  • Illinois Supreme Court says medical malpractice caps unconstitutional

    CHICAGO — The Illinois Supreme Court says limiting damage amounts in medical malpractice cases violates the state’s Constitution.

    In an opinion filed today, the court says such caps violate the principle of separation of powers.

    The court says the limits the Illinois General Assembly adopted in 2005 would infringe on the judicial branch’s power.

    The caps were seen as a way to lower medial insurance rates blamed for driving doctors out of the state.

    The measure limited what victims could collect for non-economic damages such as pain and suffering to $500,000 against doctors and $1 million against hospitals.

    A Cook County judge ruled in 2007 that caps interfered with juries’ power to award appropriate damage awards for medical errors.

    That sent the issue to the high court.

  • Quinn urges Cohen to step down as questions arise in 2005 domestic battery arrest

    The newly elected nominee for Democratic Lt. Governor is fielding questions about a 2005 arrest for domestic battery.

    Pawnbroker Scott Lee Cohen said he had gotten in a fight with his drunken girlfriend, but that he never hit her.

    However, court records tell a different story.

    The police report said Cohen supposedly put a knife to her throat and pushed her head against a wall.

    Gov. Pat Quinn said he knew nothing about the abuse allegations against Scott Lee Cohen until after Tuesday’s election.

    While calling for Cohen to fully answer all questions about the charges, he predicted Cohen ultimately will have to drop out of the race.

    “I think that will be the way it will go,” Quinn said at a news conference.

    In an unrelated incident, the woman had been charged with prostitution six months beforehand. Cohen said he thought she was a massage therapist.

    The misdemeanor charges were dropped when the victim failed to show up in court.

  • Poll spells trouble for Giannoulias

    A new poll on November’s U.S. Senate race spells trouble for Democrat Alexi Giannoulias.

    The Rasmussen poll first released to Fox Chicago News shows Republican Mark Kirk ahead of Giannoulias, 46-to-40 percent.

    The poll also shows that more people say they have either a somewhat or very unfavorable opinion of Giannoulias.

    In the poll, 39-percent say they have an unfavorable opinion of Giannoulias, compared to 33-percent for Kirk.

  • DOW BREAKS BELOW 10,000

    The Dow plunged below 10,000 today, and at 4:00 PM it was at around 9999.84.

    But same late ticks appear to have put it over the top.

    The NASDAQ: Down 2.75% to 2130 after a 59 point loss.

    The S&P 2.75% as well, dropping 30 points to close at 1066.

    Crude oil took an enormous haircut of 5.26%, falling to $72.93 a barrel amid the turmoil.

    Gold lost $50 to plummet to $1063 an ounce. Silver los nearly 6%, falling to $15.36 an ounce.

  • Batavia fifth ward alderman stepping down, city council accepting applications for replacement

    Applications are being accepted to replace Batavia 5th Ward Alderman Forrest Nelson, who announced this week that he is resigning. Nelson is moving out of the ward and his resignation is effective Feb. 15.

    His family is selling their home on the west side and moving to the 6th Ward on the east side, Nelson said.

    “It was really a tough decision,” he said.

    Nelson has been on the council since 2003 and his term expires in 2011. Whoever the mayor and city council appoint will serve the remainder of the term.

    “I’ve gotten a great deal of satisfaction while serving on the city council,” Nelson said. He has talked with Mayor Jeff Schielke about possibly serving on the Historic Preservation Commission or the Plan Commission.

    “I’m a big believer in term limits anyway. I probably would have just done one more term anyway.”

    Nelson feels he got more value out of serving on the council than the city perhaps got out of him, as he had to learn about projects as diverse as buying in to a coal mine, building a bridge and two fire stations, and voting whether to allow a waste transfer station in town.

    “The experience I got doing all those things are better than I gave the city,” he said.

    He doesn’t rule out running again for the council, but only if an incumbent alderman steps down. The 6th Ward is served by Robert Liva, whose term ends in 2013, and Lisa Clark, whose term expires in 2011.

    The remaining 5th Ward alderman is Eldon Frydendall.

    There is also a vacancy in the 3rd Ward, due to the Jan. 12 death of Linnea Miller.

    People interested in the positions should send a letter of interest to the mayor, in care of the Batavia Government Center, 100 N. Island Ave., Batavia, IL 60510. The mayor will present his recommendations to the council, which will then interview the candidates.

    Batavia has seven wards, with two aldermen per ward.

  • Audi A3 diesel Super Bowl XLIV commercial: Green Police is coming to get you (w/ video)

    Audi will air a humorous commercial during Super Bowl XLIV to promote its diesel technology that features environmental-crusading “Green Police.”

    “We decided the usual Audi style of subtle and understated would not be appropriate here,” said Audi of America President Johan de Nysschen. “We knew that it needed to be a bit bolder and that humor is a very effective way to make an impression during the Super Bowl.”

    The 60-second spot shows a shopper asking for plastic bag instead of a paper bag when the Green Police comes running and slams the shopper’s head on the price scanner and says “You picked the wrong day to mess with the green police, plastic boy.”

    An Audi vehicle does not appear until near the end, when the Green Police allows an A3 diesel to pass through a roadblock while keeping other gas-guzzling vehicles waiting in a long line.

    Audi is also running a bunch of viral ads on YouTube leading up to the big commercial during the Super Bowl game. They have also created a song called “Cheap Trick” which you can download here.

    The Jersey Shore house now rents of an astronomical $3,500 per night — and that’s just until the beach season kicks off in May. At which point, The Garden State’s summer dwellers will be forking over $6,500 per night to stay in the now famous digs.

    areview.co.cc: President Asif Ali Zardari held a meeting with Prime Minister Yousaf Raza Gilani and Chief of the Army Staff General Ashfaq Kayani in which law and order situation was discussed. War on terrorism also came under discussion in the meeting. Gen. Ashfaq Kayani informed the President about NATO Commanders meeting in Brussels. Later on, the President hosted dinner for PM Gilani and Army Chief which was also attended by Foreign Minister Shah Mehmood Qureshi.

  • Aisam into semifinals of South African ATP cup

    areview.co.cc: Pakistans No.1 tennis player Aisam ul-Haq Qureshi has made his way into the semi final of the doubles event at the South African ATP Championship in Johannesburg. Partnering with Indian Davis Cupper Rohan Bopanna, Aisam defeated the pair of Swedish Johan Brunstrom and Roger Jean-Julien of Curacao in the quarter finals. Aisam and Bopanna had to fight back from one set down, after being broken at 3-4 in the first set against the two Europeans ranked inside the top 40 of the world doubles rankings, a pair seeded no. 2 in this tournament. The Europeans took the first set 6-3 after said break of serve, and were successful in breaking Aisam’s very first service game of the second set as well. They consolidated the break by holding their own to make it 2-0 in the second set. The Indo-Pak duo recomposed themselves and rallied well to win five games on the trot, eventually taking the second set with a similar score line to the first, 6-3. They thus forced a super tie-breaker. Aisam and Bopanna carried the momentum they had acquired by now, maintaining a lead for the better part of the super tie breaker. As the super tie breaker went on, frustration began to mount on the Europeans, particularly the Swede Brunstrom. At 9-9, upon losing another point, Brunstrom lost with it his self control. He lashed out, tossing his racquet, which hit Bopanna on the other side of the net, catching him unaware. The chair umpire saw this as a gross misconduct on Brunstrom’s part, directly in violation to the spirit of the game, and penalized the Europeans by disqualifying them from the match. Aisam and Bopanna will now face the American pair of Rajeev Ram and Eric Butorac, the No. 3 seeds.

  • Teacher tortures student to death

    areview.co.cc: A government school teacher in Layyah tortured to death a 13-year-old girl. Police have arrested the accused. In an area of Jakkay TB-154, parents of Nazia told that Miss Iqbal of Girls High School tortured Nazia Arif for two days for not bringing copy. Due to which she fell unconscious. The girl reached home and started vomiting after which she died. Police sent her dead body for post mortem in District Hospital Layyah. On the request of Nazias father Arif, police arrested Miss Iqbal. According to sources, the teacher has accepted that she tortured the girl.

  • Nehalem Mac Pros Getting Hot and Bothered

    Naturally, it’s important to every Mac owner that their computer behave itself and work reliably and efficiently. But if, like me, you’ve handed over the extra shekels for a Mac Pro, instead of, say, a MacBook, you don’t just expect reliability and efficiency. You expect — no, you demand — nothing less than Perfection.

    It’s unsettling, then, that in recent months, owners of the very latest model of Mac Pro (the “Nehalem”-based machines introduced in early 2009) have been reporting worrying problems with their machines when performing otherwise very mundane tasks.

    Let me give you an example. Imagine it’s early morning and, coffee in hand, you take your comfy seat before your 30-inch HD Cinema Display and power-up your gleaming Mac Pro. In no time at all you’re on the Snow Leopard desktop. You fire-up Mail and Safari and, as you prepare to trudge through the messages and articles that have amassed overnight, you decide to play a little light music in iTunes to lift your spirits. Some Beethoven, perhaps. Maybe a little Hans Zimmer. (John Williams is much too stimulating for this hour of the morning.)

    Bam! No sooner have you hit Play and your machine inexplicably slowed to a crawl. You hear the Mac’s normally-whisper-quiet fans suddenly kick into high gear. For some unaccountable reason, your mighty Mac Pro is now guzzling power from the mains and getting very hot under the collar. It makes no sense. You’re doing the same things that would present no challenge at all to the most humble of MacBooks (a “mere abacus” by comparison, to quote the late great author and Macintosh-fan, Douglas Adams).

    This isn’t just puzzling. It isn’t just troubling. It’s completely and unremittingly maddening. Your Mac Pro cost you an arm and a leg. Nothing less than perfection, remember?

    Old Problem

    The first reports of this problem appeared on the MacRumors.com discussion forum back in October, but eventually migrated to the Apple Support Discussion pages where they have grown quite considerably in number (and noise).

    Users report the problem on machines running both Mac OS X 10.5 and 10.6. Symptoms usually include a hefty cut in overall performance (as much as 20 percent in some cases), skyrocketing internal temperatures (excesses of 30 degrees celsius are common) and dramatically-increased power consumption for even minor “low power” tasks.

    Software known to reliably and consistently trigger the problem includes heavy-duty titles such as Logic Studio and Flash, plus everyday applications like iTunes. The issue doesn’t appear to affect any earlier model of Mac Pro.

    Curiously, the problem vanishes completely for those users who boot into Windows 7, which has led to speculation that Mac OS X itself is the culprit. MacNN reports;

    Based on testing it is suspected that there could be a flaw in OS X’s handling of power management kernel extensions, or else the driver that exploits particular Nehalem features, such as SpeedStep and Turbo Boost.

    Silence

    Predictably, Apple is saying nothing. Users are also finding that even AppleCare Support is proving less than helpful. MacRumor’s Eric Slivka writes;

    Despite the thorough investigations by users into the situation, AppleCare representatives have been unwilling [to] acknowledge that any issues exist, calling such temperature spikes normal and within design parameters for the machines. Users continue to be frustrated, however, by the performance hits their machines are experiencing and Apple’s refusal to address the situation. Apple has yet to issue any statements regarding the issue.

    Anecdotal Evidence

    I am very proud of my Mac Pro, for which I paid a quite obscene amount in April last year. I could have bought a car, or gone on a fantastic, life-changing trip around the world. But I’m a geek, so instead of those things I bought a big metal box with a picture of a fruit stamped on its side. (I regret nothing.)

    And I really use this thing, all the time. I run iTunes constantly, and very regularly use audio-intensive apps like Apple’s Soundtrack Pro and Adobe’s SoundBooth. So far, I am relieved to say, I’ve never had any problems as a result.

    But I have had one issue, and I’m beginning to suspect it might be connected to these complaints.

    You see, in my experience, iMovie 09 is a great, lumbering cow. I need only use it for a few minutes before my machine collapses onto its metaphorical knees in protest. Closing the app doesn’t return things to normal, either. Instead, I have to completely restart my Mac. It’s annoying, certainly, but I spend more time in Final Cut these days, where I have no performance issues at all. I always just assumed that iMovie was a little buggy. Now, I’m not so sure.
