  • Investor run-down of FHA flipping; News from the SAFE Act, Thornburg; Why rates may not skyrocket after 3/31

    A loan agent was seen leaving a title company. "TGIF!" she exclaimed. "Thank God it’s Friday?" "No, Thank God it’s Funding!"

    In the mid-60’s Woody Allen had a nightclub routine. The contraceptive pill had just come out and he said, "I recently had my first experience with oral contraception.  I was at a party the other evening and saw this absolutely fantastic woman!  I went over to her and asked if she would go to bed with me. And she said ‘No’".

    Some things are simple, others not. On January 15, 2010, HUD issued a Waiver of Requirements of 24 CFR 203.37a(b)(2) revising exceptions to the FHA Flipping Rule policies. (Notice that HUD did not actually issue a Mortgagee Letter.) The FHA Flipping Rule prohibits FHA financing if the contract of sale for the purchase of the subject property is executed within 90 days of the prior acquisition by the seller, and the waiver temporarily puts this aside. Where do the various mortgage investors stand on following or not following the waiver?

    Wells Fargo has taken the approach of being silent on the issue – and if WF is silent on an issue, the default policy is to follow the agencies with their policies. Therefore these loans are a "go".

    Neither Bank of America, SunTrust, nor GMAC have adopted the FHA issued directive on the waiver of the 90-day FHA Flip Rule, however.

    With other investors, the issue is not black and white. Chase will buy FHA loans with a sales contract executed in less than 90 days with overlays. If the property seller is a government entity or a Chase REO, and the sales price is less than 20% higher than the purchase price, it is ok. If the gain to the "flipper" is greater than 20%, the loan is unacceptable under the waiver. If the seller is a non-Chase bank, or even Chase, and the gain is greater than 20%, it is not eligible. The same 20% line applies to inheritances; private sales are not eligible.

    CitiMortgage also has policy overlays. Any increase of sales price over seller acquisition costs should be documented if the increase is 10% or more, instead of the 20% allowed by Citi’s original announcement. The increase in sales price over the seller acquisition cost may not exceed 20%, even if documented per the announcement. If the sales price is greater than $500,000, the increase in sales price over the seller acquisition cost may not exceed $100,000.  For Citi, and other investors, all other requirements per the HUD Announcement must be followed.

    For Flagstar, the purchase transaction must be arms-length with no identity of interest between borrower and seller or any other parties participating in the transaction, FHA’s guidelines, and there is no history of flipping for the subject property. If the sales price is 20% or more higher than the seller’s acquisition cost, the property flipping waiver applies only if the lender obtains certain documentation (such as complete documentation for renovations and repairs, a very solid property inspection, etc.). "While FHA’s temporary property flipping exemption applies to all purchase transactions that meet these criteria, Flagstar will continue to prohibit FHA and VA financing for properties owned less than 90 days unless the seller meets one of the following Flagstar seller exemptions: seller is a relocation company or employer who acquired the subject property as the result of an employee transfer, seller is any one of the following: HUD, VA, GNMA, FNMA, FHLMC, seller is a non-profit approved to purchase and sell HUD-owned properties with re-sale restrictions, etc. (Check with Flagstar for the complete list.) And Flagstar Bank requires a second appraisal from an FHA-approved and Flagstar-eligible appraiser or a Flagstar-approved appraisal management company for all transactions having a new purchase price that is 20% or more higher than the seller’s acquisition cost.

    The SAFE Act continues to weigh on some agents’ minds. Different states have different interpretations. In general, the SAFE Act requires all MLO license applicants to complete 20 hours of pre-license education, including three hours of federal law and regulations, three hours of ethics, including fraud, consumer protection, and fair lending issues, and two hours of training related to lending standards for the nontraditional mortgage product marketplace. Here in California, "Approval has been granted for individuals who are currently licensed by DRE to obtain certification that the pre-license education requirement has been satisfied based on the education completed to obtain their DRE license. However, to be eligible for this process, licensees must file Form MU 4 by August 31, 2010." There are a few other things to keep in mind, but this appears to be some good news. The California site is here .

    In a story out of Reuters, four top executives of Thornburg Mortgage improperly paid themselves handsome bonuses just before the mortgage lender filed for bankruptcy last year, and stole money and ideas from Thornburg to secretly launch a new firm, the bankruptcy trustee in charge of liquidating the lender alleged in a lawsuit. Per the complaint, the four executives and their outside lawyer and law firm conspired to launch a new company, called SAF Financial, using a strategy created by Thornburg to try to save itself. CEO Larry Goldstone, former CFO Clarence Simmons, and former VP’s Deborah Burns and Amy Pell were mentioned.

    The New York Fed released an interesting paper, if you find these things interesting, on the events in the Fed Funds market in the 2008 financial crisis. In the immediate aftermath of the Lehman’s bankruptcy we see that the market seems to become sensitive to bank specific characteristics, not only in the amounts lent to borrowers but even in the cost of funds. There were sharp differences between large and small banks in their access to credit: large banks show reduced amounts of daily borrowing after Lehman and borrowed from fewer counterparties. In contrast, smaller banks were able to increase the amount borrowed from the interbank market and even managed to add lending counterparties during the crisis. The study showed that the worst performing banks in terms of ROA started accessing the Federal Reserve’s discount window after the Lehman’s bankruptcy. It seems reasonable to assume that these are banks which were rationed by the Fed Funds market since private banks were not willing to lend to them.

    Obviously the end of the Fed’s purchase program is coming to an end in a matter of weeks – but maybe mortgage rates won’t skyrocket. Once should keep in mind, however, that every estimate out there points to a mortgage origination market that is 40-50% less than 2009’s, so there is some hope that supply & demand functions enter into keeping mortgage rates relatively low – so maybe the rate increase will be less than 50 basis point. Traditionally, mortgage rates widen when Treasury prices rally, and tighten when Treasury prices worsen (and rates go up). "Negative convexity." In addition, Fannie and Freddie will be buying hundreds of billions of delinquent loans. This has hurt the pricing on higher rate mortgages, but overall could be positive for the markets and mortgage rates.

    Both the stock and bond markets improved on Thursday, which was nice to see. Both the initial and continuing jobless claims posted week-over-week drops, causing traders to ratchet their estimates for today’s jobs data downward, and pending home sales dropped. Greece began selling 5 billion Euros of 10-yr debt after promising to reduce Europe’s largest budget deficit, which included wage cuts that has prompted more protests.  Right now, the futures market is pricing in an 86% chance that the Fed keeps rates somewhere between 0% and .25% through June 23rd, 2010. But a rumor swept the markets yesterday that a very large buyer in 4.5% securities moved mortgages relative to Treasury rates. Supply from lenders (read: locks) has increased lately as rates have crept back down.

    This morning’s news, however, has really moved interest rates initially. Non-Farm Payroll "only" dropped by 36,000, and the unemployment rate held steady at 9.7%. Hourly Earnings were up, and the average workweek was down slightly. Rates shot up on the news, as did the stock markets. Call it a knee-jerk reaction, and sometimes you wonder if the market conveniently forgets that the unemployment rate is still near 10%, but stock market futures did indeed rally on the news, the yield on the 10-yr rose from 3.61% up to 3.67%, and mortgage prices worsened by upwards of .250 in price.

    You will also see an eSATA integration as well as 4 USB slots, though we were disappointed to notice that USB specs are still at 2.0 version, kinda old you know. ATI will power your graphics. The track pad is a multi-touch one where you can use your fingertips to scroll, flick and zoom.

    All in all, it really has a look of VAIO F series design, pretty much a mix of all F series flavors from FS to FW. Sony come on, you can do much better there, we expect you to awe us this year with something really cool, but if you feel like you are burning out, just take a spring break in Hawaii, refresh your team of engineers and designers minds with some sun and get back to creating and inventing!

  • Russia to invest $6 billion in auto industry by 2020

    Russian officials said that the country will invest 180 billion rubles ($6 billion USD) in its struggling automotive industry over then next ten years in hopes to revive the sector after a tough 2009. Government sources said that they see domestic car sales matching pre-crisis levels by 2014 or 2015.

    “If we want to be noticeable players in this game it will not happen at no cost,” a high-ranking government source told Reuters. ”Despite the bad shape of the industry today there are concrete perspectives, concrete plans.”

    The report comes out ahead of a government meeting planned for today to discuss the future of its auto industry.

    “Despite the seemingly large amounts, these numbers should not impress you too much,” the source said. “They are comparable with the research and development costs of any large international auto company.”

  • Google Admits That Many Of Its Own Sites Fail At SEO

    With all of the recent lawsuits claiming that Google unfairly promotes its own sites and the sites of its partners in search rankings, it’s interesting to see that the company has put out an SEO report card that is quite critical of some of its own sites for failing to do some pretty basic search engine optimization practices. While this may be the point that Google is trying to make, it certainly suggests that Google treats its own sites on the same basis as outside sites, contrary to the claims in the lawsuits.

  • GM Olympic fleet vehicles will all find their way to Canadian dealers

    They won’t make you ski, skate or snowboard with any additional talent or zest, but the “official” Olympic-branded vehicles used during the 2010 Winter Games are going up for sale in Canada later this month. Each of the General Motors supplied cars and trucks spent time in Vancouver and Whistler shuttling athletes, officials, VIPs and dignitaries to and from the competitions and related events. Now, with the Winter Olympics written in the history books and the Paralympic Winter Games closing at the end of the month, more than 4,600 lightly-used vehicles will find their way to dealerships across the vast country. The fleet includes:

    Differentiating the “Olympic” vehicles from the standard GM offerings are the commemorative (and “permanent”) Vancouver 2010 medallions adorned with the iconic Inukshuk symbol and Olympic rings on each model. That, and fact that the vehicles are all “specially-priced,” says GM. If you are interested, contact your local GM retailer ASAP as the first cars and trucks will be available for purchase in just a couple weeks. The official press release is available after the jump.

  • You Could Not Make It Up: Climate change human link evidence ‘stronger’ by Pallab Ghosh, BBC News: UPDATED

    A review from the UK Met Office says it is becoming clearer that human activities are causing climate change.

    It says the evidence is stronger now than when the Intergovernmental Panel on Climate Change carried out its last assessment in 2007.

    The analysis, published in the Wiley Interdisciplinary Reviews Climate Change Journal, has assessed 110 research papers on the subject.

    It says the Earth is changing rapidly, probably because of greenhouse gases.

    In 2007 the IPCC’s report concluded that there was “unequivocal” evidence that the Earth was warming and it was likely that it was due to burning of fossil fuels.

    Since then the evidence that human activities are responsible for a rise in temperatures has increased, according to this new assessment by Dr Peter Stott and colleagues at the UK Met Office.

    Judging by these spy shots of a Hyundai Equus we just received from an alert reader, the Korean brand may be considering giving Rhys Millen a new ride to try and break the class record he set last year at Pikes Peak. Recall that in 2009, Millen ran up the 14,110-foot Colorado mountan-side in 12 minutes, 9.397 seconds at the wheel of a Genesis coupe.

    Apparently, Hyundai may be looking to challenge the AMG S63s and Alpina B7s of the world with its new flagship by establishing the performance bona fides of the new Equus luxury sedan with some motorsports activity. Either that or somebody at the Hyundai tech center is just trying to pull a fast one on us to see if anyone is paying attention.

I think that all but the densest, tunnel-visioned and hide-bound ‘old guard’ Republicans have figured out that the Patriot Movement (what they and the lame-stream press love to call ‘the Tea Baggers’) is no flash in the pan, and has just grown stronger despite the worst the leftist press and the Democrat spin machine (and some Republicans) could do to denigrate it and drive wedges into it. Their breathless characterization of a third party fell flatter than last week’s beltway champagne.

    It is, by any measure, the new voice of the Republican party and, in point of fact, is not being controlled by the Party but is pulling the party along behind it. The new Conservative Republican party has a bright future, with a highly motivated and self-aware membership made up of solid conservative patriots who are determined that the principles of freedom that make this country great will be upheld.

  • Apple “Genius Squad” in the Works?

    Over at Patently Apple, Jack Burcher Purcher reports that Apple is applying for a trademark called “Joint Venture.” The trademark application indicates that this will most likely be some kind of new service offering by Apple. Might Apple start providing on-site service just like Best Buy’s Geek Squad?

    The key clauses in the patent application seem to indicate this just might be the case:

    “International Class 037: Maintenance, installation and repair of computer hardware, computer peripherals, computer networks, and consumer electronic devices; information, advisory and consultancy services relating to all the aforesaid.”

    “International Class 042: Technical support and consulting services pertaining to computer hardware, computer peripherals, computer software and consumer electronics; troubleshooting and computer diagnostic services for computer hardware, computer peripherals, computer software and consumer electronic devices; consulting services in the field of selection, implementation and use of computer hardware and software systems for others.”


    Would this be a good thing for Apple customers? Certainly being able to purchase additional on-site services directly from an Apple Store would be convenient. The Geniuses stay locked behind the bar (pun intended) and Apple relies on independent third-party sources who are often part of the Apple Consultants Network (ACN) or Apple Authorized Service Providers (AASP) to provide on-site service to Apple’s customers. For many of them, paying Apple directly to set up their Xserve or Airport Extreme may be a great idea and would be consistent with the offerings of big PC companies that provide end-to-end support for larger installations. Joint Venture members would be people trained by Apple, and specializing in Macs (unlike Best Buy’s on-site squad). It’s always possible that Apple could decide to have Joint Venture members be existing members of the ACN and AASP programs and the trademark could all be about branding.

    If Apple opts for its own on-site “Genius Squad,” it would likely be biased towards Apple-approved solutions, utilizing equipment that Cupertino sells. This may limit the choice of customers and marginalize third-party vendors that don’t sell items in the Apple Store or web site. Currently AASPs and ACNs don’t work for Apple and don’t always recommend pure Apple solutions for their customers. If Apple entered into this territory, it could put some of these smaller independent companies out of business just as the Apple Stores did for independent Apple resellers.

    Which is better? Independent support by non-Apple employees or on-site consultants who work for Apple? My vote, of course, is for independent solutions, but that’s because I’m a member of the ACN.

    Then again, Apple may just be covering its bases should it ever decided to compete with, or limit, the AASP or ACN program. Apple’s silent on what it intends to do; the trademark filing is the only clue. Of course, I’m not sure which color shirt a potential “Genius Squad” would wear, either. Black turtlenecks would be too obvious.

    We see a lot of weird, sometimes funny stuff on our nation’s streets and highways, but we usually don’t feel compared to share any of it with you. Until today. Wednesday, March 3 was a cool, dry day in southeast Michigan, so we weren’t expecting any significant traffic backups on our way home. But sometimes that’s precisely when the most interesting situations unfold.

    Hit the jump to see the end-game of what had to be a really odd incident. It involves a 15-foot hill, a Herculean pine tree and a very determined “Wide Track” Pontiac Grand Prix going all “Dukes of Hazard” on unsuspecting passers-by. We have no idea how this happened and we’re hoping nobody was injured, but at the same time we’re showing this video to any teenagers who think texting and driving is a good idea. Please forgive us for the iPhone-quality video and the AM soundtrack, but we feel this is definitely worth your time.

  • The Persecution of Our Military

    Yesterday we talked about the prosecution (i.e. persecution) of Lt. Michael Behenna (I actually sent him a card in prison…and I never do things like that…) The most upsetting thing about Michael is he’s already been sentenced and no one seems to know about his case. I didn’t until this week.

    So, at least with these three Navy Seals they are getting some media attention:

    “Three Navy SEALs are facing courts-martial on charges that they mistreated an Iraqi prisoner suspected in the deaths of four Blackwater security guards whose charred bodies were dragged through the city of Fallujah in 2004.

    U.S. military officials have charged one of the SEALs with punching the prisoner, Ahmed Hashim Abed, after he was taken into custody Sept. 1 in Iraq. All three SEALs have been charged with dereliction of duty and lying to Navy investigators to cover up the incident.

    The case has prompted an outcry from conservative members of Congress and members of the military’s secretive Special Operations Forces, who say the Navy commandos are innocent. More than 40 members of Congress — nearly all of them Republicans — have signed letters calling upon the Pentagon to exonerate the SEALs, while accusing military leaders of bending over backward to protect a prisoner believed responsible for one of the most gruesome slayings of Americans in Iraq.” (source)

  • Ferrari wants to offer hybrid option in all models

    According to Ferrari’s chairman Luca di Montezemolo, the Italian supercar maker wants to offer hybrid versions across its entire lineup within the next three to four years.

    “This is a first step of a long project and we want within three years, maximum four, to have a hybrid Ferrari car ready for every single product of our range. This is our goal,” Montezemolo said to reporters. “In three years we aim to cut emissions by a minimum of 35 percent.”

  • UCLA Decides To Put Course Videos Back Online; Countdown To Lawsuit Begins…

    Last month, we wrote about how the Association for Information Media and Equipment (AIME) had threatened UCLA with copyright violations for allowing professors to post videos online for students to view. This resulted in UCLA pulling down those videos — even though the university said it believed it had a very strong fair use case. Since pulling down the videos, the two sides have been talking. However, even without an agreement, UCLA has decided to put the videos back online for the next quarter. Given this, I’m guessing that it won’t be long before AIME files a lawsuit, so we might get an interesting case over fair use in educational settings…

    As if classic car fans in California weren’t spoiled enough with the annual festivities in Monterey, world-class concours in Palm Springs, La Jolla, Dana Point, Palos Verdes, and Pasadena, and first-rate museums like The Petersen and Nethercutt Collection, another incredible collection is being opened to the public this spring. Set to open April 15 in Oxnard, California, the Mullin Automotive Museum is the anchored by the vehicles of Pebble Beach-winner and Monterey Historics racer Peter Mullin, and promises to be another must-see attraction.

    According to the press release you’ll find after the jump, “the Mullin Automotive Museum will pay homage to the art deco and machine age design eras (1918-1941) that produced exquisite art and magnificent automobiles.” The centerpiece will be a huge collection of unrestored Bugattis, but expect to find other iconic brands like Delahaye, Delage, Talbot-Lago, Voisin and Hispano-Suiza, with an emphasis on French cars with coachwork by masters like Chapron, Figoni et Falaschi, Gangloff, Vanvooren, Labourdette, Letourneur et Marchand and Saoutchik among others.

    The museum will also feature art and furniture from that era and an entire floor devoted to “Club Bugatti.” Besides being home to 100 of the most gorgeous flowing designs of all time, the Mullin will also house some less beautiful but equally significant vehicles including 30 unrestored cars and a whole roster of Grand Prix and Le Mans cars.
