  • National Safety Council Names Exelon Nuclear as Recipient of 2010 Green Cross for Safety Medal

    The National Safety Council announced that Exelon Nuclear will receive its 2010 Green Cross for Safety Medal, NSC’s annual recognition of an organization that demonstrates a steadfast commitment to improving safety and health in the workplace, its community and through safety leadership demonstrated by all levels of the organization.

    Exelon Nuclear, a business unit of Exelon Corporation, operates the largest nuclear fleet in the nation and the third largest fleet in the world.

    Headquartered in Warrenville, IL, Exelon Nuclear operates 10 stations with 17 reactors and represents an estimated 20 percent of the U.S. nuclear industry’s power capacity.

    Over 17 million homes are powered by Exelon Nuclear’s generating units.

    The decision to present Exelon Nuclear with the Green Cross for Safety Medal reflects NSC’s recognition of the organization’s strong safety culture which is highly visible in all aspects of Exelon Nuclear’s work practices.

    By 2008, their share had declined to 4 in 10 residents. Since 2000, central Harlem’s population has grown more than in any other decade since the 1940s, to 126,000 from 109,000, but its black population — about 77,000 in central Harlem and about twice that in greater Harlem — is smaller than at any time since the 1920s.

  • Is Inline Linking To An Image Copyright Infringement?

    Copycense points us to a writeup by a patent attorney named Steve O’Donnell about copyright and blogging. Why a patent attorney is writing about copyright is not clearly explained. Initially, since the title of O’Donnell’s post was “How many copyrights does your blog infringe?” I thought the post might be one of those blog posts that reminds us how frequently everyone “technically” infringes on copyright incidentally and how this demonstrates how screwed up copyright law is. But, no, instead, this appears to be a serious “warning” claiming that most bloggers are risking the potential of $150,000 fines by using images they find online.

    Copycense points out the irony that O’Donnell uses an image in the post itself and notes that the image appears to be in the public domain, but isn’t sure. However, I think a bigger issue with the post is hidden in this sentence:


    If you find a picture on Flickr, another blog, or somewhere else online and upload it to your own blog (or worse yet, inline link to it from your blog) without permission, you’re committing a copyright violation.

    First of all, that’s not necessarily true. Obviously it depends on lots of other factors — but I really question the parenthetical. Would inline linking (usually called “hotlinking”) to an image be copyright infringement under any circumstance? I understand that it’s considered rude and generally frowned upon in internet circles (and, in some cases the hoster of the original file will “get back” at the hotlinker by changing the image to something different… and potentially nasty). But is it copyright infringement? Technically, a hotlinked image is no different than a link to an image. The difference in code is minimal. The image itself is never “copied” onto your server. All you are doing is telling a computer to go visit the original version of the image, which was put there on purpose.

    We’ve had similar discussions in the past about whether or not it could be copyright infringement to embed an infringing video on your site — and the situation is basically the same with hotlinked images. The content still resides on the original server and is not copied to the new server at all. If the content itself is infringing, then perhaps there’s a (really, really, really) weak case for contributory infringement, but in O’Donnell’s post, he seems to be implying that even hotlinking to an authorized image would be copyright infringement, and I just don’t see how that makes sense from a technological or legal perspective at all.

  • HTC sees full year 2009 revenue of $4.55 billion, 5% down from 2008

    Digitimes reports that HTC’s full year revenue for 2009 has clocked in at $4.55 billion, 5.03% less than the year previously. Before tax this left HTC with a $800 million profit and a gross margin of 17.5%.

    Despite hot handsets like the HTC HD2 and the HTC Hero, HTC’s Q4 was still down 13.29% YoY.  2009 saw HTC place a significant focus on their Android handsets, which sell to consumers at a much lower margin than their business-focussed Windows Mobile handsets.

    While HTC saw only a slight decline in revenue in a very difficult economic climate, rivals like Apple and RIM were seemingly unaffected by this, suggesting HTC’s move to Android has not helped it tap into the high-value zeitgeist like its  its other more popular rivals appear to have done.

  • Apple ten years on

    This is a pretty wandering post over at the NZ Herald (it starts out with a screening of Avatar, and drops a few local actor names before getting down to business), but it eventually gets to an interesting premise: what will Apple’s hardware look like not in 2010, when we’re all breathlessly awaiting the tablet, but in 2020, ten years from now? Of course we’re talking about complete speculation here — not even Apple knows what they’ll be doing in ten years. But it’s not like we haven’t done it before: Apple’s devices are smaller, faster, and more powerful than ever. What will they be like ten years down the line?

    More gesturing and intuitive human interfaces seem like a good guess — with the iPhone, the accelerometer has been used in all sorts of interesting ways, and it’s probably not far until Apple figures out a way to track movement in 3D space, either by moving an iPhone or a controller around, or as the piece suggests, by tracking our body in some way. Slimmer display screens and extra battery life will be in the future as well. And the article mentions solid state storage, but if our predictions for this year are any indication, Apple will try to move off the hard drive as much as possible, and start placing data for multimedia and other files in a cloud server, accessible via Internet whenever they’re needed.

    Like I said, interesting thought experiment. What do you think Apple will be like ten years from now?

In the future, the companies also will explore international distribution opportunities in selected markets.

    The new 3D network will feature high-quality premium content from genres that are most appealing in 3D, including natural history, space, exploration, adventure, engineering, science and technology, motion pictures and children’s programming from Discovery, Sony Pictures Entertainment, IMAX and other third-party providers.

    Discovery will provide network services, including affiliate sales and technical support functions, as well as 3D television rights to Discovery content and cross-promotion across its portfolio of 13 U.S. television networks. Sony will provide advertising/sponsorship sales support, and will seek to license television rights to current and future 3D feature films, music-related 3D content and game-related 3D content, while providing cross-promotion at retail stores. IMAX also will license television rights to future 3D films, promotion through its owned-and-operated movie theaters across the U.S., and a suite of proprietary and patented image enhancement and 3D technologies.

    Governance for the joint venture will be handled by a board of directors comprised of members from each of the three companies, with the day-to-day operations run by a separate staff and management team that will report to the board. A search for the venture’s general manager will begin immediately.

    The parties have signed a non-binding Letter of Intent. Specific financial terms of the venture were not disclosed. The parties will work towards prompt execution of definitive agreements, subject to any necessary regulatory approvals.

In a note to clients this morning, Barclays Capital analyst Doug Anmuth hazards a guess: 5 – 6 million units sold in 2010, based on distribution through T-Mobile at launch and Verizon Wireless (VZ) by spring. That’s quite a number, considering Motorola’s (MOT) 2010 global smartphone shipments are expected to be somewhere around 13 million units. And, according to Anmuth, it should allow Google (GOOG) to book incremental revenue of $2.6 billion–$3.2 billion. Not bad for a first retail effort from a company that’s not exactly known for retailing. After all, cell phones are not an easy business to get into …

    Well, I’ve been lurking around for months so I have been keeping up with what’s happening. However, I haven’t been doing so well with monitoring and self control. Something just clicked (maybe the new year?) and I am serious again. Yesterday I grocery shopped and for once wouldn’t be ashamed for forum members to see what was in my basket. I am especially excited to start with Chef Barrae’s recipes – especially the cauli-rice. Anyway, just wanted to say hi again and thanks for the information and encouragement!

    Former Renault Formula One leads Flavio Briatore and Pat Symonds

    It looks like 2010 is starting off as a better year for Flavio Briatore. According to Planet F1, a French court has overturned the lifetime ban on the former Renault Formula One head honcho, along with alleged co-conspirator Pat Symonds. As you no doubt recall if you’re still reading this, back in September, the Fédération Internationale de l’Automobile found the pair guilty in the so-called “Crashgate” conspiracy involving driver Nelson Piquet, Jr. of Renault F1. Nelsinho was allegedly told to crash on purpose to protect a win for teammate Fernando Alonso in the 2008 Singapore Grand Prix.

    The FIA had found the pair guilty, doling out a lifetime ban for Briatore and a five-year ban for Pat Symonds, then director of engineering. Although Briatore had threatened legal action against Piquet and his manager-father in the wake of the ruling, the only legal action he ended up taking was to file an appeal with the Tribunal de Grande Instance in Paris. The TGI has sided with Flavio claiming the FIA’s sanction “was illegal.” Besides overturning their bans, the court also awarded the pair damages, although the amount was small compared to what the pair was seeking. It remains unclear as to if, when, or where the duo will make their returns to racing series, but knowing Briatore, we’ll all know as soon as he decides. Thanks for the tips, everyone!

    Angry Flight Attendants Picket Airports Around the World Jan. 7

    United Airlines Flight Attendants, represented by the Association of Flight Attendants-CWA, AFL-CIO (AFA-CWA), will conduct a world-wide protest over the failure of United Airlines management to negotiate a new contract on time.

    Over seven years ago flight attendants took deep cuts in pay and then management destroyed their working conditions and cancelled their pensions.

    Those cuts were scheduled to conclude Jan. 7, 2010 as the Contract becomes amendable.

    Negotiations began early on April 6, 2009 as part of an agreement between the union and the company with the intention of having a new flight attendant contract in place by Jan. 7, 2010.

    Flight attendants are working at 1994 wage levels in the year 2010 and working 48% more compared with 2002 schedules and staffing.

    When United exited bankruptcy CEO Glenn Tilton alone took a bonus that could have provided a 10 percent pay raise for all 15,000 flight attendants.

    AFA-CWA members are angry that management has not discussed the improvements envisioned, seeming only interested in delaying a new Contract for flight attendants.
