  • Justice Department Asking Questions About Apple Trying To Block Labels From Offering Deals To Amazon

Back in March, we wrote about reports that Apple had gone around and pressured various record labels to stop working with Amazon on its “MP3 Daily Deal” promotion. The reports suggested that Apple had told the labels that it would not promote any releases that were featured as Amazon’s Daily Deal. As we noted at the time, this sounded like a classic “restraint of trade” situation that the government tends to frown upon, especially when performed by what might be considered the dominant player in the market. I’m not sure I believe it should be an antitrust issue, but it certainly is the kind of thing that the government gets upset about.

So it should come as little surprise at all to find out, indeed, that the Justice Department is now looking into this. Of course, it’s early, and nothing may come of it, but you would still think that Apple would be a bit more careful than blatantly telling partners not to work with a competitor. Or does Steve Jobs hope that his powers of persuasion will wow over the Feds as well?

  • Obama administration backs Vatican in pedophile case

    Wednesday, May 26, 2010

The Obama administration in a brief to the Supreme Court has backed the Vatican’s claim of immunity from lawsuits arising from cases of sexual abuse by priests in the United States.

The Supreme Court is considering an appeal by the Vatican of an appellate court ruling that lifted its immunity in the case of an alleged pedophile priest from Oregon.

Obama administration backs Vatican in pedophile case 130510banner3

In a filing on Friday, the solicitor general’s office argued that the Ninth Circuit court of appeals erred in allowing the lawsuit brought by a man who claims he was sexually abused in the 1960s by the Oregon priest.

The unnamed plaintiff, who cited the Holy See and several other parties as defendants, argued the Vatican should be held responsible for transferring the priest to Oregon and letting him serve there despite previous accusations he had abused children in Chicago and in Ireland.

  • Another suicide at Foxconn: 19-year-old employee

Another suicide at Foxconn 19-year-old employeeThe Chinese government today expressed his concern about the wave of suicides in the factories of Foxconn, where nine young employees have taken their own lives. Earlier this week, company officials announced the hiring of 2,000 psychiatrists to avoid precisely the wave of suicides that were taking in its delegation of China.

It seems that mental health professionals are not being very effective, or have not arrived in time. The fact is, less than a week after the eighth worker ended their life at Foxconn, a colleague of only 19, has followed them.

Apple has already started its own independent investigation into the reasons that have prompted workers from the manufacturer to take this drastic decision.

Foxconn is a branch of Taiwan’s Hon Hai industrial conglomerate that produces many components for technology multinationals such as Hewlett Packard, Dell, Motorola, Nokia, Amazon and Cisco. There were also manufactured, for example, the three next generation consoles: Wii, Nintendo, PS3 (Sony) and Xbox 360 (Microsoft), as well as the famous Apple iPhone.

“We will open all our factories to the media around the world to see working conditions”, said Terry Gou founder of the Taiwanese electronics giant Foxconn.

The motives remain a mystery, or at least contradictory. About 800,000 employees work for Foxconn in China, of which 400 000 are located in Shenzhen. Workers speak out against the harsh working conditions of the Shenzhen factory (long hours, low pay, poor communication, beatings …).

  • Google Pacman Game: 4.8 Million Work Hours Consumed In Celebrations

In the recent celebrations, marking the 30th Anniversary of the game Pacman, which Google celebrated, has almost consumed more than 4.8 million work hours. People had tuned in to play Google’s Free Pacman Game which was somewhat reported by almost all sites worldwide. According to reports, the game had cost companies, including tech giants more than $120.5 Million as people spent time playing the game rather working. The statistics has been compiled by RescueTime which is a Time Management Tool.

Google recently released the game, Pac-Man, as a playable doodle logo, which allowed users to click the insert coin button and begin gobbling ghosts. In the start the internet search giant offered the game to be online only for a week but after the popularity, Google offered to keep it alive forever at its own Web page.

Average users were found to be spending more than 36 seconds on Google’s site, where Pacman was originally hosted. 11,000 people spent 3 million seconds on Google.com on Friday which is 36 seconds more. The reason is clear that the game was made to go online and users started to stick to it.

Pac-Man consumed $120,483,800 in costs for the lost work time, where the Google user is paid $25 per hour.

  • May 26th is the Start of The 2010 Fleet Week

Fleet Week, a tradition of the United States Navy, United States Coast Guard and United States Marine Corps in which the active marine or military ships dock in a variety of major cities for one week.

This tradition has been on since 1984 to honor the United States Navy, United States Coast Guard and United States Marine Corps. This week is an opportunity for the public to tour and learn more about the visiting ships. Military aircraft would also take it’s part as they will fly over in honor of the ones that lost their lives for the service to the United States.

There are may things to do during fleet week like tour visiting ships, lectures, parade of ships in the harbor, watch competitions including eating contests and tug-of-war, attend the memorial day ceremony and watch the musical performances by sailors and marines.

All events on the Fleet Week are free, unless the events are held at the USS Intrepid Sea. You will have to go and buy tickets to enter the museum.

Fleet Week in New York City would start on May 26 until June 2, 2010. That means the big ships and huge number of sailors in uniform are visiting Manhattan.

Unless indicated, all events are held in Manhattan.

  • ITM Power Home Hydrogen Refueling Stations Restarted

When I had spoken with a couple of representatives from ITM Power a couple of weeks ago about revisiting the “green box” hydrogen home refueler and the possibility of using the same or similar refueling for the forklift market they were non-committal. This is because they had something up their sleeves and weren’t ready to reveal it yet.

Earlier this week, ITM Power announced that they had beaten out several other companies and won a design contract from The NextEnergy Centre to build a home hydrogen refueling station that “…will be suitable for the next generation of hydrogen-powered vehicles currently being developed by major automotive OEMs.”

This last point had me confused since I had thought that the “Green Box” ITM home H2 refueler that I had talked about in July 2008 had filled the bill. So, I got on the phone with ITM Power CEO Dr. Graham Cooley to clear up this confusion.

According to Cooley, the old Greenbox design didn’t meet the needs of the major automakers as it was designed to output H2 at only 75 bar. The new small scale alpha prototype, however, that is being designed to NextEnergy specifications will be able to output at both 350 bar (5,000 psi) and 700 bar (10,000 psi) satisfying the international protocols for the European Union and the United States.

Besides home refueling the new hydrogen generator, which will be able to accept both electricity from the grid (in off peak hours presumably) and the intermittent power of renewable energy such as wind or solar power, may also be headed for warehouses to be a part of the emerging hydrogen forklift and palette truck market.

But, according to Dr. Cooley, ITM Power’s main thrust going forward in refueling hydrogen cars is a two pronged approach. The first prong is the building of the ITM Power HFuel commercial refueling station that is getting ready for prime time now. And, the second approach is the development of a home hydrogen refueling station that meets international automaker standards.

This way, consumers will be able to refuel their hydrogen cars at home, take a road trip, refuel in town or another town as needed, then head back home where they will refuel overnight. Putting part of the national refueling infrastructure inside of people’s garages will cut down on the amount of large-scale commercial refueling stations that will need to be built in public area and will be consumer-friendly as well.

This is the type of win-win situation that is necessary in order to expedite the building of the hydrogen refueling infrastructure that is so badly needed within the next 5 years in order to keep up with the major automakers who say they will be rolling out commercial H2 vehicles in 2015.

  • Magna planning battery factory for EVs in U.S., Europe

    Magna Milan EV Concept

Battery manufacturers are all scurrying to secure for themselves, a relevant role in the impending boom in electric vehicles. Magna International Inc., is one such company; the Canadian company is actively seeking locations to produce batteries for electric vehicles.

CEO Siegfried Wolf has said that $200-$300 million has been earmarked for each of two factories; one in the U.S. and one in Europe.

Magna started a new business earlier in the year whereby they will focus exclusively on electric cars, producing battery units as well as complete vehicles. The company’s E-car business is a joint venture with Magna’s founder Frank Stronach and is part of a deal that will reduce his direct influence on Magna.

Wolf said that the decision about where to build the battery factories would come by year’s end. He said the company will begin serial car production in 2012 or 2013.

  • Opel unions reacted angrily after Germany delayed again state aid decision

2010 Opel CorsaOpel unions were upset upon learning that Germany’s state rescue fund didn’t make a recommendation on loan guarantees that it requires in order to aid in financing a restructuring plan worth 3.7 billion euros ($4.52 billion).

Last Tuesday, a steering committee of the rescue fund failed to recommend if taxpayers’ money should be used to backstop loans of about 1.3 billion euros to help Opel lower European production and labor capacity by 20%. According to Germany’s Economy Minister Rainer Bruederle, the decision on loan guarantees is expected to arrive in late May or early June. About 18 months have passed since Opel made its first request for aid but officials say that since Opel isn’t dangerously close to collapsing, there actually is no immediate need to make a decision. Because of these delays, more people are speculating that Berlin is only going to consistently postpone making a decision but that it has no intention of granting the request.

  • Report: Germany has yet to decide on Opel aid

    Opel

Germany has yet to put forth a final decision on aid to Opel, leaving thousands of jobs at the GM unit unstable at best. Opel, which has been losing money for quite sometime, seeks aid from Germany so that it may better compete in the tough European auto market, but GM’s recent rallying performance has made it difficult for the company to get the German Aid they need. GM however, only wants to contribute half of the 3.7 billion needed Euros, saying that Opel is a European company, for European taxpayers to worry about.

Three of the four German states that house Opel plants are ready to grant guarantees, raising pressure on the national government to do so.

GM came under much heat last year, as it scrapped its plan to sell the unit, and instead asked the European workers and governments to contribute to the cost of a return to profitability.

Germany is apprehensive about funneling taxpayer funds into the company although it is the home country to half of the 48,000 employees of the company, because of GM having reneged on a sale of the unit to Canadian supplier, Magna International, which the government set up.

  • Unraveling Results from Comparable Demand and Supply: An Experimental Investigation

    Published: May 26, 2010
    Paper Released: May 2010
Authors: Muriel Niederle, Alvin E. Roth and M. Utku Unver

    Executive Summary:

In many professional labor markets, most entry-level hires begin work at around the same time: for example, soon after graduating from college or graduate or professional school. Despite a common start time, offers can be made and contracts can be signed at any time prior to the start of employment, sometimes well over a year before employment will begin. “Unraveling” happens in markets in which competition for the elite firms and workers is fierce, but the quality of workers may not be reliably revealed until after a good deal of hiring has already been completed. Thus unraveling is sometimes a cause of market failure, particularly when contracts come to be determined before critical information is available. In this paper Muriel Niederle of Stanford, Alvin E. Roth of HBS, and M. Utku Ünver of Boston College consider conditions related to supply and demand that tend to facilitate or mitigate unraveling. Key concepts include:

    • It is commonly suggested by economists and lay participants in markets that unraveling results from competition related to an imbalance of demand and supply.
    • Unraveling can have many causes, because markets are multidimensional and time is only one-dimensional (and so transactions can only move in two directions in time, earlier or later). So there can be many different reasons that make it advantageous to make transactions earlier.
    • When looking at a labor market, it is not uncommon for participants on both sides of the market to be nervous about their prospects, and it can be difficult to be sure which is the short side of the market. Even in a market with more applicants than positions there may be a shortage of the most highly qualified applicants.
    • Attempts to prevent or reverse unraveling are often a source of new market design in the form of new rules or market institutions.

    Abstract

Markets sometimes unravel, with offers becoming inefficiently early. Often this is attributed to competition arising from an imbalance of demand and supply, typically excess demand for workers. However this presents a puzzle, since unraveling can only occur when firms are willing to make early offers and workers are willing to accept them. We present a model and experiment in which workers’ quality becomes known only in the late part of the market. However, in equilibrium, matching can occur (inefficiently) early only when there is comparable demand and supply: a surplus of applicants, but a shortage of high quality applicants.

  • High-Speed Digitizers with SMA Connections available

Fast signal sources are preferably connected by shielded coaxial cables and connectors with matching impedance to digitizers to obtain best signal quality. Only with this type of connection one can avoid crosstalk and signal reflections with signals that have frequencies in the upper several hundred MHz area.
When using PC based digitizers with their limited free space on the front plate and when also taking the standard demand for additional digital signals like clock, trigger or digital inputs into account, there are only a few connector solutions on the market that are suitable. SMB and MMCX connections are an easy to use and space-saving solution, used by many manufacturers including Spectrum GmbH. All M3i series cards of Spectrum are equipped with these connectors offering one or two analog channels and sampling rates between 1 GS/s at 8 bit resolution up 400 MS/s at 14 bit resolution. In addition to this there are five connectors for supporting digital signals.
Spectrum now offers a new option for the complete M3i range of PCI/PCI-X and PCI Express cards with professional screwed SMA connections. This option is primary intended for OEM and industrial users but can be helpful also in the area of research and development. This international standard connection with a stable screw type coupling and a very good shielding allows a reliable connection of high frequency signals even in rough industry environment or vibrating installations.
The fast digitizers are available in different versions with one or two channels, sampling rates from 100 MS/s up to 1 GS/s and resolutions between 8 bit and 14 bit. The standard version is already equipped with 256 MByte of on-board memory which can be extended up to 4 GByte. Each installed analog channel has its own pre-amplifier offering a wide variety of input ranges between ±50 mV (±200 mV) and ±10 V and several software switchable settings like 50 ohm/1 MOhm or AC/DC coupling. The cards are delivered with drivers for Windows 2000, XP, Vista and 7 as well as several Linux installations like OpenSuse, Fedora or Debian. 32 bit and 64 bit versions of all operating systems are natively supported by the Spectrum drivers.

  • Apple, Hewlett-Packard and Dell could change manufacturing sites?

Foxconn DramaThree major clients of the Foxconn (Hon Hai Precision Industry Co., Ltd.) electronics manufacturing group are pressuring the company demanding a joint investigation effort regarding working conditions at Foxconn’s Chinese site.
Apple Inc.’s spokeswoman Kristin Huguet said on Tuesday “We are saddened by the tragic loss of this young employee and we are awaiting results of the investigations into his death,” and added “We require our suppliers to treat all workers with dignity and respect.” Apple had sent a team to evaluate the working conditions at Foxconn’s Chinese facility, in the mean time HP and Dell too are evaluating and examining reports from Foxconn since they have outsourced production contracts too with this electronics manufacturing group.
The questions which this “suicide cluster case” brings up against Foxconn is that, is Foxconn really running sweatshops? Are all Foxconn operations based on human misery? The inadecvat working conditions at Foxconn are a result of a corporate directive or is this just an isolated case which is present only in one particular manufacturing site of the Foxconn factory grid? Terry Gou, Chairman of Hon Hai tried to defend the manufacturing giant by stating that Foxconn does not operates human sweatshops but normal and legit businesses, how ever all the evidences point at the opposite.
Also a question remains open. will Apple, Dell and HP move its operations to other manufacturing companies if it will be proven that this suicide cases are a result of some sort of company directive?
In the case of Sun Danyoung, a worker of Foxconn who committed suicide because of the interrogation process that he was subjected to, an interrogation which was conducted because he lost the prototype of an iPhone, one could wonder did Apple pressure the interrogation? If yes, Apple may become the prime cause of this suicide case.
