  • Troubling Ruling Against Web Hosting Firm: Your Liability Just Went Up

    Last year, we wrote about a troubling ruling against a web hosting firm, Akanoc, that was sued by Louis Vuitton for hosting some sites offering up counterfeit goods. We had trouble with the idea that a web host should be liable for what its users were doing, but some of the details that came out in the comment suggested that the hosting firm may have brought it upon itself by not responding to various takedown notices. Even so, the precedents set in this case are going to be applied to situations where the webhost wasn’t such a bad actor, and the latest ruling in that case is especially troubling on a variety of points (you can read the full ruling as well). While the common saying is that “hard cases make bad law,” at times easy cases can make bad law as well. That’s because in a case like this, where it seems clear that the web host was a “bad player” it’s easy to pile on the punishments, without realizing how those may get applied in other cases, with players who aren’t nearly as bad.

    Among the troubling aspects of this ruling, called out in Eric Goldman’s analysis above, followed by my own commentary:

    • posting photos of counterfeit goods constitutes direct copyright infringement

      Reading through the actual ruling, what happened here isn’t entirely clear, but it does seem troubling. The relevant part of the ruling states:


      Further, the Court rejects Defedants’ contention that the digital pictures of the counterfeit goods cannot constitute “copies” under the Copyright Act because Plaintiff’s copyright covers only physical goods… The Court finds no support for Defendants’ position in the language of the Copyright Act, which requires only that copies of a copyrighted work be “fixed by any method now known or later developed, and from which the work can be perceived reporduced, or otherwise communicated, either directly or with the aid of a machine or device.”… The digital pictures stored on Defendants’ servers fall squarelty within the statutory language. To find otherwise would render protection of a copyright meaningless by permitting, for example, unauthorized digital copies of a paper photograph to be noninfringing simply because the copy is embodied in a different medium than the original work. Thus, the Court finds that the evidence was sufficient to support the jury’s finding of direct copyright infringement.

      But, that “example” at the end seems to be quite different. From the basic description, this isn’t just a photograph of the official object, but a photograph of the counterfeit. Now, I could see how the counterfeit could be breaking trademark law, but why should a photograph of the counterfeit also be copyright infringement?

    • it’s become vogue to challenge copyright statutory damages on constitutional grounds, but this court rejects a due process challenge against both copyright and trademark statutory damages. A Gore challenge to the ratio of actual to “punitive” damages was inapplicable to statutory damages.

      Both the Jammie Thomas-Rasset case and the Joel Tenenbaum case have argued that the statutory copyright damages are unconstitutional on these grounds, using the Gore case as an example. Now the RIAA has a case to point to that says the Gore ruling isn’t applicable for statutory damages. This doesn’t mean that the unconstitutional claims won’t fly, but the lawyers making those arguments are going to have to dig deeper to make their case.

    • the defendant’s sole officer was personally liable for the infringements because he “had nearly complete control over Defendants’ operations. He was the general manager and sole owner of the corporate Defendants….He also held the principal decision-making authority as to responding to infringement notices, and he instructed his part-time employee regarding how to respond to such notices….Moreover, he was the designated agent under the DMCA for receiving infringement notices and decided whether or not to terminate offending customers.” Does this ruling imply that the person designated as the 512 agent for notice has an increased risk of personal liability…?

      Indeed, this is the most troubling part of the ruling. It basically could make the designated DMCA agent for any company potentially personally liable if he screws up in dealing with DMCA takedown notices. As Goldman notes later in his post: “What sucker will agree to be a 512 agent in the future?” It might not be that bad, because the court also seems to be saying that the fact that this guy ran the company by himself was part of the issue, but even that’s troubling. There’s a reason that people set up corporations, and that’s to protect the individuals from personal liability, even if it’s just a one-person company.

    Now, it may be clear that Akanoc did a number of questionable things here, but it’s resulted in a bad situation where a court can make rulings applying to a likely “bad actor” that will undoubtedly be mentioned in future cases relating to actors who weren’t necessarily so bad, and we may all suffer the consequences for it.

  • Angel Falls Photo album



    This is a great collection of photos of the great Angel Falls.  I find the name Kerepakupai merú somewhat curious as the word meru is used in India in association with a great sacred mountain that subsided millennia ago.
    It suggests a linguistic connection that I am not particularly surprised to find but still interesting.



    Angel Falls or Kerepakupai merú (which means “waterfall of the deepest place”, in Pemon language, or: “Parakupa-vena”, which means “the fall from the highest point”; Spanish: Salto Ángel) is the world’s highest waterfall, with a height of 979 m (3,212 ft) and a plunge of 807 m (2,647 ft). The waterfall drops over the edge of the Auyantepui mountain in the Canaima National Park (Spanish: Parque Nacional Canaima), a UNESCO World Heritage site in the Gran Sabana region of Bolívar State, Venezuela.

    The height of the falls is so great that before getting anywhere near the ground, the water is atomized by the strong winds and turned into mist. The mist can be felt a mile away. The base of the falls feeds into the Kerep River (alternatively known as the Río Gauya), which flows into the Churun River, a tributary of the Carrao River.

    The height figure 3,212 feet (979 m) mostly consists of the main plunge but also includes about 0.25 miles (400 m) of shallowly sloped cascades and rapids below the drop and a 100-foot (30 m) high plunge downstream of the talus rapids. While the main plunge is undoubtedly the highest single drop in the world, including the lower cascades somewhat stretches the criteria for the measurement of waterfalls. Some other waterfalls, such as Yosemite Falls in North America, also include intermediary cascades in their height figures, but, in the case of Yosemite Falls, the middle cascades are much steeper and have less run than those of Angel Falls.


    In the indigenous Pemon language Kerepakupai merú means ‘waterfall of the deepest place’. The falls are sometimes referred to as Churún-merú, an error, since that name corresponds to another waterfall in the
    Canaima National Park. Churún in the Pemon language means “thunder”.

    The waterfall was known for most of the twentieth century by the named ‘
    Angel Falls‘ after Jimmie Angel, an American aviator who was the first to fly over the falls in a plane. According to the British newspaper, The Guardian,President Hugo Chávez announced his intention to change the name to “Kerepakupai Merú” in 2009, on the grounds that the nation’s most famous landmark should bear an indigenous name. Explaining the name change, President Hugo Chavez was reported to have said, “This is ours, long before Angel ever arrived there…this is indigenous property.” However on December 23rd, President Chávez clarified that he will not decree the change of name, but only was defending the use of Kerepakupai merú.

    Angel Falls (Kerepakupai merú) is one of Venezuela‘s top tourist attractions, but, even today, a trip to the falls is a complicated affair. The falls are located in an isolated jungle region of Venezuela, and a flight from Caracas or Ciudad Bolívar is required to reach Canaima camp, the starting point for river trips to the base of the falls. River trips generally take place from June to December, when the rivers are deep enough for the wooden curiaras used by the Pemon guides. During the dry season (December to March) there is less water seen than in the other months.

    An alternative possibility is to purchase a package that includes an aerial flyby of the falls. However, since the falls cannot be seen on cloudy days, there is no guarantee visitors will see them from the air.






  • 1998 Volkswagen Scirocco Powered By Coffee Granules

    Coffee(Green Optimistic, March 9, 2010) Today, the auto field is dominated by vehicles running on electricity or other alternative sources of energy but there is a team from the BBC1 science program “Bang Goes the Theory” who believe that coffee too is a good fuel. They have converted a 1998 Volkswagen Scirocco to run coffee granules, reaching a top speed of 60mph.  Powered only by roasted coffee granules, the vehicle will be driven 210 miles between Manchester and London. The team wants to show that cars could be powered by fuels other than conventional diesel and petrol. According to the team, the “Carpuccino” will do three miles per kilo of ground coffee, being equivalent of about 56 espressos per mile.  For this trip about “11,760 espressos” are needed and the car’s coffee tank must be replenished with granules every 30 to 45 miles.  Click here to read more…

    usdaAgriculture and Food Research Initiative (AFRI) Foundational Program – The Department of Agriculture established the AFRI under which the Secretary of Agriculture may make competitive grants for fundamental and applied research, extension, and education to address food and agricultural sciences in six priority areas. The six priority areas include: 1) plant health and production and plant products; 2) animal health and production and animal products; 3) food safety, nutrition, and health; 4) renewable energy, natural resources, and environment; 5) agriculture systems and technology; and 6) agriculture economics and rural communities.  The purpose of AFRI is to support research, education, and extension as well integrated programs by awarding grants that address key problems of national, regional, and multi-state importance in sustaining all components of agriculture, including farm efficiency and profitability, ranching, renewable energy, forestry (both urban and agroforestry), aquaculture, rural communities and entrepreneurship, human nutrition, food safety, biotechnology, and conventional breeding.   • Superb Violinist Ray Chen Signs With Sony Classical

    Violinist Ray Chen, who captivated the classical music scene with his consecutive victories at the Queen Elisabeth Competition in 2009 (video below) and the Yehudi Menuhin Competition in 2008, has signed an exclusive multi-year recording contract with Sony Classical. In February of this year, Mr. Chen signed a worldwide general management contract with CAMI Music. His first album on Sony Classical, slated to be released at the end of 2010, will feature a selection of pieces – from Bach to Sarasate – that reflect the scope of Mr. Chen’s talent as well as his compelling personality. An orchestral recording dedicated to late 19th century virtuoso repertoire is planned for 2011.

    Born in Taiwan and raised in Australia, Ray Chen made his solo orchestral debut at the age of 8. He was accepted to the Curtis Institute of Music at the age of 15, where he continues to work with Aaron Rosand on expanding his repertoire. Mr. Chen plays the “Huggins” Stradivarius, on loan from The Nippon Music Foundation, and the 1721 Stradivarius known as “The Macmillan”, provided as part of the award for winning the 2008-09 Young Concert Artists International Auditions in New York.

    His recent performances, including debut recitals at the Kennedy Center in Washington D.C. and the Merkin Hall in New York, have enraptured both the audiences and the critics. “Ray Chen can do pretty much anything he wants on the violin” (Anne Midgette, The Washington Post). “From the first notes there was no doubt of being in the presence of something very special” (Dennis Rooney, The Strad).

    Mr. Chen’s rendition of Bach’s Double Violin Concerto became the much-discussed highlight of the 2009 Aspen Music Festival. Maxim Vengerov, who met Mr. Chen while serving on the jury of the Menuhin Competition in Cardiff, immediately engaged him to perform with the Mariinsky Theatre Orchestra in St. Petersburg as well as at the opening concert of the next Menuhin Competition in April 2010 in Oslo. “I have had the pleasure of knowing Ray Chen since his triumph at the Yehudi Menuhin Competition,” says Maxim Vengerov. “Ray has proven himself to be a very pure musician with great qualities such as a beautiful youthful tone, vitality and lightness. He has all the skills of a truly musical interpreter.”

    The first rocket to reach the moon had less computing power than the latest Sony VAIO series notebooks. Can a new Sony VAIO design, operate and launch a rocket? Find out at The Rocket Project.     These computers will be essential in the design stage, facilitating all Computer-Aided Engineering – CAD, aerodynamic simulation, computational fluid dynamics, dispersion analysis and Monte Carlo simulation. VAIO computers will also power the flight simulation software – ASTOS, RS-Pro, and Rocksim – and facilitate calculations for dispersion analysis, gas dynamics, aerodynamic stability, dynamic stability, structural loading, thermal heat transfer flux, fin flutter stability and much, much more.

    On April 12, 2010, the Rocket Project students will travel to the famous Black Rock Desert in Nevada to put their experiment to the ultimate test by launching their rocket as high as possible into the atmosphere. A VAIO computer will operate GPS tracking, telemetry, avionics monitoring, video and anything else the team can imagine.     Since the introduction of the third-generation Impreza, Subaru has been making incremental improvements to the rally-bred WRX, first with a significant bump in output for the 2009 MY and now the adoption of the STI‘s widebody design for 2011. And not only does the five-door model benefit from its pumped-up sibling’s sheetmetal, but the sedan gets a much-needed testosterone injection to boot.

    With a 1.5 inch-wider track front and rear, the 2011 Subaru Impreza WRX’s stance is decidedly more aggressive, and with firmer rear subframe bushings pulled from the STI and wider 17×8-inch wheels wrapped in 235/45R17 rubber, the 2011 ‘Rex is assuredly stickier than its predecessor.

    The cosmetic mods don’t end with the widened fenders, as the front fascia receives a restylized front lip spoiler, partnered with a larger, blacked-out grille and intakes. The whole package only increases the curb weight of the WRX by 34 pounds, and coupled with the “265-horsepower” turbocharged 2.5-liter flat-four, the 2011 WRX has the goods to back up its looks… no matter which body-style you choose.   • Aseptic diaphragm valve range extended to small nominal sizes

    The GEMÜ 654 stainless steel diaphragm valve has been extended to the small size MG8 (DN 4 – 15).

    An additional size has been added to the GEMÜ 654 valve range extending these to diaphragm size 8 (MG8) in nominal sizes DN 4 – 15. The bonnet is available with a seal adjuster but also with a stroke limiter as options. The seal adjuster in small valves in particular serves to protect the diaphragm against over-compression by the user and thus increases the service life of the diaphragm. The stroke limiter is used to manually set the required flow rate on fully opening the valve.

    The Kv values of the small valves are between 0.5 – 2.2 m³/h, depending on the nominal size and connection. The stainless steel valve bodies are from the proven GEMÜ modular system and are therefore fully compatible with existing equipment. Connections available are butt weld spigots, clamps and threaded connections to DIN, ASME BPE, BS and JIS. Valves with an EPDM diaphragm are suitable for use up to 10 bar and with PTFE diaphragm up to 6 bar operating pressure. The stainless steel handwheel and the bonnet are designed to be easily cleanable. The valves are CIP/SIP capable and autoclavable. With this extended size the GEMÜ 654 range is now available from DN 4 to DN 100.

AFRISO has evaluated all series DMU piezo-resistive pressure transducers relevant for the process industry according to IEC 61508 (basic) and IEC 61511 (process industry). Two different measuring principles are used to monitor relative and absolute pressure. The robust, ceramic thick-film sensors of series DMU 01 allow for pressure measurement of almost all gases and liquids that are not aggressive to the FKM seal used in the pressure channel. This aluminium oxide sensor is also available in a flush mounting version for abrasive media such as bulk solids. The oil-immersed silicon measuring cells of series DMU 03 and DMU 04 are adapted without seals to the front-mounting process connections. The DMU 08 transducer with the same measuring principle is used for hydrostatic level measurement. All DMU pressure transducers were rated SIL 2. The safety-related characteristics are provided via the manufacturer’s declaration. As a result of the evaluation, these two sensor systems can be used in potentially explosive areas with measuring ranges from 40 mbar to 600 bar and vacuum. The new SIL pressure transducers DMU from AFRISO are used, for example, in biotechnology, chemical and gas applications, plant engineering, the semiconductor industry and process technology applications.

    It looks like the vote will pass, though the Senate will have plenty to say about it before things are said and done. Nancy Pelosi has just condemned many of her party, including herself, to an ignominious retirement.
