainment device, there are a few holes. Like the iPhone, the iPad will not have support for Adobe Flash, the technology that drives YouTube and most other web videos. On top of that, Netflix has announced that its streaming video service, Watch Instantly, will not support the iPad in the foreseeable future.
Adobe urged developers to convert Flash-based apps to iPad-compliant versions through its new Packager for iPhone tool. The conversion will allow apps to run just fine on the iPhone and iPod touch, but they still won’t be able to take advantage of the iPad’s larger 1024×768 screen resolution. Apple’s other mobile devices have 480×320 screen resolution.
No Flash Could Be an Issue for IPad
While the tool won’t immediately support the larger screen size, “it is our intent to make it possible for Flash developers to build applications that can take advantage of the increased screen size and resolution of the iPad,” Adobe’s Michael Chou said on a company blog.
Converting Flash apps for use on the iPhone or iPad is a start, but the absence of native support for Flash continues to be a hole in Apple’s version of mobile web browsing, especially considering the iPad is touted as the most satisfying way to surf the web on the go. This was embarrassingly obvious in CEO Steve Job’s demonstration of the iPad browsing The New York Times. The Times site features Flash-based videos, which Jobs was unable to play.

Turns out a camera in the iPad may have been closer than we thought — Engadget has been diving into the SDK released yesterday (NDAs be darned, I guess?) and discovered that the ability to “Take Photo” is still hidden in the iPad’s code. Of course, the device doesn’t actually have a camera, but the fact that there’s code written for one could mean that prototypes of the device did have a camera, and/or that we’ll eventually see one in a future revision.
There’s a few other interesting things sneaking out of the SDK as well, including the fact that “popovers” (those windows and menus that were popping up in the video yesterday) are listed in Human Interface Guidelines as iPad-only flair. That would make designing for the two platforms pretty different — while it’s certainly possible, as we learned yesterday, to run iPhone apps on the new platform, it seems like Apple is telling developers that iPad apps will have a very different feel than their smaller predecessor’s versions. A year from now, the two platforms may end up being different markets entirely.
Privacy is a touchy subject. In almost all cases, the more fame and fortune a person or company acquires, the more scrutiny they receive. And, out comes the trolls, worms and paparazzi.
Twitter and Facebook are the beacon examples of this issue. People like being famous, and we want followers! And the evidence shows, the more personal information we put out there, the more people consume it. Today, on International Data Privacy Day, we explore the social and technical norms and issues of privacy in the network and the cloud.

It is clear that both of these organizations have a stake in data privacy as the physical infrastructure moves into the cloud.
Is it a Technology Problem?
We’ve compiled a few considerations to keep in mind about the underpinning technologies that power our online lives. Hard questions keep coming to mind: Is the system that we use to communicate secure at all? Is it even possible to build a privacy-enabled application on top of the 2010 Internet?
Internet Protocol (IP) itself has been proven to be hackable in many ways, shapes and forms. Will it ever be possible to build a truly private experience on this protocol?
Can the communication networks win the encryption arms race? This month, the 64-bit 3G encryption used by a majority of mobile providers was cracked. Researchers quickly demonstrated that they could optimize around this weakness and penetrate the 3G encryption. Our voice traffic and data traffic can now be seen by others – anytime.
Anonymous data is not really anonymous. Paul Ohm’s recent paper illustrates how easy it is to take current best-practices in data management and prove they’re not worthy of our trust. “Scientists have demonstrated they can often ‘reidentify’ or ‘deanonymize’ individuals hidden in anonymized data with astonishing ease.”
Social networks are actually taking the opposite approach to privacy. Facebook is an astonishing example of where the rules of engagement have changed. Mark Zuckerburg’s recent statements that “privacy is no longer a social norm” show with remarkable clarity that it will be especially difficult to achieve privacy if we’re not actively trying.
Search history has been a constant issue with privacy. Google is in perhaps the most difficult position by both having the history of what we look for on the Web and a reason to sell it. Recently it was reported (again), with relatively little fanfare, that Google has a backdoor that allows the federal government to view the search history for a user. Yikes!
Virtualization and cloud computing come to the rescue (or not). The biggest trends in computing this year actually advocate taking data outside of private data centers and putting it into co-located computing centers, or running multiple instances of software on one physical host. The benefits are tremendous, but there are also significant unsolved privacy issues that are going to continue to lag the adoption of cloud solutions.
Or is it a Motivation Problem?
This all begs a question of motivation. Many companies monetize sharing data, or promote the existing state of affairs in the technology stack. Others have questioned whether it is desirable to have a tamper-proof private network solution, even if such a technology exists. Would that top technologies companies promote a private network to their customers.
Google may have a motivation problem. By monetizing heavily on “knowing” what we do, it is hard to see how Google will be the best guardian of our online data. Google clearly wants to do the right thing, but will the approach to data management ever catch up? That being said, major progress is going on at the company that tries to not do evil, including the recent launch of the Google Privacy Center and the establishment of the five privacy principles.
Cisco provides a good portion of the technology infrastructure for computing. Cisco was built on the IP and has wielded IP to its advantage in gaining traction in the enterprise and in voice networks. Would Cisco be willing to take an aggressive approach in guarding citizen privacy if it risked the networking architecture franchise?
Microsoft has been criticized and brought into court for its efforts that breach anti-trust and user privacy. Microsoft may be the most experienced company in the world when it comes to seeing the challenges inherent in having the keys to peek into a user’s data but choosing not to use it.
ATT is a network company that wants to avoid be relegated to a just a “dumb pipe”. The company has been brought to task in the past by the EFF and others for its use of private data and billing information. It seems that all the networks will be challenged in producing a truly private network. It is also a question of whether they have the ability – whether they’re blocked on in a technical or regulatory way – to monetize personal data enough to truly be a risk for citizens.
What Should a Mere Mortal Do?
The leading thought leaders have not been silent on the balance of privacy and trust. These leaders leave us with a bit of hope that smart people, rather than smart companies may offer solutions to online privacy.

2010 is going to be a very exciting year for BMW with some outstanding upgrades and additions to its 2011 model year lineup. The German automaker released a huge press release detailing the additions and upgrades and we’re going to highlight some of them so you don’t have to dig through the massive document.
BMW confirmed that the M5 will take a hiatus for the 2011 model year and a new M5 sedan based on the 6-generation 5-series is in the works. No official word on when the new M5 will debut.
The German automaker also announced that its new twin-scroll single turbo 6-cylinder N55 engine will debut in the new 135i (coupe and convertible), 335i (sedan, coupe, and convertible), 535i Gran Turismo and the X6 xDrive35i. The 300-hp twin-turbo N54 engine will continue to be offered in the Z4 sDrive35i. An upgraded version of the N54 making 320-hp will power the 74oi, Z4 sDrive35is and the 335is Coupe and Convertible.

Woodcliff Lake, NJ – January 25, 2010… BMW has announced an early, exciting start to its 2011 model year in the United States. Most BMW vehicles receive minor changes for MY2011 in the form of options and new or revised packages, but some models are either all-new (for example, the new BMW 5 Series sedan and BMW ALPINA B7) or substantially updated (3 Series Coupe and Convertible). For existing models, what will not change for the start of the MY2011 are base Manufacturer Suggested Retail Prices.
Highlight: Expansion of “Value Packages” for 1 and 3 Series Models In 2009, BMW introduced a “Value Package” – a $0.00 (No Charge) option that included leather upholstery and the integrated iPod adapter on the 5 Series and 328i/xi Sedans. As expected, the Value Package proved to be very popular, and as such, the concept is being extended to additional models. The $0.00 Value Package again includes leather upholstery and the iPod adapter as its key components but may also include several additional options, depending on the model.

Highlight: New “Convenience Package” Available for 1 and 3 Series Throughout 2009 BMW spent time talking to Dealers and Client Advisors about possible ways to improve our option offering and the value of our package structure. Based on this feedback from Dealers and Client Advisors on, BMW has developed “Convenience Package” for the 1 and 3 Series for MY 2011. This package brings considerable value to a number of options that share the theme of Convenience and are typically ordered together anyway. The Convenience Package content varies depending on the model but always includes the Alarm System, Comfort Access (keyless entry) and Park Distance Control. It retails for as low as $1,000 on the 135i Coupe and Convertible.

Highlight: New Inline 6 Cylinder Twin-Scroll Turbo Engine (N55) Beginning with MY2011 production, most models currently utilizing the twin turbo inline 6 cylinder N54 engine will switch to the new single twin-scroll inline 6 cylinder N55 engine. The new engine shares the same aluminum block as the previous engine but now uses a new cylinder head with BMW VALVETRONIC combined with a single twin scroll type turbo to deliver faster response and more efficiency. The performance figures remain the same at 300hp and 300 lb-ft torque but the efficiency improves by an impressive 7%. The new engine will be installed in the 135i Coupe and Convertible, the 335i Sedan, Coupe and Convertible, the new 535i Sedan when it arrives later this year, the 535i Gran Turismo arriving this spring and finally, the X6 xDrive35i.
The 300hp version of the twin-turbo N54 engine will continue to be offered in the Z4 sDrive35i and upgraded versions of the N54 will power the 740i/Li, Z4 sDrive35is, and the 335is Coupe/Convertible.
1 Series Coupe/Convertible The 2011 BMW 1 Series Coupe goes on sale this April with several improvements. In addition to the Value and Convenience Packages described above, the Cold Weather Package has been enhanced with a heated steering wheel and the retail price has been increased $150 from $600 to $750. A Harman Kardon Surround Sound System replaces the HiFi System Professional with no change in retail price ($875). In line with the very sporty nature of the 135i Coupe/Convertible, the 7-speed Double Clutch Transmission (DCT) replaces the STEPTRONIC automatic transmission with an option price of $1,575. The STEPTRONIC 6 speed automatic transmission will continue to be available on the 128i Coupe/Convertible for a retail price of $1,375.
Base MSRP (including $875 Destination & Handling) for all the 1 Series models remain unchanged for MY2011. The 128i Coupe and 135i Coupe start at $30,025 and $36,925, respectively. The 128i Convertible and 135i Convertible start at $35,075 and $41,225, respectively.
3 Series Sedan The 2011 BMW 3 Series Sedan goes on sale this spring, and each model features changes worthy of mention. Headlining the news is BMW’s all-new 300hp inline-6 engine for the 335i Sedan. BMW’s enthusiast-celebrated 6-speed manual transmission remains standard, and the 6-speed STEPTRONIC automatic transmission remains optional for $1,375. New shift paddles (left-shift down, right-shift up) for the STEPTRONIC may be added to the Sport steering wheel for $100 when the $2,150 Sport Package is ordered.
For the first time since its introduction, the BMW 335d Sedan is now available with the
M Sport Package for $3,750. On all 3 Series models, the optional Harman Kardon Surround Sound System replaces BMW’s HiFi Professional System.
The 328i Sedan and 335i Sedan start at $34,025 and $41,475, respectively, including $875 Destination & Handling. The 328i xDrive Sedan and 335i xDrive Sedan start at $36,025 and $43,475, respectively, including Destination & Handling. 5 Series Gran Turismo The BMW 5 Series Gran Turismo made its production debut at the Frankfurt Auto Show last fall and went on sale in December 2009 as a 2010 model. Therefore, it continues as a 2010 model this year, but there is still some news to report. In April 2010, the original BMW 550i Gran Turismo will be joined by the new 535i Gran Turismo, featuring BMW’s exciting new “N55” inline-6 engine. As the 550i Gran Turismo helped introduce the new 8-speed automatic transmission to the BMW line-make, the new 535i Gran Turismo will also feature the 8-speed automatic as standard. 0-60 mph acceleration will require only 6.2 seconds for the 535i Gran Turismo (5.4 seconds for 550i Gran Turismo). Compared to the 550i Gran Turismo, the 535i Gran Turismo features unique light-alloy wheel choices and forgoes some standard equipment, including auto-dimming mirrors, universal garage door opener, and Navigation system. Each 5 Series Gran Turismo model receives two new available exterior colors starting this spring, including Milano Beige and Damast Red. MSRP starts at $56,875 for the 535i Gran Turismo and $64,775 for the 550i Gran Turismo, including Destination & Handling.
5 Series Sports Wagon The BMW 5 Series Sports Wagon will continue through to the end of production in April as a 2010 model. The 535i xDrive Sports Wagon starts at $56,825 including $875 Destination & Handling.
6 Series Coupe & Convertible The BMW 6 Series Coupe and Convertible will continue as a 2010 models until the fall of 2010. The MY2010 650i Coupe and Convertible start at $79,325 and $86,425, respectively, including $875 Destination & Handling.
7 Series Sedan The 2011 BMW 7 Series Sedan line that goes on sale this April will be the widest range ever in its 23 year history, comprising a total of 11 models. Along with the 750i xDrive, the 750Li xDrive, and the 760Li introduced last fall for MY2010, the 7 Series line will be supplemented by several new models and enhancements for 2011.
740i and 740Li with twin-turbo Inline 6 Cylinder Power
The new MY2011 BMW 740i and BMW 740Li achieve a remarkable balance of power, efficiency, and sporty driving dynamics. Both models will go on sale in the United States as 2011 models in spring 2010. The 740i models feature BMW’s internationally acclaimed twin-turbocharged inline-6 engine (N54) with an output of 315 horsepower. BMW ALPINA B7 The 2011 BMW ALPINA B7 sedan will join BMW’s North American product range as the most dynamic 7 Series model. The BMW ALPINA B7 represents the second generation of ALPINA automobiles based on the BMW 7 Series to be offered in the US. The first BMW ALPINA B7 was offered as a limited edition for the 2007 and 2008 model years. Newly interpreted and based on the current BMW 7 Series platform, the B7 will again set the benchmark in terms of performance, refinement, technology, luxury and exclusivity.
Yielding exquisite levels of power and torque from the twin-turbocharged 4.4 liter V8, and in conjunction with the electronically-adjustable suspension with active roll stabilization, the new B7 promises to offer a spectrum of driving experiences so broad as to be unheard of in this class of automobiles. ActiveHybrid 7 On the heels of the ActiveHybrid X6, BMW announced the production versions of the all-new BMW ActiveHybrid 7, which also made its US premiere at the Los Angeles Auto Show in December 2009. The BMW ActiveHybrid 7 will reach American shores late in the second quarter of 2010 as a 2011 model. Based on the 5th-generation BMW 7 Series, this unique car sets new standards for performance and efficiency in the premium luxury class.
The symbiosis of a twin-turbocharged V-8 engine with a 3-phase synchronous electric motor gives the BMW ActiveHybrid 7 a combined output of 455 hp and maximum torque of 515 lb-ft from 2000 – 3000 rpm. Power is transmitted via an 8-speed automatic transmission with the electric motor positioned between the engine and the torque converter. The electric motor receives its supply of energy from a lithium-ion battery developed specifically for this automobile.
The BMW ActiveHybrid 7 accelerates to 60 mph in 4.7 seconds, while delivering fuel economy approximately 15% better than the 750i and 750Li. Z4 Roadster The all-new Z4 Roadster that was first introduced in the spring of 2009 will become a 2011 model this spring and offer the sport enthusiast with new several options.
First, a new M Sport Package is now available on the Z4 sDrive30i and the Z4 sDrive35i for $3,900 and $3,500 respectively. The M Sport Package includes the Adaptive
M Suspension, M Aerodynamic body package, 18” M light alloy wheels (with a 19” wheel option on the 35i), exclusive M exterior color Melbourne Red Metallic, M interior trim in Aluminum Carbon, sport seats, M door sills, footrest, gearshift lever, M steering wheel (with paddle shifters if equipped with Steptronic or DCT) and an Anthracite headliner. X3 Sports Activity Vehicle The 2010 BMW X3 Sports Activity Vehicle continues unchanged through to the end of production later this year. The current X3 will be replaced with a new generation X3 produced in at BMW’s Spartanburg, South Carolina assembly plant. The MY2010 X3 xDrive30i begins at $39,725, including $875 Destination & Handling.
X5 Sports Activity Vehicle The Model Year 2011 X5 models will begin production in April 2010. Detailed information on the MY2011 X5 models will be released later.
X6 Sports Activity Coupe The BMW X6 enters MY2011 with both increased efficiency and performance facilitated by the addition of an 8-speed automatic transmission and Brake Energy Regeneration. The result is that X6 xDrive35i accelerates from 0-60 mph in 6.3 seconds (reduced by 0.2 seconds) while the X6 xDrive50i gets to 60mph in 5.2 seconds (reduced by 0.1 seconds).
Option changes include the addition of Lane Departure Warning and Active Cruise Control as stand-alone options for $950 and $2,400 respectively. Side View Cameras were added to Technology Package of the X6 xDrive35i making the new package price $2,500 and increasing functionality. The new Camera package for the X6 xDrive50i now offers both Side View and Top View for a retail price of $1,200. M3
The M3 Coupe, Sedan, and Convertible models become 2011 models this spring . BMW ups the ante on the M3 Coupe and Sedan by offering a new “Competition Package” for MY2011. The package further enhances the highly responsive chassis by installing a 10mm lower suspension and 19” wheels with greater offset for a wider track. Combined with remapped Electronic Damping Control and Dynamic Stability Control systems, the M3 with Competition Package is the best handling production M car ever built.
The MSRP of MY2011 M3 Sedan, Coupe, and Convertible remain unchanged at $56,275, $59,275, and $67,925, respectively. All prices include $875 Destination & Handling. The Competition Package is available on the Coupe and Sedan models for $2,500.
M5 Sedan The car that invented the category of ultra-high performance sport sedan back in 1985 takes a hiatus for MY2011. A new M5 Sedan based on the upcoming 6th generation 5 Series is planned but not ready to be unveiled yet.

With new models, new engines and new packages, the BMW line-up for MY2011 will be strongest ever. Most of the 2011 BMW models including the new 5 Series and the 335is will debut at the New York International Auto Show in late March. With the few exceptions noted, the 2011 BMWs will arrive in US showrooms this spring.
Making a bit more hay from the msftkitchen UI development screen shot, if one blows up the screen pretty far, its clear on that particular screen is similar to the twist UI seen in Windows Mobile 6.5.3, with the swypable screens and text labels on top.
Of course this makes perfect sense, as Windows Mobile 6.5.3 is meant to be the low rent version of Windows Mobile 7, and co-exist at the same time. It makes sense that they share the same look and feel, but does limit the amount of UI innovation we can expect to see in the OS.

The much anticipated deal between Ford and Chinese manufacturer Geely Automotive whereby the latter is to acquire Volvo, is set to be signed on February 8 according to the Chinese Media. Estimates for the final sale-price have been put between $1.5 billion and $2 billion. Ford acquired the Swedish carmaker in 1999 for $6.5 billion and has poured billions into it.
A Chinese source says that Geely plans to almost double Volvo’s production with the construction of a plant outside Beijing, and expects a return to profitability by 2011.
Chinese web site 163.com reports that the XC60 crossover could be the first model produced. The S40 and S80 sedans are already produced in China by a Ford-Mazda joint venture.
We should probably be well past this stage of speculation by now, but who can stand not exploring every little clue regarding the mystery of Windows Mobile 7.
As we posted earlier, msftkitchen posted this blurry screen shot of Windows Mobile 7 UI development in action, and to an HTC HD2 owner the proportions of the device pictured look immediately familiar, especially the narrow bezel.
Overlaying the device over a real HTC HD2 shows the screen to be in exactly the right spot, indicating at the very least that the skin being used for the device in their UI development software was modelled after the HTC HD2.
If we try the same on the TG01 for example the screen is no longer in the right position. And of course the TG01 has a resistive screen, which would be useless for the multi-touch demoed in the screenshot.

If true, this would be good news for HTC HD2 owners, as this would mean early builds of WM7 for the HTC HD2 should almost certainly start floating around soon.

Today is day three of the seventh round of ACTA negotiations, currently taking place in Guadalajara, Mexico.
La Quadrature Du Net is a French advocacy group formed to promote digital rights and online freedom. Its name comes by analogy between the unsolvable mathematical problem of “squaring the circle”, and similarly impossible attempts to “effectively control the flow of information in the digital age by the law and the technology without harming public freedoms, and damaging economic and social development”. In our ongoing series of perspectives on ACTA from around the globe, today Jérémie Zimmermann and Félix Tréguer of La Quadrature du Net describe how the trade agreement undermines democratic challenges to IP policies in France and beyond.
ACTA: An agreement between lobbyists who hate democracy
For the past fifteen years, with the advent of the networked society, we have seen a growing confrontation between rightsholders, whose business-models rely on the control of culture, and ordinary citizens. Recently, a new battle has emerged, as a growing number of policy-making arenas consider implementing “three-strikes” schemes and Net filtering practices to deter filesharing.
In these important debates, citizens and public-interest groups have scored a few successes, convincing lawmakers that such proposals are at their core irreconciliable with fundamental rights and freedoms. Our own victories include amendment 138 in the Telecoms Package by the European Parliament &mdash which provided that no restriction on users’ access to the Internet could be imposed without a judicial decision —, and the groundbreaking first decision of the French Constitutional Council on HADOPI, stating that the French Declaration of the Rights of Man implied the “freedom to access [public online communication] services”. 1.
However, in the face of such opposition in traditional democratic forums, rightstholder lobbyists 2 have pushed for a global agreement that would establish extremist IP enforcement standards to all signatory countries.
As a result of this effort, ACTA is being negotiated outside of the traditional and relatively transparent IPR policy-making arenas, such as the WTO or WIPO. As made clear by a leaked summary of the draft Internet chapter of ACTA written by the Commission, this multilateral agreement could impose three-strikes schemes and Internet filtering practices:
To benefit from safe-harbours, ISPs need to put in
place policies to deter unauthorised storage and transmission of IP infringing
content (ex: clauses in customers’ contracts allowing, inter alia, a graduated
response).
This policy laundering endeavor on the part of the EU, the US and their home-grown IPR lobbies needs to be strongly opposed. Since the adoption of the TRIPS agreement in 1994, other countries have been compelled to implement increasingly harsher IP regimes. Bit by bit, the already shaky balance found in TRIPS between rightsholders and users of informational goods is neutralized at the expense of the latter.
The EU and the US have put an increasing pressure on countries such as Canada or Brazil – who understand the value of flexible copyright and patent laws for fostering free speech and democracy, social justice and development3. Through bilateral and multilateral agreements, international trade law is aligning with the most maximalist IP regimes that benefit only a few corporations located in the richest countries4. Even worse is the fact that such trade agreements are debated out of way of public scrutiny (although they significantly impact domestic law and go way beyond tariff regulations). Through undemocratic means, the development of an inclusive knowledge society is undermined.
But with copyright and patent law, more is not always better5 – especially for developing countries. This trend must be stopped. The ongoing negotiations on ACTA must be made transparent. Once these extremist IP enforcement measures are debated democratically, it will become clear that they do not rest on a principled basis and that they do not foster socio-economic progress. It is up to citizens and public-interest groups all around the world to act so that this fundamental debate can occur.

Yesterday, it was reported that Volkswagen will introduce a new performance division called R GmbH at the 2010 Geneva Motor Show. According to Inside Line, one of the fruits from R GmbH will be a R version of the upcoming sixth-generation Jetta. The model will push Volkswagen’s efforts to give the stateside lineup a greater number of image-leading performance models to attract younger buyers.
“Our modular construction and production process make it fairly straightforward. It’s now a matter of formulating a sound business case to ensure the car is profitable,” an executive told Inside Line. “We don’t want to leave the affordable performance sedan market in the US to our rivals but importing sporting models from Europe is proving prohibitively expensive at the moment.”
Power for the Volkswagen Jetta R is likely to come from a turbocharged 2.0L 4-cylinder direct-injection gasoline engine as used in the Golf R. The engine is good for 265-hp and 258 lb-ft of torque.
The model is rumored to be shown at the 2010 SEMA Show in November.

In the Fourth Assessment Report (AR4), issued in 2007 by the U.N.’s Intergovernmental Panel on Climate Change (IPCC), scientists wrote that 40 percent of the Amazon rainforest in South America was endangered by global warming.
But that assertion was discredited this week when it emerged that the findings were based on numbers from a study by the World Wildlife Federation that had nothing to do with the issue of global warming — and that was written by a freelance journalist and green activist.
According to Mike DiGiovanni, GM’s executive director of global market and industry analysis, leading economic indicators “are pointing to a robust recovery.” DiGiovanni said that GM is now increasing its sales forecast from the old 10.7 million – 11.7 million to 11.2 million – 11.7 million.
DiGiovanni said that GM raised the bottom of the range because of increased confidence in the strengthening economy.
The update brings the low-end of GM’s forecast in line with FoMoCo’s, which expects U.S. sales of 11.5 million to 12.5 million units.

You may recall back in December that we wrote about the oddity of EMI suing Vimeo, claiming that by creating its own “lipdub” videos of people singing along to a song, it was actively encouraging (i.e., “inducing”) copyright infringement. The main example, of course, was the company’s first lipdub, which kicked off the craze, to the song Flagpole Sitta by the band Harvey Danger:
To claim that this is somehow harmful to EMI is flat-out ridiculous. The song got a lot more attention because of this video (which currently has over 2.3 million views) — and almost certainly helped the band and EMI out in terms of sales. And yet, EMI says it was harmful. The Citizen Media Law Project points out that the lead singer of Harvey Danger appears to disagree in a big way, having sent Vimeo an email after that lipdub video came out:

Mercedes-Benz has officially kicked of series production of the new 2011 SLS AMG at its Sindelfingen plant, the largest Mercedes-Benz plant.
“Made in Sindelfingen also stands for the very highest production and product quality where the SLS AMG is concerned,” says Dr. Dieter Zetsche, Chairman of Daimler AG and CEO of Mercedes-Benz Cars. “From the end of March, our customers will be able to verify this for themselves.”
The 2011 Mercedes-Benz SLS AMG will be hand-built for the highest quality for the aluminium spaceframe, the engine and the final assembly. Market launch will begin in spring 2010.
Refresher: Power comes from a 6.2L V8 making 563-hp with a maximum torque of 479 lb-ft. Mated to an E-SELECT system that controls the AMG SPEEDSHIFT DCT 7-speed sport transmission, the SLS AMG can go from 0 to 62 mph in just 3.7 seconds (with the Race Start launch control system) with a top speed of 196 mph.

Hand-built for the highest quality: The Mercedes-Benz plant in Sindelfingen starts production of the SLS AMG
The new gullwing model is now at the starting line: following its world premiere at the International Motor Show in Frankfurt/Main in September 2009, series production of the SLS AMG is now commencing in Sindelfingen, the largest of the Mercedes-Benz production plants.
“The Mercedes-Benz SLS AMG has been extremely well received by our customers,” says Dr. Joachim Schmidt, Head of Sales and Marketing at Mercedes-Benz Cars. “Even in advance of the actual market launch, orders have considerably exceeded our expectations. In summer 2008 the Mercedes-Benz plant in Sindelfingen was presented with the J.D. Power Award by the renowned US market research institute J.D. Power and Associates. This award goes to the automobile production plant with the best delivery quality worldwide. “We are very proud that the new gullwing model is being produced in Sindelfingen. The J.D. Power Award for worldwide top quality will directly benefit buyers of the SLS AMG,” says Volker Mornhinweg, Chairman of the Board of Management, Mercedes-AMG GmbH.
Hand-production in three locations
A heavy emphasis on hand-production is a characteristic feature of the SLS – for the aluminium spaceframe, the engine and during final assembly. The chassis and aluminium bodyshell are produced by Magna Steyr Fahrzeugtechnik GmbH in Graz/Austria. This highly respected system partner is able to look back on many years of cooperation with Daimler, as the Mercedes-Benz G-Class has been in production there since 1979. Innovative joining techniques are used in the lightweight spaceframe of the SLS AMG, which tips the scales at only 241 kilograms. Hand-production is also the order of the day at the AMG engine workshops in Affalterbach, where the 420 kW (571 hp) AMG 6.3-litre V8 power unit is assembled on the “one man, one engine” principle.
The assembly lines and production facilities in Sindelfingen were brought up to the very latest standards for final assembly of the Mercedes-Benz SLS AMG. This is where specially selected, highly qualified specialists produce the gullwing model substantially by hand. Premium quality is not only ensured by continuous monitoring of the ongoing production process. At the end of the production process, the entire vehicle is subjected to further, extensive quality checks.

Market launch of the multiple award-winning Mercedes-Benz SLS AMG from 27th March, 2010
In Germany alone, the SLS AMG has received a number of major awards in recent months: for example the coveted “iF product design award 2010″ and the prestigious “Golden Steering Wheel 2009″ award. Other awards include the “Auto Trophy 2009″, “TOPauto 2010″ and the “Best new IAA product” award presented by AutoScout24.
The selling price of the SLS AMG is 177,310 EUR (incl. 19 % VAT) and sales will commence on 27th March 2010.
The west side of the 18-story Edith Green-Wendell Wyatt Federal Building is getting a 250-foot-tall green wall, writes The Washington Post. The western wall is also 150 feet long, making the expanse about “three-quarters the size of an NFL playing field, minus the end zones.” The federal building’s new wall is part of a $135 million remodeling mostly funded by federal stimulus funds. The U.S. General Services Administration (GSA) (see earlier post on GSA’s Design Awards) seeks to create a “landmark high-performance building.” According to The Washington Post, it’s the largest stimulus project in Oregon.
SERA Architects, the design firm for the building, will create seven vertical “vegetated fins” that will “jut at acute angles.” The fins act as a trellis and provide the foundation for the plantings. The architects are still working out which plants will grow well 250-feet in the air, and how to fertilize, water, and prune at those heights. High-rise pruners may be deployed in the same way skyscrapers get window washers. Additionally, rainwater will be collected on the roof and an elaborate irrigation system will water the wall.
The wall helps create a new look for an unloved “modernist, International style” federal building created in the 1970’s. In addition to removing and replacing the facade, the GSA will add new energy-efficiency features: “Elevators that generate electricity on the way down, solar arrays on the roof, smart lighting systems that adjust to the daylight available, using some of the collected rainwater to flush toilets.” Construction is expected to take 30-40 months.
Green Roofs for Healthy Cities told The Washington Post: “The GSA has been a real leader in the use of green roofs and walls. It’s nice to see the government leading by example.”

After saving nine lives during a two-week deployment to help earthquake victims in Haiti, an urban search-and-rescue team from Los Angeles is set to land back in Southern California this evening.
The 72-member team, which included doctors, structural engineers, firefighters, communications specialists and six search-and-rescue dogs, was expected to arrive at the L.A. County Fire Department station in Pacoima about 6:30 p.m., said Inspector Frederic Stowers.
"They were doing ’round-the-clock search-and-rescue missions," Stowers said.
In one of its rescue efforts, a crowd of Haitians applauded and chanted "USA! USA!" as team members carried a victim to safety.
The L.A. team’s mission was coordinated by the U.S. Agency for International Development to provide aid to victims of the magnitude 7.0 earthquake that hit the impoverished Caribbean island nation Jan. 12.
The team will be greeted this evening by their families and fire safety officials, Stowers said. It had last been partially deployed to New Orleans to help Hurricane Katrina victims.
