  • New Lobbying Organization Tries To Skirt The Rules So It’s Not Called A Lobbying Organization

    The term “lobbyist” has certainly become a dirty word in many circles — for a very valid reason in many cases. I’ve noticed that many more people have been trying to make sure they’re not referred to as lobbyists, even if the activity they do is very much lobbying (accepting money from a specific set of companies for the express purpose of pushing a policy agenda that supports what those companies want). Now Copycense alerts us to a new operation that has sprung up that apparently is trying to contort itself around the rules so as not to be called lobbyists, even though they’re engaged in typical lobbyist behavior. It makes you wonder… who lobbied for the rules on how you define what a lobbyist is?

    Rumor: Miley Cyrus has a new roomie — her 19-year-old boyfriend, Liam Hemsworth! Word on The Gossip Wire claims Billy Ray and Tish Cyrus have allowed the Australian actor romantically-linked to their famous teen daughter to move into the family’s home in Toluca Lake, California.

    (Since this is an National Enquirer scoop, I’d advise you to consider the source and take this with a grain of salt. However, given The Cyrus’ track record for letting this girl get away with murder, it really isn’t that hard to believe. Movin’ on….)

    The permissive showbiz parents were “pressured” into the controversial living arrangement after Miley, now 17, threw a tantrum and threatened to move out if she didn’t get her way, tattling tipsters divulge in the Jan. 18 issue of The National Enquirer. To keep Miley at home, Billy Ray and Tish have allegedly agreed to allow Liam move into the family guest room until he finds his own pad in Los Angeles.

    “In the end, Billy Ray and Miley’s mom, Tish, decided they’d rather have Miley under their roof with Liam than not knowing where she is at night,” a family friend tells the tabloid. “Her parents want Miley with them for as long as possible.”

    This isn’t the first time The Cyrus Clan has raised eyebrows with their parental approaches. There was “ShoulderGate 2008″ that swept the country after Miley appeared covered with just a sheet in the November 2008 issue of Vanity Fair. And then there was that time that America’s Most Famous Teen was allowed to date an underwear model five years her senior. A source close to the family says there’s good reason for that:

    “Billy Ray believes it’s better to keep Miley on a short leash and to monitor her, rather than alienating her and risking a rebellion….”

    Television’s Hannah Montana began dating Liam last summer, when the lanky young man played Miley’s interest in the coming-of-age drama The Last Song. The Disney superstar was instantly smitten. So was Liam, he allegedly dumped his then-girlfriend to take up with Miley.


  • Zyxio’s ’sensawaft’ tech lets you control a cursor with your breath, you lazy jerk

    We never knew just how much work it was moving our mouse around our desktop until we blew ourself silly on Zyxio’s breath-enabled sensawaft tech. The sensor detects the directionality of breathing, which sounds really easy in theory but took a bit of learning in practice. After a couple minutes of trying, however, we were “blowing with our mind” as the promotional materials suggest, and while we wouldn’t call ourselves halfway accurate, we could see ourselves suggesting a mild amount of cursor direction with very little effort after a day or so of use. There’s an obvious application for the disabled, but Zyxio also thinks it can talk gamers into using it as a “third hand,” and envisions other applications such as controlling a mobile phone or zooming in and out of a GPS view in a car. We can’t see it taking the industry by storm, but sensawaft is certainly an impressive and entertaining technology, and with devices in the projected $70 range in Q2 or Q3 of this year, it might not be too expensive for a novelty buy.   • Blu-ray’s 3D spec isn’t what it could be

    Blu-ray 3D logoWhile 3D is all the rage at CES this year, we learned today from the BDA that one of the biggest sources of 3D content isn’t what it could be. The first thing that could, should, be better is the limited support for frame rates. Movies have been recorded at 24 frames per second for longer than our parents have been alive, and for about the same amount of time we’ve had to endure frame rate interpolation to make movies play back on our 30Hz TVs — you know, like 3:2 pull-down. That changed recently with 120hz LCDs and 72Hz plasmas because those numbers share a common denominator with 24 (so the same frame is just shown three or four times). Well so much for that because the frame rates of the new 3D displays don’t share a common denominator any more (either 30 or 60 hz per eye). But honestly the worst part is that the new 3D cameras can capture 3D at higher frame rates. Now even if new movies were recorded at a higher frame rate, the new 3D Blu-ray spec doesn’t support it. The other issue we take with the new spec is that contrary to early reports, it is possible to create a 3D Blu-ray Disc that won’t play on 2D only players. Not as big of a deal, but still sad is that even if the creator goes through the trouble to encode the movie in both formats, depending on the 3D player, you may have no choice but to watch it in 3D — say if you lost your glasses or whatever. Now don’t get us wrong we’re pretty excited about the new 3D technology, but the way we see it is that anything worth doing, is worth doing right the first time.

  • TwitAlbums: Private, Collaborative Content Sharing Via Twitter

    Have you ever wanted to share a set of memories with some of your Twitter friends, keeping the content private while still allowing for collaboration between certain folks?

    It’s not anything we thought we wanted, either, but after playing with TwitAlbums, we find the concept charming. Here’s how it works: Using Twitter’s OAuth function, users log in and create collections or “albums” containing multimedia content and text comments. They can invite whatever users they like to join them in adding files, and only the users they invite can see the content or comments. Best of all it looks like this little app already has a monetization strategy in place.

    The concept is inherently charming. Users create an album with a single click. They can then proceed to upload movies, pictures and audio files. We’d like to see options for adding more file types, such as web pages, text files and more.

    Users can then choose others to collaborate with them on the album. A tweet is sent inviting the collaborators to the album, and they are prompted to sign in via OAuth when they click the tweet in the link. This immediate request for account access without an explanation of the app might be a bit disconcerting for some, however. If an uninvited Twitter user clicks the link, they are given an “invite only” notice and denied access to the content.

    Collaborators can add content, leave comments and invite other users, depending on the permissions set by the original album creator.

    Finally, it’s interesting to note that the app’s creators have built in a mechanism for modest financial returns. Each uploaded file costs the user a single onsite credit, called a TwitSeed. Accounts come with 50 TwitSeeds, and more can be purchased in bundles of 100 for $1, 500 for $4, or 1000 for $8.

    One thing we don’t like is that the app pushes a ton of link- and hashtag-studded notifications into the user’s Twitter stream. As with other apps that gain access via OAuth, from the infamous Spymaster to the successful TinyChat, this is a very fine line that most users would appreciate the app not cross.

    Generally speaking, users won’t have a problem with a single tweet or two, but a constant stream of app-related messages when the user is active on the site can only end badly. Worst of all, we don’t see a way to opt out of these notifications, so we’ve had to delete these tweets manually, which does nothing to mitigate the swarm of updates for our friends using Twitter clients such as Tweetdeck. Particularly since the content is set up to be private, it doesn’t make sense to broadcast tweets about each user’s on-site activity.

    We think this app would work well for younger users, social media addicts and long-distance friends, especially if the above-mentioned issues are addressed.     Following a leak a couple hours ago, we can now share with you the official details and images on the new Chevrolet Aveo RS Concept, which will debut on Monday at the 2010 Detroit Auto Show. Seen by GM as “a wake-up call for the small-car segment,” the Aveo RS Concept features European design that will appeal to young enthusiasts while offering a strong hint at the next-generation Chevrolet Aveo.

    The new Chevy Aveo will be longer, wider and more spacious than the current model and will feature a more upscale look and a redesigned interior inspired by the Chevrolet Cruze.

    2011 Chevrolet Aveo RS Concept

    Besides its “Fast and Furious” looks and 19-inch wheels, the Chevrolet Aveo RS Concept carries a powerful, yet efficient 1.4L I-4-cylinder Ecotec turbocharged unit making 138-hp. It is mated to a 6-speed manual transmission to appeal to those who enjoy spirited driving. GM designers also created a special engine cover in graphite silver with brushed aluminum insert with the coolant and power steering fluid fill caps rimmed in ice blue.

    The next-generation Chevrolet Aveo, which will look like this without the bells and whistles, will go into production at GM’s Orion Assembly plant in 2011. The move will restore 1,200 jobs in Southeast Michigan. Retooling for the Orion plant will start in late 2010.

    DETROIT – Chevrolet today announced the world debut of the Aveo RS show car at the 2010 North American International Auto Show. It features a European-inspired hot hatch look designed to appeal to young enthusiasts, and hints at the next-generation Aveo.

    Longer, wider and more spacious than the current production Aveo, the Aveo RS showcases the car’s upscale-looking design cues both inside and out, and presents the many personalization options potentially available on the next-generation car.

    “We hope the Aveo RS show car will demonstrate that we are as serious about redefining the Aveo and its place in the small-car segment as we were about reinventing the Malibu,” said Jim Campbell, Chevrolet general manager.

    First impressions

    The Aveo RS show car, finished in electric Boracay Blue, wears global Chevrolet design cues such as the dual element grille, round taillamps and fender flares, but designers turned up the attitude on the show car with low openings and a lower mouth trimmed in a combination of brushed and polished aluminum. Outboard fog lamps are integrated into an exaggerated brake-cooling inlet that flows into the front fender flares, creating an aggressive-looking face.

    Exposed headlamps, with their brushed aluminum structural surround, are inspired by the designers’ affection for motorcycles. The sleek side profile is characterized by uninterrupted body side lines, a high beltline and low roofline. The side mirrors with amber-colored turn signal indicators carry the same shape as the car and seemingly disappear into the profile. At first glance, the car actually looks like a three-door hatch because the rear door handles are discreetly located in the “C”-pillar area.

    “The Aveo RS show car demonstrates how progressive design can inject personality into a small car,” said Michael Simcoe, executive director, North American Exterior Design. “We want customers to see it and have an emotional reaction to it.”

    No performance-minded car earns its street cred without large wheels and tires. The Aveo RS show car’s wheels are 19-inch, five-spoke with a gun metal metallic finish Chevrolet logo. The wheel openings reveal large Boracay Blue brake calipers.

    The rear of the show car continues the sport theme, with an integrated spoiler that flows from the roof, a center-mounted exhaust and chrome exhaust tips. The exposed motorcycle-inspired rear taillamps feature tinted aluminum housings and a discreet Bowtie logo.

    Spacious and stylish interior

    With its matte black interior highlighted by gloss black, metallic and blue accents, the Aveo RS show car reflects as much attention to detail as the exterior. The Boracay Blue theme continues inside, with accent stitching across the dual cockpit instrument panel, front and rear door insert, steering wheel rim, gear shift boot, parking brake, leather seat bolster and even the floor mats. The integrated center stack holds the gearshift, HVAC controls and the sound system, including a USB port. Ice-blue backlighting on the audio display, telltale indicator screen and knobs augments the blue stitching.

    The motorcycle inspiration also carries inside, with a round, analog tachometer set within an asymmetrical LCD readout also trimmed in milled metal with round cutouts; and round, aluminum-trimmed side vents.

    The interior is as functional as it is stylish, with storage compartments in the center stack and doors. The rear seats fold flat for carrying larger items.

    Efficient performer

    The Aveo RS show car is powered by the same highly efficient 138-horsepower (103 kW) 1.4L I-4 Ecotec turbocharged engine that will be available in the upcoming Chevrolet Cruze.

    A six-speed manual transmission is designed to ensure the car will provide a spirited driving experience.

    For the show car, designers created a special engine cover in graphite silver with a brushed aluminum insert. The coolant and power steering fluid fill caps are rimmed in ice blue, and the honeycomb vents flanking the center of the cover are matte-finished in shadow chrome and designed to match the wheel color.

    Chevrolet has previously announced the new Aveo will be built at Orion Assembly in Orion Township, Mich., in 2011, a move that will restore 1,200 jobs to Southeast Michigan. Timing for retooling Orion Assembly for Aveo production is anticipated to begin in late 2010.

  • BUSINESSWEEK: Buffett’s Big Task: Bringing Berkshire Back Up to Speed

    Bloomberg BusinessWeek asked investing pros for insights on what’s next for the soon-to-be-octogenarian investor

    At a time when Warren Buffett has never been more famous, his future—and that of Berkshire Hathaway (BRK/A:US), the company he heads—has never been more uncertain.

    Buffett’s fame multiplied after the central role he played in the financial crisis, which included lending a helping hand to Goldman Sachs (GS) and General Electric (GE) and reassuring the investing public he was buying stocks after 2008’s market crash.

    Talk to close watchers of Buffett and you find that all the publicity of the past year failed to fully answer key questions: Where is this renowned value investor going to find bargains after stock prices have advanced 67% in nine months? Why is Buffett making the biggest acquisition of his career, railroad Burlington Northern (BNI), at a price even he admits isn’t cheap?

    And, perhaps most important, what will Berkshire look like after Buffett? Though still apparently in good health, Buffett, the company’s chairman and chief executive, turns 80 on Aug. 30, 2010.

    The questions might not vex investors so much if Berkshire Hathaway hadn’t lost some stock market respect in recent years. For 15 of the last 22 years, Berkshire stock has beaten the broad Standard & Poor’s 500-stock index.

    But in 2008, shares tumbled 32%. They failed to rise more than 2.7% in 2009—20 percentage points behind the S&P 500 last year. Worsening any recent feelings of lost prestige, Moody’s Investors Service took away Berkshire’s prized AAA credit rating in April 2009, and debt from the Burlington Northern deal could threaten the AAA credit rating from Standard & Poor’s.

    The Most Trusted Investor

    The $26 billion Burlington Northern acquisition, announced in November, adds to Berkshire’s empire, which ranges from insurance to retail, utilities, and manufacturing. As part of the deal, Buffett is ending a Berkshire idiosyncrasy: Each share of its “B” class of stock (BRK/B:US), the so-called Baby Berkshires now priced at $3,320 per share, will be split into 50 shares—consequently offered at a lower, more market-friendly price—if shareholders approve the plan Jan. 20.

    But by far the most notable thing about Berkshire Hathaway is not its sky-high share prices, but Buffett himself, who remains firmly in control of the company he built from a troubled textile manufacturer into a giant conglomerate. Buffett did not respond to requests for comment for this story.

    Whitney Tilson, managing director of Tilson Capital Partners, expects Buffett to remain on the job for at least five years. “He loves what he does and he’s playing it at the highest level he’s ever played,” says Tilson, who owns Berkshire shares. “He gets better with age.”

    “No one can invest like Warren Buffett,” says Gabriel Wisdom, managing director of American Money Management.

    It’s not just Buffett’s abilities as a manager and stockpicker that have earned impressive returns. It’s also his role as the most famous, and most trusted, investor in the world—the man who got countless calls for help and advice from politicians and Wall Street executives during the financial crisis. “He has a celebrity and marquee [name] that opens doors for him,” says Wisdom, who owns Berkshire shares.

    Whenever Buffett steps down, Berkshire loses that public face.

    “Warren Buffett Premium”

    Some worry there is a big “Warren Buffett premium” built into Berkshire’s stock price, which could be deflated when he leaves.

    “The stock will not do well when he steps down or passes away,” says Douglas Famigletti, portfolio manager at Griffin Asset Management, though he believes Berkshire’s well-managed businesses could continue to prosper. Famigletti’s funds own Berkshire shares.

    Others, like Robert Cheney, founder and chief executive of Westridge Wealth Strategies, don’t see signs of a Buffett premium. He says the stock seems to trade at a reasonable valuation compared to the company’s book value.

    But the lack of a Buffett premium raises another question, Cheney says: If the stock market already recognizes Buffett is leaving sooner or later, “why hasn’t a succession plan been [made] more concrete?”

    Several Buffett-watchers say they’re expecting more details about Buffett’s successors in 2010, if only to ease uncertainty plaguing Berkshire’s stock.

    Bloomberg BusinessWeek asked Buffett experts what else Buffett might have on his “to do” list in 2010:

    Not much, says Wisdom. Burlington Northern “will be the last big acquisition of his career,” he says. “He’s clearly playing it conservatively because he’s already wealthy.”

    Commercial Real Estate Move?

    Digesting the Burlington Northern deal could take some time, says James Potkul, portfolio manager of the Bread & Butter Fund (BABFX), which owns Berkshire shares. For value investors looking for cheap stocks, there are fewer available in today’s “fairly valued” market, Potkul says. “It’s going to be a very quiet year for [Buffett].”

    Berkshire’s huge size makes it tough to deploy capital, because it forces him to focus only on large deals that can make a big impact, Tilson says. Instead of reaching for other big deals in 2010, he expects Buffett to focus on rebuilding his cash holdings after the Burlington Northern deal, in an effort to win back Berkshire’s top credit rating.

    Yet, as the financial crisis showed, Buffett often jumps on opportunities if they come his way. One frequently mentioned area where Buffett can find deals in 2010 could be commercial real estate.

    “There is a lot of opportunity out there because rents are down and vacancies are up,” says Timothy Parker, president of Hudson Capital Management. With holders of real estate facing a tough year, “I can see [Buffett] going on a bit of a spree and buying up real estate assets.”

    One possible vehicle for Buffett’s move into commercial real estate could be Berkadia Commercial Mortgage, a joint venture of Berkshire and Leucadia National (LUK), Potkul says.

    Buying Stocks Mid-Crisis

    According to SEC filings from Berkshire, during the market decline of late 2008 and early 2009, Buffett was indeed buying stocks—as he said in a New York Times op-ed at the height of the financial crisis. He opened up positions in ExxonMobil (XOM) and Nestlé (NSRGY), and added to holdings in Wells Fargo (WFC) and Wal-Mart (WMT).

    Still, some were surprised he didn’t buy more common equity shares—and get more of a pop from the market’s explosive rally that began in March. “He didn’t go out and just buy a lot of stocks,” Wisdom says. Instead, Buffett had cash left over for the railroad acquisition in November.

    Buffett is careful not to tip his hand when it comes to his next stock market moves, but Buffett experts look at the past year’s buys for clues to 2010.

    Berkshire is already heavily tilted toward the financial sector, through its insurance business and through holdings in American Express (AXP), Wells Fargo, Goldman, and others.

    As a result, he may be looking elsewhere. “I wouldn’t be surprised if he continues to increase his exposure to health care,” Famigletti says. “I see a lot of value there,” where stocks are relatively cheap but continue to generate cash and significant dividends, he says. Berkshire already owns 1.3% of Johnson & Johnson (JNJ), and has smaller holdings in Unitedhealth Group (UNH), Becton, Dickinson & Co. (BDX), Sanofi-Aventis (SNY) and GlaxoSmithKline (GSK).

    Long-Term Prosperity

    It’s hard to predict what Buffett will do from year to year, because he rarely reacts to the crisis or strategy of the moment.

    To many, the purchase of Burlington Northern seemed like an odd move given other, arguably cheaper opportunities in the market. But, Tilson says, “He is buying Burlington Northern to own it forever. He’s looking out 50 or 100 years.”

    For Buffett, the most important task in 2010 won’t be reviving Berkshire’s stock price or negotiating lucrative but relatively small deals like his Goldman investment. Rather, Buffett has more monumental concerns: In what are probably his last several years at the helm, he is trying to build Berkshire Hathaway into a company that will prosper long after he is gone.

I admit I liked the suggestion of ESPN.com columnist Bill Simmons, who said the Season 1 cast could be transplanted to someplace like Malibu for Season 2, to ensure they would remain weird outcasts. 2) Mike, Pauly D, Snooki and Jenni are presently charging $7,500 as appearance fees at parties and social events. Vinny is only charging $3K, which seems about right given his lack of tattoos, implants or tendency to say really stupid things. Interestingly, Ronnie and Sammi are a steal at $3,500 for the lovestruck pair. But then again that’s a lot of money to pay two people to sit in a corner by themselves and make out.

    “I definitely felt out of place,” he said about his time behind bars. “It’s definitely a place I never want to go back to again. Definitely a lesson learned.”

    The show is no stranger to fighting. Snooki was assaulted by an intoxicated man at the Beachcomber Bar & Grill back in August. Part of the incident made it to a very special episode of the series.

  • Police outraged by Indian KKK cartoon

    Victoria’s Police Association has reacted angrily to a cartoon in an Indian newspaper depicting one of the state’s officers as a member of the Ku Klux Klan.

    The Delhi Mail Today newspaper published the cartoon in response to the murder of Indian student Nitin Garg in Melbourne last weekend.

    The cartoon shows a person in a Ku Klux Klan hood wearing a police badge, with a caption that reads: "We Are Yet To Ascertain The Nature Of The Crime."

    The Indian media has suggested the attack may have been racially motivated, but Melbourne police say there’s no evidence of that.

    Police Association secretary Greg Davies says it is highly offensive to suggest police are not properly investigating the murder.

    "To say that our detectives are going slow on this, or for some reason trying to protect somebody, is incredibly offensive and wrong," he said.

    "It’s based on nothing but obviously a slow news day in Delhi.

    "The identity of the offender from the homicide in Footscray isn’t even known at this stage, so we don’t even know what nationality the offender is.

    "To say it’s a race-based crime is not only premature, but stupid."

    The Police Minister, Bob Cameron, has added his voice to the condemnation of the cartoon.

    "This is just terrible," Mr Cameron said.

    "Victoria Police is a very tolerant organisation and Victoria is a very tolerant state and to suggest that Victoria Police is racist is just plain wrong and it’s offensive to the good police we have here in Victoria.

    "It just doesn’t help anyone at all to have people from the sidelines throwing bricks," he said.

    "We’ve got a good police force and we should let our police force go about their policing business in a sensible and a calm way."

    :ohno: They should just let the police do their job and not jump to conclusions that is was racially motivated. It’s funny that India has 33,000 murders a year and yet they are slamming us, we are far more safer then their country, and police a hell of a lot better.
