    AP has an article on Monsanto’s business practices – Monsanto seed business role revealed.

    Confidential contracts detailing Monsanto Co.’s business practices reveal how the world’s biggest seed developer is squeezing competitors, controlling smaller seed companies and protecting its dominance over the multibillion-dollar market for genetically altered crops, an Associated Press investigation has found.

    With Monsanto’s patented genes being inserted into roughly 95 percent of all soybeans and 80 percent of all corn grown in the U.S., the company also is using its wide reach to control the ability of new biotech firms to get wide distribution for their products, according to a review of several Monsanto licensing agreements and dozens of interviews with seed industry participants, agriculture and legal experts.

    Declining competition in the seed business could lead to price hikes that ripple out to every family’s dinner table. That’s because the corn flakes you had for breakfast, soda you drank at lunch and beef stew you ate for dinner likely were produced from crops grown with Monsanto’s patented genes.

    Monsanto’s methods are spelled out in a series of confidential commercial licensing agreements obtained by the AP. The contracts, as long as 30 pages, include basic terms for the selling of engineered crops resistant to Monsanto’s Roundup herbicide, along with shorter supplementary agreements that address new Monsanto traits or other contract amendments.

    The company has used the agreements to spread its technology — giving some 200 smaller companies the right to insert Monsanto’s genes in their separate strains of corn and soybean plants. But, the AP found, access to Monsanto’s genes comes at a cost, and with plenty of strings attached.

    For example, one contract provision bans independent companies from breeding plants that contain both Monsanto’s genes and the genes of any of its competitors, unless Monsanto gives prior written permission — giving Monsanto the ability to effectively lock out competitors from inserting their patented traits into the vast share of U.S. crops that already contain Monsanto’s genes.

    Monsanto’s business strategies and licensing agreements are being investigated by the U.S. Department of Justice and at least two state attorneys general, who are trying to determine if the practices violate U.S. antitrust laws. The practices also are at the heart of civil antitrust suits filed against Monsanto by its competitors, including a 2004 suit filed by Syngenta AG that was settled with an agreement and ongoing litigation filed this summer by DuPont in response to a Monsanto lawsuit.


  • The Big Money Is Bullish, While The Small Money Remains Bearish

    As a futures trader I routinely check the commitment of traders report released by the CFTC.  For those who aren’t familiar with the report it is a breakdown provided by the CTFC of each Tuesday’s open interest for market positions in which 20 or more traders hold positions equal to or above the reporting levels established by the CFTC.  It’s widely followed in trading circles and gives a glimpse into what the big money, commercial money and even the small money is doing with their positions.

    What piqued my interest in this data were comments in Tuesday’s “Breakfast with Dave” by Gluskin Sheff’s David Rosenberg implying that the equity markets were overly bullish because the commitment of traders showed a net bullish position of 151,000 contracts.  Let’s put this in context, however.  (See here for the current allocation of large institutions – a much more useful indicator).

    I have found over the years that the commitment of traders report tends to be a fairly weak short-term indicator.  In fact, the COT tends to be more useful in following the long-term trends of large institutions and where they are currently investing money.  Mr. Rosenberg’s implication that the current net bullish position should be seen as a contrarian sign is not necessarily true.  After all, big money moves prices and knowing where the big money is going is more often than not a good indicator of where to put your money as opposed to what to avoid.  But let’s go even further.

    One of my favorite indicators is actually the reporting of small speculators in the CFTC’s report.  This shows us what the amateur and small-time futures traders are doing with their money.  I have found over the years that this is a fairly reliable contrarian indicator.  As you can see in the chart below these traders were net bullish in just 4 weeks over the last year.  The last time small traders were substantially net bullish was just before the market crumbled at the beginning of 2009.  But what is it telling us now?  As of last week’s report it is showing the largest net short position since the week following the March 8th bottom.  In other words, small speculators were this bearish just before the market took off on a 60% rally.

    What can we glean from all of this?  The big money is bullish and the small money is almost as bearish as they’ve been all year (a possible explanation for the skepticism of the rally).  You can come to your own conclusions….

    “The Copenhagen Wheel is part of a more general trend: that of inserting intelligence in our everyday objects and of creating a smart support infrastructure around ourselves for everyday life. For example, the Wheel has a smart lock: if somebody tries to steal it, it goes into a mode where the brake regenerates the maximum amount of power, and sends you a text message. So in the worst case scenario the thief will have charged your batteries before you get back your bike.”

    The City of Copenhagen is currently considering placing the first order and even thinking of using bicycles retrofitted with the Copenhagen Wheel to replace city employee cars as part of the City’s goal to become the world’s first carbon-neutral capital by 2025.


  • Asia, Europe, Gold, US Down As Citi’s Weak Secondary Reveals Limits To Liquidity

    Was it the weak pricing of the Citigroup (C) secondary that reminded people that even with all the money pumping in the world, there’s technically not an unlimited amount of cash out there for the taking?

    Possibly.

    The market’s shown impressive resilience — ignoring Dubai, Greece, and Austria — all because it’s had faith in liquidity. That’s the one silver bullett that could kill the rally dead.

    Overnight Asia tanked, with Shanghai down 2.3% and the Hang Seng down 1.2%, and European markets were lower is well, with most off less than 1%. Gold is back touching $1125/oz. and US futures are down with everal hours to go before the bell.

    There’s only a few days left in 2009, and the market’s shaping up to be an epic battle now between bulls, who have two things favoring them (liquidity, and all the money managers playing catch up) and the bears,who can point to any number of calamities and cherry-picked stats indicating a double dip.

    For example, a train ride from London to Ramsgate is reduced from 81 minutes to half an hour, and an Ashford to London trip is cut down from over an hour to 37 minutes. Such time-saving trips come at a price–a 7.3% increase in the case of some off-peak fares. But hopefully, the short trips times will still be attractive enough to dissuade commuters from driving.

    Eventually, Britain’s high-speed rail network will expand even further. Prime Minister Gordon Brown recently announced a $32 billion investment in railway infrastructure, and a North-South high-speed rail network is planned in the coming years.

  • Twitter Rolls Out German Translation

    Twitter has completed the first round of translations it announced a couple of months ago with the introduction of a German-language version of the site. It is the last of the FIGS ( French, Italian, German and Spanish) languages it initially set out to release and the last translation for 2009 apparently. It has been available in just English and Japanese for quite a while, but has recently introduced Italian, French, and Spanish versions of the site.

    As was the norm, Twitter announced the new translation in the native language, in this case German, lucky Google Translate does a decent job at getting the message out for those of us who don’t speak the language. “German is one of the most widespread languages of the EU and is the last language we introduced in 2009 on Twitter.com,” Twitter’s Jenna Sampson wrote.

    “With the indispensable help of our many fantastic translators and translators, we have five new languages in less than two months introduced – a huge achievement for our international group. The faster we can make available to Twitter for people all over the world, influencing the faster the different cultures of the world, the global conversation on Twitter,” she added.

  • Congress Commits to Fighting Piracy

    Recently, the United States Congress agreed to provide $30 million in new funding to put towards the battle against piracy. On Monday, authorities reported another victory on the piracy front- great success on a recent year-end piracy crackdown which is code-named Operation Holiday Hoax. These new pledged funds will target personnel and programs which were authorized by last year’s Prioritizing Resources and Organization for Intellectual Property Act.

    Funds will include $20 million towards new state as well as local economic, higher technology and Internet crime prevention grants. An $8 million portion will be for new FBI agents targeting IP crimes, and the last $2 million will be dedicated to new Department of Justice IP prosecutions.

    Monday, the MPAA and RIAA spent time lauding their Operation Holiday Hoax, which involved U.S. Immigration and Customs Enforcement along with with other agencies that are that make up the National Intellectual Property Rights Coordination Center. This specific crackdown targeted illegal vendors in large U.S. cities, and led to seven arrests as well as the seizure of 79,796 counterfeit CDs and 79,610 DVDs, according to the announcement.

    Also part of the announcement were figures indicating that the copyright industry in the U.S. loses $25.6 billion a year to piracy, and the U.S. economy loses nearly 375,000 jobs either directly or indirectly related to the copyright industry.   • MarketPlace – we talk to Panoramic Software

    The Windows Mobile Marketplace has been developing only slowly over the last few months, with much controversy engendered during the same period. Issues have included limited selection in many markets, poor anti-piracy features and high prices.

    We have decided to ask a developer prominent in the market how their experience has been of this new application sales channel.  Panoramic software with their moTweets and many other applications has seemed almost unavoidable in Marketplace, with their software showing up in many categories and even in the featured software bar.

    Below is the questions and answers we kindly received from Patrick Abadi, head of Panoramic Software.

    1) How many applications do you have in marketplace.We currently have 15 different products on the Marketplace spanning 126 different markets with more on the way.

    2) How have your sales been comparing marketplace to your other channels.The Marketplace has become a reliable sales channel and has allowed us to reach customers that are not comfortable purchasing software through their PC.  It is too soon to draw any comparisons between the marketplace and other sales channels.

    3) Your application MoTweets has been a featured application for some time now.  Has this boosted sales, and have you needed to do anything special to achieve this status?

    We feel that being in the showcase has improved sales for our featured products. Microsoft selects the applications to be featured and we’re honoured to have been selected but had no direct part in the selection process.

    4) How large, in terms of devices, so you believe marketplace is at present?

    Unfortunately we have no way of making any sort of reasonable estimate.

    5) Do you have any specific concerns regarding piracy and marketplace?

    We have our own copy protection methods that work across all sales channels so piracy is not a primary concern for us.

    6) Are you happy with Marketplace as it is, or is there any specific issues you wish Microsoft would address.

    Obviously with something as complex as the Marketplace there will be issues that need to be addressed and changes made. We feel Microsoft has done a good job addressing these issues so far based on the changes we’ve seen to date.

    7) Do you have any advice to other developers considering developing for Marketplace.

    Take the time to read the submission guidelines and thoroughly test your applications to ensure you pass testing the first time.

     If there is any conclusions we can draw from Patrick’s response is that Marketplace is still pretty young.  The developer fees that many have complained about does not seem to have deterred Panoramic Software from getting their inventory in the marketplace, and also to make their applications available in many territories, and also of note is that Panoramic Software seems to have managed to include anti-piracy features beyond what Microsoft puts in place, something we had not known was possible.

    In general however Panoramic appears to be happy, if not ecstatic, which will hopefully encourage other developers to jump in also.

  • Secretive Patent Holder Sues Lots Of Companies For Remote Activation Software

    Brian points us to the news of yet another questionable patent lawsuit filed by yet another shell company, yet again in Eastern Texas against a ton of software companies. The patent in question (5,222,134) is for a “secure system for activating personal computer software at remote locations,” and was originally filed back in 1991 and granted in 1993 — meaning that the patent is actually nearing end of life. Odd, then, that it was suddenly noticed that all these companies were infringing. The lawsuit is filed by a shell company called BetaNet, and no one seems willing to speak. The lawyers representing BetaNet won’t say who is behind the company, or how they even got the patent. This is typical. Many of these types of lawsuits are filed by shell companies to hide who is actually behind them. As for the defendants, here’s the list:


    Adobe, Apple, Arial Software, Autodesk, Carbonite, Corel, Kodak, IBM, Intuit, Microsoft, McAfee, Online Holdings, Oracle, Rockwell, Rosetta Stone, SAP, Siemens, and Sony.

    Obviously, none of those companies could have come up with ways to remotely activate software without this patent (yes, that’s sarcasm). As the Register notes in the link above, even some of the software products listed as violating this patent don’t seem to involve activation at all, raising serious questions about how they could possibly violate this patent. This sounds like yet another case of someone having read the book Rembrandt’s in the Attic and deciding to go trolling for companies to sue with a meaningless patent.

  • What Is The Origin Of The Superstition About Horseshoes?

    Many cultures consider horseshoes to be a good luck charm and their placement and shape are very important. A horseshoe is hung on a door with the ends pointing up as to have them pointing down brings bad luck. The idea behind this is that the good fortune will spill out if it is facing down. Some people also believe that you must find a horseshoe that has been lost by a horse for it to be lucky. A few traditions dictate that any luck – either good or bad– will only affect the owner/finder of the horseshoe and not simply the person who hangs it up. Some people believe that guests must enter and leave a house under the same door with the horseshoe hung over it in order to take the luck with them.

    The story of Saint Dunstan and the Devil tells of a blacksmith who becomes the Archbishop of Canterbury in 959 AD. It is said that Saint Dunstan once nailed a horseshoe to the Devil’s hoof when he requested re-shoeing. Seeing that the Devil was in great pain, Dunstan made the Devil promise never to enter a place that had a horseshoe hung over the door. Horseshoes are made by blacksmiths who work with fire and iron which were considered magical and so the trade was considered lucky. Many believed blacksmiths could heal the sick and that if they presided over a marriage it would be a lucky one. Another lucky aspect of the horseshoe is that it is held in place by seven iron nails. Seven has long been thought a lucky, significant number.

  • Climate victims fight back: Small island state challenges future of Czech coal plant

    Copenhagen, Denmark — The Czech Ministry of Environment publicly confirmed today that it has received a request from the Federated States of Micronesia for a transboundary Environmental Impact Assessment (EIA) of its biggest coal-fired power plant, Prunerov (1). This is the first time that current or future climate victims could legally influence a foreign industry by arguing that it endangers them due to greenhouse gas emissions.

    The Micronesian islands, in the Pacific, are on the front line of climate impacts especially sea-level rise, changing weather patterns, and increased storms. Prunerov is one of Europe’s biggest coal power plants. (1) The plant’s operator, CEZ, wants to increase the generating capacity of Prunerov but refuses to build new blocks in compliance with efficiency standards according to EU guidelines.(2)

    “As ministers and heads of state arrive in Copenhagen to try and agree a climate saving deal this week, small island states are starting to take matters into their own hands in a bid for survival. If successful, this legal challenge could have serious implications for climate changing industries worldwide.

    “Climate change is a global problem and communities whose lives are impacted by emissions from foreign industries have the right to push for a global solution. We support Micronesia’s request and demand a phase out of dirty coal plants in the Czech Republic and around the world,” said Jan Rovensky, climate and energy campaigner, Greenpeace Czech Republic.

    Greenepace closely cooperates on the Prunerov case with legal experts from the Environmental Law Service (ELS).(4) The ELS lawyers drew the attention, that CEZ have violated legal regulations and ignored concerns raised by communities living near the plant and the Ministry of Environment. It plans to use out-dated technology to modify Prunerov so it can be operated for 25 more years. Greenpeace is demanding that CEZ decommissions Prunerov by 2016. “By demanding a transboundary EIA, the Government of Micronesia hopes to determine what impact the increase of emissions from the extended operation of the plant will have on the climate and on small Pacific Island States.

    It is important to give communities which are immediately vulnerable to climate change the chance to take legal action to protect themselves against climate polluters wherever they are. However, only a fair, ambitious and legally binding global treaty in Copenhagen this week will provide the level of protection needed to secure a future for billions of people around the world, including Micronesians.

    “This week’s deal must be legally binding and include commitments by rich countries to make far deeper emissions cuts – nothing short of 40% by 2020. It must also include USD 140 billion a year so that states like Micronesia can adapt to climate change and invest in clean technologies. All the elements of a good climate deal are on the table, the only one missing is political will,” concluded Jan Pinos, campaign director of Greenpeace Czech Republic.

    Notes to Editor:
    (1) International assessment of the project is complicated by the fact that CEZ has consistently refused to include climate impacts in the EIA documentation, although this required by Czech law. There is not a single word about climate in the 250 pages of EIA documentation submitted by the utility (while the marginal impact to local protected areas is covered by nine pages). CEZ consequently states that the climate impacts of the Czech Republic’s largest power plant are “totally marginal and improvable”.

    (2) Prunerov is the 18th largest single source of CO2 emissions in Europe (data from 2007). Total annual emissions from Prunerov consist of 10 million tons of carbon dioxide. It is 40 times more than the annual emissions of the entire Micronesian Federation, and 10% more than the iconic British power plant, Kingsnorth.

    Czech Republic’s total CO2 emissions (2007): 129.949 million tons Prunerov power plant total emissions (2007): 10.103 million tons Federated States of Micronesia total CO2 emissions (1994): 0.23 million tons.

    (3) The current net thermal efficiency of Prunerov is 32 %. CEZ wants to replace the current power plant with new one with planned net thermal efficiency off 38 %. This plan is in substantial conflict with European and Czech law, which requests net efficiency of new power plants of at least 42 % (which still means that 58 % of energy content of the fuel is wasted through the cooling towers).

    (4) The Environmental Law Service (www.eps.cz) is the biggest public interest law NGO in the CEE region. The Environmental Law Service together with Greenpeace CZ lead a campaign against Prunerov power plant called “Pohoda ČEZ” (www.pohodacez.cz).

Available in both serial interface (RS-485 Modbus-RTU) and DI/DO interface version, this serie has been greatly simplified as the positioning control unit becomes unnecessary.

    Main features :

    •Simple System
    A maximum of 254 positions can be pre-registered. The amplifier allows to set 4 types of servo gain patterns, speed, acceleration / deceleration and S-curve acceleration/deceleration for each target position. After moving to the first point, it jumps to the next specified point. Point command is repeatedly executable for specified times. The system can be terminated when hitting any object while moving. Since positioning control unit is unnecessary, it saves wiring and system space.
    •Infinite or finite coordinates
    Either infinite coordinates (where object unlimitedly keeps moving), or finite coordinates (where object moves to a constant point) are selectable. Within infinite coordinates, the object may choose shortest way to the target point.
    •Serial Interface Model Added to Lineup
    only 3 wirings needed for serial interface, where to 50 wirings for I/O interface. PC is directly connected as a host device. The host device can change and rewrite travel data and the parameters of points.

  • Economical price 3D laser scanning kit

    RIFTEK has just introduced a new low cost kit for 3D laser scanning. The kit has been developed for use with any type of working CNC machines with any type of control. The supply package includes an RIFTEK Series RF603 triangulation laser sensor, synchronization module and software package. In the scanning mode, the machine CNC system sequentially moves the laser sensor over the prototype of the product thus forming a digitized model of the prototype. The model obtained is memorized as a ‘cloud of dots’ as well as in a general STL format suitable for subsequent use in CNC machining

  • Top 10 Windows Mobile Apps – number 8

    Today we have number 8 of Michael Gannotti’s top 10 Windows Mobile applications, being published on the Windows blog.

    Number 8 is Microsoft’s My Phone service, which of course is the Windows Mobile automated backup and cloud service.  Cant say I disagree with him – My Phone is just great and can be found in the Windows Mobile Marketplace.
