  • Ala. prosecutors ready for insanity claim in university shooting

    HUNTSVILLE, Ala. — A prosecutor says he won’t oppose mental evaluations for a university professor accused of shooting six colleagues during a faculty meeting one week ago.

    Madison County District Attorney Robert Broussard says Amy Bishop should receive the testing to settle any claims about her mental health.

    Bishop’s lawyer, Roy W. Miller, told The Associated Press in an interview Thursday that he believes his client suffers from paranoid schizophrenia. He said she gets in conflicts with people needlessly and then becomes obsessed with them.

    Bishop is charged with capital murder and attempted murder in a shooting that killed three fellow teachers at the University of Alabama in Huntsville. Three more were injured.

    Funerals and memorial services for two of the victims will be held Friday and Saturday.

  • Apple Moves to Quash “Overtly Sexual” iPhone Apps

    Due to repeated and numerous customer complaints, and despite the fact that they seem to pretty regularly make their way into the top 25 and 50 lists of both free and paid apps, Apple decided this week to begin removing software from the App Store it deems “overtly sexual.”

    News of the policy change comes via a letter sent to the developer of “Wobble iBoobs,” which informed them that under the new guidelines the app was determined to be inappropriate and would be removed. In the letter, Apple explained that the App Store policies are subject to change, and that it is “constantly refining” its definition of what’s deemed appropriate, based at least in part on user feedback.

    TechCrunch received a copy of the email notifying Wobble iBoobs developers about the policy change and resulting removal of their app. Apple does note in the following excerpt that the ban is reversible:

    We have decided to remove any overtly sexual content from the App Store, which includes your application. Thank you for your understanding in this matter. If you believe you can make the necessary changes so that Wobble iBoobs (Premium Uncensored) complies with our recent changes, we encourage you to do so and resubmit for review.

    While a few other similarly-themed apps have been removed from the App Store, too, apparently in keeping with the new policy changes, some others remain, raising the question of what exactly Apple categorizes as “overtly sexual.” The top 25 and 50 lists appear to have been scrubbed pretty much clean, but some apps in the Entertainment category still seem pretty sexual to me. Hard to mistake the intent of the official “Playboy” app as anything but, for instance.

    Though my gut reaction is to decry Apple for censoring something as relatively innocuous as sexually suggestive material (caveat: I’m a Canadian; we’re pretty okay with nudity and sex in general), I actually can’t help but be really pleased with the move as a regular App Store customer. As far as I’m concerned, the kind of novelty sexual app that Wobble iBoobs represents wasn’t doing much more than taking up valuable real estate in the App Store’s top downloads list, blocking spots that might otherwise be occupied by something useful I’d actually consider downloading.

    Apparently, the apps were somewhat popular, since they managed to appear on those top lists with fair frequency, and Wobble iBoobs was downloaded more than 970,000 times during its App Store career. But if you feel the need to get your jollies on the iPhone (and I really can’t imagine why you would, for screen size issues alone), then take to the web and leave my App Store out of it. Mobile Safari’s right there, and I guarantee you’ll be much better served going that route anyway. Does anyone else see this as a change for the better, or am I alone here?

    We’re not sure if it’s the raw display of power or the smell of burning rubber, but there is just something about a good burnout that puts a smile on our face. Of course, the burnout has to be done right to make us smile. A poorly executed spinning of the rear wheels prompts plenty of indifference, unless the burnout goes so terribly wrong that it proves to be somehow better than even the best burnouts.

    Luckily it just so happens that we’ve found an instance of badder is better.   • It’s Time For The Eurozone To Become A Single Nation, Or The Euro Is Toast

    Old euro currency system skeptics are coming out of the woodwork with I-told-you-so grins these days.

    That’s because the current European crisis is damning proof of their old argument that a single currency isn’t sustainable if it is shared by multiple different nations each with independent economic policies. The euro system seemed to work for awhile, but now we have discovered that problems were mounting all along.

    Thus to save the euro there’s only one, difficult solution — The United States of Europe. The idea is actually catching on:

    EUObserver: The recent financial crisis has also served to highlight the multitude of structural flaws embedded in the wider EU economy, with the bloc’s permanent president, Herman Van Rompuy, amongst those advocating a European ‘economic government’.

    Yet with EU leaders recently indicating that a euro area bailout for Greece would be available if needed, some in Europe feel the tide is moving in the direction of greater co-ordination. Amongst them is Edouard Balladur, a former centre-right French prime minister and close associate of President Nicolas Sarkozy. “We are at a crossroads,” he told French daily Le Figaro on Wednesday. Mr Balladur believes each eurozone member should have to submit its annual budget to the 16-country bloc for majority approval.

    There’s little choice really over the long haul. The currency union was supposed to normalize economic differences between member nations, aligning their economies in sync, yet the opposite has happened according to Edin Mujargic, an economist at ECR Euro Currency Research. Thus without greater cooperation, problems will get even worse.

    “The fact that interest rates in the euro area started too low has led to imbalances in southern European states,” he stressed, pointing to Spain’s current account deficit as an example. He agreed however that economic co-ordination is what is needed. “If we don’t establish some form of economic government, I wouldn’t be be too optimistic for the survival of the euro area.”

    Sure, Eurozone nations might be able to patch up their current system and make things work for another ten years. But if they want the euro to survive the next few decades, then they better prepare for the inevitable One Europe future.

  • Largest Hydrogen Test Facility Opened by NIST

    The National Institute of Standards and Technology (NIST) Boulder Labs in Colorado recently opened the largest hydrogen test facility in the U. S. for evaluating how component parts of the hydrogen production, distribution and refueling infrastructure will react to H2 gas.

    NIST has opened the largest test facility to study the smallest atom, hydrogen, which has only one electron and one proton, making it susceptible to leakage plus metal and alloy embrittlement.

    Sure, this isn’t a sexy topic like hydrogen race cars or new technology for fuel cell vehicles. This is more of the nuts and bolts work of figuring out the transporting and delivering of hydrogen which is necessary in order to build out a suitable refueling infrastructure.

    According to NIST, “Because hydrogen can penetrate and embrittle some metals and alloys, developing standards for using existing pipelines, storage tanks, pumps and delivery systems is an essential first step before the elemental gas can be considered as a viable fuel for widespread use.

    The test chamber (pictured) is one of the largest in the country and will expose different parts to pressurized hydrogen gas. The scientists will gather data on the structural stresses of the components with the ultimate goal of making hydrogen delivery as safe as possible.

  • Island Lake mayor won’t explain suspension

    When Island Lake village board members scheduled a special meeting for Thursday night, they hoped to ask Mayor Debbie Herrmann why she suspended acting police Chief Anthony Sciarrone.

    There was just one flaw in the plan: Herrmann didn’t show.

    “I am not attending the meeting because at this time there is nothing to discuss,” Herrmann told the Daily Herald in an e-mail a few hours before the gathering. “As I have stated, this matter is under investigation and I will not be talking to anyone about the details until that investigation is complete.”

    Herrmann’s absence didn’t deter the trustees, who attended the meeting and then went into a closed-door session that lasted two hours. It also didn’t keep away about 25 local residents, many of whom were upset about Herrmann’s recently announced decision to place Sciarrone on paid administrative leave.

    “It appears that Mayor Herrmann’s actions took away the checks and balances that the board provides,” resident Shannon Fox said.

    Sciarrone is the second police officer Herrmann has suspended in recent months. Last month she announced that part-time officer Fred Manetti also was placed on leave.

    Manetti attended Thursday’s meeting and spoke to the board out of the public view. He left without commenting about the conversation.

    Herrmann hasn’t explained why she suspended Manetti, either. Both decisions surprised board members and the public.

    “It appears there is a major fight going on between the police department, the mayor and the board,” resident Joe Ptak said. “And I don’t like it one bit.”

    Thea Morris was among the residents who spoke out against Herrmann’s absence Thursday night.

    “It’s just pathetic to see the lack of caring that she has for us and the community as a whole,” Morris said.

    The board reconvened the meeting in open session about 10:20 p.m. and then quickly ended the session. Afterward, Trustee Don Saville said the panel accomplished nothing with the discussion.

    “I know as much now as I did (before),” Saville said. “We all have the same concerns.”

    Trustee Connie Mascillino said she wasn’t satisfied, either. However, she said it was a productive conversation.

  • Ratings Report for ABC News’ “Nightline” For the Week of February 8, 2010

    “NIGHTLINE” CONTINUES GROWTH TREND: INCREASES +11% AMONG TOTAL VIEWERS AND +16% AMONG A25-54 YEAR TO YEAR

     

    “NIGHTLINE” POSTS BEST DEMO DELIVERY SINCE NOVEMBER 2008

     

    “NIGHTLINE” TIES “LETTERMAN” IN A18-49 RATING

     

     

    ABC News “Nightline” placed second among Adults 25-54, Adults 18-49, and Total Viewers for the week of February 8, 2010, according to Nielsen Media Research. “Nightline” also tied CBS’ “Late Show with David Letterman” in the A18-49 rating (1.2).  Additionally, “Nightline” continues to experience growth. Among Total Viewers, “Nightline” grew for the fourth week in a row. With 4.18 million, the program increased +11% compared to the same week last year while NBC’s “Tonight Show with Conan O’Brien” in comparison decreased -59%. Week to week, “Nightline” increased +3% among Total Viewers. “Nightline” is solidly in second place season to date among Total Viewers and Adults 25-54. 

     

    Among Adults 25-54, “Nightline” grew for the third straight week and posted its best demo delivery since November 2008. Averaging 1.89 million (1.5 rating), “Nightline” increased +16% compared to the same week last year, while “The Tonight Show” declined -44%.  Week to week,  “Nightline” increased +6% among A25-54 and +9% among A18-49.

     

     “Nightline” outperformed “The Tonight Show” thirty-three of the last thirty-four weeks among Total Viewers. Season to date,  “Nightline” has outperformed “The Tonight Show” among A25-54 seventeen times.  For the week, “The Tonight Show” dropped to its lowest total viewer delivery since at least the 91/92 season.

     

    Last week, “Nightline” featured a profile on the outlaw at the center of America’s longest running stand-off, an update on the Somer Thompson investigation, and continued coverage of the massive snowstorms that impacted much of the country.

     

    *Note: “Nightline” was based on a 4-day average (Monday-Thursday); “The Tonight Show” was also based on a 4-day average (Monday-Thursday) due to the opening ceremony of the Olympics on Friday night.

  • EYE concept coming to Geneva has Tesla Motors connection

    Though it proudly sports a chrome Tesla Motors logo on its nose, the Geneva-bound EYE concept pictured above was not penned by that California company’s designers. Not directly anyway. That credit goes to 11 transportation design master course students at the Istituto Europeo di Design of Turin (IED). That’s not to say Tesla Motors wasn’t involved in the effort, though. In a bid to uncover the student’s future-vision, the school decided to hook up with the company whose name they felt is “synonymous with innovation,” and the team went on to develop its green dream under the supervising eye of Franz von Holzhausen, Tesla’s chief designer.

    Though we’ll likely never see how this full-size model looks rolling down the road, we will get see it posing for the public at the Geneva Motor Show. Perhaps our photos taken there will better reveal whether the concept has successfully achieved its makers’ goal of creating a 2 + 2 sportscar “conceived to become a status-symbol.”

  • Care and Support Conference, 19th February 2010

    Key voices in the care and support world came together and discussed the key issues facing the care and support system, to give their views to national and local politicians.

    It was a helpful, broad ranging, high level discussion that helped to build consensus towards a White Paper . This report summarises views given by attendees at the conference and was agreed by delegates at the final session as a summary to provide to politicians.

    Consensus around the Vision…

    There was consensus around the vision for the National Care Service

    • A national care service, where individuals make a contribution in partnership with the state
    • A system which enables assessments of need to be portable across the country, but delivered locally with local government in the lead
    • A  personalised system, giving individuals and families maximum control of the care and support they get
    • A priority for preventative care and early support
    • A joined-up service where all the services that you need will work together smoothly. This includes better joined up working between health, housing social care and the disability benefits systems
    • Clear information and advice so people can understand and find their way through the care and support system, including disability benefits and health

    But we also agreed…

    In addition to this Vision reform also needed to

    • Give more emphasis to the vital role that carers, families and communities make to the system,
    • Give more emphasis to the importance of including adults of working age, ensuring this part of the system is fully funded and better managing transition from childhood to adulthood 
    • Recognise that workforce planning and development  are critical to the quality of care and support
    • A wider range of high quality services to support people to experience personalised services
    • Give people more detail on delivery, including winners and losers, and no perverse incentives
    • Be clear whether it is a national system or service
    • Not be isolated from other services e.g. housing, leisure, transport
    • Support people as citizens, not passive recipients
    • Promote opportunities for better integration between disability benefits and the social care system
    • Recognise that a good care and support system will not only deliver quality care for the individual and their family but will also provide an infrastructure to support employers and increase wealth

    There was concern over the possible reform of disability benefits

    • Everyone acknowledged that such benefits provide valuable support to a wide range of people, for a range of disability-related costs. It was agreed that existing or potential recipients should not lose out 
    • People were fearful that reforming disability benefits would impact on their quality of life and independence
    • Any reform needs to capture the strengths of the current benefits system, including universality

    Comprehensive is the emerging consensus

    • On balance, the majority view is in support of a comprehensive system, with a variety of ways to pay the contribution.
    • An element of compulsion was supported, whether soft or hard
    • Universality and fairness is important and we need to consider people’s ability to make a contribution (progressive, not a flat rate)
    • The contribution of carers needs to be taken into account  and recognised in the payment options
    • Any system needs to be simple and understandable
    • There needs to be clarity over what you receive in return for your contribution
    • On balance the majority view was to reject the Green Paper options of ‘Partnership’ and ‘Insurance’
    • Any change may need to be phased in over a period of time, recognising affordability
    • Any system needs to work for future generations as well as the immediate cohort 
    • The conference regretted that the option of general taxation had not been explored

    Rim dimensions are 10J x 21 at the front on 285/35 R21 tyres and 11.5J x 21 on 325/30 R21 tyres at the rear.

  • Baseball team still eyeing opener at new stadium

    Plans for a new minor league baseball stadium in Zion are being scaled down in order to have it ready for opening day, amid delays in negotiating lease agreements, owners of the Lake County Fielders said.

    Richard Ehrenreich, managing partner and president of Fielders parent company Grand Slam Sports & Entertainment in Deerfield, said he expects a deal with Zion city government by month’s end. Despite a tight timeline, he’s optimistic the stadium can be ready for the team’s inaugural 2010 season because the reduced design would require 45 fewer construction days.

    However, Enrehreich said a contingency plan is in place to play home games at another Lake County site if the ballpark isn’t ready for the June 11 home opener. He declined to identify the location.

    “It’s always tricky in Year 1,” said Ehrenreich, whose Schaumburg Flyers minor league team plays in Alexian Field owned by the village and park district. “Everybody holds their breath and hopes the stadium opens on time.”

    The revised plan calls for a single-story structure at Green Bay Road and 9th Street in Zion’s Trumpet Corporate Park. It would include all elements of the original design, such as suites, a party deck, banquet facility and concert stage.

    An upper deck could be added onto the stadium in the future, under the revised plan. Zion officials had been touting a $15 million stadium with 4,000 permanent seats to be paid with state, city and private sources.

    Stadium seating would remain at 4,000 in the revised plan, with total baseball capacity of 7,000 including lawn areas, the concert stage and party decks. Concert capacity would be 11,000, according to the Fielders.

    Northern League Commissioner Clark Griffith, a Minneapolis attorney, said Ehrenreich has assured him the stadium will be built. After starting the season in late May with 20 road games, the Fielders return for their home opener against the Gary Southshore RailCats.

    Zion’s economic development director, J. Delaine Rogers, said in a statement a network of public and private partnerships has been crafting the stadium lease for the Fielders. Rogers said she’s spent four years working with Ehrenreich to bring minor league baseball to Zion.

    “It is a very complicated project with a great number of moving parts,” Rogers said, “since we’re still negotiating a lease, finalizing our permit review with the (Illinois Environmental Protection Agency), completing design tweaks and working with our state officials on potential infrastructure grants related to Trumpet Park.”

    Democratic state Sen. Michael Bond of Grayslake is among those involved in the stadium proposal with Zion officials and Trumpet Corporate Park representatives.

    Bond said he secured $1 million for Zion to spend on infrastructure at Trumpet Corporate Park – including the stadium – from the state’s $31 billion public works program known as a capital bill. Zion has yet to receive the money.

    Illinois is in a border fight with Wisconsin to retain businesses, Bond said, which is why he sought money for Trumpet Park. He said the Fielders and the stadium would be an amenity at the business complex.

    Richard Delisle, of Lee & Associates Commercial Real Estate Services, has been working on the stadium lease on behalf of Panattoni Development Co., which began Trumpet Park.

    Delisle said the property Zion would buy from the North Shore Sanitary District for the stadium is ready for construction after movement of at least 10,000 cubic yards of soil and various tests. He said it’s not yet known how much the stadium itself would cost.

    In a statement on the stadium he issued Feb. 11, Zion Mayor Lane Harrison said 83 percent of the suites are leased, and a concourse-level, year-round restaurant is planned. He said two concerts have been negotiated for the ballpark stage.

    Harrison said more than $800,000 in private money has been committed to the project so far. Delisle said the goal is to spend as little public money as possible.

    Ehrenreich said his company intends to spend $2.5 million to $3 million on Zion ballpark improvements, including a separate scoreboard and video board. He said he’s in negotiations with a company he declined to identify for stadium naming rights.

    The redesigned stadium plan will be unveiled at the first of three Fielders Fan Fest events at 2 p.m. Sunday at Libertyville Sports Complex, 1950 N. Route 45.

  • Trapster for iPhone hits 4.0, Android and WebOS updates on the way

    Some of you might be devout Traspter users already, if so, you’re likely aware that the 4.0 release of the popular speed trap and red-light camera app hit iPhones last month with a host of tweaks. Major updates for both Android and WebOS are in the works, and we suspect that the Windows Series 7 Phones will get some Trapster love when it’s released this holiday season.

    Included in the iPhone update were three new features – Caravan, Road Hazards and Patrol – which expand the usability and increase the accuracy of the data. Caravan brings Trapster users together by allowing other drivers running the app to be seen on the map and if you’re “friends” with the user, you can see their location displayed in real-time, send them messages via audio, text or pictures and provide them with turn-by-turn directions.

    The Patrol feature makes life on the street slightly safer by displaying a blue line across the road, which glows brighter when the road has been frequented by other Trapster users and degrades over time if no one has reported speed traps recently. The Road Hazard functionality expands the database beyond traditional traps and red light cameras to include 12 new types of reports, allowing drivers to let other users know about potentially dangerous situations ahead.

    We’ve taken 4.0 out for a brief spin and can happily report that all the new features work as advertised, although the interface is beginning to grow cluttered with Trapster’s recent software expansion. For Android users, this might be less of an issue in the future, as Trapster is considering offering some of these new features as separate apps, taking advantage of the platform’s background notifications and its ability to run simultaneous apps. In the meantime, you can get the latest version of Trapster from the Apple App Store (iTunes link) and follow the site’s blog for updates.

  • Winning Essay In High School Ethics Writing Competition Argues That File Sharing Isn’t Wrong

    Well, this is interesting. Despite the various biased, one-sided, “education programs” designed by the entertainment industry for schools, it seems that plenty of students are smart enough to make ethical decisions in a more nuanced and understanding fashion. Michael Geist points us to the rather surprising news that the winner of a high school ethics essay contest wrote his essay explaining why file sharing may be illegal, but it’s not ethically wrong.

    She argues that there are a variety of reasons why kids still engage in unauthorized file trading, but one of them is that they just don’t think copyright laws are morally justified. Instead, they see the benefit and the opportunities presented in easier sharing and distribution of works, allowing more people to hear and discover new artists, while opening up lots of new potential business models. All good stuff.



    But what’s most surprising is that this essay actually won the contest. While there are plenty of us who understand the views expressed in the paper, you would think that most folks who haven’t thought too much about these issues will quickly resort to the “but.. but… infringement is bad!” arguments, and refuse to even consider an essay arguing that copyright infringement can be morally justified. So, kudos to the judges for at least having an open mind on this one.

    I didn’t plan on yesterday’s “Real words from a real agent” to incite such a firestorm of e-mails. But first, some “GFE chatter“. The grace period of the new GFE is set forth pretty clearly. But lenders are finding out that what HUD allows and what investors actually do can be two different things.

    The new Good Faith Estimate is still a problem for agents out in the field, along with title companies, Ops staffs, and investors.  One experienced agent in California wrote, “We had a loan close that was initiated on the new GFE. We did not disclose the seller’s county transfer tax to the buyer on the new GFE. The seller’s county transfer tax in every county is paid by the seller. Although the city transfer tax is usually split 50/50, this property was not located in a city that has a transfer tax. When the official GFE is issued, it comes from our company, they did not know at that time that the seller’s transfer tax needs to be on the buyer’s GFE either. When we initially asked title for the fees, the seller’s transfer tax wasn’t on their estimate as well. The doc’s go to title and bam the funder tells us “We are going to hit you for $737 for a tolerance cure.” I respond, “What about HUD’s 120 day leniency policy?” “Sorry, the investor is not following the HUD leniency policy” we are told. To add insult to injury our $737 went to the SELLER. We were not given an opportunity to re-disclose, which if you think about it is so ridiculous because the re-disclosure would not have effected a change in cost for the borrower. This is an illogical disclosure requirement in that the seller does not receive the GFE. Is this what the government really had in mind? The new GFE is absurd.”

    Another producer wrote, “I just had an investor that wouldn’t allow me to collect for a 3rd party credit report unless I could verify I had paid the bill. We are a small company pulling between 50-100 reports per month. The cost is charged directly to my Amex card at the end of each month as a lump charge. I can go pull an invoice per client but it has never reflected that the item was paid. So basically, RESPA allows us to charge for 3rd party charges. Nowhere in RESPA does it indicate we have to justify our business practices. If I don’t pay my bills, I’ll get cut off. This is really spiraling out of control.”

    “We are having to guarantee fees we often have no control over. We just did a loan with an investor we haven’t used in a few years, as it was in the client’s best interest. I ordered the appraisal on their blind website. I have no idea about the charge. Here’s a thought. The GFE has to be out within 3 days of application. The appraisal can’t be ordered until 4 days. How do you guarantee a fee for an appraisal you haven’t ordered.”

    Regarding yesterday’s “Real words from a real agent”, one wrote, “My response is “boo (expletive) hoo.” Yes, there’s more work to do but it puts us closer to the process and requires more contact with the borrower. This is a good thing. Getting more familiar with borrowers helps us develop the relationship more which could lead to continuing the relationship which could lead to keeping in touch with clients which could lead to more referrals. Hello! Isn’t this what we need? So to those who have to work more and don’t like it, I say “buh-bye.” Find another career and leave originating to those of us who will work harder.”

    Another wrote, “‘Real Words from a Real Agent’ could have been me writing. Truer words have never been spoken. That’s exactly what happens now and as an 18 year originator I find nothing sadder than this. It’s a total shame. The truth is this hurts the lending clients the most and the long time originators who have spent their entire career doing it right are right behind them! The problem is, I don’t see a good fix in sight.” Another wrote, “This is a sign that our industry is cleaning up. This non-professional needs to go back to selling cars. He is crying because he has to do his job.  How absurd that a loan officer should have to actually key in correct information into a 1003. I say good riddance to these folks who dimensioned the value of the great loan officers out there.”

    Someone else wrote, “My American dream is to spend a long weekend with Carmen Electra, but nobody appears to care about that…..maybe I’d get a little more help if they could make 1 point doing it, uh?!? Seriously. Only a loan agent would complain about having to actually do some work after spending 26 years in the business doing virtually nothing but returning phone calls. Tell them ‘it was a good run, and that Reagan is out of office now.’” Lastly, “Just wait until John Q. Public gets a load of loans not tied to commission compensation!!!  The American public and Barney Frank deserve what they are about to get for expecting everything for free (except for their services of course… THAT costs!) and boy are they going to see how expensive and frustrating ‘free’ is going to be!”

    The administration’s Making Home Affordable Program (HAMP) is “gaining traction” based on figures released by the Treasury Department and HUD. As of the end of January, over 116,000 permanent loan modifications had been signed,nearly double the 66,000 reported at the end of December, and an additional 76,000 had been extended permanent modification offers but had not yet returned the paperwork.  830,000 borrowers are still in some stage of the required three month trial period required by the program guidelines. Mortgage News Daily pointed out, however, that over 57% of loan modifications have been borrowers who are out of work or are underemployed. If those borrowers are unable to get work, those loans might end up defaulting anyway.

    Chase announced a “Special Approval Designation for Established Florida Condominium Projects” which are ineligible for delivery to Chase. Although in Lender Letter 2010-01, Fannie Mae announced the availability of a Special Approval Designation for certain established Florida condominium projects, Chase notified correspondents that “Special Approval Designation project approvals” are not eligible for delivery to Chase at this time, including on DU Refi Plus and LP Open Access transactions. The investor reminded customers that “Chase does not purchase loans on condominiums in the state of Florida, with the exception of eligible DU Refi Plus and LP Open Access transactions that are not located in Special Approval Designation projects.”

    Yesterday I published the first half of a good list that CitiMortgage provided clients: a list of tips for processing FHA loans. It is a long list, so I put in about half yesterday with the next half today:

    Qualifying Ratios

    Document compensating factors to justify the loan approval for borrowers with high ratios on the Loan Underwriting and Transmittal Summary.

    Use factors accepted by HUD and include supporting documentation.

    Income and Employment Documentation

    Verify the borrower’s employment for the most recent two full years, and explain any employment gaps.

    Income must be separated and entered accurately-self-employed, commission, over-time, rental, retirement, etc.

    AUS PITI should include the taxes, insurance and HOA fees, as applicable. Include even if not escrowed.

    If less than two years at current position, verify past employment for two years.

    Document all income sources and the likelihood of continuance.

    Obtain required documentation for self-employed borrowers – tax returns, profit and loss statements.

    Maximum Mortgage Amounts

    Calculate the loan amount and ensure that it is within the product guidelines.

    Look for seller concessions in excess of 6% and other inducements to purchase which require dollar-for-dollar reductions in the sales price.

    Seller paid closing cost & prepaids must be detailed on the HUD-1 and may not be applied as a lump sum credit.

    Cash back to borrower for repairs to be completed after closing is not acceptable
    General Data Integrity

    Analyze all file documentation to ensure consistency.

    Question and document the resolution of any inconsistencies.

    Double-check accuracy of AUS information
    Fully Insurable Loans
    Deliver a complete case binder to FHA in a timely manner
    Follow through to make sure the loan is fully insured within 60 days of origination as required by HUD.

    As the fixed-income markets worsened yesterday, dealers continued to see heavy selling days by originators. As usual, the only substantive buying has come from the FED (lighter than Wednesday apparently) and a little from servicers and money managers. The lack of interest in mortgages led to them “widening out” a little versus Treasury prices. The 10-yr hit 3.80%, and Fannie 4.5’s (4.75-5.125% mortgages) were worse by over a half a point in price in spite of Jobless Claims going up. But stocks were rallying, inflation was stronger than expected, Leading Economic Indicators and the Philly Fed survey were stronger than expected, there are continued worries about the Fed exiting buying securities, and we have another $118 billion in Treasury auctions next week (2’s, 5’s, and 7 year instruments).

    But thirty minutes after the stock markets closed here in the US yesterday, the Fed raised its discount rate by a quarter percentage point to 0.75%, which was a bit of surprise. (It is the rate of interest set by the Federal Reserve that member banks are charged when they borrow money through the Federal Reserve System.) One analyst said, “Even though the Fed wanted to say this has no real implications for monetary policy it is a relatively clear signal that the Fed is scaling back quantitative easing and it’s happening faster than perceived in the markets.”

    The only news out this morning was the Consumer Price Index, which showed that consumer prices rose less than expected in January: +.2%. The core rate, excluding food and energy, was -.1%, falling for the first time since 1982. (Energy costs were +2.8% last month, and food prices were +.2%.) After the news the 10-yr is basically unchanged at 3.80% and mortgage prices are worse by about .125 from yesterday afternoon.

    In the small Texas town of Mount Vernon, Drummond’s bar began construction on a new building to increase their business in the town.

    The local Baptist church started a campaign to block the bar from opening with petitions and prayers.
    Work progressed right up till the week before opening when lightning struck the bar and it burned to the ground.
    The church folks were rather smug in their outlook after that, until the bar owner sued the church on the grounds that the church was ultimately responsible for the demise of his building, either through direct or indirect actions or means.
    The church vehemently denied all responsibility or any connection to the building’s demise in its reply to the court.  As the case made its way into court, the judge looked over the paperwork.

    At the hearing he commented, “I don’t know how I’m going to decide this case, but as it appears from the paperwork, we have a bar owner who ‘believes in the power of prayer,’ and an entire church congregation that does not.”

    Rising temperatures in the oceans around Antarctica could lead to the continent’s penguins being replaced by jellyfish, scientists have warned.

    The results of the largest ever survey of Antarctic marine life reveal melting sea ice is decimating krill populations, which form an integral part of penguins’ diets.

    The six-inch-long invertebrates, also eaten by other higher Southern Ocean predators such as whales and seals, are being replaced by smaller crustaceans known as copepods.

    These miniscule copepods, measuring just half a millimetre long, are too small for penguins but ideal for jellyfish and other similarly tentacled predators.

    Huw Griffiths, a marine biologist, said the shifting food web, coupled with shrinking ice sheet breeding grounds, could seriously affect the world’s favourite Antarctic animal.
