  • Obama fears losing a Senate seat — and healthcare bill

    With his signature health care bill on the line, President Obama on Friday threw himself into the political brawl in Massachusetts, where Republicans have a growing chance to win a special election for the Senate that could make it far more difficult to enact the landmark health legislation.

    Growing uncertainty about the race to replace the late Sen. Edward Kennedy (D-Mass.) put enormous pressure on Democrats to settle final details of the health care bill.

    A Republican win in Tuesday’s election would strip Democrats of their 60-vote supermajority in the Senate and allow the GOP to block legislation with filibusters.

    After negotiating with Democratic congressional leaders on the bill until nearly 1 a.m. Friday, Obama decided to travel to Massachusetts on Sunday to campaign for the Democratic candidate, state attorney general Martha Coakley, whose once-wide lead over Republican state senator Scott Brown has evaporated in recent polls.

    Obama also recorded an automated “robo-call” to urge Massachusetts voters to support the Democrat, and he cut a Web video with the same message.

    The president’s actions were a clear sign of the alarm spreading among Democrats over their prospects in the race. “If Scott Brown wins, it’ll kill the health bill,” Rep. Barney Frank (D-Mass.) bluntly told reporters before heading to his home state to campaign for Coakley.

    Money from labor unions and business interests flooded into Massachusetts, and activists on both sides heard appeals that they volunteer for the competing campaigns. “Every able-bodied Democrat who can be out there in wintertime is up there campaigning,” said Rep. Louise Slaughter (D-N.Y.).

    Speculation swirled in Democratic circles about what would happen to the health legislation if Brown won. Congress could rush to pass the bill before the results were certified and the Republican was sworn in–or, after he was seated, the bill could reach Obama’s desk if the House agreed to pass, unchanged, the version of the bill already approved by the Senate.

    House Speaker Nancy Pelosi (D-Calif.) on Friday dismissed reports that leaders were speeding the health negotiations out of fear of losing the Massachusetts seat. But the Senate race still loomed when former President Bill Clinton addressed a meeting of House Democrats and tried to buck up the lawmakers.

    Clinton, who saw his own healthcare campaign collapse in 1994 just before Democrats lost control of Congress, exorted the lawmakers to help get out the vote next Tuesday.

    The special election in Massachusetts is the opening act of a year-long political drama leading to the 2010 midterms.

    Republicans are casting the midterm elections as a referendum on Obama’s agenda, especially on the health care legislation. Democrats, by contrast, are trying to cast the elections as a choice between the two parties and two agendas, with Republicans as the guardians of an unpopular status quo.

    Those dueling strategies were on display in both Washington and Massachusetts this week as Obama proposed a new tax on big financial institutions, designed to recoup the taxpayer bailout money.

    In Massachusetts, Coakley immediately backed the idea and challenged Brown to do the same, asking whether he stood with the banks or the taxpayers. Brown opposed the bank tax as a misguided economic policy in the middle of a recession.

    “Raising taxes will kill jobs,” Brown’s campaign said in a statement.

    Vice President Joe Biden, in a mass email on Friday criticizing Brown, illustrated how Democrats will try to turn the coming elections into a choice between the parties rather than focus solely on Obama.

    “Given a perfect opportunity to show where his loyalties lie–with working families in Massachusetts or with the bankers on Wall Street who helped lead us into the mess we’re in–guess who he chose?” Biden wrote of Brown.

    Drawing a bright line on health care, the conservative Club for Growth is asking Republican candidates to pledge to seek repeal of any health care bill Obama signs into law. Democrats have seized on that idea, as well, to draw distinctions with GOP policy prescriptions.

    “What are they going to say, ‘Well, you know the old system really worked well; let’s go back to the way it was,” Obama told House Democrats in a meeting Thursday.

    “I’ll be out there waging a great campaign from one end of the country to the other, telling Americans with insurance or without what they stand to gain.”

    Republicans sought to turn the spotlight on Obama, whose handling of health care is drawing low approval ratings in public opinion surveys.

    Brian Walsh, spokesman for the National Republican Senatorial Committee, said that Coakley’s problems in Massachusetts “are a direct result of her decision to embrace the Democrats’ massive health care bill and tax-and-spend agenda.”

    The health bill continued to command Obama’s attention Friday, as congressional Democratic leaders came to the White House for the fourth straight day to hammer out a compromise.

    A big obstacle had been surmounted Thursday, when labor union leaders and the White House reached an agreement on taxing high-cost health plans. Unions had initially opposed the tax.

  • Sometimes Protecting Free Speech Means Protecting Speech You Don’t Like

    I’m a big fan of Vivek Wadhwa, who I think has done some excellent research showing the importance of skilled immigration and how it helps the US economy and helps expand jobs, rather than take them away. I’ve also been an outspoken supporter of encouraging greater skilled worker immigration into the US, as I believe it’s much better to have those individuals working in the US, for US companies, rather than working at home against US companies. I’ve been regularly yelled at and attacked for these views, often by a group of folks who all are on a particular mailing list of anti-immigration supporters that often runs into extremely racist territory. The people on that list seem to be under the belief that the world owes them high paying jobs, and they do not need to keep up on new technologies nor compete in the global marketplace. Some of those folks have set up a series of rather horrific websites that are blatantly racist, economically illiterate and at times disturbing, in their attacks on skilled immigration, specifically from India.

    However, last month, when some of those sites were taken down by a court order, we were among the first to suggest this was a major overstep by the court. The lawsuit was about these sites posting a work agreement from a company that employs many H-1B visa recipients, suggesting that the company abuses the visa system. I’m all for exposing abuses of the system, because I believe that a skilled immigration program works better without such abuses. Oddly, the company, Apex, accused the sites of both libel and copyright infringement over the posting of the documents. If it were libel, it would mean the postings were not accurate. If it were copyright infringement, then that means Apex is admitting the contents were covered by copyright (meaning, they were accurate).

    But rather than just demand the takedown of the specific content in question, the judge ordered the sites taken down completely, and even a Facebook group closed. That’s way over the line and goes well beyond what the lawsuit was about. It was great to see the EFF take up the case, but it’s a shame to see others miss the bigger picture.Esahc writes in to point out that Vivek Wadhwa has penned a column for TechCrunch blasting the EFF for defending these sites. I can understand why Wadhwa is upset about the sites. The sites are undoubtedly racist and despicable. They are also ignorant and economically illiterate. Some of the posts are, clearly, hate speech, and inciting violence against certain individuals.

    If the lawsuit filed by Apex was about that, then he might have a point. But it was not. The lawsuit targeted a specific piece of information on three sites, and because of that, the court shut down all three sites, and related Facebook pages. It’s an overreach. Yes, the sites are dreadful, but the EFF is absolutely right to try to prevent such a judicial overreach. One of the reasons so many immigrants want to come to the US and want to work here is because of our respect for free speech principles and not condoning overly broad censorship, even of speech that we find repugnant. In the past, I’ve stepped forward and supported the free speech rights of even those who have attacked me the most on certain topics, when they were also attacked. I think that Wadhwa is going too far in attacking the EFF in this case. I certainly don’t agree with the EFF on everything it does — but in this case, it has made the right decision. The anti-immigration websites are disgusting, vile, racist and ridiculous — but that doesn’t mean we should allow a court to shut them down completely over a single complaint over some specific information.

    I thought this would be the worst day ever. Last Monday during the baby’s 15 month routine checkup, his doctor heard a systolic heart murmur. He told me not to panic, but promptly handed me a referral for a pediatric cardiologist. I am going today at 9:30 for my little man to have an Echo and EKG. Despite all the doctors assurances, I am pretty upset about it.

    …But, I do have to say that the special election today in Massachusetts is helping to keep my mood afloat. I think if it weren’t for the whole damper of someone questioning the function of my baby’s heart, I’d be absolutely giddy…

    Teddy Kennedy, champion of the socialization of health care, replaced by a Republican vowing to be the vote to end the health care bill? Could anything be better?

    Even though the latest polls have SCOTT BROWN polling at 51 over Coakley’s 46 (Holy crap!), I am trying not to get my hopes too far up because this really is just too good to be true.

    My lack of Haiti blogging does not denote a lack of interest or concern… It’s just so horrific -and like 9/11 you can’t seem to escape the images…

    Presidents Bush and Clinton have already raised $8 million dollars. I can’t believe how old Bushy looks. When I walked into the room while this press conference was on, I thought it was his father at first. I don’t know who would ever want to be President –it sucks the life blood from you.

    Friends of mine are in the middle of adopting a little boy from Haiti. The two year old survived the quake, but only today were the children of his orphanage given a tent. They have had to go through so much red tape to adopt this little one –and for as long as they’ve been going through the motions, he should have never even have been there for this. He should have been here…safe and sound. Why do other countries stall the American adoptions?! I hate that pride comes before the well-being of their orphaned children.

    Speaking of the unspeakable, I NEVER want to hear anyone complain about their job again. Haitians are being paid $1.50 A DAY to pull dead, rotting bodies from the rubble–and it’s not all relative.

    For any newcomers…Bathing Suit Insanity is the culmination of a bunch of us here that decided that whether we needed to lose 5, 25, 60 or 100 lbs (or just tone up), it was better to do it with support and partners in pain. The bravest of the brave will post a picture of their progress…possibly in a bathing suit…on July 26, 2010. We have a little over 6 months.

    There were two days last week I couldn’t do the DVD so I walked with the baby instead (and I had guilt-so that’s a good sign). I’m liking Slim in 6 –the second DVD gets a lot harder than the first one was (there are 3)… I have never used resistance bands before and I have to assume they work as I am sore in places I didn’t know had muscle…

    Because of many of your recommendations (and that of a friend whose Sensei is using it), I decided to order P90X for when I’m done Slim in 6. I found all 13 DVDs for $40.

    The hardest thing for me is always crunches…I ALWAYS hurt my back and neck regardless of who helps me with form. The other thing that sucks is the “nothing 3 hours before bed.”

    The Slim in 6 has a host of supplements that I didn’t order, but now I’m wondering if I should. Do I need them if I am eating well and taking a multi-vitamin?

    Rapper Wyclef Jean continues to deny any improprieties of funds raised by his charity foundation, Yele Haiti. Breaking down in tears, Wyclef denied reports that he has used money donated to the organization for personal gains. Jean gave an impassioned defense of the 12-year-old charity, which has received more than $2 million in donations in just a few days, but is accused of dodging taxes and using donated funds to pay board members.

    “My dad always told me, if you’re a man with a clear conscience, speak with a clear conscience and the world will know,” he said. “Have we made mistakes before? Yes. Did I ever use Yele money for personal benefit? Absolutely not.”

    Jean was born in Haiti but left the island nation for New York as a child. He later formed The Fugees with his cousin Pras and vocalist Lauren Hill. The group is considered one of the most successful of the ’90s.

  • Another Big Bet on Mobile Payments: Boku Raises $25 Million [MediaMemo]

    bokuIs there big money in mobile payments — systems that let people buy stuff using their phone, and charge the purchase to their wireless bill? Not yet, perhaps. But investors are betting there will be.

    Latest example: Boku, a mobile payment startup that raised $13 million last June, has added another $25 million via a C round led by DAG Ventures. Benchmark Capital, Index Ventures and Khosla Ventures are all re-upping.

    Boku and competitors like Zong are focused, for now, on letting people use their phones to buy “virtual goods”, primarily on social games run by the likes of Zynga, Playdom and Electronic Arts’s (ERTS) Playfish.

    But even if you believe that business isn’t going the way of the Pet Rock, it’s going to be somewhat limited — the most obvious user for this stuff would be kids who don’t have their own credits cards — and competition will ratchet up if Facebook decides to finally offer its own payment platform, which seems very likely.

    But the amount of money the startups are raising indicates that they have much bigger ambitions. They want to turn your phone into a payment system for “real” stuff. Easy enough to see how you could extend this to other digital purchases, like music, video, etc., but there’s no reason you couldn’t buy physical goods this way.

    Could happen, too. Though we’ve been hearing about that scenario for more than a decade, and it hasn’t taken off yet.

    One near-term obstacle, at least in the US, are carrier fees — AT&T (T), Sprint (S) et al generally take up to 50 percent of each transaction that happens on their network. If the business is going to go up, those numbers need to come down.

  • Report: Car production to increase by 69% in first-quarter of 2010

    After a sore 2009 with production being cut and plants being shuttered, American automakers are getting ready to significantly boost car production as the economy shows some signs of recovery.

    According to data from Ward’s AutoInfoBank, the industry plans to produce 2.93 million cars and trucks in North America between Jan. 1 and March 31, an increase of 69% from 1.73 million built in the first 3 months of 2009. Nonetheless, that’s still significantly less than the 3.58 million vehicles produced in the first quarter of 2008.

    “Consumers may be scared, but they don’t like that rusting hulk in the driveway,” said Sean McAlinden, chief economist with the Center for Automotive Research in Ann Arbor. He forecasts 2010 U.S. auto sales to hit 12.4 million.

    According to R.L. Polk & Co., the average age of vehicles in American driveways has increased from 6.7 years in 2001 to 8.1 years in 2008.

  • 187x faster than Bluetooth: Sony preps TransferJet-compatible devices

    TransferJet is a close-proximity wireless transfer technology Sony introduced in 2008. The idea is to let two electronic devices quickly exchange data (theoretically at up to 560 Mbps) just by bringing them close together (touch is possible, too). By way of comparison: The data transfer rate for Bluetooth Version 2.0 + EDR stands at just 3 Mbps.

    Toshiba announced during IFA in Berlin last year they are planning to use the technology in their products soon. And now Sony made its move, too (if you don’t count the TransferJet-compatible LSI Sony announced in November).

    The company is preparing a number of computers and digital cameras that support TransferJet, enabling users to transfer data between these devices as long as they are no more than 3cm apart (Bluetooth: about 10m). Sony made several big product announcements yesterday in Tokyo, but Sony’s American website shows that some devices featuring Transferjet actually will be available in the US earlier than in Japan.

    Sony already lists the DSC-TX7 (pictured above) in their American online store for $400 (to be shipped on January 25), while the DSC-HX5V will set you back $350 and will be available from March 15 in the US (in Japan, both models will go on sale next month). An 8GB Memory Stick with TransferJet is listed in Sony’s American online store for $100 (release date in the US: February 8).

    America will also get TransferJet-compatible Sony notebooks (Vaio F series) soon, it seems. This model, the VPCF11MFX, for example, is already listed and has a price tag of $1,720 but lacks a release date as of this writing (in Japan, a total of three Vaio F computers will hit stores as early as this Saturday).

  • SwitchGames building the biggest market for used games

    switchgamesSwitchGames is a game trading site that has ridden the wave of demand for used games. Today, the company says its users are now offering more than 100,000 items for trade on its peer-to-peer game trading community.

    The New York company, which was a finalist in the GamesBeat 2009 startup competition, makes it easy to trade games quickly and safely without fear you’ll be ripped off. The company hit its 100,000-item milestone in less than a year, said company founder Jason Crawford.

    Overall, used games are a $3 billion business. Much of that is traded through GameStop retail stores. But users don’t get paid very much, while GameStop resells the games for a tidy profit. SwitchGames instead empower users so they can get much better deals.

    The selection adds up to 43 percent of all current-generation console games that are available on eBay. At this rate, Crawford predicts that his site will have more games available than on eBay, the biggest site for used game sales. Some game publishers and developers hate used game sales because they say it hurts new game sales. But SwitchGames argues that gamers wind up purchasing more new games because of the value they get by buying and selling used games.

    The company has three full-time employees and launched 11 months ago. Rivals include Goozex and Swaptree. Goozex charges a $1 fee per transaction and has more than 10,000 games available. Swaptree charges for postage and has 2,727 games available. By contrast, SwitchGames allows for free trading and allows gamers to send their games directly to each other. It is funded by angel money, as well as friends and family.

  • Mobile payments firm Boku gets $25M in spending money

    bokuBoku is on a roll. The mobile payments company bought two companies, combined them and, in June, launched its service, which lets people pay for online goods and games with their mobile phone accounts. Now it has raised $25 million in a third round of funding.

    The San Francisco-based company was one of the finalists in our startup competition at MobileBeat. Now its service is available in 58 countries, and it has more than 1,000 online merchants, game publishers and others using its service. DAG Ventures led the round, and investors Benchmark Capital, Index Ventures and Khosla Ventures also participated.

    Boku lets users pay for an item simply by using their mobile phone number. On Facebook, for instance, you can pay for a virtual good in a game using your phone number, which is often easier than remembering our credit card number, says Ron Hirson, senior vice president of product and marketing. Boku verifies the transaction by sending a text message to your phone. You then reply by hitting ‘y’ in a return message. Then the charge for the item shows up on your next mobile phone bill.

    This works great for people who want simple payment, and it’s also great for people who don’t have a credit card. Customers vary from 35-year-old mothers playing FarmVille on Facebook to people living in Singapore who don’t have their own credit cards.

    The amount of money raised is impressive. So is Boku’s speed. The company has agreements with 190 carriers around the world. In June, it announced it had raised $10 million and was buying two mobile payments startups, Paymo and Mobillcash. (Prior to that, it had raisd $3 million).     The hiccup for the moment is that Boku relies on phone carriers to complete the billing transaction. For that service, the carriers collect a hefty fee. But Hirson said he believes that the mobile carriers will lower the fees this year to kickstart business.

    The company was founded in 2008 and it has 50 employees. Competitors include Zong, PayPal, credit card companies and other direct payment providers. Zong in particular has an interesting twist: It lets you use your mobile phone number to pay for something, but instead of charging the transaction to your cell phone bill, Zong charges it to your credit card. That means you avoid the big cell phone carrier charges.
